      • Management method of composite public facilities - Examination of improvement of facility operation efficiency by compounding public facilities -

        Currently in Japan, there are two difficulties in public facilities, plenty of facilities are becoming superannuated, and it will be difficult to renew them due to financial difficulties of municipalities. Under such circumstances, a lot of municipalities focus on compounding public facilities as a method for providing sustainable administrative services by increasing operational efficiency of them. In this paper, we clarified the actual situation and issues of composite public facilities from documentary and interview surveys to the five cases. From these surveys, it became clear that municipalities cannot obtain the operational efficiency of compounding unless they combine the facility functions across barriers and centralize operation by Public-Private Partnerships. Through these, we propose a management system for complex facilities that contributes to municipality finances.

        서울시 공공임대주택의 관리서비스별 주거만족도 연구

        The purpose of this study is to suggest measures of improvement for a transition into demand-oriented management by comparing and analyzing living satisfaction levels and preferences of the Seoul city's public rental housing management methods. Research method used in this study included both survey and literature research, while analysis was carried out with spss 12.0 for statistics analysis. As a results, facility maintenance service level is 3.81, management operation service level is 3.94, cleaning service level is 3.86, guard service level is 3.71. Facility maintenance service(β=.517, p<.001), management operation service(β=.487, p<.001), guard service(β=.368, p<.001), cleaning service(β=.471, p<.001) affecting the residential satisfaction.

        Although various regional development projects have been trying to solve the matter happened in rural area, it could not accomplish its original purpose because of problems in continuous operation and management at projects. When a project is finished, it is required that local community is willing to participate and cooperate by themselves in order to continue the project. But in most cases, participation rate of local community is very low as there is no government support. In fact the government cease its support as soon as a project is finished, and it makes hard to attract voluntary participation from community. Even if they have voluntary participation in community activities, self-operation and self-management of a project is not easy because they don`t have capability to deal with their own problems. Above all, there are not many valid studies regarding operation and management on a regional development projects. So 1 tried to verify importance of community`s cooperation and capability, as 1 had critical mind to that, And verified high correlation between structural factors which strengthen community capability and cooperation through empirical methods of study on the CRVDPs.

        우리나라 공역 법제의 개선방안

        Recently airspace became a hot issue considering today's international relations. However, there was no data that could be fully explained about a legal system of korean airspace, so I looked at law and practice about korean airspace together. The nation's aviation law sector is comletely separate from those related to civil and military aircraft, at least in legal terms. The Minister of Land, Infrastructure and Transport shall carry out his/her duties with various authority granted by the 「Aviation Safety Act」. The nation's aviation-related content is being regulated too much by the Ministry of Land, Infrastructure and Transport's notice or regulation, and there are many things that are not well known about which clauses of the upper law are associated with. The notice should be clearly described only in detail on delegated matters. As for the airspace system, the airspace system is too complex for the public to understand, and there seems to be a gap between law and practice. Therefore, I think it would be good to reestablish a simple and practical airspace system. Airspace and aviation related tasks in the military need to be clearly understood by distinguishing between those entrusted by the Minister of Land, Infrastructure and Transport and those inherent in the military. Regarding matters entrusted by the Minister of Land, Infrastructure and Transpor, it is necessary to work closely with the Minister of Land, Infrastructure and Transport when preparing related work guidelines, and to clarify who should prepare the guidelines. Regarding airspace control as a military operation, policies or guidelines that are faithful to military doctrine on airspace control are needed. 최근들어 ‘공역’은 뜨거운 이슈가 되었는데, 의외로 우리나라의 공역 법과 제도에 대해 전체적으로 설명된 자료는 없어, 민․군 공역 법제와 실무를 함께 정리하여 보았다. 우리나라의 항공법 분야는 적어도 법적인 측면에서는 민간항공기와 군용항공기 관련 법은 완전히 분리되어 있다. 국토부교통부장관은 「항공안전법」에서 부여된 각종 권한을 갖고 업무를 수행한다. 우리나라 항공관련 내용은 너무 많은 사항을 국토부 고시나 규정으로 규율하고 있고, 그 고시나 규정들도 상위 법규의 어떤 조항과 연결되는지 잘 알 수 없는 것들이 많다. 따라서, 현행 고시의 내용을 검토해서 가능한 법규명령으로 하도록 노력할 필요가 있고, 고시 내용도 위임된 사항에 한하여 구체적으로 명확하게 서술되도록 정비할 필요가 있다. 공역체계에 있어서는, 일반인이 이해하기에는 공역 분류체계가 너무 복잡하고, 법규와 실무의 괴리도 일부 있어 보인다. 따라서, 단순하면서도 실무현실에 부합하는 공역 분류 체계로 재정립해 보는 것은 어떤가 생각된다. 군에서 하는 공역이나 항공 관련 업무는 국토교통부장관으로부터 위탁받은 것과 군 고유의 권한을 명확히 구분해서 이해할 필요가 있다. 국토교통부 위탁사항과 관련해서는, 본래 국토교통부의 업무이기 때문에 관련 업무 지침 작성시 국토교통부와 긴밀히 협조해야 하고, 현재 국토교통부에서 국방부로 위탁한 것을 대부분 예하 비행단급까지 재위임하고 있는데 재위임 부대의 적정성을 한 번 고민해 볼 필요가 있고, 관련 지침의 작성 주체도 명확히 해 둘 필요가 있다. 군사작전활동으로서의 공역통제와 관련해서는, ‘노력의 통일’과 같은 공역통제에 관한 군사교리에 충실한 정책이나 지침이 필요하다.

        The Ministry of Agriculture, Food and Rural Affairs is granting various benefits to farmers in order to strengthen the competitiveness of farmers and to stably supply agricultural and fishery products to the people. In particular, according to the Act On Fostering And Supporting Agricultural And Fisheries Business Entities, various policies are implemented for farmers and agricultural corporations registered as agricultural business entities with the National Agricultural Products Quality Management Service, and benefits such as subsidies and loans are given. However, according to the registration of agricultural business entity, the standards for farmers are frequently changed and different from the laws, so there is confusion over the interpretation of the laws. there is a situation. Although the Enforcement Decree Of the Framework Act On Agriculture, Rural Community And Food Industry has provisions for the definition of a farmer, the Enforcement Decree of the Farmland Act also has more expanded definition of a farmer. It is problematic in the whole legal system that the same term “farmer” is used differently in related laws with similar purposes in the field of agriculture-related laws and regulations. Moreover, in a situation in which a farmers’ certificate is essential to register as an agricultural business entity and receive farmer benefits, the issuance regulation of the farmers’ certificate stipulates that the purpose is to identify the farmer of the Enforcement Decree of the Framework Act On Agriculture, Rural Community And Food Industry, and at the same time, the scope of the farmer who issues the farmers’ certificates is wider than that of the law, and it is gradually expanding. In addition, through the revision of the notice, the scope of farmers is continuously expanding. However, whether or not the farmer is eligible is not just a profit regulation that grants benefits, but it is necessary to clarify this because if a false farmers’ certificate is issued, it may be subject to fines, penalties, and even criminal dispositions. In order to solve this problem, in this paper, the Farmland Act and the issuance regulations of the farmers’ certificate are in accordance with the Framework Act On Agriculture, Rural Community And Food Industry with respect to the definition of a farmer, and the target regulation according to the example of the 'Agricultural and Rural Public Interest Direct Payment Act' It proposes a plan to separate the 'Agricultural, Rural and Food Industry Act' and to revise the enforcement ordinance of the 'Agricultural, Rural and Food Industry Framework Act'.
