        건설하도급분쟁에 대한 대응노력이 경영성과에 미치는 영향에 관한 연구: 기업 내부 대응노력과 외부 전문 컨설팅 효과 비교를 중심으로

        This study starts with the aim of discovering how the implementation of professional risk management consulting outside the enterprise has a different impact on management performance than internal education or organizational response to various disputes related to construction subcontracting in the construction industry sector before or during the dispute process. The subject of analysis of this study is the basic target of efforts to cope with various subcontracting issues arising from the two groups of original and supply-demand businesses that are parties to the construction subcontract dispute. It analyzed how internal response methods such as internal response organizations, response education and detailed response systems, and external dispute response efforts such as management, risk management, and legal response consulting affect financial and non-financial management performance. These factors impact on performance, especially between supply and demand and a sergeant major carriers to analyze whether any difference. The internal and external business using multiple regression analysis model for the response the number of non-financial and financial management is (independent variable) analyzed the impact on performance (subordination variable). According to the analysis, the impact of the recognition of construction subcontract disputes and internal and external response efforts on management performance was relatively high for the original contractors compared to the supply and demand businesses. In particular, the case of original operators was relatively higher than that of supply and demand service providers when it came to the effect on management performance by the degree of internal response activities and outside consulting assistance. This means that the conditions of the supply and demand businesses in the construction industry are relatively poor compared to the management environment of the original operators, so that they have a lower awareness of disputes compared to internal and external activities and their effects on internal and external efforts and management performance. Implications here the response focused on the subcontractor support policy in the conflict in reality, a sergeant major for professional consulting services, go ahead. 본 연구는 건설산업 분야에 있어서 건설하도급과 관련한 다양한 분쟁에 대해 발생 이전 혹은 분쟁 진행 과정 중 내부적인 교육이나 조직적 대응에 비해 기업 외부의 전문 리스크관리 컨설팅 추진 등이 경영성과에 어떻게 다른 영향을 미치는지를 밝혀보고자 하는데서 출발하고 있다. 본 연구의 분석대상은 건설하도급 분쟁 당사자인 원사업자와 수급사업자 간의 두 집단에서 발생하는 다양한 하도급분쟁 사안에 대한 대응 노력이 기본적 대상이다. 건설기업에서 분쟁대응 방법으로 내부대응조직, 대응교육, 세부대응체계 등 내부적 대응방법과 경영관리, 리스크관리, 법적대응 컨설팅 등 외부적 분쟁 대응 노력이 재무적, 비재무적 경영성과에 어떻게 영향을 미치는지를 분석했다. 특히 원사업자와 수급사업자 간에 이러한 경영성과에 미치는 영향요인들이 어떠한 차이가 나는지를 분석한다. 이를 위해 다중회귀분석모형을 이용해 기업내적, 외적 대응변수(독립변수)가 재무적 비재무적 경영성과(종속변수)에 미치는 영향을 분석했다. 분석 결과, 건설하도급 분쟁에 대한 인식과 내·외부적 대응 노력이 경영성과에 미치는 영향은 원사업자들이 수급사업자들에 비해 상대적으로 높게 나타났다. 특히 기업 내적 대응 활동과 외부컨설팅 도움 정도에 의한 경영성과에 대한 영향에 있어서도 원사업자의 경우가 수급사업자에 비해 상대적으로 높았다. 이는 건설선업 분야에서 원사업자의 경영 환경에 비해 수급사업자의 여건이 상대적으로 열악하여 내·외부적 활동과 영향에 비해 분쟁에 대한 인식이 낮고, 분쟁 대응 내·외부적 노력과 경영성과에 대한 영향도 낮을 수밖에 없다는 사실을 의미한다. 여기서의 시사점으로는 분쟁대응 지원정책이 수급사업자에 집중되고 있는 현실에서 원사업자를 대상으로 하는 전문컨설팅 등을 추진하면 지원효과가 높을 것이라는 점과 그 필요성을 함의하고 있다.

        건설하도급분쟁에 대한 외부적 대응노력(컨설팅)의 효과에 대한 연구

        The purpose of this study is to find out how any organizational response or dispute-related consulting has a significant impact on management performance before or during a dispute over a construction subcontract dispute. In this study, multiple regression models were used to analyze the impact on consulting performance. According to the result of the analysis, the positive effects on the overall external consulting effect is influenced by five variables such as financial values, increase of the number of disputes, construction of response system by contents, construction of response system in each period, dispute response external response system. The original business operators were also more likely to be affected by internal activities of conflict response companies and the extent to which external response systems were established. This means that the supply and demand service provider's business environment is relatively poor, forcing it to be lower than the internal and external activities and influences of the original business operators of the conglomerates.

        ADR에 의한 건설분쟁해결의 문제점과 개선방안

        There are two methods to resolve conflicts related to constructions which are through lawsuits and ADR (Alternative Dispute Resolution) just like any other conflicts. Along with the special characteristics pertaining to the conflicts related to constructions, the advantages that ADR is in possession of such as its cost, duration and professionalism, resolving conflicts through ADR has been considered to be more logical than any other options recently. In Korea’s case at present, the resolution of conflicts regarding constructions through ADR is mostly dependent on administrative mediation or through arbitration. However, in the case of the administrative mediation, its usage rate is very low due to problems caused by problems in its running and effectiveness. In the case of arbitration, the services of the Korean Commercial Arbitration Board is comparatively used more but because of the fact that arbitration relies on a single trial system and the fact that its executive powers while having the same effectiveness as the final ruling does not get acknowledged leads to the phenomena of avoiding its usage. In addition, in relation to the selective arbitration clause, the problem of effectiveness of the arbitrative agreement is becoming a hindrance to the activation and promotion of the arbitration process. Furthermore, in the case where the ordering body is the government, the public servant involved in the case avoiding the arbitration process because of concerns of being penalized by the internal and external audit within the institution is becoming a problem as well. These problems are not only limited to conflicts regarding constructions and there needs to be actions taken to promote the activation of ADR by enacting a basic law. The more important issue at hand however is offering a resolution measure that would be the most appropriate for users and this could probably be done only through actions such as implementing the American partnering system or the dispute adjudication board system so that they can supervise the resolution of conflicts through mediation, arbitration, and assistance as well as offering consultations regarding conflicts related to constructions.

        건설분쟁조정제도의 통일성 제고 방안

        우리나라의 행정법상 조정제도에 있어 사인간의 분쟁 조정을 규율한 최초의 법률은 (구)「건설업법」(법률 제614호, 1961. 5.5 시행)이라고 할 수 있다. 이는 건설공사의 복잡․다양한 구조 및 개별 건설공사의 전문성․특수성에 기인한다. 특히 대부분의 건설공사는 하도급거래를 통하여 이루어지고 있는바, 경제적 약자인 하수급인과 수급인 사이의 분쟁이 발생한 경우 신속․저렴한 분쟁해결수단을 위하여 건설분쟁조정제도가 활용되고 있다. 건설분쟁조정제도는 「건설산업기본법」상 건설분쟁조정위원회, 「하도급거래 공정화에 관한 법률」상 하도급분쟁조정협의회로 이원화되어 있다. 양 분쟁조정기관 모두 행정청이 분쟁기관을 제공하는 행정법상 조정제도이며, 사인간의 분쟁을 대상으로 하고 있다. 이렇듯 이원화되어 있는 건설분쟁조정제도는 「하도급거래 공정화에 관한 법률」상 하도급분쟁조정협의회의 조정에 재판상 화해의 효력을 인정하고, 「건설산업기본법」상 건설분쟁조정위원회에 행정쟁송에 대한 조정 권능을 부여함으로써 통일성을 기할 수 있다. The Previous Construction Business Act(Act No. 614, May 5, 1961) is first legal mediation system of administrative law governing the dispute between the private in korea. This is due to the professionalism and uniqueness of the complex, diverse structure and individual construction of the construction works. Especially, most of the construction works is being done through a subcontract transactions, if the dispute encountered between the contractor and socioeconomically disadvanteged subcontractor is being used for quick and inexpensive construction dispute resolution system. Construction Dispute Resolution system is dual to the Construction Dispute Conciliation Committee on "Framework Act on the Construction Industry" and Subcontract Dispute Mediation Council on "Fair Transactions in Subcontracting Act. Both dispute resolution institutions have for between private's disputes as administrative law disputes mediation system provides administrative agency. As such, construction dispute resolution system can be unity by conceding effect as a judicial compromise to Subcontract Dispute Mediation Council on "Fair Transactions in Subcontracting Act and giving mediation authority to Administrative Suit of Construction Dispute Conciliation Committee on "Framework Act on the Construction Industry.
