This study seeks to derive the problems of contracting-out by analyzing contracting-out cases that have actually been promoted by a local government (A) in Daegu Metropolitan City, and to find ways to solve the problems. The main findings of this study are as follows. First, the A local government has various problems in the process of contracting-out, such as the lack of management and supervision of the contracting-out budget, the lack of an inspection system for the monopoly of contracting-out, the lack of fairness and transparency in the selection of service provider of contracting-out, the neglect of management and supervision of renewal contracts and inadequate ordinances, non-establishment criteria for selection of service providers subject to contracting-out, inadequate evaluation indicators for selection of service providers, the lack of effectiveness and accountability for contracting-out management and supervision, and overlooking the significance of contracting-out performance evaluation. Second, as ways to solve the problems related to contracting-out of the A local government, this study suggests the ordinance revision related to contracting-out, introduction of the pre-approval system of contracting-out by local council, improvement of fairness and transparency in selection of contracting-out service providers, thorough public disclosure about contracting-out, introduction of a scientific system to select high-quality service provider, development of appropriate evaluation indicators for selection of service providers and renewal contracts, improvement of efficiency and accountability in the process of management, supervision, and audit of contracting-out, detailed guideline development for contracting-out work, and the emphasis on significance of contracting-out performance evaluation. The ways to solve the problems in contracting-out suggested in this study are expected to be applicable to solve various problems in contracting-out at other local governments in the future. Follow-up studies based on analysis of the ordinance and enforcement regulations of all local government in Korea are needed to learn how to solve problems of contracting-out effectively in the future.
민간위탁 대상시설 및 수탁기관 선정에 관한 사례연구 : - 서울시 사례를 중심으로 -

민간위탁이 성공적으로 수행되기 위해서는 ‘무엇을 누구에게’ 위탁할 것인지에 관한 천착이 전제되어야 한다. 민간위탁이 관료제의 비대화를 억제하고 민간의 전문성을 활용하여 능률적으로 행정서비스의 질을 높일 수 있는 전략적 수단인 것은 분명하지만, 민간위탁을 어떻게 추진하고 관리하는지에 따라 그 성패가 달려있다고 할 수 있다. 본 연구는 민간위탁의 대상시설 및 수탁기관 선정을 분석하는 데 그 목적을 두고 있으며, 서울시의 민간위탁 가운데 수탁기관의 유형에 따라 6개의 사례를 선정하여 다중사례분석을 시도하였다. 사례연구를 통해 두가지 연구질문에 답을 구하고자 하였다. 첫째, 시설의 특성을 감안할 때 민간위탁 방식이 적정한가? 둘째, 서비스의 특성을 감안하건대 경쟁입찰이 바람직한가? 분석결과는 다음과 같다. 산하기관이 수의계약에 의해 수탁기관으로 선정되었다면, 이를 민간위탁의 대상시설에 포함시키는 것이 바람직한지 여부에 대해 근본적인 검토가 이루어질 필요가 있다. 전문적 기술이 필요한 장치시설은 경쟁의 도입이 필수적이지 않으며, 안정적 서비스 공급과 전문역량 축적이라는 점에서 오히려 수의계약이 효과적으로 판단된다. 다만 여기에는 체계적인 관리가 전제되어야 한다. 복지시설의 민간위탁에 있어서는 수의계약이 필수적이지 않으며 경쟁 메카니즘이 도입될 여지가 크다. Contracting out in the public sector is a strategic means toward 'small government'. It enables introducing entrepreneurship of the private sector as well as reducing X-inefficiencies in the public sector. Even though contracting out has several potential merits, managing contracting out is a critical success factor. This study focuses on how to manage contracting out, specially what and to whom to contract out. Six cases of Seoul Metropolitan Government were chosen and analyzed. From multiple case study, it is found that there might be some contracting out cases which were better not included as such. Including inappropriate cases in contracting out can incur inefficiency in itself as well as information bias. Contrary to general conception, competition does not seem to be essential in contracting out. Rather, it is argued that competition in contracting out should be encouraged contingently. If contracting out is needed to retain technical specialty, frequent change by competition can do more harm than good. On the contrary, competition had better be encouraged if welfare facilities are to be contracted out.
직장보육시설 대학위탁 현황 및 위탁운영에 대한 시설장과 보육교사의 인식

본 연구는 현재 직장보육시설 대학위탁의 현황 및 위탁운영에 대한 대학위탁 직장보육시설 시설장 및 보육교사의 인식을 조사하여 직장보육시설 대학위탁의 개선방안을 모색함으로써 대학의 산학협력의 기능과 역할을 강화할 수 있는 기초자료를 제공하고자 하였다. 연구결과 첫째, 직장보육시설 대학위탁 현황은 대학 총장이 대표자로 공개경쟁 선정방식을 통하여 위탁한 후 실질적으로는 유아교육관련 학과에서 지원하는 형태로 직장보육시설 총390개소 중 61개소를 운영하고 있었다. 둘째, 직장보육시설 대학 위탁운영과 관련하여 시설장이 보육교사에 비해 위탁제도를 높게 인지하고 있으며, 시설장과 보육교사 모두 대학의 위탁이 전담인력이나 전문적인 지원체계가 부족하더라도 보육시설 운영의 전문성 보장, 우수 종사자 확보가 가능하여 보육의 전문성 확보라는 목표를 이루는 데 가장 적합한 위탁방식이라고 인식하고 있는 것으로 나타났다. 셋째, 직장보육시설 대학위탁의 문제점과 개선방안으로는 짧은 위탁기간으로 인한 시설장 신분의 불안전성, 위탁제도 미비 등으로 이를 보장하기 위한 위탁제도의 개선이 필요하다고 인식하였다. 따라서 향후 직장보육시설 대학위탁을 강화하기 위해서는 대학에서 적극적인 위탁 참여의 필요성을 인식하여 참여방안을 모색하고, 직장과 대학은 직장보육시설 위탁과정에서 평등성과 자발성을 기반으로 양질의 육아교육 실현을 위한 동반자적 산학협력 관계로 나아가야 할 것이다. The purpose of this study was to examine the state of university contracting-out of employersupported childcare centers and the awareness of the heads and teachers of the childcare centers about the contracting-out childcare. This is an attempt to provide some information on ways of improving university contracting-out system of employer-supported childcare centers, and of bolstering the industrial- educational collaboration. The findings of the study were as follows: First, as for the state of university contracting-out of employer-supported childcare centers, the eligible universities were selected through an open competition, and the presidents of the candidate universities became the representatives of the universities in the competition. After the selection of the eligible universities, the departments of early childhood education were primarily responsible for contracting-out childcare centers. Out of 390 employer-supported childcare centers, 61 centers utilized the contracting- out. Second, concerning perception of the contracting-out childcare, the heads of the centers viewed it more favorably than the teachers. Both of the heads and teachers thought that it was the best contracting-out way to attain the object of childcares. Namely ensuring the professionalism of childcare, in that it was possible to guarantee the professionalism of childcare management and secure excellent personnels. Third, regarding problems with the university contracting-out and reform measures, they perceived that the contracting-out system should be improved because the job security of employees wasn't guaranteed due to a short contracting-out term, and because the contracting-out system was yet inadequate.
지방자치단체의 민간위탁제도 개선에 관한 델파이 분석: 지방자치단체의 조례를 중심으로

Since 1980s, the provision of the public service by contracting out has increased and the importance of this provision mode has been emphasized, because the government has aimed to improve efficiency and performance in the public sector based on neoliberalism and market-based governance. Previous studies about contracting out has focused on the study on arguments for and against contracting out and the prerequisite for success in contracting out, on the study on empirical-positive approach in terms of outcome of contracting out, and on the study on problems in the contracting out process. This study uses the delphi survey research on the ordinance related to contracting out in the local governments and aims to improve the contracting out system in the local governments. 공공부문에서 1980년대 이후 신자유주의 사조와 시장 매커니즘에 기반을 둔 행정 서비스의 효율성 증진 노력과 성과 위주의 정부 활동에 영향을 받아 민간위탁에 의한 공공서비스의 제공 영역이 증가하고 중요성이 부각되어 왔다. 민간위탁에 관한 선행연구는 공공서비스 민간위탁방식에 대한 찬반논쟁과 이러한 정책집행방식이 성공적으로 이루어지기 위해서 구비되어야 할 요건에 관한 이론적 연구, 민간위탁의 결과에 대하여 어느 정도의 성과가 있었는지에 대한 경험적・실증적 연구, 민간위탁의 과정을 분석하여 문제점을 찾아내는 경험적 연구 등이 있어왔다. 본 연구에서는 현재 지방자치단체의 민간위탁 관련 조례를 대상으로 전문가 델파이를 실시함으로써 공공서비스를 민간위탁을 통하여 효과적으로 제공할 수 있는 제도적 개선방안을 모색하고자 한다.

오늘날 행정의 효율성 제고와 민간의 참여를 촉진하기 위해 행정사무의 민간위탁이 활성화되고 있는바, 본고는 중앙행정기관의 민간위탁에 논의의 범위를 한정하여 행정법적 쟁점에 대해 검토하는 것을 목적으로 한다. 민간위탁은 행정권한의 이전이 아닌 행정기관의 사무를 이전하여 수탁자의 명의와 책임으로 행사하도록 하는 것을 말한다. 「정부조직법」은 민간위탁 대상사무를 “조사ㆍ검사ㆍ검정ㆍ관리 업무 등 국민의 권리ㆍ의무와 직접 관계되지 아니하는 사무”로 규정하고 있으나, 개별법령에서 공권력 작용을 민간에 위탁하는 조항을 두고 있는 등 위탁 범위에 대한 판단기준을 정립되어 있지 않는 문제가 있다. 아울러 위탁사무에 관한 사후관리가 제대로 이루어지지 않고 있는 문제점도 지적할 수 있다. 이러한 문제점에 대하여 ① 효율성ㆍ수익성이 높을 것, ② 공공성 침해 가능성이 적을 것, ③ 서비스 질의 하락이 없을 것이라는 세 가지 요건을 민간위탁 대상사무의 판단기준을 삼아 민간위탁제도를 운영하는 것이 필요하다. 또한, 민간위탁에 대한 철저한 사후관리체제를 구축하는 것이 요청된다. 아울러 행정사무의 민간위탁은 행정(공법)과 민간(사법)의 접점에 위치하는 영역으로서, 법률유보의 원칙, 평등의 원칙, 행정절차상의 원칙 등 행정법상 일반원칙을 적용을 고려하는 공법적 접근이 필요하다고 생각한다. For the purpose of the improvement of administration efficiency and the acceleration of private sector participation, the Contracting-out of administration affairs is widespread these days. This article aims to review the Contracting-out of the central administrative agency’s administration affairs from the legal point of view. The concept of the Contracting-out is not the delegation of administrative authority, but the partial transfer of administration affairs. Although the subject of the Contracting-out is prescribed as “affairs not directly related with the people’s right and obligation such as investigation?test?license? management affairs” in the National Government Organization Act, there are some controversy regarding the scope of the Contracting-out affairs. The representative examples are some legislations which contain the provisions of the contracting-out of the governmental authority. Also the post management for the Contracting-out is not conducted well. Therefore it is necessary to establish the standard judgment for the subject affairs of the Contracting-out as follows: ① improved efficiency and profitability, ② low publicness, ③ sustained quality of services. And the establishment of the post management system to supervise the operation conditions is required as well. Furthermore, the basic Principles of the Administrative Law, such as the Principle of the Legal Reservation, the Principle of the Equal Treatment, the Principle of Administrative Procedure, are taken into account when analyzing the issues about the Contracting-out from the point of public law.

This study aims at analyzing the reason why contracting-out to public agency by the metropolitan governments of Korea has been preferring more than contracting-out to non-public sector last 13 years. In order to achieve the goal, this study uses seven independent variables which influences contracting-out to public agency with the data of 13 years from 16 metropolitan governments. Four variables out of seven independent variables turned out to be statistically significant at the 0.01 level in a panel regression analysis. Variables having positive causal relations with a dependent variable, the expenditure amount of contracting-out to public agency are an institutional change such as law revision and the total amount of local government budget. On the other hand, the expenditure amount of contracting-out to non-public sector and an interaction variable between the expenditure amount of contracting-out to non-public sector and an institutional change are negative causal relations with dependent variable. Other three variables are not statistically significant at the 0.05 level. Based on the findings, this study suggest that the management and performance evaluation in contracting-out to public sector should be strengthened by local assembly 본 연구는 지방정부가 공공서비스를 공급하는데 있어서 민간위탁보다 공기관대행사업을 더 선호하고 있는 현상을 분석하는데 목적이 있다. 이 목적을 달성하기 위하여 2008년부터 2021년까지의 16개 시․도의 공기관 대행사업규모를 종속변수로 하고, 민간위탁규모, 법제도 변경, 민간위탁규모×법제도 변경, 총예산규모, 인구변화율, 정당일치도, 재정자립도를 독립변수로 활용하여 패널분석을 실시하였다. 실증분석결과 α = 0.01 수준에서 민간위탁규모(-), 법제도 변경(+), 민간위탁규모×법제도 변경(-), 총예산규모(+)는 통계적으로 유의한 것으로 나타난반면 인구변화율, 정당일치도, 재정자립도는 α=0.05 수준에서 통계적 유의성을보이지 않았다. 공기관 대행사업이 크게 증가한 것은 민간위탁보다 거래비용이적고 감독이 용이한 측면이 있기 때문이며, 지방정부의 출자․출연기관의 제도적 정비, 보조금 사업 제한 등의 법제도 변경이 공기관 대행사업의 규모를 확대한 것으로 해석된다.

The Kim Dae Jung government has actively promoted the contracting out of the public sport facilities to reform efficiency, effectiveness and equity. The contracting out, however, has been not evaluated on original purpose. The purpose of this study was to exam the current status of the contracting-out on the public sport facilities, then to contribute to successfully accomplish the contracting out. To perform the purpose, this research surveyed public officers from 15 cities. The study evaluated the way of management, the application of the facilities, the equity of the facilities, the fiscal management of the facilities and the management of the facilities from the contracting out. According to the result, three significant things were suggested. First, although public officers positively evaluated the contracting-out on the quality of service and program, more special regulation and law on the contracting out should be established for the successful contracting out Second, it is recommended the new paradigm that pubic service and profit from the facilities is not antagonistic, but cooperative. Third, the sustained monitoring on the process and evaluation of the contracting out is essential, and the successful model should be propagated.
민간위탁 노동자 근로조건 보호 가이드라인의 법적 쟁점과 한계

The government of the Republic of Korea announced Direction of Contracting-out Policy on Feburary 27, 2019 and Guidelines for protection of working conditions for contracting-out workers on December 4, 2019. It is significant in that it was the first to prepare a labor policy for contracting-out workers. This guidelines are informal administrative functions. However, their main content will be effective as a contract. It is expected to prevent the use of fixed-term workers through a short labor contract period and contribute to job security through employment succession. However, the demand for the same labor contract period as the contracting-out period is similar to the recruitment-type worker dispatch. It removed the opportunity to hire a non-fixed term employee. And it is silent about whether the government is an employer under the labor law. There is a problem that distinguishes between contracting-out workers and service contracts workers. In principle, it is appropriate that the government does not intervene in determining working conditions. However, if the government has presented guidelines, it must be continuously updated.

Securing core facility is used as a main mean that increases the effectiveness of urban regeneration project. Public Private Partnership is necessary in management of urban regeneration core facility, and contacting out is one of way to participate private sector in management of core facility. This study aim to suggest management of urban regeneration core facility through public private partnership by exploring purpose and process of change in contracting out and analysing feature of contracting out urban regeneration core facilities in 'seoul 20'. Analysis contents is as following. First, task of contracting out core facility have complexity, and complexity is shown in contract and management system. And it is hard to result evaluation of task of core facility management. It oppose with purpose of introducing contraction out. In contradiction to that, direction of change in contraction out toward to enforce supervision and controls.

Public administration in the 21st century is based on the concept of governance where as the counterpart in the 20th century on the one-sidedness of government. Governance means partnership between public and private sectors in dealing with social issues. The basic spirit is to expand the role of private sector while the government focuses on drawing blueprint for the future of a society; pulse-reading of public opinion and prioritizing; mobilizing resources to deal with social issues. Contracting out is expected to increase in this context. This paper sketches the realities of contraction out in Korean local government with a case study method. More specifically, it collects all cases of contracting out of a local government (hereafter A city) and analyzes the characteristics from them. The research result tells that contracting out in A city started to increase since 2000 and expected to increase in the future. In spite of the significant increase, there was no clear motivation and policy direction in connection with contracting out. In addition, contracting out was concentrated on a few services and there was lack of transparency in the process of awarding contract. Lastly, problems were identified in connection with evaluating the results of contracting out. This paper suggests policy options for addressing the above problems.
