In general, if it was agreed that the mandatary is to receive remuneration, he is entitled to receive remuneration. If a court, however, decides that the remuneration or the service fee is unduly excessive, the court, at its own discretion, may reduce such amount. A typical example would be an attorney’s fee. In many cases, when the courts decided that an attorney’s fee was unduly excessive to a client, the courts have reduced the payment for legal services. In 2006, the Korean Supreme Court has applied the regulation of attorney’s fees for the reduction of a tax accountant’s service fee when the Court ruled that such service fee was unduly excessive to a client (Supreme Court Decision 2004DA59393 Delivered on June 15, 2006). The lower courts have applied the same legal principle to general mandate contracts for the reduction of unduly excessive service fees. Under my view, such reduction, however, gives a little basis to be a positive law because the courts’ rulings are based on the principle of Trust and Good Faith in a general provision of Article 2(1) of the Civil Act. Moreover, it is my view that it is inadvisable for the courts to change the terms of a contract after the completion of one’s obligations solely based on a general provision in Civil Act. In the light of the outcome of the review of the courts’ rulings on the reduction of service fees, it is questionable whether the courts can always properly reduce the contract amounts. I agree that in many cases it is practically necessary to reduce the unduly excessive service fees. I, however, still believe that the reduction of service fees by the courts should be only made in the following three cases. Please note that the most of the court's decisions which reduced the service fees were in the following three cases as well. ① An attorney or a professional who holds a professional license such as a public accountant license, patent attorney license, etc. ② In the case a mandate contract is rescinded prior to the completion of one’s obligations. ③ In the case where a mandatary is not liable for compensation for the non-performance of his obligations, but in the case where the mandatary didn't manage the affairs entrusted to him with the care of a good manager in accordance. 수임인의 보수에 관한 약정이 있으면 수임인은 위임인으로부터 보수를 지급받을 권리가 있다. 그런데 그 보수가 부당히 과다한 경우 법원은 직권으로 그 보수를 감액하여 왔다. 대표적인 경우가 변호사의 보수에 관한 것이다. 이 사건의 대법원 판결(대법원 2006. 6. 15. 선고 2004다59393 판결)은 변호사의 보수 감액에 관한 법리를 그대로 빌려와, 세무사의 보수를 감액하였다. 하급심 법원의 판결들은 이러한 보수 감액의 법리를 과도한 수임인 보수의 감액을 위하여 위임 계약 일반에 적용하고 있다. 그러나, 위와 같은 수임인 보수의 감액은 신의성실의 원칙이라는 일반조항에 근거한 것이어서 실정법적인 근거가 미약하다. 그리고 법원이 위와 같은 일반조항에만 근거하여 계약 체결 후 이행이 완료된 계약관계를 사후적으로 수정하는 것도 바람직하지 못하다. 이 글에서 수임인 보수를 감액한 판결들을 분석한 결과에 비추어 보면, 법원이 항상 수임인 보수를 적절히 감액할 수 있는지도 다소 의문이다. 물론 많은 사건들에 있어 과도한 수임인 보수를 감액해야 할 현실적인 필요성은 인정된다. 졸견으로는 보수 감액은 다음과 같은 세 가지 경우에 한하여 이루어져야 한다고 생각한다. 수임인 보수를 감액한 법원의 판결들은 주로 이러한 세 가지 경우에 관한 것이었다. 첫째, 변호사 및 공인회계사, 변호사와 유사한 전문자격사들의 경우 둘째, 위임계약이 수임사무 완료 전에 해지된 경우 셋째, 수임인이 손해배상책임이 인정되는 채무불이행의 정도에 이를 정도는 아니지만 수임사무를 처리함에 있어 선량한 관리자로서의 주의의무를 다하지 못한 부주의가 인정되는 경우

First Record of the Subcortical Beetle Genus Bitoma (Coleoptera: Zopheridae) in Korea

The family Zopheridae Solier consist of members from several previous families, Zopherinae Solier, Monommatinae Blanchard and Colydiinae Erichson, and more than 1,700 described species are placed in the Zopheridae. They are widely distributed in all major biogeographical regions. The zopheridine genus Bitoma Herbst comprise more than 30 species worldwide including four Palaearctic species. A taxonomic study of the genus Bitoma in Korea is presented. The genus Bitoma and its two species, B. crenata (Fabricius) and B. siccana (Pascoe), are new to the Korean Peninsula. A key, diagnoses, habitus photographs, and illustrations of aedeagus of the Korean Bitoma species are provided.

유공압 방식 항공기 착륙장치의 동적거동은 대부분 완성도 높은 상용 소프트웨어로 예측한다. 상용 소프트웨어는 비교적 정확한 반면 모델링 구성 및 변경에 많은 시간이 소요된다. 설계 초기에는 잦은 설계 변경이 발생할 수 있으므로, 간단하며 모델링 변경이 쉬운 도구가 필요하다. 본 연구에서는 설계 초기에 필요한 간단한 착륙장치 성능 해석을 위해 유공압 착륙장치를 비선형 2자유도 질량/스프링/감쇠시스템으로 모델링하였다. 또한, 해석 결과를 착륙장치 낙하시험과 비교하여, 비선형 2자유도 모델의 유용성을 검토하였다. Usually, the performance of oleo-pneumatic landing gear is predicted by commercial softwares. While commercial softwares predict landing gear behavior more exactly, it takes a long time to construct or modify a model. Because frequent design modifications happen in a initial stage, a simple and easy tool is necessary. For a simple analysis of a oleo-pneumatic landing gear performance, a oleo-pneumatic landing gear is modeled by a 2 degree of freedom model. To review the availability of the model, the analysis results are compared with landing gear drop test results.

Two Zopheridae (Coleoptera: Tenebrionoidea) Species New to Korea and a Key to the Korean Genera

The Zopheridae Solier consisting of members from three previous families, Zopherinae Solier, Monommatinae Blanchard and Colydiinae Erichson, is considered the taxonomically most challenging group, and comprises more than 1,700 described species worldwide. The members of Zopheridae represent diverse morphological variations, and are difficult to separate morphologically from other tenebrionoid families. Two Zopheridae genera, Colobicus Latreille and Lasconotus Erichson, are identified for the first time in Korea, and two wood-boring species, C. hirtus (Rossi) and L. niponicus (Lewis), are newly reported in the Korean fauna. A key to the genera of Korean Zopheridae, and diagnoses, habitus photographs, and illustrations of diagnostic characters of the two species are provided.
