In commemmoration of 25th Anniversary of founding of Korea Association of the Law of Civil procedure, I presented the study of the relation between the first instance of court and the appeal court. About 20 years ago, the advisory committee for revision of Korean civil procedure recommended the limitation of submitting new materials in appeal court. I annalysed that the recommended limitation was not enough for that purpose and functioned not well, and researched the discussions about the theme in Germany, and suggested that the stricter limitation was needed to regulate it. But the law was not revised, and present law is same to that law of 20 years ago. From that time on, lots of professors and judges proposed the revision of law for the stricter restriction of submitting new materials similar to German civil procedure law. In this research, I also analysed the American appeal system. In U.S.A. the appeal court gives ‘de novo’ deference to the legal conclusion of the t rial court, and ‘clear error’ deference to i ts fact-finding. And the appeal court gives ‘substantial evidence’ deference, and ‘abuse of discretion’ deference in reviewing the trial court’s decision. At last part of this research, it is showed that it is distinguished between adjudicative fact and legislative fact in America, and different standards of review are applied to each fact. But I analysed that the former is equal to fact, and the latter to law. So I suggest that the former should be treated as fact finding, and the latter as law conclusion in Korea. It shows that the distinction between fact-finding and legal conclusion is not easy both in U.S.A. and in Korea.
폴리스티렌 수지(樹脂) 재활용(再活用) 기술(技術)의 특허(特許) 동향분석(動向分析)

폐 폴리스티렌 수지의 재활용에 대한 관련 기술의 추이 및 동향을 조사하기 위하여 특허 출원 검색을 시행하였다. 검색 범위는 공개 특허를 대상으로 하였으며 특허 검색 데이터베이스는 미국의 USPTO 및 DELPHION, 일본의 PAJ, 유럽의 EPO, 그리고 한국의 KIPPIS를 선정 조사하였다. 폴리스티렌 수지의 재활용 관련 키워드는 PS, polystyrene, 폴리스티렌, 스티로폼, 그리고 IPC 분류 중 B29B-017, C08J-011를 대상으로 하여 검색하여 총 534건을 선정하였으며 이를 1974년부터 2002년까지 년도 별, 미국, 일본등 주요 국가별, 주요 회사별, 그리고 관련 기술별로 분류하여 분석하였다. In this paper the world wide patents on the recycle of used polystyrene were inspected. The trends and directions of on going and future technologies on this matter were analyzed. The range of search was limited in the open patents and in DB of U.S.A.(USPTO, DELPHION), Japan(PAJ), Europe(EPO), and Korea(KIPRIS). For the search condition the keyword, polystyrene or PS, and IPC classification, B29-017 and C08J-011 were used. The total of 534 cases was selected and analyzed according to years, countries, companies, and technologies.

When the complaint is received by court, the trial judges have the discretion whether to order the trial date or to order to prepare for the trial. If the judge chooses the latter procedure, it can be done by a form of pleadings or a form of pretrial date. In american civil procedure, not only pleading but also pretrial conference for preparing for trial can be available. They are very useful for the system of preparing for trial. I want to research rule 16 of american Federal Rules of Civil Procedure, which regulates the pretrial conference. American trial judges have the broad discretion to open pretrial conferences. About the trial judge`s positive role to prepare for trial, the pros and cons are asserted in the view of traditional judge`s model, rule of due process, procedural economy and delay. I will research the detailed material of pretrial conferences, including scheduling order, formulating and simplifying the issues, pretrial order, final pretrial conference and orders, Sanctions, and Settlements. I hope that this research could be helpful for improvement of pretrial date practice in Korean civil procedure.

폐 건전지의 재활용에 대한 관련 기술의 추이 및 동향을 조사하기 위하여 특허 출원 검색을 시행하였다. 검색 범위는 공개 특허를 대상으로 하였으며 특허 검색 데이터베이스는 미국의 USPTO 및 DELPHION, 일본의 PAJ,유럽의 EPO,그리고 한국의 KIPRIS를 선정 조사하였다. 폐전지 재활용 관련 키워드는 배터리, 전자 셀, 특허, 재활용, 그리고 IPC분류 중 H01M-006/52 및 H01M-010/54를 대상으로 검색하여 총 2,490건을 선정하였으며, 이를 2단계 필터링 과정을 거쳐 871건 선정하여 최증 분석하였다. 1971년부터 2000년까지 년도별, 주요 국가별, 주요 회사별, 그리고 관련 기술별로 분류하여 분석하였다. In this paper the world wide patents on the recycling of used batteries were inspected. The trend and direction of on-going and future technologies on this matter were analyzed. The range of search was limited in the open patents and in DB of U.S.A.(USPTO, DLPHION), Japan(PAJ), Europe(EPO), and Korea(KIPRIS). For the search condition the keyword, battery, batteries, electric cell, patent, and recycling, and IPC classification were used. The total of 2,490 cases was found at the first search stage, then, through the 2 steps of filtering processes the total of 871 cases was selected for the final analysis. These 871 cases were classified by countries, companies, and technologies between the year 1971 and the you 2000.

隨着全球經濟迅猛發展,中國港口呑吐量也飛速增加. 特別是,浙江省政府對貯波港的支持港口轉換戰略的實施, 使得國際樞紐港흔快的굴起. 貯波港的集裝箱呑吐量從2006年706万標箱到2011年1451万標箱,這5年期其呑吐量增加了100%,成爲全球第六位和中國第3大港口,目前貯波港正在向排名全球第5大港口的釜山港고近. 因此,本硏究分析了貯波港快速成長的秘訣,浙江省政府的三位一體結構,貯波市政府的6個加快政策,擴大內陸地區的腹地,完成多試聯運與集疏運體系,構建綠色港口,最后,由此給韓國港口發展戰略提供參考。
