본 연구에서는 자치경찰의 실시를 위해 노무현 정부 때 추진했던 자치경찰법(안)의 문제를 쟁점별로 검토하고 국정철학을 반영하여 새 시대에 맞는 ‘실용적 자치경찰제’의 출범을 위해 개선방안을 제시해보고자 시도되었다. 우선, 자치경찰 실시와 관련된 여러 쟁점들을 도입단위, 조직운영, 인력관리, 재정문제, 사무범위로 정리하여 문제점을 파악하였다. 개선방안으로서 첫째, 모든 기초자치단체에 설치하고 둘째, 현재의 지구대 업무와 인력, 그리고 자치단체의 특별사법경찰 업무와 담당인력을 대폭 자치경찰로 이관하여 ‘생활치안센터’를 운영하고, 셋째, 지구대에 배정된 국가경찰을 특별채용하고 자치단체 인력을 전환시켜 인력을 구성하며, 넷째, 인건비를 비롯 경상적 경비의 일정부분을 국가에서 지원하며, 다섯째, 자치경찰 업무를 확대 강화하여 그 위상을 높여 명실상부한 자치경찰을 출범시킬 것을 제시하였다. 자치경찰의 출범으로 지역특성에 맞는 치안서비스 제공이 가능하게 되어 보다 안전하고 편안한 생활을 기대해 본다. This study examines the problems incurred within previously promoted the Municipal Police Law (Bill) that supported the application of Municipal Police according to each issue. In addition, its objective lies in the effort to apply ‘Governing Philosophy’ and come up with a improvement to lead an implementation of ‘a practical Municipal Police’ that complies with a new age. Generally, we have organized the issues related to Execution of Municipal Police according to the introduction unit, the operation of organization, the personnel administration, the financial issue, and the scope of affairs in the effort of pointing out the problematic aspects. As for the improvement, first of all, the Municipal Police should be implemented throughout all primary governments. Second of all, the organization should be operated by transferring operations pertaining to Special Judicial Police Services and Local Police Headquarters operations as well as corresponding labor force to municipal police. Third of all, there should be a special employment of national police within Local Police Headquarters and circulation of local government in distributing the labor force. Fourth of all, personnel and a part of extraordinary expenses should be subsidized by the government. Last but not least, we have proposed the enlargement of importance of municipal police, which in all will increase the pride of municipal police as well as to set them forward as a high-reputation municipal police. As a result, the regionally customized public order service will be applicable where we can expect safer and more convenient environment.

「제주특별법」에는 자치경찰의 목적규정이 없다. 다만, 「제주특별법」 제90조에서는 제주경찰의 사무를 일일이 열거하고, 제100조 제1항에서는 「치안행정의 연계성을 확보하고 지역특성에 맞는 치안서비스를 제공」한다고 하여 제한적으로 열거된 자치사무의 업무적 특성을 통하여 자치경찰의 본질을 간접적으로 밝히는 입법기술방식을 취하고 있다. 여기에 자치경찰이 목적규정이 없다고 하여 자치경찰제의 본질과 정체성을 나타내는 존재이유 및 그 해석의 범위와 기준, 개정방향까지 제시할 수 없다고 보아야 하는가의 문제가 있다. 왜냐하면 「제주특별법」상 자치경찰의 목적규정은 실질적 자치경찰을 구현하기 위한 지도적 원리 및 이론적 기초가 될 뿐 아니라 그 법령의 해석지침을 제시하는 중요한 역할을 하기 때문이다. 따라서 다양한 경찰작용을 행하는 자치경찰사무를 규정한 동 법 제90조의 의미도 정책론이 아닌, 현행법으로 재해석되고 재정립되어야 하는 것은 아닌가하는 의문이 생긴다. 이에 본 연구에서는 「제주특별법」상 자치경찰사무의 범위를 현재와 같이 제한하는 근거가 되었던 행정경찰의 개념 및 「제주특별법」이 자치경찰의 규정을 두면서 목적규정을 두지 않았던 가능한 이유, 나아가 이러한 목적규정의 내용에 포함되어야 할 개념요소를 면밀히 검토하여 현행법을 목적규정의 제정에 따른 실질적 치안서비스로서 자치경찰사무에 대한 목적적 해석론을 시도하고 제주자치경찰의 목적규정을 도출하였다. There is no provision of purpose for the Autonomous Police agency under the Jeju Special Act. Article 90 of the Special Act lists every detail of Jeju police agency business affairs. And Article 100(1) stipulates that ‘secure the connectivity of regional policing administration and provide policing service customized to the region. In this manner, the Act describes the nature of Autonomous Police indirectly by mentioning the characteristics of policing business in a limited manner. It is questioned that whether the absence of purpose provision of Jeju Autonomous Police also limits its reason of existence representing the nature and identity of the Autonomous Police, the scope and criteria of its interpretation and even ways of Autonomous Police improvement. It is because, the purpose provisions of Autonomous Police in the Special Act serve not only as a guiding principle and theoretic basis to realize practical local policing service but also as an important guideline for the law interpretation. In this situation, it becomes curious whether the meaning of Article 90 of the Act stipulating diverse policing functions and Autonomous Police affairs should be interpreted not from the perspective of policy theory but from the perspective of current law. With this understanding, this study scrutinized the ground for limiting the scope of Autonomous Police affairs as it is now under the Jeju Special Act; reasons of not including the purpose provisions in the Autonomous Police section of the Jeju Special Act; and conceptual factors to be included in such purpose provisions. By doing so, this study tried the purposive analysis theory on Autonomous Police business of the present law as a practical policing service according to the establishment of purpose provisions and produced the purpose provisions of Jeju Autonomous Police agency.

최근 현장중심형 인재채용이라는 말이 많이 나오고 있다. 특히 중소기업의 경우 인재채용에서 기술과 현장경험을 중시여기는 경 향이 있어 현장실습은 취업에 중요한 디딤돌이 될 수 있다. 이러 한 현장실습은 실무중심의 전문대학뿐만 아니라, 4년제 대학에서 도 많이 시행하고 있으며, 최근에는 마이스터고, 실업계고 등 특성 화고에서도 실시하고 있다. 그러나 학생들이 현장실습을 통해 ‘일 을 통한 교육’을 체험하기 보다는 값싼 노동력으로 활용되며, 근 로자와 학생 신분을 동시에 가짐에 따라 여러 가지 제도적 혜택의 사각지대에 놓이게 된다. 따라서 현장실습에 대한 현형과 관련규정을 종합적으로 검토한 결과 다음과 같은 논거를 찾아내었다. 첫째, 현장실습 관련 규정의 입법이 절실하다. 둘째, 현장실습시 보험가입의 의무화, 셋째, 현장 실습의 평가 시 현장실습관리자 의견반영, 넷째, 현장실습관리자의 배치를 통한 안전한 현장실습이 될 수 있도록 구축해야 한다. 이를 통한 안전하고 합리적인 현장실습이 이루어지도록 해야 한다.
