개발행위허가제도의 개선에 관한 연구

김태경김제국권대한48적인 방법들이 논의되기 시작하였고 , 2000년 1월 28일 「도시계획법」의 일부개정(제46조)에 의해 도시지역에 한하여 개발행위허가제도가 최초로 도입되었으며 , 2002년 「국토의 계획 및 이용에 관한 법률 」(이하 「국토계획법」) 제정을 통해 비도시지역에도 적용되게 되었다. 개발행위허가제도가 도입된 이후 전국의 개발행위허가 건수와 면적이 꾸준히 늘어나고 있는데, 2000-2005년간 건수는 195%, 면적은 172% 증가하였으며, 동 기간동안 51,698건, 145,7백만㎡의 개발이 허가되었다 . 지역별로 경기도가 2005년 기준 6,115건, 31.5백만㎡로 각각 전체의 30.7%, 36.1%의 비중을 차지하고 있다. 그 외 혁신도시 , 행정복합도시 등의 지정에 앞서 당해지역에서 많은 개발행위가 일어났으며, 지정 후에는 주변지역의 개발행위가 급증하는 추세이다 .개발행위허가제는 개 별적인 개발행위에 대하여 도시계획 차원의 타당성 , 기반시설의 공급 여부, 주변의 환경 및 경관과의 조화 등을 검토하여 허가 여부를 결정하는 제도로서 특성상 지방정부에게 매우 큰 재량권을 부여하는 등 제도의 특성상 운용에 있어서 고도의 전문성이 요구된다. 특히, 개발행위허가제는 도시기본계획 등의 계획제도와 용도지역제 등의 계획수단과 연계하여 법적 기준에 의해서만 이루어지던 도시계획행정의 한계를 보완하기 위한 제도로서 법적 기준 외에 계획 , 지침, 조례 등 각종 제도적 수단을 활용하여 운용할 때 그 실효성이 담보될 수 있다 .그러나 지자체의 행정관청에 주어진 재량권은 추상적인 기준과 주변환경 , 타 법과의 관계에 따른 복잡성으로 운용하는 데 있어 많은 부작용을 야기해 왔으며 , 그 동안의 도시계획 행정의 관행과 지방정부의 인력운용의 한계에 따라 계획, 지침, 조례 등의 개발행위허가제 운용을 위한 지원제도가 활성화되어 있지 못하여 개발행위허가제의 실효성에 대한 비판이 제기되고 많은 민원을 발생시키고 있다 . 본 연구는 개발행위허가제 운용상의 문제점과 보완과제를 도출하고 , 이에 대한 체계적인 대응방안을 모색하는 데 목적을 두고 있다 . 기존의 연구들과는 달리 각 지방정부 행정청의 개발행위허가 담당 일선 공무원을 대상으로 개발행위허가제도의 문제 점들을 실증적으로 분석하였으며, 이를 통해 해결방안을 모색하였다.본 연구의 분석에서 다루는 사항들은 세부적인 문제점들이지만, 각각의 문제점들에 대한 세부적인 해답을 구하기보다는 전체적인 시스템 측면에서 근본적으로 개선되어야 할 사항에 초점을 맞추고 있다 . 이는 향후 세부적인 사항에 대한 개선방안을 제시하는 연구들의 좋은 길잡이 역할을 할 수 있을 것으로 기대된다.

The sick sinus syndrome refers to a combination of symptoms (dizziness, confusion, fatigue, syncope, and congestive heart failure) caused by sinus node dysfunction and marked sinus bradycardia, sinoarterial block, or sinus arrest. 'Abdominal pulsation' means a disagreeable symptom that is defined as sensation of beating at the abdomen. We experienced a 84 year-old female patient who had dizziness, fatigue, abdominal pulsation and frequent voiding. These symptoms were related to previous episodes and presumed sick sinus syndrome by symptoms, ECGs and 24 hrs of holter monitoring. In the point of Differentiation of Syndrome (辨證), this patient was diagnosed as 'Water retention(水氣)' and was administered with Yeonggyechulgam-tang(岺桂朮甘湯). After the treatment, abdominal pulsation (frequency) and dizziness (VAS) were improved. Futhermore, the interval of voiding was longer and each volume of urination increased.

The novel Kirikirijin (Kirikirians) is enough to be called the compilation of the literary world of Inoue Hisashi. One day, the village of Kirikiri suddenly declares its independence from Japan. This article pays attention to the fools who decide the overall state affairs of Kirikiri. How is solidarity and community possible beyond the myth of meritocracy? The Kirikiri are consciously aware of their minorities. It is important that all members of the fools have a disability somewhere. The point is that Kirikirians raises a very critical question: “Do we think of human community as a system of essential interdependence?”(Judith Butler) When we recognize that all human beings are minority beings with “vulnerabilities” and “disabilities,” we can finally escape from the bondage of discrimination and realize a true community. Moreover, the Kirikiri people are not, as we often think, burning with resentment and revenge against the Japanese about the history of contempt and discrimination they have been subjected to so far. They caricature the world with laughter and cheerfulness, but always look at the world with warm eyes. Even at this moment, Kirikirians is dreaming of and striving to realize a new world of interdependence beyond ressentiment. 소설 『키리키리인』은 작가 이노우에 히사시 문학세계의 집대성이라 불리기에 충분한 작품이다. 어느 날 갑자기 키리키리 마을이 일본으로부터 분리 독립을 선언한다. 본고는 키리키리국국정 전반을 결정하는 우인(愚人)회의에 주목하였다. 능력주의 신화 너머 연대와 공동체는 어떻게 가능한가? 키리키리인들은 자신들의 마이너리티성을 자각적으로 인식하고 있다. 고정 멤버화한 열 명의 우인 모두가 ‘장애’를 지니고 있음은 중요하다. 여기에서 주목하고 싶은 지점은『키리키리인』이 “우리가 인간 공동체를 필수적인 상호의존성의 체계로 생각하고 있는가”라는비판적인 문제를 제기하고 있다는 사실이다. 키리키리인들은 우리 모두가 취약성과 장애를 지닌 약자 즉 마이너리티적 존재임을 받아들이고겸손함과 마주할 때야 비로소 차별과 복수의 굴레에서 벗어나 상호의존하는 진정한 공동체를실현할 수 있음을 깨닫게 한다. 더욱이 그들은이제껏 받아온 멸시와 차별의 역사에 대해 일본인에 대한 원망과 복수심으로 불타 있지 않다. 웃음과 활달함을 가지고 세상을 늘 따뜻한 눈으로 바라본다. 『키리키리인』은 지금 이 순간도 르상티망 너머와 상호의존의 새로운 세상을 꿈꾸고 실현하기 위해 애쓰는 중이다.

老年期女性의 背面彎曲度 減少效果를 爲한 衣服디자인 硏究

The author has studied the effect of clothes design to mask the dorsal curvature that is one of the commonest changes in elderly women. Body measurements including the body type and the status of dorsal curvature were performed on 153 women of over 60 years of age, and then a body form to fit to the mean measurements was made to evaluate the effects of various designs to it. With 31 pattern designs modified by changing in their slash lines and gathers using darts, the diminishing effect of the rounded back were evaluated by means of sensory test. The results of this study can be summarized as follows: I. Results from the body measurements 1) The mean body type in elderly women was that of obesity. 2) With the advancement of age, the angle to indicate the degree of dorsal curvature as well as the angle to indicate the posture are increased. II. Concerning to the clothes design to diminish the shape of dorsal curvature 1) Among the designs by the position of darts, the basic pattern (Fig. 5-1-①) showed the best effect to mask the shape of dorsal curvature. 2) Out of the applied designs of princess lines, that in which the slash line is pointing toward the shoulder point (Fig. 5-2-①) seemed to be most effective. 3) What has angled princess line (Fig. 5-3-①) had the most diminishing effect among the waist darts and armhole princess lines. 4) Among the V-shaped designs, the slashed at the shoulder point (Fig. 5-4-①) had the best effect to lessen the shape of the dorsal curvature. 5) Wider angle yoke had better effect to the narrow angle one among the designs with straight yoke, and that with downward direction (Fig. 5-5-①) showed the best effect. 6) Between straight wide angle yoke and curved yoke, that of curved one with downward direction (Fig. 5-6-①) had better effect as far as the masking effect of dorsal curvature is concerned. 7) Gathers around the neck showed better effect to those around the shoulder, and the more amount of gathers (Fig. 5-7-①), there was better effect. 8) The design with midline gathers at the level of horizontal slash line of armhole (Fig. 5-8-①) showed better effect to that with seperated gathers. 9) In case of design with gathers at the horizontal line of armhole, it showed the better effect with less amount of gathers in midline ones, but with more amount in the side ones. 10) Considering all 7 different designs with better effect in covering the shape of dorsal curvature, it was evident that the design with gathers was far better than the design with application of slash lines.
