This paper seeks ways to ensure the legitimacy of human rights as a moral right by using modified naturalism as a clue and further demonstrating the specific content of human rights and the problem of application. Human beings have human rights as rights to design their own lives with various abilities and desires(goals) and show their abilities to the fullest extent. The securing of freedom and welfare, which are necessary conditions for purpose-oriented humans, is the purpose of human rights and the reason for the nation’s existence. And the securing and guarantee of such human rights should be expanded domestically and internationally so that people in developing countries can enjoy freedom and welfare to achieve their goals. Until now, theories have sought to build a foundation for human rights’ legitimacy as a moral right of human rights by legal philosophy, and this trend belongs to deontological theory. New methodologies such as utilitarianism or methods of value relativism have become the basis of those theories. In such cases, where human rights are recognized as a moral right, a philosophical review and academic establishment are necessary for analytical and normative issues surrounding human rights’ moral legitimacy. Besides, even if contemporary human rights theory emphasizes an individual’s essential freedom and welfare as a moral right, there is no consensus on issues such as the content and application of human rights, limitations of human rights, conflicts, priorities, and so on as well as way of solution. Human beings who are rational in existence regard necessary conditions as inevitable good to achieve their goals and demand the right to these conditions as essential. As these general rights have become familiar to all other actors, resulting in the highest moral principles, they can explain the specific details of human rights, mutual relations, and conflict. By introducing inevitable arguments into the world of morality dialectically, Modified naturalism aims to overcome the theory of human rights of value relativism and utilitarianism and explain the specific contents and application of human rights by deriving the best moral principles common to all other actors from the genetic rights.

인간은 어떻게 살아야하는가를 묻는다. 이러한 물음은 도덕의 핵심 주제이다. 도덕은 인 간다운 삶에 대한 논의를 포함한다. 인권은 인간다운 삶의 필요조건이다. 그런 만큼 도덕과 인권은 공통점을 갖는다. 인권 실현을 위해서는 교육이 필요하다. 그런 의미에서 교과교육을 통한 인권교육은 중 요하다. 도덕과는 교과교육을 통한 인권교육에서 주도적 역할을 해 왔다. 인권은 도덕과 교 육과정의 핵심내용 성취기준 중 하나이다. 한편 교과를 통한 인권교육은 교과간 중복 문제 를 야기한다. 도덕과 또한 다른 교과와의 중복 문제에서 자유롭지 않다. 그런 만큼 도덕과 의 특성을 살린 인권교육에 대한 검토가 필요하다. 이와 관련하여 논자는 도덕과 인권 단원 구성 방안을 제안한다. 그것은 도덕과 인권 단 원의 핵심 내용 성취기준이 ‘인간의 존엄성’, ‘인권의 보편성’이어야 한다는 것이다. 또한 이 러한 핵심내용 성취기준에 대한 도덕 논증이 필요하다. 논자는 이를 ‘인권의 도덕적 정당 화’라고 주장한다. 이는 인권에 대한 도덕적 탐구이자 인권의 가치를 내면화하는 것이다. 이를 통해 도덕과의 특성을 살리는 인권교육을 실현할 수 있을 것이다. Humans ask how they should live. This is a key topic of morality. Morality involves the discussions about human life. Human rights is human being’s rights. It is a requisite for human life. Therefore, morality and human rights have common ground. Realization of human rights needs education. In that sense, human rights education through subjects curriculum is important. Moral subject has played a leading role in human rights education through subjects. Human rights are one of the key content-performance standards of moral subject curriculum. On the other hand, Subjects’ human rights education gives rise to overlapping problem between subjects. Moral subject is not free from this problem with other subjects. Therefore, review of human rights education reflected moral subject’s traits is needed. In this regard, this proposes construction principles of human rights units in moral subject. They are ‘human dignity’ and ‘universality of human rights’ which should be key content-performance standards of human rights units in moral subject. These standards need to be argued from moral perspective. This article calls it moral justification of human rights. It is a moral quest and internalization of human rights. By doing so, human rights education enhancing the moral subject’s traits can be achieved.
