Contracts of carriage evidenced by bill of lading which are made between carrier and unidentified number of the shipper are to a large extent regulated by statute law such as Hague-Visby Rules and Hamburg Rules. These rules qualifies the contractual liberty of parties and especially restrains the carrier from introducing exemption from his liability beyond those admitted by the Rules. However, these Rules are applied only to goods in respect of which a bill of lading or similar document of title has been issued. In this reason, it is possible that liability of carrier in respect of goods shipped could become an issue where electronic bill of lading is used instead of paper bill of lading because electronic bill of lading is not generally recognised document of title in existing rule. Thus, this article discuss the relation between the carrier who create electronic bill of lading and the Rules regulating liability of carrier. Also, new Rules which has been examining in UNCITRAL will be introduced.

중세의 임직식에 관한연구: 가톨릭 성사신학과 『보좌신부를 위한 핸드북』을 중심으로 본 성품성사

이 논문은 그리스도교 역사에 나타나는 임직식 가운데 중세교회사 분야에서 로마 가톨릭의 성사신학 안에 위치한 성품성사에 초점을 맞추어 중세 로마 가톨릭 교회의 임직식을 통해 사제의 임직이 갖는 의미와 사제의 역할에 대한 연구이다. COVID-19 팬데믹 이후 교회의 사회적 책임이 소홀해짐으로 인해 목회자에 대한 사회적 신뢰도가 저하되었을 뿐만 아니라, 목회자 개인의 윤리 문제가 대두되고 있다. 이를 개선하기 위해 ‘목사’ 또는 ‘성직자’라는 직분과 본질적 역할에 대한 재고가 요구된다. 이 논문은 문헌연구를 방법론으로 하여 1330년대 몬테 로첸의 귀도가 스페인 테루알에서 작성한 『보좌신부를 위한 핸드북』 (Handbook for Curates) 제5권에 나타난 임직식의 절차와 역할부여를 중심으로 중세의 임직식을 탐구하고, 중세의 임직식의 절차를 통해서 임직자에게 부여된 역할이 무엇인지를 밝힌다. 또한, 이 논문은 로마 가톨릭의 성사신학과 성품성사가 가지고 있는 신학적 문제점에 대해서 지적함으로써 이 문제가 사제직 이해에 어떻게 영향을 미치는지를 살펴본다. 이를 통해 오늘날 한국교회 안에서 목회자의 역할과 책임에 대한 문제를 제기한다. This paper focuses on the sacrament of the holy orders in the context of the sacramental theology of the Roman Catholic Church, emphasizing the ordination ceremonies that took place in the medieval Church. It explores the significance of priestly ordination and the role that priests play in these ceremonies. To address these issues, it performs a reconsideration of the office and the essential role required of the pastor or the clergy. Through a literature review methodology, this paper examines the ordination procedures and role assignments described in the Handbook for Curates, written by Guido of Monte Rochen in the 1330s in Teruel, Spain, which focuses on medieval ceremonies of ordination. It elucidates the roles assigned to those ordained through the procedures of medieval ordination ceremonies. Inaddition, the paper points out theological problems in sacramental theology and the sacrament of the holy orders of the Roman Catholic Church, examining how these issues influence the understanding of the priesthood.

This research aims to explore the importance of emotions to theological anthropology in Julian of Norwich’s Showing of Love. The unique expression of integrating reason and emotion forms a holistic spiritual experience. Through her work, Julian achieves dualistic distinctions such as reason and emotion, body and soul, and human and divine, presenting a monism. Her distinct expression “I understand in my feeling” reflects her belief in the integration of reason and emotion as a nondualistic world view.

국제복합운송계약에서 로테르담 규칙의 적용상 문제점에 관한 연구

The continuing advance of multimodal transport with the importance for efficient and effective logistics management emphasizes the need for uniform legal approach to international multimodal transport. However, the current fragmented instrument regulating such transport is being an obstacle to development of multimodal transport as it aggravates confusion and uncertainty. The Rotterdam rules, which was adopted in December 2008 by UNCITRAL, expands its scope of application to door-to-door transport. However, the new rules has some problems in its application to multimodal transport operation as it has been conceived not to regulate general multimodal carriage but to regulate contract of carriage by sea that extends its services to the transport by other modes. This article examines conflict of conventions in the Rotterdam Rules. The applicability of the Rotterdam Rules in international multimodal transport contract and possibility of potential conflict with other transport conventions are analyzed with some hypothetical cases. Furthermore, problems arising from application of the Rotterdam Rules under international multimodal transport Contracts are indicated in the chapter Ⅳ.

US / European Shipping Regulatory Development and Its Impact on Liner Shipping Industry

Historically shipping conference has enjoyed antitrust immunity in consideration of the importance of liner service in international trade in that it is essential to ensure stable movement of international freight. However, shipping deregulation which has been carried out for last decades in the US and EU has caused significant changes to the liner shipping market. In fact, most of shipping conferences have broken up or transformed as discussion agreement since shipping regulatory reform. However, on the other hands, it is also true that it has contributed to developmore efficient and responsive negotiating process that are better tailored to the needs of individual shippers.

한국 초등학생의 사회적 자본: KYPS 초등자료 분석

This study tries to examine the social capital of Korean elementary school students using the KYPS database. The KYPS was surveyed by Korea Institute for Youth Development(KIYD) in order to assess Korean students` school life. We find that social capital is related to parents education, school location, and class-level grade. Thus, for Korean elementary students, the levels of social capital can be increased by female students and class-level grade. We also discuss the implications of these findings for making Korean elementary students to actively increase their social capital.

초등학교의 생활통지표 개선방안 연구

This study examines elementary school report cards in Korea in terms of how parents and teachers conceive student report cards and of finding a way of improving student report cards in order to make teachers more accountable. Using survey and analyzing documents related school report cards, we found there are many issues which still need to be improved. For example, teachers and parents had a different opinion about the problems of school report cards. Moreover, schools did not show any different patterns of describing school report cards, even though they had very different composition of students. Finally we also suggest for a future study and policy implications of improving student report card.
