준강간의 불능미수 - 대법원 2019. 3. 28, 2018도16002, 전원합의체 판결을 중심으로-

With sexual crimes after drinking frequently reported among acquaintances in recent years, the Supreme Court has made a rather unusual ruling: an impossible crime of the quasi-rape. The gist of the Supreme Court's ruling is that even if the victim was not “in a state of condition of unconsciousness or inability to resist,” if the defendant mistakes the victim for being in such a state, it constitutes an inability of Article 27 of the Criminal Law. Since crimes committed under the influence of alcohol among acquaintances, neither the actor nor the victim has the ability to distinguish things and make decisions, and the degree of individual difference, the room for dispute exists. This paper reviews the issue of the 2018Do16002decision by the Supreme Court and proposes its own solution. It was questionable whether the concept of an impossible crime of the quasi-rape was a viable one. And it came to the conclusion that quasi-rape is not a crime of result, but a crime of action, contrary to the conventional view. It also stands to say that it is possible to establish an criminal attempt against a crime of action. However, it is concluded that it is impossible to establish an impossible crime. 본고에서는 2018도16002 전원합의체 판결의 사안에 대하여 검토해 보고, 나름대로의 해결 방안을 제시하고 있다. 준강간의 불능미수라는 개념이 도대체 성립 가능한 개념인지에 관하여 준강간죄와 불능미수의 본질과 성립요건에 관하여 논한 후, 대상판결에 나타난 대법관들의 의견에 관하여 검토하고 대상판결의 사안에 관한 본고 나름의 해결방안을 도출한다. 대상판결은 제1심에서 검사측이 강간죄로 고소를 하고도 제대로 이를 입증하지 못하였고, 검사측이 준강 간, 준강간의 불능미수로 공소장변경을 하면서 여러 논의가 이루어진 판결로 보인다. 본고의 기본적인 입장은 대법원의 반대의견의 결론을 지지하나, 반대의견도 논리적인 결함이 존재하는 것 같아 그런 점 때문에 다수의견을 설득하지 못한 점이 아쉽다. 특히 대법원의 논의에서는 준강간죄와 불능미수의 본질에 이해의 방식이 다양하게 나타나는데, 본고에서도 이번 판결을 계기로 준강간죄의 거동범적 성질에 초점을 맞추어 미수범 성립여부를 검토해 보았다. 또한 이 사안은 다른 범죄가 성립할 수 있지 않은지에 대한 판단을 했었어야 하고, 본고에서는 검사 의 최초 기소대로 강간죄가 인정되어야 한다는 입장이다. 사회의 변화에 맞추어 법의 해석도 변화되고 판결의 모습도 변화되기를 기대해 본다.

자기를 실현한다는 것은 자신의 고유한 내적 특질을 목적론적으로 실현해 간다는 것을 의미하는 것이 아니라 자신이 원하는 자기로 만들어간다는 것을 의미 한다. 융의 경우에는 인간 안에는 자기를 실현하고자 하는 근본적인 추동력이 있다 고 보는데 이는 야스퍼스 실존철학에서 ‘알 수 없는 심연’인 인간이 밝혀지지 않은 어두운 근원의 소리에 충실하면서 스스로를 방향지워나가는 정향력에 따라 자신을 구성해갈 수 있다고 하는 것과 같은 맥락이다. 융은 진정한 자기로 살기 위해서는 페르조나를 벗어야 하며 무의식의 암시적인 힘에서 벗어나야 한다고 주장했는데 철 학상담은 무의식의 암시적인 힘에서 벗어나고 페르조나를 벗는 과정을 효과적으로 도울 수 있다. 철학상담의 과정에서 자기 자신에 대해 비판적 사고를 적용하다보면 내담자는 자신의 생각에서 논리가 작동하는 영역과 논리가 작동하지 않는 영역을 구분할 수 있게 된다. 철학상담은 이 과정에서 논리가 작동할 수 있는 영역에 대해 서는 ‘논리를 비틀고 들어오는 심리’의 문제를 제어하여 논리가 더 잘 작동하게 하 고, 반대로 논리가 작동하지 않는 영역은 그 자체로 존중하는 태도를 갖추게 할 수 있다. 철학상담이 성공적으로 진행될 경우, 내담자는 인간의 모든 비논리의 밑바탕 에는 ‘타인으로부터 인정받고 싶음’이라는 욕구가 있고 이 욕구는 외로움과 공허감 을 피하고 싶은 욕구이며 결국 이는 죽음을 회피하고 싶은 마음이라는 통찰에 이 르게 된다. 인간은 살아가는 과정이 곧 죽어가는 과정이라는 실존적 조건에 직면해 야만 무의식의 의식화 과정을 더 촉진할 수 있다. 철학상담은 내담자가 실존적 조 건에 직면하고 무의식을 의식화하도록 도움으로써 자기실현의 길을 걷도록 도울 수 있다.

Myths reveal the mentality of the groups who create it, through their characters and the events. In ‘Okunynusi’, there are many symbolic characters such as the obedient . and fainthearted ‘Ohonamuchi’, the ruthless ‘Yasogami’, the rabbit prophet, the princess ‘Inaba’ who recognizes Ohonamuchi’s potential, the devoted mother, the dam Goddess who has healing power, ‘Sesaeribum’ who helped ‘Ohonamuchi’ in passing the tests, ‘Sesaono’ who gave rough tests to ‘Ohonamuchi’, and a mouse. Each character symbolizes the group mentalities and the needed object of ancient Japanese people. The rite of passages Ohonamuchi takes in the process of becoming a hero symbolizes the difficulties that Japanese people had to overcome until the founding their country. And Okunynusi’s process of becoming a powerful founder from the humble, weak, and fainthearted ‘Ohonamuchi’ symbolize the mental development of Japanese people. Japanese people of the primitive ages have barely survived because of the rugged environment and enemies. And they suffered from an persecution anxiety. And in the process of venturing to survive, ‘Ohonamuchi’ -the symbol of the Japanese people-received help from holy assistants(the Mother, a rabbit, the princess ‘Ibana’, ‘Sesaeribum’, the treasure and the horse of ‘Sesaeribwn’, and a mouse). Through their assistance, ‘Ohonamuchi’ overcome the persecution anxiety on the ruthless ‘Yasogami’, and he rums into a heroic figure with a coherent mentality. In this story, there are many assistants who have supernatural energy that supplement the mental unbalance of Japanese people. It reflects the environmental and mental deficiency of Japanese people in those days. ‘Okunynusi’ should be the ideal model who compensates the Japanese people’s inferiority who were in a state of ‘Ohonamuchi’.
