이 글에서는 고령자 근로권 도출과 보장방향을 모색하기 위한 논의를 전개하였다. 먼저, 고령사회에서 고령자의 근로가 필연적으로 요구되는 상황에서 향후 고령자 고용을 유지하고 확대하기 위해서는 외형으로 드러나는 고용률에 경도되지 않고 실질적으로 고령자의 노동을 재인식하고 이들의 노동을 보호하여야 할 필요성을 제기하였다. 고령자의 근로생활이 계속하여 이루어지기 위해서는 고령자의 노동에 대한 보호가 전제 또는 병행되어야 하는 점, 고령자의 노동이 헌법과 노동법으로부터 당연히 보호되어야 하지만 그 동안 독자적인 시각에서 충분히 논의되지 못한 점, 고령이라는 그 자체의 취약성으로부터 권리의 보장이 요구되는 점 등으로부터 고령자 근로권의 의의를 찾을 수 있다. 이로부터 구체적인 고령자 근로권의 개념을 모색하기 위해 고령자 근로권의 근거가 되는 헌법상 근로권과 국제노동기준을 살펴보았다. 그리고 그 원칙과 내용에 착안하여 고령자 근로권을 구성하는 주요한 내용을 도출해 보았다. 구체적으로, 일할 자리에 대한 보장, 고용사회의 동등한 참여 및 기회의 보장, 고용의 보호, 고령자에 적합한 근로환경의 보호, 적정임금의 보장, 직장 내 산업안전보건의 보호이다. In this article, I tried to draw the idea of “the aged right to work” and to find out the directions of the right’s security. Working longer may seem an unavoidable obligation in an era when the workforce is ageing and life expectancy is increasing. In order to extend and keep working lives, new understanding and protection for older worker is necessary. This suggests that we need to move the debate on from an emphasis on the numbers of older people in employment to a focus on the question of the quality of work available for older workers. The significances of the aged right to work is that it is only possible to encourage olders to work on the premise of older worker’s working capacity. Also the older worker’s rights have not been received any spotlights on their values based on the Constitutional principle and basic ideology of the labour law. And the special protection for older workers are needed to guarantee the worker’s dignities. From this context, this paper is to understand the notion of the aged right to work and to establish detailed meaning and contents of their rights. The basic of the older worker’s rights can be found from the right to work as defined in the Constitution and a number of standard and principles set forth in the international organizations. Also, the specificity of the aged right to work can be extracted inductively based on the current legal system on the aged. Accordingly, specific contents of the aged right to work that need to be stressed out are : first, guarantee of working opportunities, second, ensure the equal participation and opportunities of labor, third, protection of employment, fourth, protection of the working condition and environment for older workers, fifth, ensure a proper wage, sixth, protection of the workplace occupational safety and health.
Posttranslational and epigenetic regulation of the CLOCK/BMAL1 complex in the mammalian

Most living organisms synchronize their physiological and behavioral activities with the daily changes in the environment using intrinsic time-keeping systems called circadian clocks. In mammals, the key molecular features of the internal clock are transcription- and translational-based negative feedback loops, in which clock-specific transcription factors activate the periodic expression of their own repressors, thereby generating the circadian rhythms. CLOCK and BMAL1, the basic helix-loop-helix (bHLH)/PAS transcription factors, constitute the positive limb of the molecular clock oscillator. Recent investigations have shown that various levels of posttranslational regulation work in concert with CLOCK/BMAL1 in mediating circadian and cellular stimuli to control and reset the circadian rhythmicity. Here we review how the CLOCK and BMAL1 activities are regulated by intracellular distribution, posttranslational modification, and the recruitment of various epigenetic regulators in response to circadian and cellular signaling pathways.
