공무원이 아닌 근로자의 신분을 가지고 있음에도 불구하고 업무가 공공성을 띄고 있다는 등의 이유로 관련 법률에 의해 근로3권 행사를 제한받고 있는 이들을 발견할 수 있다. 그런데 이들 대다수가 근로3권중 에서 공익을 위한 최소한의 필요조치로서 단체행동권만을 제한받을 뿐, 직접행동을 수반하지 않는 단결권과 단체교섭권은 정상적으로 행사할 수 있다. 그러나 청원경찰은 청원경찰법 제11조에 의해 이들의 업무상 공공성 등을 이유로 근로3권을 전부 금지 받고 있다. 이 때문에 청원경찰이 마찬가지로 공공적 업무를 수행하는 다른 근로자들에 비해 상대적으로 근로3권을 과도하게 제한을 받고 있는 것이 아닌지 의문이 든다. 앞서 헌법재판소는 2008년에 해당 조항의 위헌성을 두고서 심사를 한 적 있다. 그러나 당시 다수의 재판관이 위헌이라는 견해를 피력했음에도 불구하고 위헌결정이 내려지기 위한 정족수를 충족하지 못해 판결이 미뤄지고 말았다. 헌법적 의미에서 보면 입법자는 입법을 통해 개인의 기본권을 제한하더라도 원칙적으로 과잉금지의 원칙이나 평등의 원칙과 같은 기본권 제한의 한계를 정하는 원리를 일탈할 수 없고, 타법과 체계상 균형을 이루는 선에서 기본권을 제한하는 입법이 가능하다. 그리고 기본권에 법 이론상 절대적 부분이 존재 한다면 기본권 중에서 제한이 허용되는 범위 밖에 본질적인 핵심영역을 제한해서는 안된다. 이 모든 사실을 감안한다면, 청원경찰의 근로3권을 전부 금지하는 청원경찰법 제11조는 기본권제한입법의 한계를 일탈한 것으로서 헌법에 위반한다. We can easily find people who are laborers not public servants and yet cannot exercise labor's three primary rights because their work is related to public interest. All those people mentioned above have one thing in common. They cannot exercise the right of collective action, among labor's three primary rights, due to the consideration of public interest. However, unlike others, police assigned for special guard, under article 11 of POLICE ASSIGNED FOR SPECIAL GUARD ACT, are banned from exercising all of the labor’s three primary rights, because their work is related to public interest. Because of this restriction, it seems that police assigned for special guard are disproportionately discriminated from invoking labor’s three primary rights compared to other laborers whose works are also related to public interest. The Constitutional court once examined to provision whether it is unconstitutional. On the ruling, although many judges claimed that the provision is unconstitutional based on the fact that it is restricting labor’s three primary rights, they failed to meet the quorum. Although legislatures can restrict fundamental rights they cannot deviate from the principles such as Principle of the proportion and The rule of equality that limits the restriction of fundamental rights. Moreover, theoretically if there are absolute portion, when restricting fundamental rights, this portion cannot be disturbed. Considering all these, restriction on labor's three primary rights of the police assigned for special guard based on article 11 of POLICE ASSIGNED FOR SPECIAL GUARD ACT surpassed the limits of restricting fundamental rights and cannot be freed from the doubts whether the provision is unconstitutional.
블렌딩을 이용한 폴리우레탄 그라프트 다중벽 탄소나노튜브/폴리우레탄 복합체의 전기 전도성 및 분산 특성

The PU-g-MWNTs/PU film was synthesized by simple blending method to fabricate composites which have excellent mechanical and electrical properties. PU-g-MWNTs based composite revealed much enhanced dispersity than pristine MWNTs composite because of interfacial interaction related with interfacial compatibility between polymer matrix and PU on the MWNTs surface. The electro-conductivity of composite was measured as a function of PU-g-MWNTs concentration. The results were correlated with percolation threshold theory. As a result, the critical concentration and exponent of electro-conductivity behavior was equal to 0.78 wt% and 0.945.

This study began with the recognition that development of retirement cities is necessary to solve the retirement housing and welfare problems of retirees for the rapidly aging era. However, the government s policy on low birthrates and aging has been extremely passive and the private sector has not been participated. In contrast, advanced countries such as the U.S. and the U.K., which experienced industrialization and urbanization first, have combined physical urban planning with social communities to systematically build and operate collective residential complexes for the elderly and retirees and large retirement villages to cope with the aging population. This study analyzed the institutional problems of rural life pursued by individuals and introduced examples of overseas retiree villages and test cases of domestic retiree community village and rural town development as alternatives.

In recent days, the public institution have been actively relocated from the central government to local government. In case of the relocation of provincial government, some provinces have been already relocated such as Gyeongnam, Jeonnam and Chungnam, other province like Gyeongbuk has a plan for relocation. The relocation of the provincial government is supported by the logic that the public office should be placed under the jurisdiction. On the other hand, it is criticized for weakening centrality of metropolitan city and destruction of nature by developing underdeveloped land. Based on the Multi-regional input-output model and I-O data obtained by RAS method, this study examines the multiplier effects of the relocation in terms of production, value added and employment on Daejeon. According to the analysis, the relocation is expected to reduce the production by 863.1 bllion won, value added by 497.5 bllion won and employment by 6,856 persons in Daejeon region. Also, discussion for utilization of land used for Chungnam-Do provincial government office is currently underway. In this context, this study shows forward and backward linkage effects of Daejeon based on I-O data. As a result, “the first metal goods industry” records the highest backward linkage effects of Daejeon region, followed by “others”, “transport equipment”, “metal ware”, “electron and electronic instrument”. This study can help to find a alternative for solving problem due to relocation.
수영 운동이 외상성 뇌손상 유발 흰쥐에서의 c-Fos 발현에 미치는 영향

Traumatic brain injury is known to cause severe neurological damage and has a high mortality rate. c-Fos expression is recognized as a marker of increased neuronal activity, however, excessive c-Fos expression represents apoptotic neuronal cell death. In the present study, the effect of swimming exercise on traumatic brain injury-induced c-Fos expression in rats was investigated by c-Fos immunohistochemistry. The rats were divided into 3 groups: the sham-operation group, the traumatic brain injury-induction group, and the traumatic brain injury-induction and swimming exercise group. The animals in the exercise group were forced to swim for 30 min once a day during 14 consecutive days. The present results showed that traumatic brain injury enhanced the number of c-Fos-positive cells in the paraventricular nucleus (PVN) and ventrolateral periaqueductal gray (vlPAG) regions and that swimming exercise significantly suppressed the traumatic brain injury-induced c-Fos expression. In the traumatic brain injury rats, swimming exercise exerted inhibitory effect on the c-Fos exepression in the PVN and vlPAG regions. Based on the present results, it can be suggested that swimming exercise has a neuroprotective against traumatic brain injury by suppressing c-Fos expression.

Harpacticoid copepod Tigriopus japonicus is widely distributed in coastal waters of Korea and plays important role in marine trophic structure as a first consumer. In this study, a series of experiment were conducted to test the potential of the species as a standard test species for marine bioassay. Tolerance on salinity and pH, sensitivity on the reference materials(copper sulfate and cadmium chloride) and response on the ocean dumping materials(waste sludge) were tested to identify if the species satisfy the basic criteria as standard species for marine bioassay. The nauplius of the species(100~200 ㎛) showed wide tolerance on salinity with >90.0% survival rates exposed to 5.0~35.0 psu for 48 h. Wide adaptability on pH's were also observed from 6.3 to 8.2 with >90.0% survival rates during the test. LC?? values for copper sulfate and cadmium chloride were 3.6±0.7 ppm, 1.7±0.8 ppm, respectively. The variations in mortality between replicates were less than 10.0%. Comparison of LC?? values indicated that T. japonicus nauplius was lower sensitive to copper sulfate than the most marine crustaceans included copepods, however, the sensitivity of test animal to cadmium chloride higher than the adults of copepod T. japonicus, Paracalanus parvus, and marine rotifer Brachinonus plicatilis. There were significant concentration-response relationship in the mortality of T. japonicus nauplius using the elutriates of three ocean dumping materials(industrial waste sludge). 48 h LC?? values were 31.1±1.1% for the elutriate of sludge from leather processing company and 54.4±15.1% for that of dye production company. Based on the above experimental results, bioassay using benthic harpacticoid T. japonicus nauplius must be a good estimation tool for marine ecotoxicological assessment of waste or chemicals. Wide tolerance on the salinity and pH, and significant linear relationship between concentration and response(mortality) supported the high potential of the species as standard test species.

This paper presents a surface acoustic wave(SAW) micro-electro-mechanical-systems(MEMS) interdigital transducer (IDT) gyroscope with 80MHz central frequency on a $128^{\circ}\;YX\;LiNbO_3$, which is consisted of a two-port SAW resonator, metallic dots and dual delay lines for the sensor and reference oscillators. Reason for using two delay line oscillators is to extract the gyroscope effect by comparing the resonant frequencies between two oscillators and to compensate the temperature effect. Based on the coupling of modes(COM) simulation, an 80MHz two ports SAW resonator and dual delay line were fabricated and characterized by the network analyzer. Obtained sensitivity was $109Hz/deg{\cdot}s^{-1}$ in the angular rate range of $0{\sim}1000deg/s$. Good Linearity and superior directivity were observed.
