자유학기제의 확장을 위한 자유학기와 일반학기의 연계 원리 탐색

본 연구는 학생들의 주도적 학습과 역량 증진을 중요한 목표로 하는 자유학기제가 다른 일반학기들과 잘 연계되기 위해서는 어떠한 원리에 기반하여 운영되어야 하는지를 탐색적으로 제시하는 데 목적이 있다. 이를 위해 자유학기 교육활동을 일반 학기와 연계하여 잘 운영하는 학교를 대상으로 교원, 학생, 학부모에 대한 면담 조사를 2015년 4월부터 9월까지 진행하였고, 이 자료를 토대로 자유학기제의 4대 연계 원리를 도출하였다. 자유학기제 4대 연계 원리는 첫째, 구성원의 협력성이다. 둘째, 교육과정의 통합성이다. 셋째, 지역사회 기반의 지역성이다. 넷째, 평가의 혁신성이 다. 마지막으로 자유학기제 연계 원리가 잘 작동될 수 있기 위한 정책적 제언을 제시 하며, 자유학기제의 단절이 아닌 연속성과 확장성이 필요함을 강조하였다. The purpose of this study is to provide an exploration of what principles should be used in order for the Free-semester program, which is an important goal of students leading learning and capacity building, to be well connected with other general semesters. For this purpose, we conducted interviews with the members of the schools which operated well in connection with the general semester, and derived the principle of linkage of the Free-semester program school based on these data. Core principals of linking Free-semester program with general semester as well as operation models were outlined by combining results from survey and case study analysis. The four core operation principals for successful linkage are 1) cooperation of school members, 2) integration of curriculum and 3) strong locality around school, and lastly 4) innovative evaluation method. This paper suggests policy proposals to make the principle of linking Free-semester program work well and emphasizes continuity and extensibility rather than disconnection of Free-semester program.

지방아카이브의 역할 : 일본 지역협의체 활동 사례를 중심으로

This paper examines the characteristic records management activities and meanings of the regional council of the Gunma Prefectural Archives and the Tottori Prefectural Archives. Gunma Prefectural Archives and the Tottori Prefectural Archives have established a cooperation system between the municipalities and the municipalities and have promoted the establishment of the regional archives and developed various methodologies to improve the records management. This case study of the Japanese local archives will provide insights on the direction of the archives of the Korean local archives in the new transition period and the work design, especially the ‘cooperation and cooperation’ program with the local government. 이 논문은 일본 지방아카이브 중에서 군마현립문서관과 돗토리현립공문서관의 지역협의회 사례를 중심으로 특징적인 기록관리 활동과 의미에 대해 고찰한 것이다. 두 지방아카이브는 광역 자치체와 기초 자치체간 협조 체제를 구축하고 기초 자치체 아카이브 설립을 촉진하는 한편 기록관리 개선을 위한 여러 가지 방법론을 개발해서 제시하였다. 이러한 일본 지방아카이브 사례는 새로운 전환기에 들어선 한국 지방아카이브의 기록정책 방향과 업무 설계, 특히 자치체와의 ‘연계·협력’ 프로그램 등에 대한 시사점을 제공해 줄 것이다.

특허법상 분할출원의 공지예외주장- 대법원 2022. 8. 31. 선고 2020후11479 판결을 중심으로 -

If inventors disclose inventions “with their will,” or inventions are disclosed “against their will,” the inventors cannot obtain a patent right for the inventions. The reason is that the inventions have already become public domain. However, it is too harsh for the inventors if they cannot 'always' obtain patent rights. Accordingly, the Patent Act allows inventors to overcome the reason for rejection of lack of novelty under 'certain conditions' even if they file an application for a patent after disclosing the inventions. This is referred to as the ‘grace period exceptions’. According to the Republic of Korea’s Patent Act, if inventors file an application for a patent ‘within 12 months’ from the date of disclosure of inventions, describes the purpose of claiming grace period exceptions in the patent application, and submit the documentary evidence of claiming grace period exceptions within ‘30 days’ from the date of filing the patent, the inventions is regarded as unknown. In the 2020Hu11479 decision, the Supreme Court had decided based on the provisions, words, and purpose of the grace period exceptions and the divisional applications, even if the applicant did not claim for grace period exceptions while filing the original patent application, if the claim was made in compliance with the due procedure, and the original application was filed within 12 months from the date of publication of the inventions, the effect of the grace period exceptions could be recognized. The 2020Hu11479 decision is significant in that the Supreme Court interpreted the grace period exceptions in a way that can effectively protect the applicant's rights as inventors. It can provide a ‘strong motivation’ for inventors to create another invention. The Supreme Court's policy in the 2020Hu11479 decision is a ‘good policy’ that can contribute to the industrial developments of the Republic of Korea. 발명자가 자신이 완성한 발명을 ‘자신의 의사로’ 공개하거나, 또는 자신이 완성한 발명이 ‘자신의 의사에 반하여’ 공개된 경우, 발명자는 당해 발명에 대하여 특허권을 받을 수 없다. 그 이유는 당해 발명은 이미 공개되어 일반대중의 공유재산이 되었기 때문이다. 그러나 이러한 경우 발명자가 ‘항상’ 특허권을 받을 수 없게 된다면, 발명자에게 너무 가혹하다. 이에 특허법은 발명자가 자신이 완성한 발명을 공개한 이후에 특허출원을 하여도, ‘일정 요건’ 하에서 신규성 흠결이라는 거절이유를 극복할 수 있도록 하는 제도를 두고 있다. 이는 ‘공지예외주장제도’라고 칭해진다. 우리 특허법은 발명자가 자신이 완성한 발명을 공개한 날로부터 ‘12개월 이내’에 특허출원을 하면서, 특허출원서에 공지예외주장의 취지를 기재하고, 특허출원일로부터 ‘30일 이내’에 공지예외주장의 증명서류를 제출하면, 당해 발명은 공지되지 않은 것으로 간주한다는 규정을 두고 있다. 2022년 8월 31일 대법원은 2020후11479 판결에서 공지예외주장제도 및 분할출원제도의 규정, 문언, 취지에 근거하여, 출원인이 원특허출원을 하면서 공지예외주장을 하지 않았더라도 분할출원을 하면서 적법한 절차를 준수하여 공지예외주장을 하였고, 원특허출원이 발명의 공개일로부터 12개월 이내에 이루어졌다면, 공지예외의 효과가 인정된다고 판시하였다. 2020후11479 판결은 공지예외규정을 ‘출원인의 발명자로서의 권리를 실효적으로 보호할 수 있는 방향’으로 해석하였다는 점에서 중요한 의의가 있다. 2020후11479 판결에서 대법원이 채택한 법리는 발명자로 하여금 신규성 흠결이라는 거절이유를 분할출원에 대한 공지예외주장을 통하여 극복할 수 있도록 함으로써, 발명자로 하여금 이후 또 다른 발명을 창출할 수 있도록 하는 ‘강한 동기’를 제공할 수 있다. 이는 특허법이 목적으로 하는 혁신을 통한 산업발전에 기여할 수 있다. 결국 2020후11479 판결에서의 대법원의 정책은 우리나라의 산업발전과 경제발전에 기여할 수 있는 ‘좋은 정책(good policy)’이다.
