Comparative law is a branch of law aiming to compare laws or legal institutions and norms that constitute laws of various legal spheres. Naturally, comparative law has contributed largely to the enactment of national laws, interpretation of laws, legal education, adoption of laws and legal unification. Of all contributions, the most important and ultimate purpose of comparative law is international unification of private laws. Therefore, legal unification is the ideal and final goal of legal comparatists. Ever since the 19th century, comparative law has contributed greatly to the integration of national laws for codification and legal unification purposes, and helped the formation and development of regionally or internationally unified laws. Nowadays, the European Union is attempting regional legal unification in order to fulfill the ideal of unified law. This paper dealt the unifications of both the Law of International Sale of Goods and European Private Law as accomplishments of comparative law. Numerous comparatists have contributed greatly to achieve the aforesaid results. Especially, Rabel opened the way towards unity by advocating and practicing functional comparison method even though unification of private laws was deemed impossible in the past. The Hague Convention was enacted based on Rabel's research. As the Hague Convention is not only founded on continental law but also tries to be harmonious with the civil law, the convention is said to be the achievement of modern comparative law. Also, since the CISG retains the basis of the Hague Convention, the efforts of many comparatists including Rabel were fruitful. It seems that the ongoing unification project, regarding the field of contract law to overcome the non-unified situation within EU member states, is to proceed largely in accordance with common reference standard that includes vast amount of comparative studies. Comparative research is a prerequisite for preparing private law unification. Since serious comparative research can not be attained in a day, it is necessary to accumulate research work with regularity and diligence. Interpretation of national law in comparative aspect is especially a way to prepare for the unification of laws in the future. 비교법이란 다양한 법역에 있어서 법질서 전체 또는 그것을 구성하는 법제도와 법규범의 비교를 목적으로 하는 법학의 한 분야이다. 비교법은 자국의 입법, 법의 해석, 법학교육, 법의 계수, 법의 통일 등 다방면에 걸쳐서 기여한 바가 크다. 그 중에서도 비교법의 가장 중요한, 그리고 궁극적인 목적은 법, 특히 사법을 국제적으로 통일하는데 있다. 따라서 법의 통일은 비교법학자들의 이상이며, 최종적인 목표이기도 하다. 19세기 이래 비교법은 법전편찬을 위한 국내법의 통합과 양국 간의 법적 통일 및 지역적, 또는 국제적인 통일법을 형성ㆍ발전시키는 데 크게 기여하였다. 또한 오늘날 유럽연합이 통일법의 이상을 실현하기 위하여 지역적인 법적 통일을 시도하고 있다. 본고에서는 비교법의 성과로서 국제물품매매법의 통일과 유럽에 있어서의 사법의 통일에 대하여 살펴보았다. 이러한 성과를 이루는 데는 여러 비교법학자가 크게 기여하였다. 특히 Rabel은 종래 불가능하게 여겼던 사법의 통일을 기능적 비교방법을 제창하고 실행함으로써 통일의 길을 열었다. 이러한 Rabel의 연구를 바탕으로 헤이그협약이 제정되었다. 헤이그협약은 대륙법에만 기초를 두는 것이 아니라 영미법과의 조화를 시도하고 있어서 현대비교법의 성과라고 할 수 있다. 또한 비엔나협약도 헤이그협약의 근간을 그대로 유지하고 있어서 Rabel을 비롯한 여러 비교법학자의 노력이 결실을 거두게 되었다고 할 수 있다. 그리고 EU회원국 간의 법의 불통일이라는 장애를 극복하기 위하여 현재 진행되고 있는 계약법 영역에서의 통일작업에 있어서도 방대한 비교법적 고찰이 포함되어 있는 공통참조기준이 중심이 되어 진행될 것으로 생각된다. 사법의 국제적 통일을 준비하기에는 먼저 비교법적 연구가 선행되어야 한다. 본격적인 비교법적 연구는 일조일석에 실현할 수 없으므로 평소의 착실한 연구의 축적이 필요하다. 특히 국내법을 비교법적 입장에서 해석함으로써 장래의 법의 국제적 통일을 준비할 수 있다.
