경찰정당성과 경찰물리력 관계성 연구: 법준수 의무감 매개효과를 중심으로

이 연구는 두 가지를 검증하는 것을 목적으로 설계되었다. 첫 번째는 시민의 경찰정당성과 경찰물리력 수용 인식의 관계를 검증하는 것이 목적이며., 두 번째는 경찰정당성과 경찰물리력의 관계에서의 법준수 의무감의 매개효과를 검증하는 것이다. 연구목적의 달성을 위해 서울시 시민들 539명을 대상으로 온라인 설문조사를 실시하였다. 이후 SPSS 27.0 프로그램과 Macro Process Model 4.2의 Model 4 분석방법을 활용하여 분석하였다. 그 결과 시민의 경찰정당성 인식의 증가는 시민의 경찰물리력 행사의 정당성 인식의 증가로 이어짐을 확인했다. 구체적으로 다차원 경찰정당성, 절차적 공정성, 경찰효과성, 분배적 공정성, 합법성 모두 경찰물리력 행사의 정당성 인식에 유의미한 정적 영향을 미쳤다. 다만 법준수 의무감의 매개효과는 다차원 경찰정당성 하위요인 중 하나에서만 확인할 수 있었다. 연구 결과를 토대로 경찰정당성 인식과 경찰물리력 인식을 제고할 수 있는 방안을 제시하였다. This study was designed to verify two things. The first is to verify the relationship between citizens' perception of police legitimacy and acceptance of police use of force. The second is to verify the mediating effect of the sense of obligation to comply with the law in the relationship between police legitimacy and police use of force. To achieve the research objectives, an online survey was conducted on 539 Seoul citizens. After that, the analysis was performed using the SPSS 27.0 program and the Model 4 analysis method of the Macro Process Model 4.2. As a result, it was confirmed that the increase in citizens' perception of police legitimacy leads to an increase in citizens' perception of the legitimacy of exercising police physical power. Specifically, multidimensional police legitimacy, procedural fairness, police effectiveness, distributive fairness, and legality all had a significant and positive effect on the recognition of the legitimacy of the exercise of police physical power. However, the mediating effect of the sense of legal compliance obligation could be confirmed only in one of the sub-factors of multidimensional police legitimacy. Based on the research results, a plan to raise the awareness of police legitimacy and police physical power was suggested.

경찰정당성과 경찰신뢰 인식 차이에 관한 연구 -LDA 토픽모델링 분석을 중심으로

오늘날 경찰정당성의 개념화에 대한 합의가 부재하다. 심리학적 접근법(Psychological Approach)이라 불리는 전통적인 접근법에서는 경찰신뢰를 통해 경찰정당성을 측정한다. 반면 정치학적 접근법(Political Science Approach)에서는 신뢰와 정당성을 별개의 개념으로 구분하고 있다. 그러나 이러한 논의는 미국과 영국을 중심으로 한 서구사회에서 들어온 개념으로 우리나라 국민들의 경찰정당성을 어떻게 이해하고 있는지에 대한 고려는 포함되어 있지 않다. 이 연구의 목적은 한국인은 경찰정당성과 경찰신뢰를 어떻게 이해하고 있는지 확인하는 데 있다. 연구목적을 달성하기 위해 서울시 성인남녀 539명을 대상으로 주관식 설문을 진행하였다. LDA 토픽모델링 분석을 통해 시민들은 경찰정당성과 경찰신뢰를 어떻게 정의하고 있는지 확인하였다. 분석결과, 경찰정당성에 대한 인식으로부터 “공정한 수사”, “정당한 법집행”, “범죄억제”, “합법성”, “시민보호” 토픽명을 도출할 수 있었다. 경찰신뢰의 경우 “시민보호”, “시민보호”, “공정한 수사”, “청렴성”, “공권력 신뢰” 토픽명을 도출하였다. 이러한 연구결과는 시민들이 경찰정당성과 경찰신뢰를 다양한 시각에서 이해하고 있음을 지지한다. 연구결과 시민들은 대체적으로 경찰정당성과 경찰신뢰를 다른 개념으로 정의하고 있었다. Nowadays, there is no consensus on the conceptualization of police legitimacy. The traditional approach, called the psychological approach (Tylerian method), measures police legitimacy through trust in the police. On the other hand, the political science approach distinguishes trust and legitimacy as separate concepts. However, this discussion does not include consideration of how the Korean people understand the legitimacy of the police, as it is a concept introduced from Western society, especially the United States and the United Kingdom. The purpose of this study is to verify perceptions of police legitimacy and trust in the police among adult men and women in Seoul. To achieve the purpose of the study, a subjective survey was conducted on 539 adult men and women. Through LDA topic modeling analysis, we confirmed how citizens define police legitimacy and trust in the police. As a result of the analysis, it was possible to derive the topic names “fair investigation,” “legitimate law enforcement,” “crime suppression,” “legitimacy,” and “citizen protection” from perceptions of police legitimacy. In the case of trust in the police, the topic names “Citizen Protection”, “Citizen Protection”, “Fair Investigation”, “Integrity”, and “Trust in Public Power” were derived. These research results support that citizens understand police legitimacy and trust in the police from various perspectives. Based on the research results, we proposed a conceptualization and measurement method for police legitimacy.

경찰 정당성이 법의식에 미치는 영향에 관한 연구

Law-abiding acts have become a major subject of research in police science because it is an vital element of social control. The law-abiding acts are active or passive depending on drivers behind them. While passive law-abiding acts using compensation and punishment are temporary and unstable, active law-abiding acts due to legitimacy are voluntary and long-term because they are related to an individual's internal attitude. Thus, causes and consequences of police legitimacy have been studied in police science. However, the fact that only law-abiding acts were discussed as a result of police legitimacy was considered as a limitation. This is because behind the law-abiding acts, which start with police legitimacy, there is an internal value judgment on the law and criminal. Hence, this study included law-abiding acts and internal value judgment as a higher concept of legal consciousness and then verified the influences of police legitimacy. Multiple regression analysis shown that police legitimacy had a statistically significantly positive effect on law-abiding acts only. Although police legitimacy did not arouse legal favorability, the importance of legitimacy was not denied as it still induced the law-abiding acts.

지역주민들의 경찰정당성 인식에 영향을 미치는 요인에 관한 연구

이 연구의 목적은 경찰정당성에 대한 지역주민들의 인식에 영향을 미칠 수 있는 요인들을 분석하는데 있었다. 경찰정당성은 시민의 경찰협조 및 법규범 준수행동에 영향을 미칠 수 있는 중요한 요인이므로 연구의 필요성이 존재한다. 이에 연구의 수행을 위해 기존 문헌의 검토를 통해 경찰정당성의 개념과 영향요인에 대하여 논의하였다. 통계적 분석을 위해 대구시 주민을 대상으로 실시한 설문자료를 이용하였다. 통계분석 결과 이론적 모델들 중 지역맥락모델이 가장 일관되게 지지를 받는 결과를 보여준 반면 다른 모델들은 부분적인 지지를 받는 것으로 나타났다. 개인적 특성 중에서 연령은 경찰정당성에 대한 주민들의 인식을 유의미하게 예측하는 것으로 나타났으나 다른 인구학적 특성 변인들(성별, 교육정도, 주택소유여부, 거주기간)은 아무런 영향이 없었다. 삶의 질 관련 상황모델의 결과는 기존 연구결과와는 달리 무질서가 경찰정당성과 관련이 없는 반면 직접적인 재산 및 폭력범죄피해 경험과 범죄피해 가능성에 대한 인식은 경찰정당성에 부정적인 영향을 주었다. 마지막으로 지역사회 유대와 애착이 강하다고 인식하는 주민들은 경찰정당성을 긍정적으로 인식함으로써 지역사회의 결집력의 중요성을 보여주었다. This primacy purpose of this study was to examine the factors influencing the residents' perception of police legitimacy. Previous studies on public opinion in the police have not taken an attention on the issue of police legitimacy. The data collected from 710 respondents in Dea-gu City were used in the statistical analyses. According to the results, community context model was the best predict model among theoretical models explaining the effects of police legitimacy. Among demographical characteristics, age showed a positive significant effect on police legitimacy while other demographic variables, including gender, education, home-ownership, length of living fail to show significant effects. Unlike previous research findings, disorder as a main variable in the situational model related to quality of life failed to show direct impacts on police legitimacy. However, property and violent victimization experience and the risk of victimization successfully showed negative significant effects on police legitimacy. Finally, community cohesion and attachment have an impact to increase police legitimacy of residents so that community solidarity is one of the most important predictor to understand police legitimacy.

북한이탈주민의 경찰에 대한 정당성 인식의 구조적 관계 검증

이 연구는 북한이탈주민의 경찰에 대한 정당성 확보를 위한 선행요인으로 절차적 공정성 요인을, 결과요인으로 경찰 지시순응 요인으로 이들 요인간 구조적 관계를 확인하는 것을 목적으로 한다. 구체적인 연구방법은 구조방정식모형을 활용하였으며, 분석결과는 다음과 같다. 첫째, 북한이탈주민의 경찰에 대한 절차적 공정성은 경찰 정당성에 긍정적인 영향을 미치는 것으로 나타났다. 둘째, 북한이탈주민의 경찰에 대한 정당성은 경찰 지시순응에 긍정적인 영향을 미치는 것으로 나타났다. 셋째, 북한이탈주민의 경찰에 대한 절차적 공정성은 경찰 지시순응에 긍정적인 영향을 미치지 않는 것으로 나타났다. 마지막으로, 북한이탈주민의 경찰에 대한 정당성은 절차적 공정성 요인과 경찰 지시순응 요인간 영향관계에서 완전매개효과가 있는 것으로 나타났다. 이 연구는 경찰 정당성 확보에 관한 연구를 북한이탈주민을 연구대상으로 하여, 경찰에 대한 정당성 확보에 미치는 선행요인과 확보 이후의 결과 요인에 일부 영향관계를 제시했다는 점에서 의의가 있다. 이러한 연구의 결과에도 불구하고 표본수와 표본선정 방식, 그리고 횡단연구의 한계점 역시 도출되었다. The study of procedural fairness factors leading factor for ensuring the legitimacy of the police defectors, as a result of these factors, factors require compliance with police instructions aims to determine the structural relationship between human beings. Specific research method was utilized for structural equation modeling, analysis results were as follows. First, The procedural fairness for the police of North korean refugees was found to have a positive impact on police legitimacy. Second, The police legitimacy of North korean refugees was found to have a positive impact on police compliance. Third, The procedural fairness for the police of North korean refugees was not found to have a positive impact on police compliance. Finally, The police legitimacy of North korean refugees are conformed to have a full-mediated effects relationship between procedural fairness and police compliance. This study is significant in that it suggests some influence factors of the results obtained since the antecedents and on to the study defectors research on the police to secure justice, ensuring the legitimacy of the police. Despite the results of the sample size of these studies and the sample selection method, and also the limitations of cross-sectional studies have been derived.

시민의 법률준수 및 경찰협력에의 영향요인: 경찰 정당성 이론을 중심으로

이 연구의 목적은 주로 미국, 영국, 호주 등에서 연구되어 왔던 경찰 정당성 이론을 우리 나라의 경찰활동 상황에서 검증하기 위해서, 경찰 정당성 인식, 경찰 효과성 인식, 시민의 법률준수 및 경찰협력 의도 간의 인과관계를 실증적으로 분석하고, 특히 경찰 정당성 인식이 경찰 효과성 인식과 시민의 법률준수 및 경찰협력 의도 간의 관계에서 매개효과를 갖고 있는지 여부를 분석하고, 시민의 경찰 정당성 인식을 향상시키기 위한 정책적 함의를 제시하는 것이다. 이 연구의 통제변수로서 성별, 연령, 소득수준, 집합적 유효성 인식, 사회적 정체성 인식이 활용되었다. 이 연구를 위한 데이터는 2018년 12월 1~10일 동안 온라인 서베이 업체를 통해서 8개 특별시 및 광역시에 거주하고 있는 19세 이상 80세 미만의 시민 505명으로부터 수집되었다. 다중회귀분석의 결과는 경찰 정당성 인식, 사회적 정체성 인식이 시민의 법률준수 의도에 통계적으로 유의한 영향을 미치고, 경찰 정당성 인식, 집합적 유효성 인식, 사회적 정체성 인식이 시민의 경찰협력 의도에 통계적으로 유의한 영향을 미치는 것을 보여주었다. 특히, 경찰 정당성 인식은 경찰 효과성 인식과 시민의 법률준수 및 경찰 협력 의도간의 관계를 매개하는 효과를 갖고 있었다. The purpose of this study is to test the police legitimacy theory in policing context of South Korea, which has been studied in the United States, the United Kingdom, and Australia. In particular, this study empirically analyzes the causal relationship between police legitimacy, police effectiveness, and public compliance with law and public cooperation with police. The study also analyzes whether police legitimacy has a mediating effect between police effectiveness and public compliance with law and public cooperation with police and suggests policy implications to improve public perceptions of police legitimacy. The data for this study were collected from 505 people aged 19 to under 80 living in eight metropolitan cities in South Korea through an online survey company during December, 2018. The multiple regression analyses showed that the perception of police legitimacy had a statistically significant and positive effects on public compliance with law and public cooperation with police. In particular, the perception of police legitimacy had the effect of mediating the relationship between police effectiveness and public compliance with law and public cooperation with police. Therefore, if police institutions want the public to comply with law and cooperate with the police actively, they first need to make the efforts to develop the perception of police legitimacy through effective police practices and policies in South Korea.

경찰의 절차적 공정성이 시민 협조와 법 준수를 통해 범죄억제 효과성에 미치는 영향 : 경찰의 강압적인 수단과 시민의 자발적 복종 모형 간의 차이 검정

본 연구는 경찰의 절차적 공정성, 시민 협조와 법 준수, 범죄억제 효과성 간의 인과관계에 있어서 경찰의 강압적인 수단인 처벌과 시민의 자발적 복종을 유도하는 경찰 정당성 간의 영향 차이를 검정하고자 한다. 이를 위해 경찰의 강압적인 수단 모형인 경찰의 절차적 공정성-처벌-시민협조·법 준수-범죄억제 효과성 경로를 그리고 시민의 자발적 복종 모형인 경찰의 절차적 공정성-경찰 정당성-시민협조·법 준수-범죄억제 효과성 경로를 설정하였다. 분석결과, 경찰의 절차적 공정성, 처벌, 경찰 정당성, 시민 협조, 법 준수, 그리고 범죄억제 효과성 간에는 통계학적으로 유의미한 인과구조가 존재하는 것으로 나타났다. 이런 인과적 구조에서, 처벌을 중심으로 한 경찰의 강압적 수단 모형과 시민 협조를 중심으로 한 시민의 자발적 복종 모형 간에 분명한 차이가 존재하는 것을 확인할 수 있다. 특히 시민 협조에 있어서 경찰의 강압적 수단 모형과 시민의 자발적 복종 모형 간에 상반되는 결과가 도출되었다. 분석결과를 토대로 본 연구는 경찰의 법 집행의 공정성과 경찰의 권위 및 법 집행의 정당성 제고를 통해 시민의 자발적 복종을 유인하기 위한 제도적·행태적 개선방안을 제시하였다. This study is to investigate causal relationships among procedural justice, sanction, police legitimacy, police cooperation, compliance, and criminal deterrence. In line with this perspective, this study includes police's coercive force model and public voluntary obedience model to examine the effects of sanction and police legitimacy on the causal relationships between police cooperation, compliance, and criminal deterrence. This study employs a survey questionnaire to evaluate the effects of police's coercive force model and public voluntary obedience model on the causal relationships between police cooperation, compliance, and criminal deterrence. A 31-item survey questionnaire was administered to 400 residences in 2 metropolitan cities and 2 provinces, collecting 249 questionnaires, of which were used 193 to conduct a statistical analysis. The research data are analyzed by using structural equation model. As the result of analysis, the total effects of public voluntary obedience model on the causal relationships between police cooperation, compliance, and criminal deterrence are higher than ones of police's coercive force model. This study can find that police legitimacy is more effective than police’s sanction to citizens by promoting citizen cooperation with police and compliance for criminal deterrence. In the causal relationship, it shows that procedural justice, sanction, police legitimacy, police cooperation, and compliance have positive influences on criminal deterrence, which means that police’s sanction and police legitimacy can play roles of a control mechanism to reduce and deter crimes in a society. In particular, the analytical result highlights that police organizations should establish alternatives for enhancing procedural justice and police legitimacy to effectively deter crimes by triggering police cooperation and compliance.
