중간재시장에서의 담합시 직접구매자 및 간접구매자에 대한 손해배상: 법리적 쟁점과 경제학적 산정방법

In this paper we examine recent stances of courts and competition agencies in U.S., EU,and Korea on direct and indirect purchasers’claims in damage suits related to collusion in intermediate product market. Actual damages of direct and indirect purchasers depend on collusive overcharges of intermediate product price, and consequent passing-on leading to increases in final product price. We also introduce into theoretical foundations and econometric methods of estimating collusive overcharges and consequent passing-on. Moreover, we discuss recent damage suits related to flour companies’collusion and credit card/VAN companies’collusion, focusing on the role of economic analyses in the court decisions. 본 논문은 중간재시장에서의 담합손해배상 소송에서 직접구매자와 간접구매자의 청구권 인정 및 배분을 둘러싼 법리적 쟁점에 대한 미국, EU 및 우리나라의 법원과 경쟁정책 집행기관의 최근 입장을 정리한다. 직접구매자와 간접구매자의 실제 손해액은 담합으로 인한 중간재가격의 상승과 최종재가격 인상으로의 전가에 따라서 결정되는데, 이를 산정하기 위한 경제이론적 기초와 계량경제학적 추정방법을 소개한다. 그리고 최근의 관련 국내사례로서 밀가루사 담합과 신용카드/VAN사 담합 손해배상소송 판결에서 경제분석의 역할을 논의한다.

WMD 확산 방지가 국제사회의 최대 안보위협이라는 점과 이 문제의 중심에 북한이 자리하고 있다는 것은 PSI가 남북문제와 국제문제의 교차점에 위치하면서 한국의 핵심적인 통일·외교·안보문제로 등장했다는 사실을 뜻한다. 본 논문은 PSI를 역사적, 이론적 관점에서 심층적으로 분석하고 우리 정부의 대응책을 제시했다. PSI는 행정부의 교체에도 불구하고 지속적으로 발전되고 있는 미국의 내구력 있는 외교안보전략수단이다. 이제 한국에서도 PSI에 대한 오해와 편견을 해소하고 한국의 안전을 확보함과 동시에 핵확산 방지라는 국제사회 공동의 목표에도 부응할 수 있는 정교한 정책을 마련해야 한다. 본 논문은 PSI 정책의 기조로 북한의 행위를 기준으로 사안별로 대응하는 ‘분리접근’과 전면참가를 원칙으로 하되 대상국별로 참여수위를 조절하는 ‘조절된 접근’ 두 가지를 제시했다. The fact that North Korea is at the center of WMD proliferation which is the number one security threat to the international community indicates that the PSI is an international issue as well as a critical concern for South Korea. This article conducts an in-depth analysis of the PSI from the theoretical and historical perspectives, and proposes policy options for the ROK government. The PSI is a durable strategic tool of the United States, being continuously developed by the various U.S. administrations. South Korea needs to remove misunderstandings and prejudices regarding PSI, and develop better policy options that can meet the international demand of WMD non-proliferation as well as assure its national security. The article proposes two policy directions of separate approach and managed access. According to separate approach, the ROK reaction will depend on the DPRK behavior, rewarding for the good and sanctioning for the wrong or dangerous. With managed access, Seoul will hold on to the principle of full participation to the PSI activities, and differentiate the level of commitment depending on the target nation. For North Korea, its level of participation will be moderated in order not to stir up the North, while it will guarantee full participation in case of a third country.

H.264 디코더에서 기울기 벡터를 이용한 에러복원 방법

Recent advances in information technology have resulted in rapid growth in the mobile communication. With this explosive growth, reliable transmission and error concealment technique become increasingly important to offer high quality multimedia services. In this paper, we propose an improved BMA(Boundary Matching Algorithm) method using gradient vectors to conceal channel errors in inter-frames of H.264 video images. General BMA method computes the sum of pixel differences of adjacent pixels of the candidate block and its neighbouring blocks, assuming that adjacent pixels have almost the same value. In real images, however, there exist some gradients, which means that the pixel values are increasing or decreasing in a specific direction. In this paper, we develop a precise estimation method of errors in candidates blocks using gradient information and try to recover lost blocks with this technique. Experimental results show the improvement of picture quality about 1~3dB compared to existing methods. 이동 통신의 급속한 발전으로 고품질 영상 서비스가 요구됨에 따라 이동 통신 환경과 같은 에러에 노출된 채널환경 하에서 고품질 영상 서비스를 제공하기 위한 에러 복원 기술의 필요성이 증가되고 있다. 본 논문에서는 H.264 화면간(Inter) 프레임에서의 채널 에러에 대한 보완 방법으로 기울기 벡터를 이용한 강화된 BMA(Boundary Matching Algorithm) 방법을 제안 한다. 일반적인 BMA 방법은 후보블록과 인접블록에 대해 차분을 계산할 때, 인접한 픽셀들의 차분의 합을 구한다. 이는 인접한 픽셀들이 대체적으로 같다는 가정에서 이루어지나 실제 영상에서는 기울기가 존재하게 되고 인접한 픽셀들은 특정한 방향으로 픽셀값이 증가하거나 감소하게 된다. 본 논문에서는 이러한 영상에서의 기울기를 고려한 정확한 차분방법을 개발하여 이를 적용한 영상복원을 시도한다. 채널 에러로 손실된 영상에 제안 방법을 적용한 결과 기존에 적용된 방법에 비해 약 1∼3dB 정도 향상된 영상을 획득할 수 있었다.

Tracking International Efforts Preventing WMD & Missile Proliferation and North Korea

WMD is defined as nuclear explosive weapons, radiological weapons, lethal chemical and biological weapons, and those that will be equal to the above mentioned weapons in terms of destructive effects and will be developed in the future. It has included high explosives. This paper tracks international efforts to prevent the spread of WMD, missiles, and their technologies and draw policy implications. After introducing the historical definition of WMD, the paper focuses on less?strict but powerful norms and rules arranged by advanced industrial nations to reduce the chance that their export might be diverted to military purposes. Then, it investigates how the further efforts have been forged to counter possible use of WMD by terrorists or rogue regimes. With due consideration of the importance of missile proliferation by North Korea, the paper also presents political and security implications of North Korean missile proliferation.
