법률번역에서 등가의 의미와 비교법적 분석사례 - ‘특수관계인’의 번역을 중심으로

This article aims to provide a systematic model for determining equivalents in legal translation based on comparative law methodology. Because of the inherent incongruity of legal terms between different legal systems, legal translators need to search for functional equivalents in the target legal system that convey similar concepts with the source legal system, and determine the acceptability of such equivalents. By adopting Šarčević (1997), this article presents a methodology for measuring the degree of functional equivalence and reliable means of compensating for terminological incongruence and other alternative equivalents in the case of low acceptability of functional equivalents. In order to demonstrate the process of determining functional and other linguistic equivalents, this article analyzes the English translation of “특수관계인(teok-su-gwan-gye-in)”, one of the complicated legal terminology in Korean law. The findings show that only partial or non-equivalence exists between the Korean term and its functional equivalent candidates, which requires other linguistic equivalents such as literal equivalents and borrowing supported by clarification strategies.

This study investigates terminological consistency in the authentic Korean texts of bilateral investment treaties. All the authentic texts of a single international instrument should archive two processes of ensuring terminological consistency: intralingual harmonization and interlingual concordance, However, most of the authoritative Korean translations of international law has not been examined in terms of terminological consistency; and none of the institutional guidelines for authoritative translations pays due attention to this issue. In this regard, this study defines the types of terminological consistency which should be ensured in authoritative translations, and introduces comprehensive methods for investigating terminological consistency in authentic translations of international law. For terminologies of juristic person taken from some Korean texts of BITs, this study examines intertextual variability and intratextual variability for intralingual harmonization, and translation adequacy for interlingual concordance, which reveals complete failure of achieving terminological consistency in those instruments.
한국의 제도 법률번역에 대한 고찰: 개념, 범주, 품질지표

In the era of multilingual law making and law enforcement, legal translation conducted in institutions at national, international and supranational levels has been at the core of legal translation studies over the past decade. This study investigates the concept, scope and quality indicators of institutional legal translation with special attention on improving its quality in Korean settings. Based on the academic literature and the European Commission’s Translation Quality Guidelines, this study identifies three key quality indicators or parameters, i.e. accuracy, consistency and clarity, with prioritized, fit-for-purpose rules depending on the legal status, communicative purpose, recipient, and text type of the translation. In order to apply such indicators with necessary modifications to Korean institutions, this study presents the genre taxonomies of institutional legal translation in Korea and suggests key indicators and the priority of their application in the case of authentic and non-authentic translation produced by Korean institutions.

As the technology for high-performance automobiles is developing rapidly together with the significant growth of the automobile industry in modern society, customer demand for automobile safety is increasing accordingly, and thus the development of safety products is gaining momentum. The brake system is indispensable for safe driving of the automobile, and malfunction or disorder of the brake system can lead to serious accident, resulting in injury or death. Meanwhile, if the brake system can be monitored on a real-time basis, such monitoring system can notify drivers of dangerous circumstance, like excessive wear of brake pad, or overheating of brake disc. However, in the case of high-performance/oversize automobiles, frequent or sudden braking during summer causes disc temperature to rise above 600 °C, which affects the useful life of the sensor. In contrast, there has not yet been a breakthrough for the sensor that can be used in a condition that exceeds 600 °C. Based on the heat transfer theory, we have developed the sensor in this study that normally works under the temperature exceeding 600 °C and verified that the sensor works normally under the temperature of ≥ 825 °C.

The objective of this paper is to investigate the possibility of using key word analysis of corpus linguistics methodology in the translation quality assessment in legal genre. The conventional approach in translation quality assessment focuses on the achievement of equivalence between the source text and the target text. However, this kind of strong emphasis on preserving the letter of law often disrupts the understanding of the target reader, thus causing default in securing the same legal effect intended in the translated legal text. Against this backdrop, this study adopts more reader-oriented approach in legal translation quality assessment based on the concept of textual fit proposed mainly by Biel (2014). Focusing more on the expectancy norm of the target audience, this mode of assessment evaluates the extent to which the translation fits into the non-translated convention of the relevant sub-genre of legal language, thus lessening the cognitive processing efforts of the target reader. This paper suggests a model for assessing textual fit by examining the overused lexical, grammatical and semantic patterns of English-translated Korean statutes compared to non-translated English statutes, based on hierarchical key word analysis results provided by Wmatrix.
