보건의료법학에 있어 역사적 연구방법

이 연구는 보건의료법학의 발전 과정과 법학방법론에 대한 기초적 이해와 문제의식을 토대로 보건의료법학에 있어 역사적 연구의 의의와 그 접근 방법을 제시하는 것을 목적으로 한다. 보건의료법학에 있어 역사적 연구는 보건의료법이 역사적 현실 속에서 변화하고 발전하는 모습을 탐구하는 것을 그 일차적 목적으로 한다. 그러나 보다 실천적인 관점에서 보건의료법에 대한 역사적 연구의 목적은 '현재'의 보건의료법 체계를 올바르게 이해하는데 도움을 준다는 점에서 찾을 수 있다. 또한 역사적 연구는 보건의료법상의 여러 제도들이 유기적으로 연결되어 있으며 상호작용하고 있다는 사실을 인식시켜 주는데 도움을 준다. 더 나아가 역사적 연구는 미래의 보건의료법을 설계함에 있어서도 중요한 준거 자료로 기능할 수 있다. 따라서 역사적 연구에서는 과거의 보건의료법이 어떤 특정한 체계와 규정을 두고 있었는가에 대한 사실의 확인을 넘어, 과연 그러한 규정을 두게 되었던 이념적, 철학적, 정치 경제 사회적 이유 내지 압력 등을 탐구하여야만 한다. 법규범이 법현실 속에서 실제로 어떻게 집행되고 구현되었는지를 확인하는 것 또한 역사적 고찰의 중요한 부분을 구성한다. 이처럼 역사적 연구는 현재의 보건의료법을 보다 깊이 있고 정확하게 해석, 적용할 수 있도록 해줄 뿐만 아니라 미래의 법형성에 있어서도 결코 간과할 수 없는 통찰을 제공해준다는 점에서 그 의의를 찾을 수 있다. This research aims for suggesting the significance and approaching method of historical study in health law in light of its historical progress and fundamental understanding of jurisprudential method. Historical research method of health law primarily targets to investigate the changes of the law in historical circumstances. In a further practical view point, however, the purpose of the study is to understand the 'current' system of health law appropriately. In addition, historical study enables us to recognize the fact that many systems related to health law are connected and interactive. The study can even function as an important reference when designing future health law system. Therefore, health law researchers have to investigate ideological, philosophical, political, economic, or social reasons of why such rules were legislated beyond a mere confirmation of past forms of the health law system. In other words, it is not only important to understand the provisions of past health law but also to examine how the regulations have formed, how they established the regulatory power in reality. Identifying how the rule of law had been executed in the reality of law is also a crucial part of historical study.

중대 핵심 시스템 상에서 상황인지 적용

중대 핵심 시스템은 변화하는 상황에 대해서 정보를 빠르게 획득하고, 대처하는 것이 매우 중요하다. 임무 수행 중에 시스템의 환경이나 예상하지 못한 상황이 발생하였을 경우, 임무를 효율적으로 처리하는 데 문제가 발생한다. 이를 해결하기 위해 상황 인지를 중대 핵심 시스템에 적용하여 환경의 변화와 상황에 대해서 유연하게 대응할 수 있게 한다. 이는 시스템 주변 환경과 상황을 인지하여서 적절한 판단을 내릴수 있도록 하여 임무에 도움을 준다. 본 논문에서는 상황 인지를 적용한 시스템의 아키텍처를 제안하고 이를 검증하기 위해서 공중 방어 시스템 시뮬레이션에 적용한 실험 결과를 통해서 유효성을 검증한다.

실시간 운영체제의 모듈화를 위한 그래픽 기반 AOP 프레임워크

본 논문에서는 실시간 운영체제(RTOS)를 모듈화 하기 위하여 그래픽 기반의 Aspect-Oriented Programming (AOP) 프레임워크를 제시한다. 기존의 컴포넌트, 객체 지향 방법론, 그리고 최근의 AOP들은 RTOS와 같이 많은 기능들이 복잡하게 연관된 소프트웨어를 모듈화 하는 데는 적합하지 않았다. 본 논문의 새로운 AOP 프레임워크는 다음과 같은 특징을 가지고 있다. 첫째, 클래스나 메소드의 단위를 넘어서서 구현되는 기능들이 어떻게 aspect로 모듈화 되는지를 시각적으로 보여준다. 또한 기존의 AOP와 같이 여러 aspect들을 이리저리 옮겨 다닐 필요 없이, 한 곳에서 코드가 어떤 순서로 수행될 지 알 수 있도록 해 준다. 둘째, 코드를 삽입할 위치를 지정하는 단위를 메소드 단위보다 더 세밀하게 하여 메소드의 수행 중간에 특정 aspect를 위한 코드를 삽입할 수 있도록 하였다. 그래서 하나의 메소드에 여러 aspect가 복잡하게 관여하는 경우가 많은 RTOS를 디자인 할 때 특히 유리하다.

Automotive software is inherently distributed and possesses fault-tolerance and real-time requirements. Middleware is a software layer that can handle these intrinsic complexities of automotive systems thus enables programmers to concentrate on their own logic. This paper presents a middleware architecture specially designed for automotive software. It is based on message-oriented middleware (MOM) so that it can be efficiently implemented on automotive network hardware. It incorporates many features required in automobiles such as real-time guarantee, fault-tolerance, and existence of a global time base.

치과의사의 면허 범위 해석에 관한 비판적 고찰

Under the premise that the scope of dental license should be decided with individual consideration of several factors of medical law; such as the legislative purpose, academic principles of medical practices, the supreme court ruled that the scope of dental practice should be settled according to the degree of risk in public health. The court articulated that the boundary need not be limited by literal meaning of traditional dentistry, and concluded that not all `facial botoxes` done by dentists are against the law but could be legal due to the low risk nature of the surgery. Nevertheless, the court`s unclear position is against our legislative background that adopted an independent license system which distinguishes doctors and dentists, and against the literal meaning of procedural scope ruled by medical law. Moreover, the concept of “the degree of risk in public health” was originally held as a standard to determine what is a medical practice. By using the concept even to determine the scope of dental license, the court aggravated legal uncertainty and entailed a deepened conflict between doctors and dentists. To conclude, it is not adequate to include non-dental surgeries in the scope of dental practices. Dental practices should only be limited to dental and relevant activities under the current legislation.

This paper aims to comprehensively review the scholarly contributions of Professor Jeon Kwang-seok in the field of social security law. Professor Jeon's research in social security law is broadly categorized into constitutional and social security law, general and individual social security laws, the history of social security law, and comparative and international social security law. His work demonstrates that constitutional law and social security law are not isolated sub-disciplines but are constantly interacting, proving that a constitutional approach to social security law is not only possible but essential. In the context of Korean legal studies, Professor Jeon has pursued the uniqueness and systematic nature of social security law from a constitutional perspective, marking a distinct achievement. Social security law ultimately aims to realize constitutional values, considering not only social fundamental rights but the constitution as a whole. The constitution acts as both a proactive guideline and a restrictive norm in the formation of social security law. Professor Jeon's research encompasses not only individual social security policies, like national health insurance or pension schemes, but also the general theory and individual laws of social security law. In 2019, he published ‘The History of Social Security Law in Korea,’ a seminal work that moves beyond traditional historical divisions of social security law to describe the historical evolution of the entire field based on criteria such as political responses to social problems, changes in life risks and lifestyles, new social risks and their understanding, and the interaction between welfare and the ideology of equality. Finally, Professor Jeon's research areas include international social security law and comparative studies, with notable works such as ‘Social Security Law and Social Policy in Germany’ (2008), reflecting changes in Germany's social structure and policies, and ‘International Social Security Law’ (2002), discussing various social security law issues arising from the accelerated international movement of labor.

미국 대선 후보로 알아본 미국 언론이 한국 언론에 미치는 영향 분석: 텍스트마이닝을 중심으로

2020년 미국 대통령 선거 후보가 대한민국 언론에 끼치는 영향을 텍스트 마이닝 기법을 통해 분석한다. 본 논문에서는 분석 데이터 확보를 위해 미국 언론사와 한국 언론사에서 각 후보자의 이름을 키워드로 기사들을 수집한다. 데이터 전처리를 진행하고, 미국 기사와 관련 있는 한국 기사에 대해 이분 그래프를 구성한다. 각 후보자에 대한 이분 그래프를 날짜순으로 빈도수를 측정하여 그래프를 그리고 관련 기사가 폭증한 날짜들을 Peak 날짜로 선정하여 추출한다. Peak 날짜별 이슈들을 알아보고 기사들의 단어 빈도수를 그래프로 그려 둘 사이의 연관성에 대해 분석한다. 또한, 미국 기사들과 연관성이 있는 기사를 작성한 국내 언론사들을 조사하여 어떤 언론사들이 미국 기사에 민감한지 분석한다. The impact of the 2020 U.S. presidential candidate on the Korean media is analyzed through text mining techniques. In this paper, articles were crawled with keywords by US and Korean media companies to collect data for analysis. With proceeding with data pre-processing, we construct a bipartite graph for Korean articles related to American articles. A bipartite graph for each candidate is drawn by measuring the frequency in the order of date. After that, we selected and extracted by associated articles as peak dates. We explore issues by peak dates and analyze the association between the two by visualizing word frequency in articles. It also examines local media outlets that have written articles related to American articles to analyze which media outlets are sensitive to American articles.
