        한국에서 외국인의 범죄 실태 분석: 국내체류자를 중심으로

        The aim of this paper is to analyze the real state of the foreign criminals in Korea with focusing on the crimes committed by foreigners in Korea, and based on such analysis, to seek appropriate measures in order to prevent crimes by them. Following these research objective, the results of this thesis analyzed as below. First, there is growing trend of the foreign population and the foreign illegal immigrants in Korea from the 1990s to the present of the late 2000s. According to the NPA(National Police Agency)`s criminal statistics, as of the end of 2008, the total size of the foreign residents in Korea stands at 1,158,866, 17.3 percent of which, or 200,489, are here illegally. Second, the number of crimes committed by the foreign residents and the foreign illegal immigrants in Korea are increasing rapidly from the 1990s to the present of the late 2000s. For example, the number stood at about 770 in 1991 to 1,276 in 1998, 2,040 in 2000, 4,328 in 2001, 12,657 in 2006, and to 20,623 in 2008. Third, the types of foreign crimes in Korea mostly well preserved with significant marks of murder, robbery, rape, theft and violence. The another main feature of foreign crimes in Korea is that some of these foreigners are beginning to organize in groups to commit bigger crimes. And also its other different nature is that with the number of crimes committed by foreigners increasing rapidly, more local people are becoming victims. This characteristics have sparked growing uneasiness on the foreign crimes in Korean society. This is what these are crimes of xenophobia in the multi-cultural society of Korea nowadays. In conclusion, an increasing foreign crimes in korea has recently come to the fore as a public order's maintenance problem and a serious social issue. To cope with the growing number of crimes committed by foreign nationals, and in order to respond to the different types of organized their crimes, must set up the comprehensive, systematic, permanent and effective measures at the Korean all-government(especially at the NPA level). For this, this thesis made a suggestion that the Korean government must set up the tentatively named 'the National Comprehensive Support Agency of Foreign Affairs'(NCSAFA), and also the NPA would established 'the Victims Notification Center of Foreign Crimes'(a provisional name) in all the police station, the police district and the police box, an affiliate of the NPA, but operated them on its own. 본 논문의 연구목적은 한국에 체류하고 있는 외국인의 범죄 실태를 분석하여 그 대책을 모색하는 데에 두고 있다. 본 연구의 분석결과는 다음과 같다. 첫째, 1990년대 이후 2000년대에 들어와 국내불법체류의 외국인이 급증하고 있다는 점이다. 이들은 1991년 41,877명에서 1999년 135,338명으로 증가하였고, 2000년에는 전년도에 비해 39.6% 증가한 188,995명으로 급증한 후 2008년 200,489명에 이르기까지 ‘200,000명대’를 유지하고 있다. 둘째, 1990년대에 이어 2000년대 들어와 국내체류의 외국인과 국내불법체류의 외국인에 의한 범죄가 계속 급증하고 있다는 점이다. 1990년대 이들의 전체 범죄는 1991년 770명에서 1997년 824명에 이르기 까지 700명-800명대 수준에서 발생했으나, 1998년부터 2,000명대 내외로 급증한 이후 2000년에 이르기까지 해마다 연속적인 급증세를 나타냈다. 2000년-2008년 동안에도 이들의 전체 범죄자 수가 2000년 3,438명에서 2003년 6,144명으로 해마다 약 1,000명씩 증가하였고, 그 이후 2006년에 12,657명으로 1만명대에 진입하더니 2008년에는 20,623명으로 전년도 대비 6,099명(41.9%)이나 급증하였다. 이로써 2008년대말 국내체류의 외국인범죄는 ‘2만명대’의 수준에 달하고 있다. 셋째, 국내체류 외국인의 범죄 유형이 살인, 강도, 강간, 절도, 폭력 등을 중심으로 마약밀매, 돈세탁, 무기밀매, 위조 통화·신용카드 유통, 불법음반·비디오 유통, 인신매매, 채권·채무관계 해결, 사이버 범죄, 보이스 피싱, 산업기술 유출 등에 이르기까지 다양화․지능화․조직화의 추세로 나타나고 있다는 점이다. 또한 국내체류 외국인의 범죄가 외국인 폭력조직과 연계되어 한국을 새로운 활동무대의 교두보로 겨냥하고 있다는 점이다. 이와 관련하여 특히, 국내에서 외국인의 마약류(마약, 향정신성의약품, 대마 등) 범죄가 1990년대에 비해 2000년대에는 크게 증가하고 있는 것으로 나타나고 있다. 결론적으로, 본 연구의 분석결과를 종합해 보면 한국에서 외국인 범죄의 증대문제는 우리 정부의 치안수요를 급증시키고 있는 심각한 치안문제이자 우리 사회에서 국민의 생명과 안전을 위협하는 하나의 큰 사회문제라고 평가되었다. 이에 우리 정부가 효율적으로 대처하기 위해서는 기본적으로 정부가 치안정책 차원에서 국제성 범죄의 전문수사요원, 각국 언어의 수사전문통역가, 세계 각국의 지역연구전문가를 확보하여 외국인 범죄대책을 종합적․체계적․지속적으로 관리․운영해야 한다고 보았다. 이를 위해 ‘정부외사종합지원청’(가칭)의 설치, 경찰청 산하의 모든 경찰서·지구대·파출소에 ‘외국인범죄피해신고센터’의 전면 설치․운영을 제안하였다.

        국내체류 외국인의 통일교육 필요성 검토

        Review of the Need for Unification Education forForeigners Residing in KoreaHyanghee Yun & Sekyung Jeon Abstract: This study aims to review the necessity of unification education so that foreigners residing in Korea can be aware of the relationship between South and North Korea while living in Korea. As a research method, interviews were conducted with 6 participants or graduates of the 5th stage of the Social Integration Program of the Ministry of Justice. The contents of the study are the understanding of Korea and the fact that it is a divided country, the experience of fear of war during life in Korea, and whether foreigners living in Korea received education on the relationship between South and North Korea in the Social Integration Program of the Ministry of Justice. This was investigated through interviews. Foreigners residing in Korea encountered Korean culture through the Internet, YouTube, and dramas before entering Korea, and after entering Korea, they learned that it was a divided country. However, they felt no fear of war because they experienced a safe life in Korea. He also wanted to live in Korea with his family. In the Social Integration Program of the Ministry of Justice, in which they participate, information about the relationship between South and North Korea should be included, and unification education should be conducted for foreigners residing in Korea.         다문화 가족의 보호와 지원에 관한 법제 소고

        With the increasing cases of international marriages, Korea has currently suffered from many societal disorders For thousands of years, Koreans have been a group of people with a higher sense of ethnical simplicity, however, the strikingly increasing number of foreign females has undoubtedly threatened Korean's sense of simplicity Unlike other foreign laborers who return to their hometown after a certain period, those foreign females who marry Korean males are naturalized to be members and have permanent residence in Korea Hence, it can be perceived that several problems on female immigrants' rights have been revealed. Apparently, Korea has become a multicultural society gradually owing to the increasing number of ling-staying foreigners, including marital immigrants. This phenomenon also demonstrates that it is indispensable to carry out some policies to protect or support these foreigners in Korea On these grounds, Korean Parliament has enacted "Act on the Treatment of Foreigners in Korea", "Support for Multicultural Families Act". Furthermore, "Proposed Standard Ordinance to Support Resident Aliens" is also established. All of these regulations focus on protection and support for the marital immigrants. The author has discussed the positions of marital immigrants in Korea and its legal problems in previous essay generally In this paper, the author will chiefly discuss the importance of marital immigrants' positions and human rights, and meantime, examine the existing problems The following will focus on these regulations and their existing legal problems First of all, it is regulated that "Act on the Treatment of Foreigners in Korea" can only apply to legal-staying foreigners in Korea, not other illegal-staying foreigners in Korea But it is evident that all of the marital immigrants and their children, foreign laborers, long-staying foreigners, and refugees also need some supports or protection so that they can adapt themselves to Korean society without discrimination Hence, it may call it in question if all of the illegal-staying foreigners are excluded from this regulation, without considering each situation or type of the illegal-staying foreigners As the illegal-staying foreigners also need some supports or special protection, it is much better to provide them appropriate supports or protection in accordance with the situation of each case Secondly, it's better to set up an institution which deals only with the supports and protection for those long-staying foreigners, such as immigration institution If there is difficulty in setting up such an institution so immediately, then Ministry for Health, Welfare and Family Affairs could take charge of this affairs focusing on the supports and protection for these foreigners, but not on restraints or penalty Next, most of these regulations are declarative and advisory, without any actual effects Hence, it is likely that these regulations will become 'decorative' regulations Lastly, it seems that it is not necessary to regulate that foreigners can receive language and cultural education, child care, and education for children only within 3 years after obtaining nationalities because some of foreigners still need some supports after this regulated period of time So it appears appropriate to abolish the limit of time in this item

        국내 이주민에 의한 잠재적 소요 예방을 위한 재한외국인처우기본법 개선안

        Nowadays, it is considered that one of the most prominent social phenomena in Korea is the rapid pace of change toward a multi-cultural society. There are more than 130 million foreigners including migrant workers and marital immigrants in Korea. This trend has led Korean society to promote increased understanding of multi-cultural society. The Framework Act on Treatment of Foreigners Residing in the Republic of Korea provides that The state and local governments shall endeavor to take measures such as education, publicity, and correction of unreasonable institutions, etc. to ensure that Koreans and foreigners in Korea understand and respect each other`s history, culture and institution (Article 18). On the other hand, Korean people have been rebellious towards the potential that the occurrence of crime by foreigners will be on the rise. In this respect, it seems that Korea shares lots of similarities with France in many ways. France has already experienced such a period of transitional arrangement to a multi-cultural society prior to Korea and has been supporting the assimilation policy since there were riots by the second generation of Muslim immigration in 2005. This can give us a direction of immigration policy because both of the countries have a lot of similarities. As France did, Korea may not be able to avoid crime committed by young people who have multi-cultural background. France carried out an integrated policy focused on the “assimilation. As a result, the conflict between French locals and the immigrants was cumulative and erupted as a form of riot in the end. The current condition in Korea is similar to the French`s situation in 2005 in many aspects. While Korea has considered “Single-nationalism as an absolute value, “Republicanism in France. For this reason, the need to learn a lesson from the French riot about what is predicted in our society is sufficient. However, statistically, the immigrant crime rate is lower than the local one in Korea, so there is little possibility that such a large-scale riot as the French one will occur soon. Nevertheless, if the conflict between the locals and immigrants develops as the immigrants` children grow up, nobody can say that Korea is free from a riot by the immigrants. Therefore, through the revision of Framework Act on Treatment of Foreigners Residing in the Republic of Korea, we need to prevent a riot with proper precautions and should make the immigrants and local Koreans able to live together with harmony.

        이주민의 법적지위와 관련하여 재한외국인처우기본법의 한계와 개선방안에 대한 고찰

        세계화로 인하여 국가 간의 이동이 자유로워짐에 따라 우리나라에 유입된 외국인도 2백만 명을 넘어서고 있다. 그 중에서는 대한민국 국적을 취득한 이주민도 있으며, 우리나라에서 근로를 제공하고 있는 외국인 근로자의 수도 증가하여 국내에 이주하여 장기체류하는 외국인도 증가하는 추세이다. 이에 따라 이들의 법적 지위도 중요한 이슈로 떠오르고 있다. 우리나라뿐만 아니라 해외도 이와 같은 이주민들이 늘어남에 따라 헌법, 출입국 관리법, 국적법 등 관련 법률로 이들의 법적 지위를 규정하고 있으며 특히 대표적인 이민국가인 캐나다의 경우 「다문화주의법」을 제정하여 국가의 이념 또한 다문화주의를 따르고 있다. 국내에는 이러한 이주민에 관련된 법률로써 「재한외국인처우기본법」을 대표적으로 꼽을 수 있다. 「재한외국인처우기본법」은 국내에 거주목적으로 체류하고 있는 외국인들의 처우에 대하여 규정하고 있는 법으로 다른 나라에는 존재하지 않는 데에 의의가 있겠으나, 규정이 많지 않고 미흡하여 재정비 방안이 필요하다. 따라서 본 연구에서는 「재한외국인처우기본법」의 궁극적인 목적과 더불어 동법의 한계와 그 개선방안에 대해 고찰함으로써 향후 다문화 사회에서의 기본법의 역할을 「재한외국인처우기본법」이 할 수 있도록 방향을 제시하고자 한다. Due to globalization, the number of foreigners who have flown into Republic of Korea has exceeded 2 million as the freedom of movement between countries has become free. Among them, many immigrants have acquired Korean nationality, and the number of foreign workers who provide labor to Korea is increasing, and more foreigners are staying in Korea. As a result, their legal status is becoming an important issue. As the number of immigrants increases not only in Republic of Korea but also abroad, it regulates their legal status with related laws such as Constitution, Immigration Control Act, Nationality Act. Especially in Canada, which is a representative immigrant country, the law of multiculturalism which called “Multiculturalism Act” is enacted and the ideology of the nation is also following the multiculturalism. In Korea, the “Framework Act on the Treatment of Foreigners Residing in the Republic Korea” is one of the representative laws for immigrants. Although the “Framework Act on the Treatment of Foreigners Residing in the Republic of Korea” is a law stipulating the treatment of foreigners staying in Korea for the purpose of residence, There is a good meaning that it does not exist in other countries. but There are not many sections and it is insufficient and it is necessary to revise it. Therefore, in this study, we will examine the limit of “Framework Act on the Treatment of Foreigners Residing in the Republic of Korea”. and also will examine the ultimate goal of the Basic Law for the Treatment of Foreigners in Republic of Korea, and suggest the direction of the Basic Law of Treatment of Foreigners in the future do.

        Determination Factors of Dental Clinics of Foreigners Residing in Korea

        Objective: This study is aimed to be used as basic data to strengthen the competitiveness of dental services by investigating the satisfaction and the will to reuse dental services targeted at foreigner revisit with experience of domestic dental care. Methods: This study was conducted as a survey from November 31, 2014 to February 23, 2015 with some foreigners residing in Korea. The subjects of this study were 121 foreign residents in Korea. For questioning items, structured questionnaire was used. It was composed of 23 questions. Results: Among respondents, the more the age of low satisfaction, the lower were satisfied. This is the very reason that older patients have higher level of expectation for service than younger patients do. Satisfaction measurement for reservation & payment process was the highest in respondents who had stayed in Korea for 5 years (3.66%) and in respondents who had health insurance. It was found that scheduling appointment and making a payment were the main factors affecting patients to revisit followed by satisfaction rating the facilities. Conclusion: To attract more foreigners residing in Korea, efficient systems for scheduling appointment and dental insurance system for foreigners residing in Korea need to be developed. In the other institutions, we must be ready for communication for resolving language barrier between respondents

        재한외국인처우기본법 이민기금 설치의 필요성

        A fund is established by law only when the state needs to operate certain funds flexibly for a specific purpose, which means funds that can be operated without being subject to revenue or tax expenditure. To realize a special policy objective, the fund can be held and operated for a specific project so that it can be operated more flexibly away from the general constraints of the budget principle. The budget and the fund are the same fiscal management tools of the government, but in the case of the fund, they differ from the budget in that the autonomy and resilience of fund management entities are guaranteed. The biggest feature of funds being distinguished from budgets is the ability to draw up a fiscal management plan for the purposes of the fund management entity without going through a general budget process. In modern fiscal policy seeking an integrated budget, funds are included with general account and special account to be used as data for fiscal policy, increasing the importance of management and control. However, it is generally over budgeted, and the benefits are based on the law. It can be operated without budget and has relative autonomy in operation under the responsibilities of the Minister in charge through separate operational regulations. Taking into account the nature or characteristics of these funds and fund systems, there is a need for immigration funds to pursue and support a realistic and effective immigration policy for true social integration in Korean immigrant communities. At a time when the number of foreigners residing in Korea is rapidly increasing as a social phenomenon and the purpose of staying in Korea is gradually diversifying, many social problems have arisen, including anti-foreign sentiment among the public by implementing a policy of consistent benefits by considering Korean foreigners as simply those who need support. Going one step further, the failure to come up with a realistic and integrated support policy for Koreans and foreigners could lead to serious social problems by deepening conflicts between Koreans and foreigners as well as greatly increasing the tax burden on the people. Another important policy is to minimize the public's tax burden on integration costs between Koreans and foreigners in the future and to secure stable resources to support foreigners' smooth adaptation to the country through a shift in the policy that has been implemented so far at a time when conflicts between Koreans and foreigners are emerging. The fund needs to be raised using fees levied on immigrants and others to resolve conflicts between their own people and foreigners, resolve reverse discrimination and finance stable social integration. The time has come for Korea to contribute to the development of the Republic of Korea and social integration by promoting people's anti-depression by directly utilizing various expenses incurred by foreigners in their social integration and securing the funds needed for efficient social integration of foreigners living in Korea.

        본 논문의 목적은 한국에 살고 있는 외국인이 어떻게 한국 구비문학을 보는가하는 질문에서 시작하여 그 질문의 저류에 있는 보다 깊은 문제를 파악하고 그에 대한 답을 제시하는 데에 첫걸음을 내딛는 것이다. 이를 위해 한국 거주 외국인 대상으로 설문조사를 실시했으며 응답자 중에 두 명을 선택하여 직접 인터뷰를 했다. 그 결과는 다음과 같다. 설문조사 1부는 응답자에 대한 통계학적 정보를 얻기 위한 것으로 국적, 인종, 한국 거주 기간, 직업, 연령, 성별, 한국어 능력 등의 정보를 수집했다. 2부는 한국 전통·현대 문화와 구비문학에 대한 질문이었다. 한국 전통 문화는 유교문화로 특징되고 현대 문화는 기술로 특징된다는 답이 우세했다. 전통 구비문학 장르의 인지도는 설화, 속담, 판소리, 민요, 탈춤, 무가, 인형극 순으로 나타났으며 문화축제나 예술극장에서 접했다는 답이 많았다. 한국 현대 구비문학에 대한 의견은 대략 세 가지로 분류할 수 있다. 전통 장르 중에 설화나 판소리와 같이 아직도 살아 있는 구비문학을 지적한 것, 대중음악이나 드라마와 같은 현대적인 장르를 지적한 것, 그리고 전통과 현대의 만남이라고 지적한 것이 그것이다. 인터뷰 내용은 대략 두 가지 문제를 다루었다. 첫째는 어떻게 하면 외국인이 한국 구비문학에 더 쉽게 접근할 수 있을까하는 것이며 둘째는 한국이 진정한 다문화주의 사회로 가려면 어떻게 해야 하는가하는 것이었다. 첫째 질문에 관하여 기본적으로 인터뷰 대상자 모두 비슷한 의견을 제시했다. 즉, 한국 구비문학을 알리는 것이 일방통행 길이 되면 안 된다는 것이다. 외국인의 입장을 고려해야 하고 어떻게 하면 외국인의 입맛에 맞게 할 수 있을까하는 문제를 다루어야 한다는 의견을 제시했다. 둘째 질문에 대하여서도 비슷한 맥락에서 한국을 외국인에게 알리는 것보다 한국에 살고 있는 외국인을 이해하려는 노력이 필요하다고 주장했다. 또한 타자가 한국 문화나 문학을 재해석하는 것이 인정되어야 한다고 했다. 외국인이 한국 구비문학을 어떻게 보고 있느냐는 질문은 결국엔 타자와의 만남을 다루는 문제이다. 일방적으로 외국인에게 한국 문화나 구비문학을 알리겠다는 생각을 하기 보다는 타자와의 만남 속에서 그 문화와 구비문학을 공유하는 단계를 목표로 삼아서 서로 간의 이해와 교류가 있는 세상을 이루어가는 것이 바람직하다고 하겠다. This paper begins with the question of how foreigners in Korea view Korean oral literature and goes on to deal with the issues underlying that question, ultimately aiming to take the first step in providing an answer. To this end, a survey was conducted that targeted foreigners residing in Korea; in addition, two of the respondents were interviewed. The results are as follows. The first part of the survey dealt with demographic information, with questions on nationality, ethnicity, length of stay in Korea, occupation, age, and Korean language proficiency. The second part dealt with views and opinions on traditional and modern culture and oral literature. Most respondents chose Confucian culture as the defining characteristic of traditional Korean culture, while technology was seen as the defining characteristic of modern Korean culture. Recognition of traditional genres of Korean oral literature was as follows, from highest level of recognition to lowest: tales and stories, proverbs and sayings, pansori, folk songs, mask dances, shaman songs, and puppet plays. Opinions on modern Korean oral literature can be placed into one of three general categories: those that focused on a traditional genre that survives to the present, such as tales and pansori, those that focused on a modern representation, such as pop music or television dramas, and those that saw modern oral literature as a meeting of past and present. The interviews dealt mainly with two questions: how can we make Korean oral literature more accessible to foreigners, and what does Korean need to do to become a truly multicultural society? With regards to the first question, the interviewees had similar views, namely that bringing Korean oral literature to foreigners cannot be a one-way road. They also mentioned that the views of foreigners must be taken into consideration and thought given to the issue of how to make oral literature more palatable to foreigners. Replying to the second question, they stressed the need to come to a greater understanding of foreigners living in Korea rather than efforts to simply advertise Korea to foreigners. They also noted that Koreans needed to accept the possibility of a reinterpretation by the Other of Korean culture and literature. The question of how foreigners view Korean oral literature ultimately deals with a meeting with the Other. Rather than engaging in a one-way education of foreigners on Korean culture or oral literature, it would be better to aim for a place where culture and oral literature are shared within a meeting with the Other, and to work to create a world of mutual understanding and communication.

As the subject of production and consumption of foreigners residing in Korea at this point it is necessary to pay attention to the role of beauty in the domestic market. Therefore Satisfaction Survey for their beauty education is considered a very appropriate time. This study was conducted to see beauty educational satisfaction of foreigners residing in korea, and its subjects were 212 trainees attending beauty education institutes located in Seoul and Gyeonggi-do. Targeting analyze the beauty educational qualifications and educational status of foreigners residing in Korea. and Identify the satisfaction of foreigners residing in beauty education according to sociodemographic characteristics.
