정상 청소년의 정량적근전도 간섭양상 분석

Objective: The aim of this study was to establish the turns-amplitude, activity-envelope amplitude and activity-number of small segments (NSS) clouds of normal adolescent with using quantitative interference pattern analysis. Method: Healthy adolescents whose ages were from 15 to 19 years old participated in this study. Using quantitative EMG of the biceps brachii, and tibialis anterior muscle, the interference patterns were analyzed. The interference patterns were measured at three to five different force levels, ranging from minimum to maximum, and recorded at least 20 epochs at each muscle. Results: The turns-amplitude, activity-envelope amplitude and activity-NSS of the biceps brachii, and tibialis anterior muscles were obtained in males and females. On the basis of the linear regression equation of log of each variables, the±2 standard deviations were set to a normal range. These range were drawn on the original plot with linear scale and normal range was obtained by setting upper limits on each variables. The establishment of normal clouds of gender related turns-amplitude, activity-envelope amplitude and activity-NSS were obtained. Conclusion: By using normal cloud patterns of turns-amplitude, activity-envelope amplitude and activity- NSS, automatic interference pattern analysis may contribute to diagnose neuromuscular disease in adolescent patients.

The National Health Insurance Corporation has been retrieving from health care providers the payments made to them by insured patients as a result of the health care providers’ arbitrary denial of coverage under the National Health Insurance, and has been disbursing such retrieved monies back to the patients, pursuant to Article 57, Sections 1 and 4 of the National Health Insurance Act. However, such practice is an application of the law that lacks legal exactitude. Another problem with such practice is that there is no legal provision under any laws or notices that expressly prohibits arbitrary denial of coverage. A legislative solution, therefore, is called for to address these issues.

도급계약에 의해 신축된 건물의 분양·임대와 관련된 민사적 법률문제

대법원 판례는 수급인이 자기의 재료와 노력으로 건물을 신축한 경우, 명시적 또는 묵시적 합의에 의 해 신축건물의 소유권을 도급인에게 귀속시키기로 하였다면 도급인에게 그 소유권이 원시적으로 귀속 되나, 그러한 합의가 없는 경우에는 도급인이 공사대금을 지급하고 건물의 인도를 받기까지는 원칙적 으로 수급인에게 그 소유권이 귀속되었다가 인도에 의해 도급인에게 그 소유권이 이전된다는 입장이다. 이 논문에서는 이러한 대법원 판례의 입장의 타당성 여부를 논하려고 하는 것이 아니라 이러한 대법 원 판례의 입장에 입각하여 신축건물이 제3자에게 분양․임대될 경우의 구체적 분쟁사례들을 검토하고 자 한다. 즉, 원칙적으로 수급인으로부터 도급인에게 신축건물의 인도가 아직 이루어지지 않은 상태를 전제로 하여, 신축건물의 소유권이 수급인에게 귀속되는 형태에서 도급인이 분양․임대하는 경우, 신축 건물의 소유권이 수급인에게 귀속되는 형태에서 수급인이 분양․임대하는 경우, 신축건물의 소유권이 도급인에게 귀속되는 형태에서 도급인이 분양․임대하는 경우, 신축건물의 소유권이 도급인에게 귀속 되는 형태에서 수급인이 분양․임대하는 경우로 나누고 각 경우마다 발생가능한 민사적 권리분쟁을 상 정하면서 그 권리관계를 정리해 보고자 한다. 또한 도급관계유형에서 도급인이 수급인에 대한 공사대금채무의 지급방법으로 신축건물을 처분하여 그 처분대가로 충당 내지 변제하기로 하는 내용의 특약, 즉 공사대금지급방법에 관한 특약의 존부 및 그 내용은 신축건물을 둘러싼 민사적 권리분쟁의 해결에 있어서 중요한 지침이 되는 경우가 많다. 이 논문에서는 이러한 공사대금지급방법에 관한 특약이 있는 경우와 없는 경우로 나누어서 민사적 권리분 쟁을 정리해 보고자 한다.

As a part of license renewal for the continued operation of Wolsong unit 1, the periodic safety review report was submitted near the end of design lifetime, 2012, and now is under reviewing. Major components of primary system such as pressure tubes, feeder pipes and so on are being replaced and many components of secondary system are also being repaired. So the license renewal of Wolsong unit 1 is expected to be acquired without significant issues. But on the other hand, steam generators of Wolsong unit 1 had the good performance and therefore the replacement and repair for the steam generator are not needed. Recently it is reported that some cracks were detected in a few of european steam generator with Alloy 800 tubes and the cause of cracks was the outer diameter stress corrosion cracking(ODSCC) due to the concentration of chemical impurities on the outer surface of tube. Accordingly the overall review on this issue was performed. The long-term operation is likely to results to form the concentration mechanism for the tube corrosion as the sludge build-up in the secondary side of steam generator and the crack in the crevice between tube and tube-sheet and expansion transitions is apt to be occurred. In this paper, the history of steam generator inspection and operation of Wolsong unit 1 are reviewed and the reliability of steam generator tube is evaluated and the steam generator aging management program for Wolsong unit 1 is introduced.

유전자 질병 관련도 분석을 위한 소프트웨어 플랫폼

While the quality of life is enhanced as many types of diseases are remedied, there is a high demand for analysis and research on gene-related diseases. There exists various forms and requirements in analyzing the relevance between genes and diseases, and the runtime efficiency can be decreased due to the level of algorithm optimization. This paper proposes a platform for analyzing gene disease relevance, provides API for remedying the variability issue, and suggests two algorithms which optimize the runtime efficiency. And, we conduct experiments for measuring the relevancy using the analysis API, and compare the two algorithms. The first algorithm is to improve the runtime efficiency comparing to the conventional methods, and the second algorithm is to improve the runtime efficiency with lower accuracy. This platform can be well utilized for analyzing various forms of gene disease analytics. 많은 질병들이 정복되면서 삶의 질을 향상시키지만, 유전병들은 많은 분석 및 연구가 필요하다. 이러한 질병과 유전자 관련도를 분석할 때 다양한 요구사항이 존재하고, 알고리즘 최적화 유무로 인해 런타임 효율성이 저하된다. 본 논문은 유전자 질병 관련도 분석 플랫폼을 소개하고 위의 이슈를 해결하기 위한 분석 API와 두가지 런타임 효율성 최적화 알고리즘을 제시한다. 그리고 제시한 분석 API를 이용하여 관련도 측정 실험을 진행, 두 최적화 알고리즘의 결과와 비교했다. 첫 번째 알고리즘은 이전 실험과 같은 결과를 적은 시간에 도출했고, 두 번째 알고리즘은 이전 실험들에 비해 낮은 정확도의 결과를 더 적은 시간에 도출했다. 따라서 본 플랫폼을 통해 여러 방식의 유전자와 질병 관련도를 효율적으로 얻을 수 있다.

Essentially, Article 49 Subparagraph 6 of Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions is true of ‘manager whose right is prearranged to be converted definitely on the date following the date of the public announcement of transfer’. So, such manager shall be forbidden from using land or structure or using it for the purpose of earning profits from the date of public announcement of authorization for Management and Disposal Plan. A person subject to parcelling-out comes under such manager. But, ‘manager whose right is not prearranged to be converted definitely on the date following the date of the public announcement of transfer’ shall be forbidden from using land or structure or using it for the purpose of earning profits from the date when he or she receives due compensation money. A person entitled to receive the settlement money was ‘manager whose right was prearranged to be converted definitely on the date following the date of the public announcement of ParcellingOut Disposal’ under the Urban Redevelopment Act adopting post settlement system Supreme Court Decision 91Da22094 Delivered on December 22, 1992 [Damages(Other Categories)] came from the Urban Redevelopment Act. But under operative Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions adopting advance settlement system, a person entitled to receive the settlement money shall be forbidden from using land or structure or using it for the purpose of earning profits from the date when he or she receives due compensation money. Article 43 Subparagraph 2 of Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions states that「Provisions of Articles 27 through 48 of the Urban Development Act shall apply mutatis mutandis to the land substitution relating to the rearrangement project.·····」 The concept of the land substitution in Article 43 Subparagraph 2 includes not only Provision of Land in Substitution for Land in Article 6 of Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions, but also Provision of Structures in Substitution for Land or Provision of Structures in Substitution in broader sense, namely Provision of Right in Substitution for Right in Article 55 Subparagraph 2 of Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions Therefore, Provisions related to the method of Land Substitution should apply mutatis mutandis to the method of Management and Disposal except as specially provided in Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions or as are not applicable owing to essential difference. Article 38 and Article 65 of the Urban Development Act provide the details of the procedures for removal of buildings, the compensation standards and the procedures for the indemnity of loss. Article 38 and Article 65 of the Urban Development Act should be observed in removal of buildings forbidden to use or to use for the purpose of earning profits after the date of public announcement of authorization for Management and Disposal Plan. Article 38 Subparagraph 4 of the Urban Development Act provides that the indemnity of loss should be paid before relocation or removal of buildings, etc. or that the indemnity of loss should synchronize with relocation or removal of buildings, etc. From the standpoint of the tenant of building, Article 38 Subparagraph 4 of the Urban Development Act means that the tenant doesn’t have to evacuate or leave it before removal of building unless he or she receives due compensation money fixed according to an agreement at the end of consultations with the project implementer or adjudication of the competent Land Expropriation Committee. Regardless of whether the owner of the building the tenant occupies is a person subject to parcelling-out, or a person entitled to receive the settlement money, or a person subject to a request for sales, or a person subject to expropria... 도시 및 주거환경정비법 제49조 제6항의 본래적 적용대상은 ‘이전고시일 다음날에 확정적인 권리변환이 이루어질 것이 예정된 권리자’이므로, 이러한 권리자의 사용·수익권 상실의 효력은 관리처분계획 인가고시일로부터 즉시 발생한다. 분양대상자가 이에 해당한다. 그러나 ‘이전고시일 다음날에 확정적인 권리변환이 이루어질 것이 예정된 권리자가 아닌 권리자’의 경우에는 정당한 손실보상금을 지급받는 것을 정지조건으로 하여 그 사용·수익권 상실의 효력이 발생한다. 청산대상자는 사후청산제도를 취하였던 도시재개발법하에서는 분양처분 고시일 다음날에 확정적인 권리변환이 이루어질 것이 예정된 권리자였고 대법원 1992. 12. 22. 선고 91다2294 판결은 이러한 배경하에서 이루어진 것이다. 그러나 사전청산제도를 취하고 있는 현행 도시정비법하에서는 청산대상자는 정당한 청산금을 지급받는 것을 정지조건으로 하여 그 사용·수익권 상실의 효력이 발생한다고 보아야 한다. 도시정비법 제43조 제2항 본문은「도시개발법 제28조부터 제49조까지의 규정은 정비사업과 관련된 환지에 관하여 이를 준용한다··」로 되어 있는데, 여기서의 환지는 도시정비법 제6조에서 규정하고 있는 평면환지는 물론이고, 도시정비법 제55조 제2항에서 규정하고 있는 입체환지나 그보다 넓은 의미의 환지 즉 환권을 포괄하는 개념이다. 그러므로 관리처분방식에 관하여 도시정비법에 특별규정이 있거나 그 성격상 적용이 배제되지 않는 이상 도시개발법상의 환지관련 규정들이 준용되는 것이라고 보아야 한다. 도시개발법 제38조와 제65조는 건축물의 철거절차와 보상기준 및 보상절차에 관하여 상세한 내용을 담고 있다. 관리처분계획의 인가고시 이후에 사용·수익이 정지된 건축물을 철거함에 있어서는 도시개발법 제38조와 제65조에 규정된 내용을 준수해야 한다. 도시개발법 제38조 제4항은 손실보상이 건축물 등의 이전·제거와 선이행관계에 있거나 동시이행관계에 있음을 규정한 것이다. 이 규정을 건축물 세입자의 경우에 한정하여 본다면, 건축물 세입자는 사업시행자와의 협의나 수용절차를 거쳐 확정된 자신의 손실보상금을 사업시행자로부터 지급받게 되기까지는 건축물철거에 선행하여 건축물을 명도하거나 건축물에서 퇴거할 의무를 부담하지 않는다는 의미이다. 이 규정은 세입자가 점유하고 있는 건축물이 분양대상자의 소유이든, 청산대상자의 소유이든, 매도청구대상자의 소유이든, 수용대상자의 소유이든 상관없이 모두 다 적용된다.
