This study aims to analyse actual operation condition of confirmation hearing system implemented in local autonomous governments, disclose its problems, and suggest desirable alternatives and its policy implications. Currently local governments operate personnel qualification for a few high ranking posts and presidents for local public corporations in various ways, such as advance verification system according to the corresponding law and regulation, advance verification prescribed in the local council regulation or by the agreement between the head of local government and the local council, and post verification based on the related ordinance. For securing stability and continuity of the personnel hearing system, most of all, the applicable law should be amended in advance. Next, institutional improvement plans, such as specification of verification criteria and submission of information, grant a binding force on hearing results, extending verification time, disclosing the hearing process, and improvement of ability and talent of the hearing party concerned, are implemented. This is a descriptive research for the confirmation hearing system of local autonomous governments, of which operation condition has not been studied sufficiently. The systems have been classified by their types, and the actual condition of implementing the system is compared and analysed in this study. This preliminary study has implication for the future confirmation hearing system of a local autonomous government.
단체장에 대한 지방의회 통제유형의 실제:서울특별시 사례를 중심으로

The purpose of this study is to classify the types of local council control over the head of local government which has been overlooked until now by selecting Seoul Metropolitan City as the case and to understand how it is actually implemented. Among the total of 202 cases analyzed, 50 cases were based on laws, and 152 cases were based on ordinances. By control type, there were 112 cases of reporting, 45 cases of submission, 19 cases of consent, 14 cases of hearing, and 12 cases of approval. In terms of control nature, there were 31 cases of authoritarian control and 171 cases of non-authoritarian control. Control based on laws by the central government showed the largest increase in 2008 and 2011, and in recent years, non-authoritarian control such as hearing, reporting, and submission was more prevalent than authoritarian control such as consent and approval. Control based on ordinances significantly increased after the establishment of the 8th Seoul Metropolitan Council, and there were many cases that defined post-control measures such as reporting and submission. The implications of the analysis results are as follows: Internal control over the head of the local government by the local council is becoming more active, as control based on ordinances has been increasing greater than control based on laws determined by the National Assembly and the central government. However, in the case of control based on ordinances, local council can only passively and subsequently intervene within the scope of oversight regarding matters that fall under the executive agency’s exclusive authority. Active intervention prior to the exercise of such authority is not allowed due to the limitations of the ordinance-making authority. Therefore, non-authoritarian control rather than authoritarian control measures and post-control rather than pre-control measures are becoming more prominent. 본 연구는 서울특별시를 연구대상으로 선정해 그동안 연구의 사각지대에 놓여있던 단체장에 대한 지방의회 통제유형을 분류해 보고 그것이 실제로 어떠한 형태와 방식으로 이뤄지고 있는지를 파악하는데 목적이 있다. 분석 대상 총 202건 중 법령에 근거한 통제는 50건, 조례에 근거한 통제는 152건이었고, 통제 유형별로는 보고 112건, 제출 45건, 동의 19건, 의견청취 14건, 승인 12건이었으며, 통제 성격별로는 권력적 통제 31건, 비권력적 통제 171건 등으로 분석되었다. 중앙정부의 법령에 의한 통제는 2008년과 2011년에 가장 큰 폭으로 증가했고, 최근으로 올수록 동의나 승인 등 권력적 통제보다는 의견청취, 보고, 제출 등 비권력적 통제가 더 많았다. 조례에 의한 통제는 제8대 서울시의회 출범 이후 이전에 비해 큰 폭으로 증가했으며, 사후 보고 내지 제출 등 사후적 통제 수단을 규정한 사례가 많았다. 이상의 분석 결과의 함의를 제시하면 다음과 같다. 국회와 중앙정부 등이 정하는 법령보다는 조례에 의한 통제가 최근으로 올수록 많아지고 있다는 점에서 지방의회의 단체장에 대한 내부통제가 더욱 활발해지고 있음을 알 수 있다. 다만, 조례에 의한 단체장 통제의 경우 지방의회는 집행기관의 고유권한에 속하는 사항의 행사에 관해 견제의 범위 내에서 소극적・사후적으로 개입할 수 있을 뿐 사전에 적극적으로 개입하는 것은 허용되지 않는다는 조례제정권의 한계로 인해 권력적 통제 수단보다는 비권력적 통제가, 사전적 통제 수단보다는 사후적 통제가 활발해지고 있음을 알 수 있다. 이는 우리나라 지방자치제도가 강시장-약의회형의 구조라는 모습을 보여주는 또 하나의 사례라 할 수 있다.
