        탈모관리 서비스품질이 서비스가치와 고객만족도 및 애호도에 미치는 영향 -헤어살롱과 병원을 중심으로-

        This study is for improvement of the service quality of the hair loss treatment business, so it aimed at customers who use the hair loss treatment. And it also has an aim to present a direction of the customer developing strategy and an improvement of the service quality of the hair loss treatment business as showing influences on the customer loyalty by measuring and analyzing of the service value and the customer satisfaction and understanding of the service quality which customers perceive. The subjects of this study are located in the Metropolis of Seoul and other Metropolitan cities, and to customers of the hair loss treatment who visit hair salons and medical clinics for the hair loss treatment, This study used a method of questionnaire. First of all, set up seven research hypotheses and surveyed 46-questions for 700 customers. A result of this study is as follows. In a result above, we could recognize that the service quality factors of the hair loss treatment influence the service value or the customer satisfaction and the customer loyalty positively. This means that when the service quality value or the satisfaction is high, the customers who use the hair loss treatment could be loyal customers with the high customer loyalty. And it could be also understood that when general service quality increase, the accompany increase of the service value or the customer satisfaction could make the customer loyalty high. In this result, This study concluded that salons would develope the management programs not for the customers in proceeding of the hair loss but for the customers in sign status of the hair loss in purpose of prevention of the hair loss. However, the hair loss treatment in medical clinics usually helps the customers in proceeding of the hair loss. This phenomenon is analyzed that the customer service and the treatment circumstances are important as well as the medical treatment and shows that the medical clinics should be fulfilled in various and continuous education support for developing the treatment service of professional and technical manpower.

        SERVPERF 모형을 적용한 재활치료서비스의 질과 만족도 조사

        본 연구는 SERVPERF 모형을 적용하여 권역별 보훈이용자의 특성에 따른 재활치료서비스의 질과 만족도를 확인함으로써, 질 높은 재활치료서비스를 위한 기초자료를 제공하고자 하였다. 연구 기간은 2017년 2월 6일부터 3월 31일까지, 연구 대상은 권역별 보훈병원 이용자 684명이었다. 연구결과, 서비스이용자의 일반적 특성 중 지역이 재활치료서비스의 질에, 월 소득과 지역은 재활치료서비스의 만족도에 영향을 미쳤고, 서비스이용자의 재활치료서비스 이용 특성 중 재활치료에 대한 중요도, 대기시간, 치료비 부담의 정도가 재활치료서비스의 질에, 재활치료에 대한 중요도와 치료비 부담의 정도는 재활치료서비스의 만족도에 영향을 미쳤다. 따라서 보훈병원은 이용자의 영예로운 삶과 더 나아가 지역사회 주민의 국민건강권을 보장하는 전문공공의료기관이다. 권역별 보훈병원은 지역 간의 재활치료서비스 편차를 줄이기 위해 이용자 중심의 전문 인력확충, 장비교체 및 보완, 첨단화시스템에 따른 특화된 전문재활치료 프로그램의 구축 및 운영을 권장해야 하고, 월 소득별 치료비 부담을 줄일 수 있는 지원제도를 재정립해야 할 것이다. 더불어 병상의 수 및 인력 부족 등으로 대기시간이 길어지고 있는 경우나 퇴원 후 지속적인 사후 관리를 위해서는 원격재활상담 및 치료, 교육등의 재활치료서비스를 제공해야 할 것으로 사료된다. This study intended to provide basic materials on high-quality rehabilitation treatment services for veterans by examining the quality of rehabilitation treatment services provided to them and their degree of satisfaction with such services according to the characteristics of veterans through the application of SERVPERF model. The research spanned from February 6 to March 31, 2017. The subjects of this study were 684 rehabilitation service users at the Korea Veterans Hospitals. The results were that among the general characteristics of service users, their living area affected the quality of rehabilitation treatment services, and monthly income and their living area influenced their degree of satisfaction with rehabilitation treatment services, and among the characteristics of the service users" utilization of rehabilitation services, the importance of rehabilitation treatment, waiting time, and treatment cost had effect on the quality of rehabilitation treatment services, and the importance of rehabilitation treatment and treatment cost incurred by them had influence on their degree of satisfaction with rehabilitation treatment services. Therefore, a Veterans Hospital is a specialized public medical institution that guarantees its users` honorable life and further the right of its local community residents` public health. A Veterans Hospital by each area expand professional human resources centered on users, replace and complement equipment, and establish and operate specialized rehabilitation treatment programs through the modernization of the system in order to reduce differences in rehabilitation treatment services by each Veterans Hospital, and reestablishment of the support system to reduce treatment cost incurred by veterans in consideration of their monthly income is considered necessary. Furthermore, rehabilitation services such as remote rehabilitation counseling, treatment and education should be provided in cases of long waiting time due to the limited number of beds and insufficient manpower or for continuous follow-up after discharge.

        중국 의료미용 수요자를 위한 전문병원 서비스 개발 방향 연구

        경제성장과 문화의 발달로 생활수준이 향상되면서 현대인들은 아름다움에 대한 욕구를 추구하고 있다. 중국에서도 의료미용의 수요가 날로 커지면서 의료미용 시장이 급증하고 있지만 중국 수요자의 잠재된 요구파악에 대한 조사는 부족한 상황이다. 본 연구는 중국 의료미용 시장 현황을 파악하여 수요자들의 잠재된 요구를 발굴하고 중국 의료미용 수요자 요구에 맞춘 서비스 방향을 도출하도록 목적이 있다. 중국 수도권인 경·진·기(京津冀)도시권의 의료미용 서비스 수요자를 대상으로 연구를 진행하였다. 현장조사와 관계자 인터뷰를 통하여 기존의 유·무형 의료미용 서비스 현황을 파악하고 508명의 의료미용 수요자를 대상으로 의료미용의 선택요소, 의료미용 서비스에 대한 설문조사를 실시하였다. 의료미용 시장의 현황과 설문조사 결과를 참조하여 분석한 결과 의료 미용 전문병원 서비스의 문제점은 주로 무형서비스인 성형 후기를 올리는 단계에서 나타났고, 수요자의 잠재된 요구는 예약, 접수, 상담 중과 상담 후 단계에서 특히 심리적 배려와 유형서비스 부분에서 발견되었다. 성형후기 단계는 의료미용 경험자의 마지막 경험이자 수요자의 첫 경험이 되는 중요한 서비스 단계로서 의료미용 수요자, 경험자, 전문병원이 상호작용하고 잠재 소비자를 유인할 수 있는 의료미용 소통 플랫폼 개발방향을 도출 하였다. 또한 의료미용의 최종단계와 시작단계가 다시 연결, 순환할 수 있는 원상의 의료미용 전문병원 서비스 체험 단계를 도출하였다. 급증하는 중국 의료미용 시장의 수요자들이 더욱 만족스러운 의료미용 서비스를 향유하고, 경험자의 서비스경험이 의료미용 전문병원에도 도움이 되는 상생 관계를 이룰 수 있기를 기대한다. As the standard of living has improved due to economic growth and cultural development, the modern people are trying to satisfy their needs for beauty. Also in China, as the demand on medical beauty treatment has increased, its market is rapidly growing, but there is lack of investigation on Chinese consumers’ potential requirement. Thus, the purpose of this study is to grasp the current state of the medical beauty treatment market of China, excavate consumers’ potential requirement, and suggest the direction of service development reflecting Chinese medical beauty treatment consumers’ requirement. The current state of tangible and intangible types of medical beauty treatment service was examined through field investigation, and a survey was conducted on the choice elements of medical beauty treatment and medical beauty treatment service targeting 508 consumers of medical beauty treatment. As a result of the analysis, most problems of medical beauty treatment service by special hospitals occurred in the stage of posting comments on plastic surgery, and consumers’ potential requirement was found in the stages of reservation, reception, consultation, and after consultation. As the stage of posting comments on plastic surgery is the last experience of the experienced and the first experience of consumers, the direction of the development of communication platforms for medical beauty treatment was proposed so that medical beauty treatment consumers, the experienced, and special hospitals could interact with one another attracting potential consumers. In addition, unlike the existing linear process, circular communication service direction was proposed so that the final stage and the beginning stage of medical beauty treatment could connect with each other and circulate again. This study expects that the consumers of the growing medical beauty treatment market in China could enjoy medical beauty treatment service more satisfactorily, and that the service experience of the experienced could make a win-win relationship with special hospitals providing medical beauty treatment

        장애아동 재활서비스 지원 사업 실태 및 개선방안

        본 연구는 장애아동 재활서비스 지원사업의 일환인 발달재활서비스와 치료지원 의 지원실태 및 이용자의 서비스 이용 실태를 파악하여 문제점을 분석하고 이에 따 른 개선방안을 제시하는 연구이다. 이를 위해 한국보건복지정보개발원의 사회서비스 전자바우처 시스템에서 결제가 이루어진 500만 건의 데이터를 대상으로 전국의 1,535개의 발달재활서비스 제공기관과 8,901명의 발달재활서비스 제공인력, 55,556명 의 이용자들을 분석대상으로 하였다. 또한 교육부의 치료지원 서비스의 경우 치료지 원 대상자 6,483명, 치료지원 이용자 40,401명, 659개의 치료실 현황자료를 활용하여 분석하였다. 분석결과 발달재활서비스 제공기관 유형은 언어재활이 1,359개소로 가장 많았고, 바우처 1회 평균 결제금액은 26,465원으로 이용자 1인당 연 평균 이용 금액 은 1,649,210원, 서비스 이용은 지적장애유형이 55.6%를 차지하고 있었다. 치료지원을 받는 대상자는 물리치료 3,535명(54.5%), 작업치료 2,948명(45.5%), 치료지원 외 서비 스의 경우 언어치료가 17,491명(44.8%)으로 가장 많았으며, 치료지원 이용자 총 40,401명 중 약 80% 정도인 32,415명이 1개의 영역에서 치료지원을 받고 있으며, 나 머지 20%는 중복수혜를 받고 있었다. 이를 통해 발달재활서비스-치료지원 수혜자격 의 불일치, 발달재활서비스 제공인력의 자격강화, 발달재활서비스-치료지원 서비스의 이원화된 전달체계 문제, 각 시도에 따른 치료지원 제공방식의 상이함 등이 관련쟁 점으로 부각되었다. 향후 두 제도의 효율적인 운영을 위해 발달재활서비스와 치료지 원의 유사·중복서비스 대상·영역 관련 업무조정 방안 강구, 발달재활서비스와 치 료지원의 통합에 따른 대상자, 제공명칭, 제공인력, 제공영역 차원에서의 법령개정, 발달재활서비스와 치료지원 전달체계의 일원화 등에 대한 개선방안을 제시하였다. This research is to find out problems of developmental rehabilitation service which is a part of supporting status of rehabilitation service for children with disabilities by analyzing the usage status and supporting status and to suggest improvement. For this purpose, 1,535 developmental rehabilitation service providing organizations, 8,901 development rehabilitation service providers as well as 55,556 service users throughout the nation were targeted based on 5 millions of payment data made on the social service electronic voucher system of Korea Health and Welfare Information Service. In addition, the status data of 6,483 service applicants, 40,401 treatment support users as well as 659 treatment rooms were analyzed. As a result, organizations providing developmental rehabilitation service and the most common rehabilitation service was language rehabilitation service which was provided from 1,359 organizations. Average payment amount per voucher was 26,465 while annual payment amount per person was 1,649,210. Children with intellectual disability used the service the most taking 55.6% and physical treatment was used by 3,535 people (54.5%) while work treatment was used by 2,948 people (45.5%). It was shown that 80% of people which is 32,415 out of 40,401 only received the treatment support in 1 area and the rest 20% received the support in more than 2 areas. It was indicated that main issues were disagreement between developmental rehabilitation service and treatment eligibility, qualifications of service providers, dual delivery system of development rehabilitation service and treatment supporting service and difference between delivering methods of treatment support in each province. For effective operation of two systems, the improvement of coordinating methods for duplicated/similar service applicants of developmental rehabilitation service and treatment support, applicants of consolidated developmental rehabilitation service and treatment support, provision title, provision resource, law establishment for defining provision area and unification of delivery service between developmental rehabilitation service and treatment support were presented.

        도박중독예방치유서비스 구매계약제도 비교연구 - 캐나다 온타리오, 호주 빅토리아 사례를 중심으로 -

        The purpose of this study was to analyse the purchase of problem gambling prevention and treatment service policies of Ontario and Victoria. For this purpose the author developed an analysis tool based on literature reviews. To analyse the purchase of problem gambling prevention and treatment service contract policies the author thoroughly researched lots of governments publications and put the details of contracts policies in order based on the analysing tool. Two states share common features in such as financial sources, service targets, the contexts of introduction of the purchase of service contracts, collaborative relationship between government and private contractors. Above all, the two states pursue collaborative relationship before and after contracting. But these collaborative relationship does not mean the loosening of monitoring. In Victoria the government collaborate with private contractors to monitor thoroughly the provision of problem gambling prevention and treatment services. But two states are different in contract types, government's role in defining services, monitoring process and funding system. Overall, Victoria is more developed than Ontario in the purchase of problem gambling prevention and treatment service contract policies. Victorian government has developed detailed service standards, unit cost funding system and monitoring system. The author suggested several things for the government's purchase of problem gambling prevention and treatment services based on the findings. Above all, the government needs to improve professionality in problem gambling prevention and treatment services. Secondly, the governments should be cautious about balancing between competition strategy and cooperation strategy. Thirdly, the governments has to develop contract models, service standards and monitoring systems. Fourthly, the government needs to consider different model of purchase of service contract other than single master contract by which government transfers the private contractor most of the duties and rights in operating service center with block grants. This study has limitations in that it is based on literature analyses without examining the practice of the purchase of service contracts in both states. 본 연구는 서비스 구매계약에 대한 문헌연구를 통해 구매계약제도 비교분석을 위한 분석틀을 개발하고 이를 활용하여 캐나다 온타리오주와 호주 빅토리아주의 도박중독치유예방서비스 구매계약제도를 비교분석하는데 목적이 있다. 본 연구의 사례분석을 위한 서비스 구매계약제도 분석틀은 사회복지정책분석과 서비스 구매계약에 관한 문헌연구를 통해 도출하였다. 온타리오와 빅토리아는 도박중독예방치유서비스 재원, 서비스 자격요건, 구매계약 적용배경, 민간기관과 협력적 관계의 강조 등에서 공통점이 발견되었다. 하지만 온타리오와 빅토리아는 도박중독예방치유서비스 전달을 위한 구매계약제도의 운영에 있어 구체적인 서비스 내용과 서비스 제안 주체, 재정환급방식, 계약기관의 유형, 모니터링체계, 계약유형에 있어 차이가 두드러졌다. 두 지역의 도박중독예방치유서비스 구매계약제도 분석결과를 바탕으로 우리나라 도박중독서비스 구매계약과 관련하여 정책적 함의를 제안하였다.

        服务投资领域的国民待遇 : 基于贸易规则和投资规则的比较分析

        服务领域的外国直接投资,从理论上来说,既可能受国际投资法,主要是双边投资条约和区域一体化条约的调整,也可能受国际服务贸易法尤其是GATS的约束。但是二者的规定,并不完全相同。具体到国民待遇而言,贸易和投资领域在诸方面存在差异:就文本规定而言,GATS国民待遇的适用对象是“相同服务和服务提供者”,而投资条约下的国民待遇将外国投资者及其投资享受的待遇限定为“相似情形”下;就争端解决机构对国民待遇条款的解释和适用而言,GATT/GATS国民待遇条款下的相似性分析集中在对外国产品或服务和国内产品或服务的竞争条件的分析上,着重关注市场准入机会和整体福利。对较低待遇的评估是基于外国相同产品或服务这一整体,而非单一的生产者。而投资仲裁庭对相似性的分析尚未形成统一的标准,对较低待遇的分析基于单一的外国投资者,且允许对政府措施的背景和目的予以考虑。这种规则和实践的差异无疑会造成贸易和投资规则适用的潜在冲突。目前除部分区域贸易协定通过不同方式解决此类冲突,明确其受贸易规则或投资规则或双重规制以外,多边层面缺乏相关规定。伴随着经济一体化的逐步深入,贸易和投资的相互融合,贸易法和投资法之间的联系进一步增强。在国际投资体制改革的背景下,越来越多的投资条约开始纳入投资自由化条款和一般例外条款。在投资自由化的背景下,国际投资条约同样以维护外国投资者在东道国境内的平等竞争机会为其宗旨,而一般例外条款的增加将会对国民待遇条款的适用法理产生重要影响。与此同时,争端解决机构在国民待遇的解释和适用路径上也呈现出相似性。尤其从晚近WTO争端解决机构的实践来看,在确定较低待遇时考察争议措施的目的和宗旨似乎已为WTO 上诉机构所认可。在多边立法尚未对贸易和投资条约的适用关系予以明确之前,争端解决机构之间的深入沟通和相互借鉴,是从实体法层面协调国际贸易法和国际投资法下国民待遇义务的现实途径。 In theory, Foreign investment in service sectors is regulated both by international investment law, especially BITs and FTAs, and International trade law, or more exactly GATS. But their corresponding provisions are not the same. In terms of national treatment, there exist textual discrepancies and different interpretation by trade and investment tribunals. National treatment in GATS applies to “like services and service suppliers” while investment treaties define national treatment as no less favorable treatment “in like circumstances”. When interpreting national treatment, GATT/WTO tribunals take a two-step approach which includes the determination of likeness and no less favorable treatment. The analysis of likeness is to determine whether products or services and service suppliers are in a competitive relationship with each other. The determination of no less favorable treatment demands a group analysis, focusing on whether the contested measures has a disproportionate effect on foreign products. Such analysis reflects the concern of trade law for market access and overall welfare. In contrast, arbitral tribunals disagree with each other on the determination of “like circumstance”. The analysis of no less favorable treatment is based on individual investor, holding that foreign investors are entitled to the most favorable treatment for domestic investors. Moreover, consideration of objective and purposes of contested measured is also permitted. With the development of economic integration, trade and investment are increasingly inseparable and the link between international trade law and investment law is growing stronger. In the context of reform of international investment regime, more and more international investment treaties incorporate such provisions as liberalization and general exceptions. The preamble of some treaties confirms that foreign investors enjoy equal competitive opportunity in domestic market. The inclusion of general exceptions will exert great influence on the jurisprudence of national treatment. At the same time, trade and investment tribunals begin to take similar approach in interpreting national treatment. The WTO appellate body in recent cases seems to open the door for consideration of objectives and purposes of governmental policy in the determination of “no less favorable treatment”, which is similar to practice of investment tribunals. Before the multilateral legislations respond to the potential conflicts between trade and investment law, the judicial dialogue and cross-fertilisation are a feasible way for harmonization of national treatment in the two regimes.

        합리적 가치 소비를 희망하는 소비자와 경영 악화 극복 대책을 강구하는 사업자의 필요로 인해 O2O플랫폼 서비스는 마케팅의 중요한 수단이 되었다. 특히 O2O플랫폼 서비스의 이용특성을 파악하고 헤어 시술상품 만족도를 매개효과로 지속사용의도에 미치는 영향을 파악하고자하는 것이 본 연구의 목적이다. O2O플랫폼 이용특성에 영향을 미치는 변수를 살펴보기 위해 후기수용모델을 근거로 이용용의성, 상호작용성, 경제성, 오락성, 안전성, 지속사용의도, 헤어 시술상품 만족도간의 관계를 규명하였다. 2018년 11월 5일부터 11월 9일까지 O2O플랫폼 서비스 이용경험이 있는 대학생과 일반인을 대상으로 설문지를 배포하여 350부를 회수 하였다. 부실기재 96부를 제외하고 254부의 유효 표본을 SPSS 22와 AMOS 22를 통해 가설검증을 수행하였다. 가설검증 결과 첫째, O2O 헤어 시술상품 플랫폼 서비스 이용특성의 이용용이성, 상호작용성, 오락성은 헤어 시술상품 만족도에는 직접적으로 유의한정(+)의 영향을 미치는 것으로 나타났고, 이용용이성, 상호작용성, 오락성 모두 지속사용의도에는 직접적인 영향을 미치지 않았으나, 만족도를 통해 간접적으로 유의한 정(+)의 영향을 미치는 것으로 규명되 었다. 둘째, O2O 헤어 시술상품 플랫폼 서비스 이용특성의 경제성은 헤어 시술상품 만족도와 지속사용의도 모두에 유의한 정(+)의 영향을 미치는 것으로 나타났으며, 만족도의 매개효과는 유의하지 않았다. 셋째, O2O 헤어 시술상품 플랫폼 서비스 이용특성의 안전성은 헤어 시술상품 만족도와 지속사용의도 모두에 유의한 영향을 미치지 않는 것으로 규명되었다. 본 연구는 네트워크 효과를 통해 규모의 경제를 실현하고 있는 O2O플랫폼 서비스를 대상으로 이용자의 헤어 시술상품 만족도 및 지속사용의도에 미치는 관계를 규명하였다는 점에 의의가 있으며, 관련 업계의 O2O플랫폼 서비스품질 개발과 활용에 시사점을 제공할 수 있을 것이다. O2O platform service has become an important means of marketing due to the need of consumers wishing to spend reasonable value and operators seeking measures to overcome bad management. In particular, the purpose of this study is to identify the usability characteristics of O2O platform services and to identify the effects of hair treatment product satisfaction on the intended use of the product as a medium. In order to examine the variables that affect the usage characteristics of O2O platform, the relationship between usability, interactivity, economy, entertainment, safety, persistence, and satisfaction of hair treatment products was identified based on the later acceptance model. From November 5 to November 9, 2018, 350 copies were collected by distributing questionnaires to university students and the public who had experience using O2O platform services. With the exception of 96 parts of non-conforming apparatus, 254 effective samples were performed through SPSS 22 and AMOS 22. First, it was found that the usability, interactivity, and entertainment of O2O hair treatment product platform service use characteristics had a direct significant impact on hair treatment product satisfaction and that although usability, interactivity and entertainment all did not directly affect the intended use, they had an indirect (+) effect through satisfaction. Second, the economics of using O2O hair treatment platform service was shown to have a significant positive effect on both the satisfaction of hair treatment products and the intended use, and the mediated effect of satisfaction was not significant. Third, it has been established that the safety of the O2O hair treatment platform service use characteristics does not have a significant effect on both the satisfaction of the hair treatment product and the degree of continued use. This study is meaningful that O2O platform services, which are realizing economies of scale through network effects, have identified their relationship to users satisfaction with hair treatment products and their intended use, and it will be able to provide implications for the development and utilization of the service quality of the relevant industry O2O platform.

        GATS 내국민대우 분석

        GATS에서의 내국민대우는 모든 상품무역에 적용되는 GATT의 내국민대우와는 달리, 회원국이 시장을 개방하기로 약속한 분야에 대해서만 적용되며, 이런 분야에 대해서도 내국민대우를 면제받는 제한 조건이 설정될 수 있다. 따라서 GATS XVⅡ조 내국민대우 분석은, 양허표의 내국민대우 허용 분야 및 이에 관련된 제한사항을 모두 보아야 하는 복잡한 사안이다. 본 글은 최근 채택된 China-Publications and Audiovisual Products 및 China-Electronic Payment Services 사건을 중심으로 GATS 내국민대우 위반여부에 대한 3단계 분석방법을 다루었다. 먼저 1단계로 내국민대우 약속의 범위에 대해 GATS 내국민대우의 특성상 관련 분야에 내국민대우 제한사항이 있는지, 수평적 약속에 내국민대우 제한이 있는지, 그리고 시장접근 및 내국민대우를 모두 위반하는 조치는 시장접근란에 기재하도록 GATS XX조에 의거, 시장접근 제한사항이 있는지도 살펴보아야 함을 보았다. 특히 시장접근을 양허하지 않은 상태에서는 내국민대우를 완전히 양허했다 하더라도, 시장접근과 내국민대우를 위반하는 조치는 내국민대우 대우 위반이 아니라고 본 China-Electronic Payment Services 사건의 패널의 판정은, 이미 차별적 대우를 포괄하고 있는 GATS XVⅠ조 및 양허 작성 원칙을 다룬 XX조와 양허표 작성지침 규정 등을 감안했을 때 최선으로 판단되나, 완전한 내국민대우 약속이 무효화되는 문제도 존재한다. 2단계로 서비스 공급에 영향을 미치는 조치에 대한 분석이 필요한데, 서비스 공급에 영향을 미치는 조치는 넓은 범위를 포괄하고 있는 것으로 해석된다. 3단계로 동종 서비스 및 서비스 공급자에 대한 불리한 대우가 있었는지 분석하는 것이 필요하다. 사례별로, 경쟁조건상 본질적으로 동일하면 동종 서비스이고, 국적이유일한 차별기준이거나 동종 서비스를 제공하면서 서로 같은 사업영역을 공유하고 경쟁자로 인식하고 있는 서비스 공급자들은 동종 서비스 공급자임을 보았으며, 이러한 동종 서비스 또는 서비스 공급자에게 경쟁조건이 변경하는 대우를 하는 경우 그것이 불리한 대우임을 보았다. 서비스의 상품과 다른 성격을 감안, 서비스 내국민대우가 상품과는 다른 분석틀을 통해 해석되는 것이 바람직하나, 분석틀의 주요 개념인 "경쟁 조건"이 좀더 정치하게 해설될 수 있도록 판례 및 학계의 이론 축적이 필요할 것으로 보인다. Based on the recently adopted WTO cases, this article dealt with a three-part analysis to assess whether a measure is inconsistent with national treatment of the GATS. The first step was to assess the scope of commitments on national treatment, considering limitations inscribed in national treatment and market access column of the relevant sector and horizontal section. In particular, in the case of a measure inconsistent with both market access and national treatment obligations, if "unbound" is inscribed in the market access entry, that measure is not inconsistent with national treatment even though full national treatment was committed. The second step was to assess whether the measure affects the supply of services. The concept of "affecting" has been interpreted broadly. The third step was whether the measure accords to foreign services or service suppliers "less favorable treatment" than "like" domestic services and service suppliers. On a case-by-case basis, if the services in question are generally the same in competitive terms, those services would be like services. Also, if the service suppliers in question are providing like services, have similar business scope, and perceive each other competitors, they would be like service suppliers. In addition, if the measure modifies the conditions of competition, it results in less favorable treatment. It would be desirable to give more clarification to the conditions of competition in the context of the GATS.

        의료영역과 한방의료영역의 업무구분에 관한 고찰

        Doctors have the right to treat patient with no interference. However, in the present legal system, the treatment is divided into two parts, western and oriental treatment, and doctors who has acquired a licence in one sector are able to treat only in his acquired licenced part. Unlicenced treatment will be punished by criminal law. This division restricts the self regulations of doctors, and brings about the problem to hinder the development of medical services. For this, following paper will discuss the development of national medical services in the constitutional aspect, comment that the two-seperated treatment system is right or not. And this paper will figure out that whether doctor's treatment over his licenced part make a restriction of doctor's self-regulation or not. And finally adduce the way the medical law should be. First, It needs to show us the way how the individual medical law should be made. Because the importance of this law as a people's healthy right and human dignity which depends on this law, as one of constitutional law's main principals, the principal of state-medical service, it needs to be written and to be guided. This paper will produce the principal of state-medical service, and analysis the fundamental right of medical service in the point of constitutional view, and explain the individual laws in harmonizing with constitutional law, try to synthesis the individual medical laws with constitutional law as center. Second, in constitutional law, the principal of state-medical service is actualized with the individual laws in the end. The core of this principal is security of the doctor's self -regulated and independent treatment practices. But the division of western and oriental medical treatment restrict the autonomy of doctors in the name of professionalization and becomes an obstacle to the development of new medicine and treatment technic at the same time. And it threats the people's healthy right and the right of to be cured. Furthermore, since the self-regulation of doctors is the essence of medical laws, it would be asked whether the doctor who treat over his or her right should be punished is excessive or not. It needs to departmentalize the composition requirement and be improved to reduce the court sentences and, and regulate by the administrative measures as possible. Third, the purpose of medical law is to make every people could enjoy the high quality medical services, and to secure and to promote people's healthy life. I would like to propose the system of cooperated treatment system as a solution of this problem. Fortunately, last Jan. 2009. the ground rules have taken effect to regulate. But it still needs more efforts and guidances on specific direction and policies. This paper will introduce the specific strategies how to practice the cooperated medical treatments.
