      • 채권자취소권에 있어서 피보전채권의 성립시기 : 대법원 2004. 11. 12. 선고 2004다40955 판결

        Creditor’s right of rescission can be claimed when preserved right and debtor’s fraudulent actions exist. In principle, preserved right have to exist before debtor’s fraudulent actions happens, but in many cases, Creditor’s right of rescission does not exist or only ambiguously exists. In this case study, the original court and Supreme Court have different opinion regarding the establishment time of credit card debt. The Supreme Court’s decision, so-called the theory of exception, stands for that credit card debt is established after using credit card, after debtor’s fraudulent actions exist. So, the theory of exception admitting the time of formation regarding preserved right is the main issue of this paper, but there are several changes related to this theory. At first, when Supreme Court first admitted the exception, there were conflicts between pro and contra. However, most theories has changed into pros lately, although some arguments about the basis still remain. This paper introduces general theory and precedents about Creditor’s right of rescission by reviewing the case of exception admitted. The purpose of this paper is to find the tendency of precedents, also to analyze objected decision on this criteria. 채권자취소권은 피보전채권의 존재, 채무자의 사해행위, 채무자와 수익자의 악의를 요건으로 하고 있다. 대상판결은 채권자취소권이 성립하기 위한 피보전채권의 성립시기와 관련된 문제로, 카드대금에 관한 채권의 성립시기를 언제로 보는지에 대하여 원심과 대법원이 견해를 달리하고 있다. 대법원은 대상판결에서의 카드대금에 관한 채권이 채무자의 유일한 부동산을 처분한 후 성립되었다고 보고 있기에 피보전채권의 성립시기에 관한 예외이론이 주된 쟁점이 된다. 과거 판례가 처음 피보전채권의 성립시기에 관한 예외를 인정하였던 당시에는 예외 인정 여부에 대하여 견해가 대립하였으나, 근래에는 예외를 인정하는 판례의 태도에 찬성하되 그 근거에 대하여 견해가 대립하고 있다. 따라서 본 판례평석에서는 채권자취소권의 일반이론과 피보전채권의 성립시기와 관련된 학설 및 판례에 대하여 자세하게 살펴본 후 판례가 제시한 요건을 충족하여 사해행위 이후에 발생한 채권이 채권자취소권의 피보전채권으로서의 적격성을 가지는 구체적 사례는 어떤 경우인지, 대상판결의 경우 그러한 요건을 충족하지 못한다고 단정할 수 있는지에 대하여 최근의 이론적 경향을 바탕으로 검토해 보도록 한다.

        Mode Evolution and Lasing Characteristics of a Passively Mode-locked Nd:YAG Laser with a Saturable Output Coupler (SOC)

        We demonstrated the first diode-pumped passively mode-locked Nd:YAG laser with semiconductor saturable absorber output coupler (SOC) and generated 12 ps pulses with M2 of 1.1 - 1.3, and time-bandwidth product of 0.47 which is very close to the transform-limited Sech2-shape pulse. The maximum output power of CW mode-locking was 1.55 W at the incident pump power of 12.7 W at 124.6 MHz. Insertion of a lens greatly reduced the divergence of the SOC from 17 - 24 mrad to about 1 mrad. Damage of the SOC caused by Q-switching mode-locked pulse induces TEM00 mode loss and results in higher order mode lasing. The irreversible threshold pump power was directly related to the damage threshold of the SOC that was about 197 MW/cm^2. This is the first paper reporting about the evolution of lasing mode of Q-switching and CW mode-locked diode-pumped Nd:YAG laser with SOC.

        FTC Regulation with the Case of Comparative Advertising from 1972 through 2006

        This study examined a total of 21 comparative advertising FTC decisions dating from 1972 through the first six month of 2006. The full text of each case was derived from the official website of the FTC and the volumes of Federal Trade Commission Decisions in the Law library at the University of Georgia. The majority of the FTC comparative advertising cases (52.4%) were decided in the 1990s followed by 28.6 percent in 1980s and 19 percent in 1970s. Since new millennium, none of comparative advertising case was heard by the FTC. Nearly one third of respondents appealed, and in only one case, the initial decision was modified based on substantiate evidences achieved by scientific study, yet it took 18 years after the complaint. This result provides the relatively low rate of appeals and the low reversal rate comparing to the Lanham Act lawsuit cases with approximately 65 percent of the appeal rate and 30 percent of the reversal rate.

        정치 유튜버의 공신력 속성이 콘텐츠 태도와 유권자의 정치적 의사결정에 미치는 영향

        The purpose of this study is to investigate effects of source credibility of political youtubers on attitude toward contents and politicians/political party and political decision making. The total number of 326 responses from online survey were analyzed. Results indicate that three factors of source credibility, similarity, charisma, and expertise positively affected attitude toward political contents on youtube in statistical significance. Five attributes of source credibility, familiarity, charisma, similarity, attractiveness, and trustworthiness positively affected attitude toward political youtube contents and politicians/political parties. Furthermore, attitude toward contents and politicians/political parties significantly increased voting intention to politicians/political parties.

        결합기법을 이용한 요양보험 등급판정 모형 연구

        The prediction model is a very important factor to support the long-term insurance system. The present prediction model is decision tree as one of datamining techniques. In recent studies, the generalized additive model (GAM) could be the alternatives of decision tree model as assessment models in long-term care insurance because GAMs may explain the non-linearity of data. In this study, we extend the GAMs to ensemble models for prediction of functional conditions. It is known that ensemble models, such as bagging, random forests have better prediction performances than single predictor's. We consider a ensemble model using GAMs as base predictor to assess the level of functional conditions. As a results, we find that the ensemble model has good performances of the long-term insurance data. 요양보험 대상자에 대한 요양인정점수의 산출 및 등급판정 도구는 노인장기요양보험제도의 신뢰성에 있어 매우 중요한 요소 중 하나이다. 현재 사용하고 있는 요양인정점수 산출 도구는 데이터마이닝의 방법론인 의사결정분석(decision tree)의 결과를 이용하여 개발된 것이다. 최근의 연구에서는 일화가법모형(generalized additive model)을 통해 의사결정나무에서 발생하였던 등급판정 자료의 역전현상 및 비선형관계를 설명할 수 있는 도구로 활용될 수 있음을 보였다. 본 연구에서는 일반화가법모형에서 나아가 결합기법(ensemble)을 이용한 모형을 판정도구로 고려하였다. 결합기법은 배깅(bagging), 랜덤포레스트(random forest) 등과 같이 단일 예측보다 더 좋은 성능을 보이는 것으로 알려져 있다. 따라서 등급판정도구에 일반화가법모형을 기본 분류자로 하는 결합기법을 고려하였으며 실제 자료 분석결과 등급판정에서 우수한 결과를 보임을 확인하였다.

        티백 형 수정과의 관능적 특성 및 소비자 기호도 조사

        Sujeonggwa is a popular Korean traditional beverage. However, consumers only prepare it at home on special occasions due to the time and effort required. Developing a convenient form of Sujeonggwa may promote its consumption. The objectives of this study were to 1) develop Sujeonggwa in a tea bag using different sweeteners and 2) describe the characteristics of Sujeonggwa's flavor in tea bag samples and 3) determine how well consumers accept the tea bag samples. A total of four types of Sujeonggwa in a tea bag were developed: two samples with varying amount of sugar, another sample using sugar and stevia and the last sample using sugar and short chain fructo-oligosaccharide as a sweetener. A commercial ginger tea and cinnamon tea were used as control products. Descriptive analysis was conducted on the same six samples and a descriptive panel identified its attributes. A total of 61 consumers evaluated acceptability using a nine-point hedonic scale and how they felt about intensities of the samples using a just-about-right scale. The results indicated that consumers liked Sujeonggwa samples in a tea bag more than commercial ginger tea and cinnamon tea.
