The trade facilitation concept of PTAs has evolved from limited provisions on customs issues to include more comprehensive provisions on regulatory and border issues affecting the movement of goods across borders. In addition, although the convergence of these provisions in terms of the subject matter and language of PTAs is increasing due to the influence of the WTO TFA, it is also unavoidable that significant differences remain. The use of technology is supporting the modernization of customs, other regulatory and border agencies and expanding the scope of trade facilitation provisions. In particular, many countries are exploring the use of new technologies such as blockchain to support international trade and border management activities. In modern free trade agreements, a number of developments are taking place simultaneously to modernize and simplify the administration of preferential rules of origin. As customs administrations in each country make better use of automation concepts and build risk management and post-clearance audit capabilities, customs administration business processes will become more sophisticated. The modernization of customs administration is also likely to have an impact on the customs union, especially customs and tax collection. It is analyzed that the process, reporting and documentation requirements will be further simplified.

UN CISG의 특성과 국제법적 효력에 관한 연구

The CISG is an international standard established to facilitate international trade in goods by codifying unified customs while excluding the application of domestic laws and regulations in international trade. Unless there is a treaty on contracts for the international sale of goods, the law of a specific country designated by the private international law regulations of the country in which the litigation relating to the international transaction is filed shall be applied as the governing law. As such, due to the problem that each country's private international law regulations are not the same, the unpredictability of the applicable law causes an unstable legal status for the parties to the litigation. Accordingly, this study was conducted focusing on the legal characteristics of the CISG, international legal effects, recent domestic application implications, and suggestions for future improvement. ‘The United Nations Convention on Contracts for the International Sale of Goods 1980' (hereinafter referred to as the ‘Convention' or ‘CISG') The interpretation of this Convention shall take into account its international character and the necessity to promote uniformity in application and good faith in international transactions.' This provision prevents interpretation by the principle of interpretation of domestic law, guarantees universal use of the Convention, and considers the special circumstances of international transactions rather than the usual standards set by domestic law. This means that the judgment should be respected by referring to its contents CISG는 국제물품매매에 있어서 국내법규의 적용을 배제하고 통일된 관습을 성문화하여 국제물품매매거래를 원활히 하기 위하여 제정된 국제규범이다. 국제물품매매계약에 관한 조약이 없는 한, 해당 국제 거래에관한 소송이 제기되는 국가의 국제사법 규정에 의하여 지정되는 특정국가의 법이 준거법으로서 적용이 될것이다. 이렇게 각국의 국제사법규정이 같지 않은 문제로 인하여 준거법의 예측불가능성 발생에 따라 해당소송 당사자들의 불안정한 법률적 상태가 야기되게 된다. 본 연구는 이에 따라 CISG의 법률상 특성과 국제법적 효력, 최근 국내 적용 시사점과 향후 개선방안에대한 제언을 중심으로 연구를 진행하였다. CISG의 가장 주요한 특징 중 하나는, 손해배상청구권을 주된 구제방법으로 보지 않는다는 것이다. 이는CISG상에서는 계약을 가능한 유지시켜서 본래의 이행의 실현을 도모하려는 것이 기본원칙이기 때문이다. 영국법에서는 계약의 위반이 중대한 경우에는 계약을 해제할 수 있고 매수인은 계약해제권과 대체물급부청구권도 인정되어진다. CISG상에서는 계약위반의 유형별로 구제방법을 규정하지 아니하고 매도인의 위반인지, 아닌지에 따라 구제방법상에서 요건을 적용시키는 것이 가능하다. 즉 매매계약에서 계약위반의 효과는 국가간의 거래를 통한다는 특수성을 고려한다면 개별 사안에 따른 복잡한 판단기준에 영향을 받지 않는 통일된요건의 적용을 통해 거래의 안전을 도모할 필요가 크며, 이는 CISG가 가장 중요한 국제법적 효력으로서의의미를 갖는 것으로 이해할 수 있는 중요한 개념이 된다.

Evaluating the Factors That Influence E-commerce Performance on SMEs in China

This paper investigated the factors that influence the e-commerce performance of Chinese small and medium enterprises (SMEs). E-commerce provides a platform the fair competition between SMEs and large enterprises. In fact, within a decade, e-commerce has brought economic benefits to many SMEs. Hence a number of SMEs rapidly adopted this platform in recent years. SMEs are facing critical barriers to e-commerce application. First, there are e-commerce implementation and adoption decision issues. Second, there is a need to consider the key success factors and its relationship with other variables. Third, these is a dilemma on how to measure the effect on the firm of implementing e-commerce and the appropriate performance evaluation procedure. In this paper, theoretical and empirical explorations and critical research were conducted on e-commerce among SMEs in China. Considering the downward trend in the performance of SMEs and the existing theoretical models, this study presented relevant hypothesis. Past studies were also reviewed and organized to support the argument. This paper analyzed the factors that influenced e-commerce performance based on a number of research papers. Using the statistical SEM verification method, this study also discovered the critical success factors in doing business through e-commerce among SMEs. Two critical factors were verified from about 200 cases which are subjected to statistical processing. It was found that internal human resources and e-commerce strategies are the statistically significant success factors for e-commerce performance among Chinese SMEs.

Purpose: In the 21st century, the flow of openness and internationalization, fueled by the rapid globalization trend, is emerging in a complex way. As an alternative to solving problems that cannot be solved by these existing methods, it is urgent to present an illogical presentation of national priority and protectionist trade and to establish a system for understanding international trade theory and practice. In addition, by introducing a curriculum that can look at international trade processes linked to international trade, economic integration, international trade policies and negotiations from a global perspective, competencies for this are strengthened at an early stage, and furthermore, in-depth case studies are conducted in various ways. In particular, through a basic understanding of the trade practice process linked to corporate globalization, foreign direct investment, and overseas market entry strategy, students will strengthen the basics for preparation in advance for the field-linked internship program that will be experienced in the future. 글로벌 블록체인 플랫폼 구축에 관한 연구 - 디지털 무역 전략을 중심으로 -

Purpose : This paper analyzes digital trade as a dimension to maintain and spread its function as a new trade growth engine in Korea in the future, along with a plan to build it as a global platform, centering on blockchain, one of the innovative technologies initiating in 4IR. The purpose of this study is to continue research at the convergence level as a new national development strategy. Research design, data, methodology : Therefore, this paper was executed with a focus on how to effectively implement a digital trade acceleration strategy so that Korea can maintain a competitive edge in the future based on the establishment of a blockchain platform. Results : The recent acceleration of the spread of Digital Trade and the expansion of CBEC transactions has brought about a major change in the scope and form of global trade, and is contributing greatly to the global growth of Global SCM.
