        우리나라의 환경분쟁조정제도에 관한 연구

        Environmental disputes not only possess the special characteristics of collectivity and plural value relativity but it also possesses the unique features of difficulty to prove cause and effect as well as the structural maldistribution of evidence and information. Therefore, the positive resolution of an environmental dispute can be brought about more easily with the Alternative Dispute Resolution (ADR) which can take the form of talks, compromises, as well as arbitration or mediation rather than through a trial process. Such being the case, this paper first looks into the problems and effectiveness of the arbitration system of environmental lawsuits and then takes an even closer look at Korea s environmental dispute arbitration system and finally offer some reform methods. In Korea, the environmental dispute arbitration system was implemented in 1991 and has been executed since then. Although this system does have positive features such as the high rate of coming to an agreement between the involved parties but unfortunately, most of the cases rely on decisions based on right and wrong which cannot but be far away from the intentions of the ADR system. It is heavily centered around claims regarding psychological compensation regarding noise and vibrations and the ratio of the actual amount of compensation is comparatively lower than the requested amount. In addition, with the limits in organization and manpower, it leads to a lack of professionalism as well as the problem of low usage with the low awareness rate. As reform measures against the aforementioned problems, this paper suggests the following. First, in order to activate the arbitration process more fully, it proposes aggressive usage of compulsory arbitration as well as submission to arbitration, while at the same time raising ADR professionals to fill in the missing gaps. Secondly, in order to overcome the problem of concentration of related cases, making representative lawsuits of environmental organizations would be a good idea. It also states that in order to make the compensation amount more realistic, it should go out of the across-the-board decision making process and reach a decision about the compensation amount that takes the individual situation s dispute into consideration. In order to boost the professionalism of the environmental dispute arbitration, it is necessary to reform the organization and manpower such as expanding the number of members of full standing, and increasing the professionalism of the examiners. Also, to increase the usage rate of the ADR system, the paper suggests stationing a civilian consultant regarding environment, or activating the compulsory arbitration which is the premise for public participation on the part of the residents.

        저당권의 불가분성에 관한 연구 - 일본의 학설과 판례를 중심으로 -

        The mortgagee can exercise the right for the entire object until the whole credit is reimbursed, which is called the inseparability of mortgage, the regulation of the lien, the Article 321, our Civil Law shall apply to the regulation of the Article 370, our Civil Law, with respect to the inseparability of mortgage. This concept is not clear state since it is the circumstances that there has been no thesis dealing with this in our country and the textbook mentioned that the regulation of the lien shall apply in only and there has been no special explanation in the lien. Therefore, it would be so necessary to clear up the concept of inseparability of mortgage and review the several issues in relation to the inseparability. The comparatively concrete principle of Law has been established by introducing the legal theory of France with respect to the inseparability of mortgage in Japan, the inseparability is considered to be the sphere of functional area comprising two different concepts. Namely, the inseparability of mortgage is comprised of the inseparability in connection with the secured claim aiming at keeping the object as each part of secured claim is in pledge by the entire mortgage object before the exercise of mortgage and the inseparability in relation to the mortgage object as each part of mortgage object is to hold a mortgage of the entire secured claim functioning related to the sphere of preferential repayment right at the time of exercise of mortgage. We, in this manuscript, intend to further definitize the meaning and contents of mortgage which has been thought abstractly till now in our country by inspecting the legal theory in relation to the inseparability of mortgage in Japan. This manuscript is analyzing and arranging the theory and the judicial precedent, to begin with, after inspecting the debates in relation to the inseparability both in the process where the inseparability of old Civil Law has been introduced and in the process where the current code of Civil Law has been established, in Japan, This manuscript will help establish the legal theory in relation to this in our country where there has been no advanced research in relation to the inseparability of mortgage at all. 저당권자는 채권전부의 변제를 받을 때까지 목적물 전부에 대하여 그 권리를 행사할 수 있는데 이를 저당권의 불가분성이라고 하며, 우리 민법 제370조는 저당권의 분가분성에 대하여 민법 제321조의 유치권 규정을 준용하도록 하고 있다. 우리나라에서는 지금까지 이에 관하여 다룬 논문이 거의 없는 실정이고, 교과서에서도 유치권의 규정을 준용한다고 하고 있을 뿐이고, 유치권에서도 특별한 설명을 하고 있지 않아서 이 개념은 명확하지 않은 상태라고 할 수 있다. 그러므로 저당권의 불가분성의 개념을 명확하게 하고 불가분성에 관련된 여러 문제를 검토하는 것은 매우 필요한 일이다. 일본에서는 저당권의 불가분성에 관하여 프랑스의 법이론을 받아들여 비교적 구체적인 법리를 정립하고 있는 바, 저당권의 불가분성을 기능영역이 다른 두 개의 개념으로 구성된다고 보고 있다. 즉 저당권의 불가분성은 피담보채권의 각 부분은 담보목적물 전부에 의해 담보되는 것으로서 저당권 시행 전에 그 객체의 유지를 목적으로 하는 ‘피담보채권에 관한 불가분성’과, 담보목적물의 각 부분은 피담보채권의 전부를 담보하는 것으로서 저당권 실행시에 우선변제권의 범위에 관계되는 것으로 기능하는 ‘담보목적물에 관한 불가분성’이라는 두 개의 개념으로 구성된다는 것이다. 본고에서는 일본에 있어서의 저당권의 불가분성에 관한 법이론을 살펴봄으로써 우리나라에 있어서 지금까지 추상적으로 생각되어 온 저당권의 불가분성의 의미와 내용을 보다 명확히 하고자 한다. 우선 일본에 있어서 구민법상의 불가분성이 도입되는 과정과 현행민법전이 성립하는 과정에서의 불가분성에 관한 논의에 대하여 살펴본 후, 일본의 현행민법전 상 저당권의 불가분성에 관한 학설과 판례를 분석․정리하고 있다. 본고는 저당권의 불가분성에 관한 선행연구가 거의 없는 우리나라에 있어서 이에 관한 법이론을 정립하는데 큰 도움을 줄 수 있을 것이다.

        일본 ADR법상 인증제도의 현황과 과제

        ARD Act in Japan was proclaimed on 1 December 2004, and since the act was enforced on 1 April 2007, five years have passed. ADR Act enables qualified dispute resolution businesses to be the certified ADR business holders through the government's accreditation system, contributing greatly to the advancement of a private ADR. As of June 2012, the number of ADR institutes certified by the government has increased to 112. In Article 2 of the supplementary provisions of Japan's ADR Act, it provides for as follows: “The government should review the progress of the Act five years after the enforcement, and find measures, if recognized as necessary, based on the results". Any problems revealed in the process of implementing the Act is expected to be revised at the point of 5 years after the enforcement. To this end, the academic circle established an association called ‘Arbitration ADR Act Society’ in 2004, considering issues of ADR Act and considering measures to improve the legislation, make policy suggestions, and to improve the Act management, through seminars, forums, and journal. The Japanese ADR Association composed of ADR institutions as members, came to put forward a suggestion entitled "Towards the revision of ADR Act" to the Ministry of Justice on April 2, 2012. This paper intends to identify the current state of the accreditation system, one of the most important systems under ADR Act in Japan, in terms of the consideration of the ADR Act revision. The consideration includes particularly measures to improve the accreditation system as well as data analysis on accreditation application, the current state of accredited institutions, ADR performance of the accredited ADR businesses. In Korea, the ADR Act has not been legislated yet although the issue is actively taken into consideration. This paper will be a meaningful reference for the Korean government to develop an accreditation system for legislating the ADR Act, in the future.

        의료정보의 제공에 관한 연구

        In the matter of medical care, the medical records that are made out by the medical professionals occupy a very important place in this profession as they are absolutely necessary. Furthermore, along with the patient's right of self-determination, more emphasis is put on the informed consent principle whereby there is mutual corporation between the medical professional and the patient to overcome the disease together. The Medical Treatment Law in Korea has certain regulations regarding the duty to issue medical records. However, the actual reality is that these rights are not being properly carried out with the present regulations. The reason for this is because foremostly, with the exception of a few, the preparation and the maintenance of the medical records are not appropriately carried out. Not only that, various reasons like the protection of individual privacy or the medical institutions' personal reasons, it is almost realistically impossible to approach the patients' medical records.

      • 동산양도담보제도의 확충에 관한 연구

        Until now, mortgage of real property have played on important role in mortgage system in our country. But, because real property is restrictive quantitatively and the owner of it is a minority, it is very limited in practical use for mortgage. Because of this problem, it is needed to apply chattel mortgage system positively. Meanwhile, because the present chattel mortgage system has many problems and does not answer the purpose, it is requested to establish the new chattel mortgage system realistically. In this paper, First, the principle of law on the chattel mortgage system is examined generally, and then the judicial precedent on double-assign-mortgage which has problems is examined. Finally, the core contents of legislation on chattel mortgage up to present and the contents of "the law on the security of moveables and bonds and so" which is established in 2010. 6. and will be carried from 2012. 12. are examined. In this order, the expansion plan on chattel mortgage will be deliberated. Especially, Of contents of the law on the security of moveables and bonds and so, The problems of qualification of mortgage setter, The problems of provisions on the continuance period of mortgage, The revision direction are commented. 지금까지 우리나라의 물적 담보제도는 부동산 저당권이 그 중심 역할을 하고 있는데, 부동산은 양적으로 제한적일 뿐 아니라 소유자도 소수이기 때문에 담보물로의 활용이 극히 제한적일 수밖에 없다. 이러한 문제점 때문에 동산담보제도를 적극적으로 활용할 필요가 생긴다. 그러나 현행 동산담보제도에는 미흡한 점이 많아서 현실적인 요구를 충분히 부응하지 못하고 있어서, 새로운 동산담보제도의 창설을 필요로 하는 현실적인 요구가 강하다. 본고에서는 우선 동산양도담보제도에 대한 법리에 대하여 개괄적으로 살펴본 후, 이 중 가장 문제가 되고 있는 이중양도담보에 대한 판례를 검토하고, 마지막으로 그간 우리나라에서 논의되어온 동산담보제도의 법제화에 대한 핵심내용과 더불어, 금년 6월에 제정되어 2012년 6월부터 시행예정인 ‘동산 및 채권 등의 담보에 관한 법률’의 내용을 검토함으로써, 동산양도담보제도의 활성화 방안을 강구하고 있다. 특히 이 논문에서는 ‘동산 및 채권 등의 담보에 관한 법률’의 내용 중 담보권설정자의 자격제한의 문제, 담보권존속기간에 대한 규정의 문제 등에 대한 비판과 아울러 개정방향을 지적하고 있다.

        A Case of Mesenteric Myxosarcoma in a Dog

        A 6-year-old male Shih tzu dog was presented for evaluation of abdominal distention. Abdominal radiography and ultrasonography revealed a soft tissue density mass containing large amount of fluid. Ultrasonography-guided fine needle aspiration of the mass was performed and cytologic impression was granulation tissue with hematoma and fibroplasias. On exploratory laparotomy a mass was identified at the root of mesentery adhered to distal jejunum. Because the mass could not be separated from the attached jejuna loops, the mass and the adhered sites were surgically removed all together and enteroanastamosis was performed. Histologically a low grade myxosarcoma was diagnosed. Tumor cells were positive with alcian blue stain and Ki67 index by immunohistochemistry was 2.5. The dog recovered from surgery uneventfully, and has been in good condition without any signs of recurrence or metastasis for about 30 months after surgery.
