        Pre-hospital i-gel blind intubation for trauma: a simulation study

        Objective This study aimed to evaluate the efficacy of i-gel blind intubation (IGI) as a rescue device for definitive airway management in ground intubation for pre-hospital trauma patients. Methods A prospective randomized crossover study was conducted with 18 paramedics to examine intubation performance of two blind intubation techniques through a supraglottic airway devices (IGI and laryngeal mask airway Fastrach), compared with use of a Macintosh laryngoscope (MCL). Each intubation was conducted at two levels of patient positions (ground- and stretcher-level). Primary outcomes were the intubation time and the success rate for intubation. Results The intubation time (sec) of each intubation technique was not significantly different between the two positions. In both patient positions, the intubation time of IGI was shortest among the three intubation techniques (17.9±5.2 at the ground-level and 16.9±3.8 at the stretcher-level). In the analysis of cumulative success rate and intubation time, IGI was the fastest to reach 100% success among the three intubation techniques regardless of patient position (all P<0.017). The success of intubation was only affected by the intubation technique, and IGI achieved more success than MCL (odds ratio, 3.6; 95% confidence interval, 1.1 to 11.6; P=0.03). Conclusion The patient position did not affect intubation performance. Additionally, the intubation time with blind intubation through supraglottic airway devices, especially with IGI, was significantly shorter than that with MCL.

        부동산유치권의 제한

        유치권은 타인의 물건이나 유가증권을 점유한 자가 그 물건이나 유가증권에 관하여 생긴 채권이 변제기에 있는 경우에 그 채권의 변제를 받을 때까지 그 물건 또는 유가증권을 유치할 수 있는 권리이다. 민법상으로는 유치권은 유치적 효력을 가지는데 불과하지만 민사집행법상 유치권에 관해서는 인수주의를 취하고 있기 때문에, 그리고 부동산의 유치권은 물건의 점유에 의해 인정되므로 등기에 의한 공시가 필요하지 않기 때문에 다른 부동산물권자에게 불측의 손해를 안길 우려가 있다. 그리하여 부동산유치권이 다른 권리보다 우위에 있게 되는 폐단울 극복하는 방법을 강구할 필요가 있다. 현 제도상 해석론으로는 ‘물건과의 견련성’에 관한 엄격한 해석을 통해 유치권의 성립을 제한하는 방안과 대항력의 영역에서 유치권의 행사를 한정적으로 취급하는 것을 고려할 수 있을 것이다. 유치권이 인정되기 위해서는 목적물 점유자의 채권은 ‘그 물건에 관하여 생긴 채권’이어야 한다. 즉 채권과 목적물 사이에 견련관계가 있어야 한다. 이에 관해서 다수설과 판례는 ‘채권이 목적물 자체로부터 발생한 경우’와 ‘채권이 목적물의 반환청구권과 동일한 법률관계 또는 동일한 사실관계로부터 발생한 경우’에 견련관계가 있다고 한다. 다수설 및 판례의 입장에 의할 때에는 유치권의 인정범위가 너무 광범위해지고, 그럴 경우에 유치권이 제3자의 권리를 해치는 경우가 많아지게 될 것이다. 유치권의 성립범위는 제3자를 희생시켜서라도 채권자를 보호하는 것이 타당하다고 인정되는 경우로 한정하여야 할 것이다. 다수설 및 판례의 입장을 기본으로 하면서도, 구체적 사례에서 개별적 공평성·타당성 판단으로 환원하여서 민법상의 다른 제도와 충돌하는지 여부나 다른 적절한 구제수단이 있는지 여부 등을 포함하는 신의성실의 원칙에 의한 심사를 통하여 유치권에서의 견련성을 제한하여야 할 것이다. 목적물과 채권 사이의 견련성에 관한 해석에서 유치권의 성립범위를 제한한다고 해서 유치권과 관련된 문제가 모두 해소되는 것은 아니다. 유치권은 일정요건을 갖추면 성립하는 법정담보물권이면서 민사집행법상 인수주의를 취하는 결과 다른 물권자보다 실질적으로 우선변제를 받는 결과를 가져와서 물권 선순위원칙을 간접적으로 침탈하게 될 수도 있다. 이러한 부분은 대항력의 영역에서 해결하여야 할 것이다. 생각하건대 유치권과 저당권을 시간적 선후관계에서 구체적으로 분석하고, 그 관계에서 신의성실의 원칙 또는 권리남용의 법리에 근거하여 유치권의 대항력 유무를 판단하여야 할 것이다. Provided in the Article 320 of Korean Civil Act, if a person possesses a thing or valuable stock comes into another's own and has time-expired claim for it, he has right to retain the possession of it until his claim is satisfied. This right is named retention right. One of requisites for establishment of retention right is the fact possessor's claim is for the possessed thing. It is called the connection of claim and thing (in following, connection). Majority theory and precedent argue that the connection exists in a case the claim occurred from the possessed thing itself and a case the claim occurred from same judicial relation or factual relation in a right requested to return the possessed thing. According to Majority theory and precedent, retention right is granted in a wide scope. Meanwhile a successful bidder shall be responsible for reimbursing the claim of retention righter that are secured by the retention right(Clause 3, Article 91, Civil Execution Act). Because of this provision, retention right in real estate belongs to exception of the principle, "prior tempore, prior jure". So that brings unsuspected damage to persons who hold the right of prior-order security, hypothec. As above, retention right has several difficulties in interpretation and application. Therefore it is necessary to restrict the scope and counterforce of retention right in real estate. First, in relalation to establishment of retention right, the scope of connection must be restricted to the case in which is reasonable to protect holder of retention right in preference to any other holder of hypothec. In other words, as to interpretation of connection, the scope of connection is restricted by principle of trust and good faith while judging connection on the basis of majority theory and precedent. Second, although the scope is restricted in interpretation of the connection, one of requisites for establishment of retention right, difficulties of retention right are solved entirely. Because a person with retention right in real estate is satisfied for his claims preferentially to hypothec, the principle of "prior tempore, prior jure" is violated mediately. To solve this unreasonable problem, the solution is found in the sphere of counterforce of retention right. Thinking of it, it is necessary to analyse the relation between retention right and other hypothec and to judge the counterforce of retention right on the basis of principle of trust and good faith.

        기업의 환경오염에 대한 사법적 책임

        The nation guarantees the right of living in a good environment, and tries to make preservation and protection of environment. However the equipment and the operation of the enterprise occasionally bring to environmental pollution. In this case sanctions are taken against the enterprise in administrative law, and in some cases liabilities are imposed on the enterprise in private law. (1) The injunction of pollutive operation is one of the liabilities in private law. In a claim for injunction, it is necessary to understand the basis of that claim as a personal right or a environmental right. (2) The other is tort liability. In tort liability for pollution, we must not grasp it as a general tort liability because the damage due to pollution has the different characters from the damage caused by an unlawful action. Therefore the demand for necessary conditions is loosen in sufferer's making proof of injurer's negligence. Moreover, so as to solve the difficulties in making proof of the dependence of effect on cause between injury and pollution, we should judge causal relation on the basis of the only probability that the pollution brings to the damage in the general cases.

        $1910{sim}1965$ 건조물문화재 보수공사의 시공특징에 관한 연구

        This study is on the construction work of Preservation for Korean architectural properties during the period of japan invader. Korea lost their preservation ability of architectural properties when went through specific background from 1910 to 1945, which was the period of japan invader. Through this situation japan had to face the preservation of architectural properties for japan and korea. After 1945, korea has preserved the architectural properties over 50's years and which accomplishment every yew. Also, there are some architectural properties which registered in world heritages. However, the study of this period is not studied enough. Especially a construction work for architectural properties during this period is not become known. Therefore, the purpose of this study is for three. First is to analyze construction work data(a specifications and etc.) for accessing originality of korea architectural properties. Second is to understand about the construction works of preservation for the korean architectural properties. and the last is to compare the peculiarities of construction work of Preservation for korean architectural properties between during 1910-1945 and 1945-1965.

        T-반사 응답의 분석을 위한 디지탈 신호 처리 시스템의 설계

        Tendon reflex responses generated from mechanical stimulus had been studied for quantitative analysis of activity of tendon reflex, especially patellar tendon reflex responses are known to be a criterion for diagnosing the L3 or L4 radiculopathy. In this paper, we developed a digital signal processing system for analysis of the tendon reflex response. The system parameter, i.e., $\textit{sampling frequency, pre-amplification gain, input channel and filter bank}$ are selected by Using software switches. From the view points of flexibility, the system hardware is connected to an IBM PC for analyzing the tendon reflex parameters, amplitude, latency duration We applied the proposed system to the analysis of the patellar tendon reflex reponses. In the experiment, we measured latency, duration, amplitude of the reflex action potentials generated from vastus medialis, vastus lateralis and rectus femoris that compose quadriceps, and the measured data are analyzed througll the ANOVA test which has 5% significant level. As a result, we showed that the mean amplitude of reflex action potential at the vastus lateralis is larger than any other muscle and the mean latency of the reflex action potential at the rectus femoris is shorter than any other muscle.
