예술의 법적 정의에 관한 고찰

이 논문은 법과 예술의 관계 및 예술의 법적 정의에 대한 고찰을 다룬다. 이를 위해 예술법 분야에 있어 선도적인 국가인 미국에서 예술법이 발전하게 된 역사를 먼저 살핀 후, 미국의 연방 법규와 판례를 통해 구체적인 사안에서 예술은 어떻게 정의되고 해석되었는지 분석할 것이다. 그리고 미국의 각 주법에서의 예술의 정의를 비교하여 미국의 연방법과 주법은 어떠한 차이를 보이는지에 대해 알아보고, 이를 국내의 문화예술진흥법과 저작권법 등의 태도와 비교할 것이다. 마지막으로 국제적으로 국제협약 등에 나타난 예술의 정의도 함께 고찰하고 이를 통해 앞으로 문화 예술과 관련된 우리나라의 법규에서도 예술을 해당 법규 내에서 보다 구체적이고 자세하게 규정하여 적합한 법적보호를 하여야 할 필요성이 있음을 논증하고자 한다. This paper examines the relationship between art and law and legal definition of art. For this purpose the brief history of art law in U.S. will be introduced in the beginning. Secondly U.S. federal statutes and cases will be analyzed to review how art was defined and interpreted in various contexts. Third, selected state statutes will be examined to identify the differences among the definitions in the respective state statute. Also international convention and current articles in Korean Culture and Arts Promotion Act and Copyright Act will be reviewed for comparison. On this ground, it will be asserted that more precise and detailed definition and classification of art in the Korean statutes is needed to provide proper protection to pertinent type of art.

바터 팽대부에 발생한 선암과 대세포 신경내분비암의 충돌종양 1예

Most tumors affecting Vater’s ampulla are adenocarcinomas, but a neuroendocrine carcinoma in the ampulla of Vater is extremely rare. The coexistence of these two tumors has been reported in only a few cases. Here, we report a rare case of a collision tumor of the ampulla of Vater with an adenocarcinoma and a large cell neuroendocrine carcinoma. 바터 팽대부에 발생하는 악성 종양은 대부분 선암(adenocarcinoma)이며 다른 조직학적 형태의 암 발생은 극히 드물다. 특히 선암과 신경내분비암이 동시에 발생하는 복합종양은 매우 드문 것으로 알려져 있다. 저자들은 최근 상복부불쾌감과 황달을 주소로 내원한 60세 여자에서 바터 팽대부암 의심 하에 유문보존 췌십이지장절제술 후 조직학적으로 선암과 대세포 신경내분비암이 병발한 바터팽대부의 충돌종양을 진단하였다. 복합종양 중 대세포 신경내분비암이 췌장 주위 지방조직으로의 침윤 및 림프절 전이가 있어 수술 후 보조항암요법을 받았던 예를 경험하여 문헌고찰과 함께 보고한다.

해양권역의 재인식과 "태평양지역연구"로의 전환

본 연구는 제주도를 동아시아의 섬에 국한할 것이 아니라 환태평양의 일원으로 바라보아야함을 강조하고 있다. 한국학계에서는 대부분 `아시아태평양`을 논하면서 `아시아` 대륙과 미국만 논의할 뿐, 정작 `태평양`은 제외시키고 있다. 이는 해양중심적 사고가 결여되었기 때문이다. 태평양은 제국주의의 역사적 발명품이며, 태평양의 문화권 구분도 서구의 발명품이다. 태평양지역(Pacific Region)과 태평양사람들(Pacific Islanders)이란 개념조차 2차대전 이후의 산물이다. 우리가 통념상으로 알고 있는 문화권 구분도 그네들이 태평양에 관해 얻고자 했던 국외자적 창조물이었을 뿐이다. 우리가 통념상으로 알고 있는 폴리네시아, 미크로네시아, 멜라네시아 같은 명칭도 유럽인들의 발명품이다. 일본 제국주의가 후발주자로서 태평양으로 진출하자 남양군도라는 명칭도 탄생하였으며, 한국사와 태평양이 본격적으로 관계를 맺기 시작한다. 제주도 및 한반도는 동북아의 일원이면서 동시에 북서태평양 권역의 일원이다. 해양사적으로는 `북서태평양`이라는 자기 권역을 분명히 할 필요가 있으며, 이는 동북아라는 표현과 또 다른 의미를 갖는 것이다. 북서태평양의 해양적 시각에서 볼 때, 과거의 남양군도를 포괄하는 태평양 섬들과의 연맥관계가 선명히 다가올 것이다. 태평양의 지구(地球) 아닌 해구(海球)로서의 재인식은 제주도를 이해하는 방식에서도 `육지에 딸린 섬`이 아닌 `태평양으로 한 걸음 나아간 섬`으로 재인식 시킬 것이다. 태평양의 섬들에 관한 본격적 이해와 연대는 이제부터 시작이다. 우리 학계에 필요한 것은 태평양을 하나의 분명한 지역, 즉 지구상에 가장 드넓은 해역(海域)으로서의 지역연구를 수행하는 일이다. 그동안 태평양 연구의 정치경제학 일변도에서 벗어나 `태평양 인문학`으로 나아가는 시각전환도 요구된다. This study emphasizes the viewpoint of Jeju Island as part of the Pacific rim and avoidance of restriction to consider it only as an island of East Asia. The Korean academic society discusses the Asia but actually excludes the Pacific. This is a result of insufficiency of ocean centered thinking. The Pacific is a historical invention of imperialism, and the classification of a cultural area is also an invention of the West. The notions of the Pacific reigon and Pacific people are the product after the World WarⅡ. The classification of a cultural area was just a creature of western onlookers who wanted to acquire about the Pacific. Even the names of Polynesia, Micronesia and Melanesia are all inventions of Europeans. As the Japanese imperialism invade to the Pacific, the name of the `Namyang Gun-do`(南洋群島) was created. The Jeju Island and the Korean Peninsula are the members of the northwest Pacific area. In the oceanic history, it is required to clarify its own area called `the northwest Pacific` and this has another meaning different from the expression of the northeast Asia. The renewed appreciation of the Pacific not as a zone but as a trench will lead a renewed appreciation of the Jeju Island not as a `island belonging to a land` but as an `island which moved ahead one more step to the Pacific` even in the understanding method. Furthermore, the full-scale understanding and solidarity about the Pacific is a beginning from now on. What our academic circle requires is performing the area study for the Pacific as a clear area, namely as the widest sea area in the world. The past exclusive devotion to the political economics of the Pacific study should be avoided to have a conversion of a viewpoint to move ahead to `the Pacific Riberal arts`.

조선후기 우이경 농민생활풍습 : 1우경과 2우경을 중심으로

In traditional Korean life Ploughs occupied high rank. The beginning of Ploughs goes back to the ancient times. Ploughs used rice field. The Ploughs in the Yi-Dynasty is divide into two: (1) One plough - One cow(一牛耕) (2) One plough - Two cow(二牛耕) In early Chosen Dynasty, the southern part of Korea including Kyunggi-do (province) was generally used for the rice field and the northern pant including Whanghae-do and Kangwon-do was used mainly for the dry field. In late Chosen Dynasty, the rice field was extended to tlne southern part, and to some of the northern part. In this period, Ricesplants Transplantation Techniques(移秧法) was widely used. Riceplants Transplantation Technique was an advanced agricultural method that had been developed in the southern part of our country in 14th century. But it was not popularized until late Chosen Dynasty. Riceplants Transplantation Technique increased productivity of the rice field and its effect on ploughs system. So,'One plough - One cow' systems used in the Riceplants Transplantation field(north Korea):'One plough - Two cow' systems used in the Non Rice plants Transplantation field(south Korea). The differance of ploughs influence Peasants' Life in the Yi-Dynasty.

鷄胎器官 成長에 미치는 Testosterone의 效果에 對하여

Although many research have been described previously for the various effects of testosterone on the several embryos, most of these study are based on simple weight gain which is not adequate for evaluation of the various organs statistically. The author intended to determine the effects of testosterone on the weight gain of body weight and various organs of chick embryos. On the 8th and 12th day of incubation, 0.5㎎ and 7.5㎎ of testosterone were injected into chorioallantoic membrane of each incubated egg of two groups, and each main group were divided into three more small groups such as control, 0.5mg injected group and 7.5㎎ injected group. Between the 12th and 18th of incubation day, a daily total of 10 treated eggs was broken for weighing the body weights of chick embryos and six organs―brain, eye ball, heart, lung, liver and kidney. The effects of doses and difference of injection times on growth were analyzed by the Repeated Two Way Lay out Method, and the determination of the significance in the levels of difference was made by the Turkey's Method. The results are summarized as follows: 1. When injected with testosterone injectable aqueous suspension, the chick embryos were observed with significant difference on the growth of organs between the 8th day group and the 12th day group. 2. In the 8th day group, growth retardation appeared in body weight, brain, eye-ball, lung, liver and kidney throughout 7.5㎎ injected group. 3. Generally, the growth inhibition was found on the 12th day group in comparison with control group. 4. In the both 8th day group and the 12th day group, were unique in that the growth increasing appeared hearts in 7.5㎎ injected group. 5. When injected with 7.5㎎ testosterone on the 8th day, kidney were observed with growth inhibition, but on the other hand, 12th day injected group showed growth promotion.
