턴키제도가 도입된 지 40년이 되어간다. 민간기술의 활용, 책임소재의 명확, 건설업계의 경쟁력 향상 등 긍정적인 면도 있지만 대형건설회사의 사실상 수주 독점에 의한 입찰참여의 제한과 담합시비, 공사비의 적정 대가 지불 불명, 평가심사의 불공정 등의 문제도 있다. 그 간 발생된 문제점 때문에 서울시는 2012.11월부터 턴키입찰을 더 이상 시행하지 않겠다고 하였다. 그러나 정부는 턴키계약제도의 긍정적인 면을 살리기 위해 대책을 마련 중이다. 현재의 기준들은 대형건설업체의 보호장벽의 성격이 강하고 다수의 설계가나 기술보유자, 중견 건 설업체의 규제장벽으로 되고 있다. 마련한 대책도 담합방지에 미흡하다. 턴키의 특성상 예 정가격을 작성하지 않지만 실시설계 심사 시 가격심사도 할 필요가 있다. 담합하여 국민의 세금을 대가 없이 가져가도 눈뜬장님이 된다. 그간 담합방지나 공정한 심사를 위하여 여러 제도를 개선하였다. 그 중에서 2011년 담합 으로 과징금을 3년에 3회 부과 받은 경우에 건설업면허 취소라는 삼진 아웃제도를 마련하 였는데 2014년에 들어 대부분의 대형건설업체가 면허취소 시비에 휘말리게 되었다. 그간 대형건설사들은 담합하여도 처벌받지 않아 공정한 계약질서를 무너뜨리는 데 대하여도 대 책마련이 필요하다. 본고 이러한 턴키제도의 운용실태와 제문제점을 살펴보고 그 대안을 모색하는 데 있다. It has been almost 40 years since turn-key bid system introduced in Korea public sector procurement market. Turn-key system has contributed positive effects, such as improvement of construction management know-how and the competitiveness of foreign construction markets. It gives also negative effects such as un fair methods of competition and unfair or conceptive acts or practices by big construction companies. Seoul metropolitan government announced that no-more Turn-key system from November 2012 cause of negative aspects. Central government has tried to improve the Turn-key system for its positive effects. The current improvements for turn-key system however, could not effectively work to eliminate the negative issues. The procedure and bid offer conditions are available for major companies not to middle and small size ones. Penal provisions does not work to them. This paper attempts to find ways to improve the system.

국제 턴키수출 계약시 공급자의 주요 고려사항 : ICC Model Turnkey Contract for Major Projects(Pub. 659)를 중심으로

ICC Model Turnkey Contract for Major Projects(Pub.659)는 공급자와 구매자간의 균형을 우선적으로 하는 모델계약서로써 산업플랜트 뿐만 아니라 소프트웨어와 같은 서비스 분야와 도시 기반시설 구축 등의 토목 공사까지 다루는 모델계약서로써 계약서를 작성하는 데 소요되는 시간과 노력을 절감 하게 한다. 국제턴키수출계약 체결 시 공급자는 공급한 계약 물품을 구체화 하는 것에서부터 계약의 본격적인 이행단계 그리고 대금 회수에 이르기까지 발생할 수 있는 위험을 최대한 고려하여 계약서를 작성하여야 한다. 그리고 계약의 이행이 완료 된 후 하자 보수의 규정에 대하여도 최대한 구체적으로 작성하여 추후에 문제가 발생하지 않도록 방지해야 하며, 문제 발생 시 해결방법에 대하여 준거법 및 중재 조항 등을 삽입하여 원활히 해결할 수 있도록 하여야 한다. 향후 국제턴키수출계약을 진작시키고 해외 수출을 장려하기 위하여 ICC모델 계약서를 비롯한 이 분야에 대한 연구가 더욱 활발히 진행될 것으로 기대한다. ICC Model Turnkey Contract for Major Projects(Pub.659) makes as a model contract primarily a balanced between suppliers and buyers and includes service sectors such as software issues as well as industrial plants. When closing a international turnkey export contract, A supplier has to draw up a contract considering the available risk from shaping up the works, implementation of the contract to collection of the price for turnkey exports. And a supplier prescribes the part of defect correction concretely in order to stop the contract causing troubles and includes governing law and arbitration articles to solve the problem smoothly. From now on, It's hope to study further about this thesis including ICC Model Contract in order to promotion international turnkey export contracts and foreign exports.

턴키대안 건설공사의 입찰 및 설계심의제도 개선방안

우리나라는 2000년부터 턴키ㆍ대안입찰 발주물량이 급증하였으며 업체선정 및 평가과정의 객관성과 적정성확보 문제, 업체간 과다 수주와 대형업체들의 수주편중현상 등이 문제점으로 제시되고 있다. 초기 턴키심의방식은 일원화된 설계심의위원회 구성에 의해 기술평가를 통해 설계우수업체를 선정하였다. 이 방식은 설계심의위원의 공정성 및 자격성 문제 등으로 개편되었으며, 2004년 이월 01일부터 공개토론방식에 의한 기술위원회와 평가위원회로 이원화되어 구분 시행되고 있다. 변경된 방식은 현재 시행 2년이 지나면서 일부 개선된 방식으로 수정되기도 하였으나 여전히 많은 문제점을 내포하고 있다. 본 연구에서는 이러한 문제점을 분석하여 개선된 운영방식을 제안함으로서 국내 건설시장에서 턴키 및 대안 설계심의방식의 효율성을 높이고자 한다. The application of turnkey and alternative-design contracts has been increasing for large SOC projects since the practical application was revitalized by our government from 2000. Recently rapid growth of turnkey projects cause many problems such as too many contracts by large companies, increasing of design cost and excessive competition. That become an important issue in domestic construction market. The current design deliberation procedure of turnkey project is being operated by an open forum type that consists of technical committee and appraisal committee since 2004. But this system also is analyzed to be including many problems. So, This paper suggests some improvement methods and operational problems caused from application of an open forum type for selecting contractor of turnkey project. This study is intended to contribute that turnkey and alternative-design contracts can be well operated in domestic construction markets.

사례 분석을 통한 턴키 프로젝트 실시설계 업무 관리방안

턴키공사의 업무수행체계는 기본설계, 입찰, 낙찰, 실시설계, 계약, 시공, 사업물 인도와 같은 절차로 구성되어 있다. 턴키발주 공사의 프로세스 중 이러한 설계업무는 일괄계약자인 기존의 건설회사에서 담당하지 않은 생소한 부분의 업무이다 이 중 실시설계 적격자 선정이후단계에서 계약단계까지의 과정에 해당하는 실시설계단계에는 사업내용에 대한 구체적인 조정 및 최종결정과 관련된 업무가 존재하므로 사업성패에 상당히 중요한 단계로 여겨지고 있으나, 기존의 시공단계의 관리업무만을 수행하던 일괄 사업자에게는 현실적으로 다소 생소한 업무분야이다 현재 국내 턴키공사에서는 실시설계단계에 대한 체계적이지 못한 업무관리로 인해 설계변경 요청, 클레임 제기 등이 발생하고 있다. 이러한 원인은 턴키공사라는 실시설계업무에 대한 구체적 문제점 인식과 이에 대한 관리방안이 체계화되어 있지 못함에 기인한다. 따라서 본 연구에서는 턴키수행공사 기존 설계시공 일괄사업 관련문헌 및 선행 연구고찰을 통한 사례조사연구를 설계하고 이를 토대로 현재 공사 중인 현장에 대한 사례조사를 수행하였다. 사례조사 내용을 분석함으로써 현행 턴키공사의 실시설계 주요 관리업무 및 수행상의 문제점을 구체화하였으며, 실제 실시설계 관리업무 담당자들의 개선방향에 의견을 정리하고 이를 통한 실시설계 관리업무에 대한 개선방안을 제시하였다. The contractors which execute the design-build project have difficulties in design management and contract administration in the pre-construction phase because they have managed construction projects focused on only construction phase so far. Moreover, they have to manage the design development stage without any contingency following-up various design revisions from the design reviews of outside experts. Therefore, the design management in the design development stage is a critical success facto. of the design-build project. The objective of this study is to structure the problems in the management skill for design development phase in the domestic design-build projects and to suggest a design development management method to settle the problems. To achieve these objectives, this study 1) analyzes the prior studies about the design-build procurement methods, 2) designs and performs a case study to embody the problems of the domestic design-build projects, and 3) proposes a method of design development management by analyzing the results of case study and interviewing experts.

효율적인 턴키사업 추진을 위한 클레임 저감방안

현재 우리나라에서 진행되고 있는 턴키사업은 근원적인 장점을 살리기 보다는 여러 가지 문제점이 지적되고 있다. 설계심의 방법 및 적격자 선정단계의 문제점과 제도 및 계약기준, 입찰안내서(지침서)의 불명확한 내용 등으로 턴키사업수행과정에서 각종 클레임(Claim)이 증가되고 있는 것이 현실이다. 국내 턴키사업이 바람직하게 정착되기 위해서는 입찰 및 계약단계에서 설계심의 방법과 실시설계 낙찰자 선정에 대한 적정한 대안을 마련하여야 하는 것은 물론, 턴키사업과 관련된 계약 및 발주기준, 입찰안내서의 불합리한 부분에 대한 합리적 기준을 마련하여야 한다. 본 연구는 설계변경 등 계약변경이 어려운 턴키발주사업의 클레임 사례를 분석하여 문제점을 도출하고, 이를 토대로 관련 계약 조건 및 입찰안내서의 개선방안을 제시함으로써 턴키사업으로 추진하는 공동주택건설사업의 클레임을 저감하여 효율적 사업수행에 기여하고자 하는 것이다. Currently, TK(Turn-key) projects have been implemented, the projects on TK basis still have shown several problems rather than its own merits as a bidding method. Increasing the number of claims being occurred during construction process of the projects is reality because of unclear notice of tender documents and conditions of the contract, design review system, and decision process of the qualified bidder. To establish desirable TK projects in domestic market, not only should resonable alternatives for carrying out design review system and selecting the bid winner be set up, but also proper standards for reforming irrational system of contract, bid, and notice of tender related to TK projects. This study is intended to reduce the number of claims and implement efficient projects of apartment construction on TK basis by identifying potential problems through analysis of claim examples of TK projects which have difficulties of revising contract agreement such as drawings and suggesting improvement methods for contract conditions and notice of tender docuements.

공공공사 턴키입찰 시행에 따른 효율화 방안 고찰 : 저작권을 중심으로

정부는 “국가를 당사자로 하는 계약에 관한 법령”과 “지방자치단체를 당사자로 하는 계약에 관한 법령”에 정하고 있는 바에 따라 설계와 시공을 일괄하여 발주하는 설계・시 공일괄입찰(Turn-key)을 시행하고 있으며, 낙찰자로 결정되지 아니한 자에게는 입찰참여 를 위하여 소요된 설계비의 일부를 보상하고 있다. 건설업체들은 높은 설계점수를 얻기 위해 나름 최고의 품질을 확보할 수 있는 설계서 를 제출하기 때문에 낙찰탈락자의 설계서도 우수한 부분이 있을 수 있는데, 현실과 같이 그대로 사장되고 있다는 것은 국가적인 측면이나 건설사 입장에서도 모두 안타까운 일이 라 할 수 있다. 그러므로 입찰시 제출된 다수의 설계서를 필요시 적재적소 활용할 수 있 도록 함으로써 예산집행의 효율성을 극대화하는 한편, 보다 나은 품질을 확보할 수 있는 개선방안이 필요하다고 할 수 있다. 턴키입찰에 있어 기본설계서의 저작재산권에 대한 양도는 발주기관이 설계비 일부를 보상하면서 설계도서 전부에 대한 권리를 양도받는 점이 불합리하다는 것이 문제가 되는 것이므로, 양도를 위한 적절한 보상과 절차에 따르면 문제점은 해결될 사항으로 판단된 다. 즉 발주기관이 입찰시 제출된 낙찰탈락자의 기본설계서의 일부내용을 반영할 계획이 라면 필요시 적절한 보상과 절차 수행을 위해 '저작권 양도를 위해 낙찰탈락자와 발주자 간에 협의를 진행하게 된다.'는 문구를 입찰공고 등에 게재하면 되는 것이다. 또한, 턴키 입찰에 있어 낙찰탈락자의 설계서를 활용함에 있어 반드시 저작재산권을 양도받아야 할 필요는 없으며, 당해 공사에만 활용하는 개념이라면 지적재산권의 양도보다는 오히려 저 작물의 이용허락을 받는 것이 타당하다고 볼 수 있다. 우리나라는 년 간 60건 내지 80여건의 턴키입찰을 실시하고 있으며, 금액으로는 년간 10조원 정도의 예산이 투입된다. 정부는 건설기술진흥법에 따라 설치운영 되고 있는 중 앙건설기술심의위원회를 활용하거나 또는 이를 전담할 별도의 전문부서를 신설하여 낙찰탈락자의 설계서를 이용하기 위한 검토 기능을 부여함으로써 예산집행의 효율성을 극 대화하여야 할 것이며, 이와 병행하여 설계서에 대한 저작재산권의 양도와 관련된 협의 기준도 조속히 마련하여야 할 것이다. The turn-key system or the package of design/construction system operated for artistic construction works requiring a landmark design and construction or those works required to be implemented rapidly. In order to develop the turn-key bidding system, the researcher divided the problems impeding the system in view of contract system, awarders and construction industry, and therewith, explored the ways to minimize or solve the problems per sector.

건축턴키공사 입찰·계약 단계에서의 클레임 예방을 위한 클레임요인 분석 및 대응방안에 관한 연구 : 국내대형건축턴키공사 사례중심으로

In the inner turn key constructions the problems of uniform types are repeatedly occurred, and, especially, many problems happen up to the stage of pre-construction(from a bid to a contract) owing to the specialties of the turn key constructions. So the claim factors of the Korean turn key constructions were abstracted through the literature searches, the site document examinations, the case studies and the interviews with the experts. When the technicians meeting the interior turn key constructions for the first time and working here now are well acquainted with only these factors, many claims will be prevented. By analysing the degree of claims by claims factors through the questionnaires to the experts about the abstracted factors and surveying the amount of the claims through the case studies, what factors exerted how much of influence on the claims was tested and analyzed. Proposing the response devices to the factors affecting the claims much led the technicians in charge of internal turn key constructions to the prevention and the proper solution of the site claims.

턴키·대안입찰공사 낙찰자 결정방식의 문제점 및 개선 방안 도출

2010년부터 턴키심의위원 풀 제도를 폐지하고, 상설심의위원 제도를 도입하여 현재까지 턴키입찰공사는 설계적합최적가방식, 종합평가방식으로서는 입찰가격, 설계점수조정, 가중치기준, 확정금액최상설계방식의 5가지 낙찰자 결정방식으로 선정하고 있다. 또한 낙찰자 결정방식으로서 설계심의분과위원회를 크게 중앙 지방 특별 설계자문위원회의 분과위원으로 구성하여 운영하고 있으나, 아직 로비 부담에 대해서 개선되지 못한 것은 심의위원 풀제에서 상설심의위원으로 심의 주체만 변경되었을 뿐, 턴키입찰에서 설계심의가 가지는 비중과 설계심의방식도 과거와 유사하기 때문이다. 그러므로 가격경쟁을 부분적으로 강화하여 설계점수가 낙찰을 좌우하는 풍토를 개선하고, 기술경쟁은 영업력보다 실질적인 기술력이 경쟁력을 가질 수 있도록 설계심의제도를 개선하는 것이 필요하다. 이에 이 연구는 낙찰자 결정방식의 설계심의 운영제도와 문제점 그리고 개선된 설계심의방안을 제시하였다. Full system of turnkey deliberation committee in 2010 was abolished and permanent Deliberation committee was introduced. So far, ordering organization selected the best method suitable for the design and comprehensive evaluation method in the turnkey bid construction. Comprehensive evaluation method have bid price design score coordination, weighted basis, the best design approach fixed amount, five successful bidder decision method in addition. Design deliberation branch committee in the successful bidder decision way configured and operated branch members of special design consultation committee, But main agent changed from committee deliberation pull system to permanent committee deliberation, as well as and The lobby burden was not improved. This similar to the past at the portion of the design deliberation and the way of the design deliberation in the turnkey bid construction. Therefore it is necessary to improve the design deliberation system. In other words, design score and technology competition should be adapted to determine a successful bid. This study suggested the operating system of the design deliberation, the decision method problems of the successful bidder and ways to improve the design deliberation.

ICC모델 턴키 계약의 쟁점에 관한 연구 : ICC Model Contract for Turnkey Supply of Industrial Plant를 중심으로

This Work intends to study on some issues of business and law in relation to Contract for Turnkey Base System. The continuing advance of export system of the plant with the importance for efficient and effective management emphasizes the need for business and legal approach to uniform international model contract. ICC Model Contract for Turnkey Supply of Industrial Plant by ICC covers a particular category of turnkey contract, i.e. contracts for the supply of a plant or production line to be erected within facilities which already exist or which are constructed by the purchaser. Furthermore, the application of the ICC Model Contract for Turnkey Supply of Industrial Plant leaves much to be desired from a business and legal point of view. Therefore, there would appear to be room for compromise between the supplier and purchaser in respect to make a contact for Turnkey supply of industrial plant.
