HVPG as a Predictor of Mortality in Non-Critically-Ill Cirrhotic Patients

Portal hypertension (PH) is defined as an increased portal venous pressure gradient above 5 mmHg, and is closely related to complications and mortality of cirrhosis.1 In particular, PH is greatly important before the onset of decompensation state where the degree of PH is well correlated to the prognosis. Portal pressure is known to be more useful in predicting development of complications of cirrhosis in chronic liver disease than the degree of fibrosis observed in liver biopsy. Direct measurement of portal pressure is excessively invasive and no longer used in clinical practice. Instead, because hepatic venous pressure gradient (HVPG) is safe, reproducible, and relatively less invasive, it is most widely used and standard test that reflects portal pressure. Recently, HVPG has been used in variety of fields such as diagnosis and prognosis of cirrhosis, risk stratification, monitoring therapeutic response of beta- blocker, and prediction of development of hepatocellular carcinoma.2

This study explores the issues of using present indicative in place of shall in the English translation of Korean statutes. Due to the Plain Language legislative attempt over the past few decades, shall is now rapidly being replaced by the simple present and other performative forms in many common law countries. Against this backdrop, this study compiled three sub-comparable corpora consisting of translated Korean Statute Corpus (TKSC) and non-translated British Statute Corpus (BSC) and American Statute Corpus (ASC), and examined the frequencies, types, and patterns of present indicative in each corpus. In particular, the present study separately calculated the frequencies of present indicative forms that convey prescriptive force using CLAWS 7 tagged text files. Analysis of the three comparable corpora shows many discrepancies in the use of present indicative between translated corpus and non-translated corpora. While the simple present is restrictively used in definition provisions in TKSC, many present simple verb forms are found in ASC and BSC as a performative marker to indicate constitutive rules, application provisions, deeming provisions, and other declaratives.
한국 법령 번역에서 ‘shall’의 사용에 대한 고찰 : 비교 코퍼스 분석 결과를 중심으로

Modal auxiliary ‘shall’ has been one of the most controversial words in legal texts because of ambiguities in its interpretation. Due to the Plain Language Campaign to modernize legal English over the past few decades, ‘shall’ is now used restrictively to imposing obligations, or prohibited altogether in legislation in the U.K. and many other common law countries. However, it is still the most frequent word to express the illocutionary forces of legislative provisions in translation of Korean statutes. In order to find the differences between ‘shall’ used in translated and non-translated statutes, this study compiles translated Korean statute corpus (TKSC) and non-translated British statute corpus (BSC), each consisting of 1 million words. American statute corpus (ASC) of 4 million words is also used for reference corpus. The comparison of the two corpora shows that TKSC uses ‘shall’ more excessively than BSC. Keyword analysis also reveals that the frequency of ‘shall’ in TKSC is much higher than ASC, questioning the current practices of using ‘shall’ in translation of Korean statutes. 한국 법령 상호텍스트장치의 영어 번역에 대한 고찰 - 영미법계 국가들의 최신 법제지침 분석결과를 중심으로

This study investigates translation issues involving the intertextual devices found in Korean statutes. Legal discourse, especially legislative provisions, is interlinked with various cross-references that serve specific functions in the legislation, which includes signaling textual authority, providing terminological explanation, and facilitating textual mapping. Countries of Anglo-American jurisprudence have traditionally used different types of cross-referencing expressions to display these specific functions in legal discourse. Recently, the legislation drafting guidelines in many English speaking countries have made changes in the traditional usages of expressions due to the Plain Language Movement. English translators of Korean statutes need to have due regard for these changed functions and expressions to preserve the same legal effect as the original. On this backdrop, this study examines legislative guidelines and plain language manuals in legislation developed by common law countries as well as Korean counterparts to identify distinct functions and contexts of use of each cross-referencing expression. Then, a case study is conducted to compare the expressions recommended by legislative guidelines and those used in the translated statutes.

비알콜성 지방간은 최근에 우리나라에서도 매우 급격하게 유병률이 증가하고 있으며, 이 중 진행된 비알코올성 지방간염 및 섬유화가 동반되어 있을 가능성이 높은 환자를 선별하여 정밀하게 검사하고 치료를 적용하는 것이 요구된다. 현재까지 비알코올성 지방간염을 진단할 수 있는 가장 정확한 표준 검사법은 간 조직검사이지만 환자 및 의사 모두에게 쉽게 선택할 수 있는 검사법이 아니기 때문에, 간 조직검사를 대신하여 비침습적으로 비알코올성 지방간염의 진단 및 조직학적 중증도를 평가하고자 하는 노력이 영상의학 검사 및 생화학 검사 분야를 중심으로 진행되고 있다. 간과해서는 안 되는 중요한 문제는 지방간염 진단기준이 서양에서 도입된 방식을 따라가다 보니 진단에 요구되는 여러 가지 구성요소를 유전적, 환경적으로 다른 우리나라와 같은 동양인에도 획일적으로 적용되고 있다는 점이며 조직검사의 적절한 시기 및 병리 판독자 간의 일치도, 치료의 올바른 선택에 대하여 보다 적절한 근거가 필요한 실정이다.
