경찰업무영역 확장에 따른 경찰윤리 강화방안

경찰의 임무는 국민의 생명과 신체ㆍ재산을 보호하고 국민에게 교통질서유지ㆍ각종 민원서비스 등과 같은 치안서비스를 제공한다. 초기 경찰의 임무는 국민의 안전과 생명ㆍ재산을 보호하는 제한적인 업무가 대부분이었으나, 1945년 광복이후 미 군정기를 거치며 영미법계 경찰의 치안서비스가 도입됨에 따라 교통질서유지 및 각종 치안서비스 제공과 같이 업무영역이 증가하게 되었다. 경찰은 국민에게 강제할 수 있는 공권력을 가지는 등 경찰 업무의 특수성으로 인해 높은 윤리 수준이 요구되고 있다. 게다가, 경찰의 업무영역 증가에 따라 더욱 높은 수준의 경찰윤리 수준이 요구되고 있다. 그러나 감소되지 않고 발생하는 경찰의 부정ㆍ부패, 경찰의 반 윤리적인 행위에 대한 호의적인 문화, 업무의 특수성으로 인한 반윤리적인 행위의 발생 등으로 인해 우리나라의 경찰윤리 수준은 높지 않은 것으로 나타났다. 그래서 이 연구에서는 현재 업무영역 증가로 인하여 발생하는 높은 윤리수준의 요구와 현재 윤리 수준을 기존의 문헌연구 및 관련 통계로 알아보고, 경찰윤리 강화를 위한 방안으로 경찰윤리에 대한 접근의 변화ㆍ경찰윤리의 방해요소의 제거ㆍ내부 감시활동의 강화ㆍ자율적인 형태의 청렴한 조직문화 조성ㆍ경찰윤리 교육의 강화와 같은 방법을 제안하였다. The mission of the police is to protect people's lives as well as to protect property, public order maintenance and transportation, such as providing civil policing services. The initial mission of the police is to preserve public safety and to protect life and property; but most of the limited work, after the liberation forces in 1945 and undergo regular security service of Anglo-American legal system the introduction of police order maintenance and other transportation services such as police was an increase in work areas. Due to the fact that the police may enforce their power to the people, which is a characteristic of the police, high ethical standards required. Furthermore, depending on the high levels of ethical standards of the police, an increase in the realm of police work is required. However, although there has been a decline, corruption of police, anti-ethics activities favorably on the cultural, business due to the uniqueness of the occurrence of anti-ethics activity due to the level of our country were not high levels of police ethics. Therefore, in this study occurred in the current business area due to the increased demands of high ethical standards and ethical level of current research and existing literature to find out the relevant statistics, police ethics as a way to enhance access to police ethics and police ethics of the change removal of the interfering element and strengthen internal surveillance activities and composition of the organizational culture of integrity in the form of voluntary ethics training and the strengthening of the police the same way as proposed.

자치경찰 시대 한국 경찰공무원의 직업윤리 확립방안에 관한 연구 : 부정청탁 및 금품 등 수수의 금지에 관한 법률과 관련

세계는 바야흐로 제4차 산업혁명시대를 맞이하며, 국내적으로는 남북분단의 지정학적여건 속에서 우리 경찰도 21세기에 걸맞는 사고와 행동으로 자치경찰 시대에 대처하는 세계의 일류경찰 로 변모해 가고 있다고 본다. 그동안 우리 정부에서도 많은 변화가 있었다. 특히 문재인 정부에서 우리나라 국가경찰 창설 76년만인 2021년 7월 1일을 기해 전국 17개 광역시도에 18개의 시도자치 경찰위원회(경기도는 남부와 북부에 2개)를 합의제 행정기관으로 설치하였다. 국가경찰은 정보, 보안, 외사를 국가수사본부는 수사와 형사를 그리고 자치경찰은 생활안전, 여성청소년, 교통 분야를 담당하게 되는 등 자치경찰제 시대를 활짝 열었다. 이러한 관점에서 한국의 경찰윤리의 준수실태를 정확히 분석하고 부족한 저해요인을 파악하여 미래지향적인 경찰윤리 확립방안을 마련함은 물론 경찰공무원에게 제시하고 주지시켜 맡은 바 직무를 성실히 수행토록 하는 것이다. 또한 경찰관들이 법집행과 경찰활동을 위해서는 공직자로 서 최근 제정·시행중인 “부정청탁 및 금품 등 수수의 금지에 관한 법률” (일명: 부패방지법) 등 법집행 관련법령과 각종 공직 윤리와 경찰윤리를 정확하게 숙지하여 솔선수범하여 준수토록 교육훈련을 강화하여야 한다. 그러므로 모든 경찰관이 올바르고 공정한 법집행과 국민들에게 진정으로 봉사할 수 있는 경찰윤리 확립방안인 “경찰활동의 민주성과 독자성 확보” 등 7개 방안을 제시하고자 했다. The in the world of the forth industrial revolution, nationally, Korea is in the disjunction of south and north by the geopolitical element, Korean police is changing for the first class police of 21 century. In this point of view, I want to analysis correctly the observance situation of police ethics and find insufficient baffling factors. Therefore, I want to arrange for the established devices of police ethics in the future and I will propose to all police officers. Also, It must reinforce ethics education and training for the law enforcement and democratic activity of police officers. Like this, I will suggest the established devices of police ethics that police officers must do to try for the equitable law enforcement and the service for the people. The severalty of police activity. The reasonable human resources management and the adequacy of police treatment. The reinforcement of police education and training. The enhancement of democratic morality and the opening of police administration. The innovative thought and fairminded law enforcement establishment. The exaltation of human rights. The activation of service for citizen.

자치경찰제 실시에 따른 경찰윤리 확보방안

이 연구는 새 정부의 국정과제 중의 하나인 지방자치개혁의 일환으로서 ‘자치경찰제의 실시’ 와 관련하여 향후 논의 되어야 할 점으로서 자치경찰의 경찰윤리성 확보를 위한 방안을 제시 하였다. 이를 위하여 이 연구에서는 국가경찰제도하에서 발생하는 경찰윤리의 유형들 중 경찰의 지방 자치화 시대에 더 심각하게 나타날 수 있는 윤리적인 문제를 인적요인, 제도적 요인, 환경적요 인의 세 가지로 나누어 경찰관 8명을 대상으로 심층면접을 실시하였다. 이러한 본 저해요인과 심층면접 결과에 기초하여 이 연구에서는 인적요인의 확보방안, 법적· 제도적 요소의 개선, 환경적 요인의 개선방안으로서 다음과 같이 제시하였다. 첫째, 인적요인의 확보방안으로 지역적 특색에 맞는 선발단계의 노력, 자치경찰의 윤리의식의 함양을 위한 교육훈련의 강화, 경찰관의 재교육 프로그램의 다양화, 둘째, 법적·제도적 요소의 개선방안으로 자치경찰의 윤리적 의사결정 기준과 과정의 확립, 자치경찰의 윤리성 평가에 다 면평가제도 활용, 중치적인 중립을 위한 제도적 보완, 셋째, 환경적 요인의 개선방안으로경찰 조직문화의 정립, 대외적인 자치치안의 환경조성방안을 제시하였다.

경찰 중간관리자의 윤리적 리더십이 경찰관의 직무몰입에 미치는 영향

The main purpose of this study is to test the relationship between police middle manager’ ethical leadership and police officer’ job involvement and to suggest the measures to improve the police middle manager’ ethical leadership. Data for this study were collected from 320 police officers belonging to Daejeon Metropolitan Police Agency. Multiple regression analyses show that police middle manager’ ethical leadership has a statistically significant effect on police officer's job involvement(β= .583, p<.001). In order for police agencies to develop police middle manager’ ethical leadership, first, police agency must select applicants based on individual-organizational values “fit”. Second, once a police officer is selected, the police agency should use role modeling to develop the follower’ ethical leadership. Third, the police agency should implement various types of training in order to develop police middle manager’ ethical leadership. Finally, the organizational culture and socialization can promote the development and retention of ethical leaders. 윤리적 리더십은 리더가 조직의 비전 및 목표 달성을 위하여 조직구성원과의 양방향 의사소통과 합리적 의사결정을 토대로 조직 내행위규범에 맞게 행동하도록 유도하는 것이다. 이 연구의 주요 목적은 경찰 중간관리자의 윤리적 리더십과 경찰관의 직무몰입 간의 관계를 검증하고 경찰관의 직무몰입을 증진시키기위해서 경찰 중간관리자의 윤리적 리더십의 향상방안을 제시하는 것이다. 이 연구를 위한 자료는 대전광역시경찰청에 소속된 경찰관 320 명으로부터 수집되었다. 다중 회귀분석은 경찰 중간관리자의 윤리적리더십이 경찰관의 직무몰입에 통계적으로 유의한 영향을 미치는 것을 보여준다(β=.583, p<.001). 경찰 중간관리자의 윤리적 리더십을 향상시키기 위하여 먼저, 경찰기관은 개인-조직 가치의 적합성을 토대로 경찰관을 선발해야 한다. 둘째, 경찰관이 채용된 후에는 윤리적 리더십을 개발하기 위하여 역할모델링을 활용하여야 한다. 셋째, 윤리적 리더십을 개발하는 데 많은도움이 될 수 있는 다양한 종류의 훈련을 실시해야 한다. 마지막으로, 윤리적 리더의 개발 및 유지에 도움이 될 수 있는 조직문화 및사회화 과정을 촉진시켜야 할 것이다. 경찰 중간관리자의 윤리적 리더십이 더욱 향상된다면 경찰조직 성과 또한 더욱 향상될 것이다.

경찰의 부적격자 재교육방안에 관한 연구

2008년부터 2010년 8월까지 집계된 경찰부패 및 부적격자 적발 인원수는 2,785명으로 상당히 많은 인원이 적발되었다. 실제 적발되지 않은 부패자 및 부적격자의 수를 합친다면 상당히 많은 인원이 경찰관으로서 부적격행위를 하였다고 예상할 수 있다. 일반적으로 부적격 행위는 부패의 개념과 차이가 있다고 볼 수 있다. 부적격 행위의 경우 부패 보다 더 넓은 개념으로서 기존의 부패에 대한 개념이 법률을 위반한 행위에 목적을 둔것과 달리 부적격 행위는 공직자의 사생활까지도 범위를 넓혀 모범을 보여야 함에도 불구하고 그러지 못한 행위를 한 것 까지 부적격 행위로 간주하였다. 이러한 부적격행위 중 경찰의 부적격행위는 경찰이 가지는 특수성 등에 의해 일반 공직자 부 적격행위와 차이점을 두고 있다. 특히, 공권력을 가지는 권력기관이기 때문에 경찰이 저지르는 부 적격행위는 심각한 문제를 양산하고 있다. 현재 경찰에서는 부적격행위로는 금품수수, 부당처리, 직무태만, 품위손상, 규율위반으로 분류 하고 있다. 그러나 이러한 부적격행위를 학자별로 다양하게 분류하고 있다. 이러한 문제점을 해결하기 위하여, 경찰의 윤리교육강화ㆍ경찰의 유해환경개선 및 감시의 강화 ㆍ근무여건개선 등과 같은 방안을 제시하고 있다. 이중 경찰의 윤리교육 강화를 위해 재직자 교 육과정을 통해 부적격행위를 한 경찰관에게 재발을 방지하고, 부적격행위를 예방하며, 주변 경 찰 관들에게 부적격행위에 대한 위하효과를 기대할 수 있는 ‘자기개발향상과정’을 경찰교육원에서 실 시하고 있다. ‘자기개발향상과정’은 기존의 재직자교육과정을 통한 윤리교육에서 실패하였던 환류 등의 방법 을 실질적으로 도입하여 윤리교육이 강화되었으며, 효과성까지 측정하여 교육에 대한 문제점을 개선하였으며, 장애인 봉사활동 및 참여식 교육을 통해 효과적인 교육이 진행되도록 하였다. 따라서, 이 논문에서는 지속적으로 발생하고 있는 경찰부패 및 부적격행위에 대해 효과적으로 대처하여 일반 국민들에게 경찰의 신뢰도를 향상 시킬 수 있는 방법으로서 기존의 부패제도개선 , 감찰기능강화와 같은 방법에서 벗어나, 재직자 교육방법을 통한 부적격행위자에 대한 윤리교육 에 대해서 살펴보았다. From 2008 to August, 2010, the number of corrupt and disqualified police officers was revealed to be 2,785. Combining the unexposed corrupt or disqualified police officers, it can be predicted that considerable number of officers have committed actions that are unqualified for a police officer. Unqualified action generally differs from the notion of corruption. Unlike the existing notion of corruption, which only concentrates on illegal acts, disqualifying action is a wider concept that expands its range to the private lives of public officials and considers public officials failing to serve as a model disqualifying. Within such disqualifying acts, the disqualifying acts of police officers differ from those of general public officials due to the distinct characteristics of police. Disqualifying actions committed by police officers cause serious problems especially because the police have governmental authority. Currently, the police categorizes disqualifying actions into take in the money and goods, unfair treatment, neglect of duty, damage to dignity, violation of rules. However, the categorization varies among different scholars. In order to solve these problems, education on police ethics, improvement of noxious environment, reinforced surveillance and improved working conditions have been suggested. For better police ethics education, the Police Training Institution is implementing “self-development courses,” which is expected to prevent the occurrence and recurrence of disqualifying acts as well as to alert police officers. “self-development courses” strengthened ethics education by practical introduction of the methods that failed in ethics education through existing refresher and extension course such as feedback. It also improved the ethics education by measuring the effectiveness of the program, and guaranteed the effectiveness of education by public service for disabled and participation-based learning. This study therefore examined ethics education via refresher and extension course over existing methods such as “Corrupt System Improvement” and “Enhancement the work of prosecutors” as a means to effectively manage corruption and disqualifying acts and to increase the credibility of the police from people.

경찰의 공직윤리 향상 방안

본 연구는 언론보도의 분석을 통해 경찰의 부패 및 청렴도 인식을 분석하고, 경찰윤리의 덕목으로서 공직청렴의 이론적 기반을 구축하며, 청렴문화의 정착을 위해 독일의 콘스탄츠 대학 G. Lind 교수가 창안한 도덕판단역량측정도구(MCT)를 활용한 청렴교육을 제안하려는 목적으로 수행되었다. 이를 위해 청렴의 개념과 의미, 중요성 등에 대한 선행연구를 고찰하고, 경찰윤리를 정립하는 데 시사점을 도출하는 데 주안을 두었다. 본 연구는 언론보도 분석을 통해 나타난 경찰의 청렴도는 아직까지 부정적인 인식이 다수 나타나고 있으며, 청렴도 개선이 요구된다. 따라서 경찰조직은 청렴에 대한 확고한 이론적 기반 위에서 체계적인 청렴교육을 실시하고, 이를 실증적으로 측정할 필요가 있다. 청렴도는 개인윤리로서 요구되는 덕목이기도 하지만 조직의 윤리로서 그것이 발휘되기 위한 조직풍토가 정착되어야 하는데, 이는 규범적 강조가 아니라 체계적 교육프로그램의 설계와 시행, 효과성 평가가 뒷받침되어야 한다. 이를 위해 본 연구는 국민권익위원회 청렴교육원에서 시행하는 청렴교육프로그램 등 다양한 선행연구를 분석하여 경찰을 위한 청렴교육프로그램을 제안했는데, 여기에는 청렴에 관련된 다양한 법령과 사례 등 인지적 영역의 지식 교육이 필요하고, 더불어 실제 직무수행 과정에서 부패행위에 저항하고 청렴을 실천하기 위한 가치의 내면화 교육이 필요하다. 이를 위해서는 기존의 의무론적, 당위론적 교육에서 벗어나 가치과학적 방법을 적용하여 각 개인의 도덕성 판단력을 측정하고, 이를 향상시키기 위한 체계적인 교육이 필요하다. J. Rest, G. Lind 등 도덕성 관련 선행 연구자들이 정립한 도덕성측정도구는 개인의 청렴인식과 역량을 측정하고, 청렴도 인식을 향상하기 위한 교육적 처방을 구성하는데 적합하다. 본 연구는 경찰윤리로서 청렴문화를 정착하기 위한 교육프로그램 구성을 위해 G. Lind의 도덕판단역량측정도구의 알고리즘 적용을 제안했다. This study analyzes the police's perception of corruption and integrity through the analysis of media reports, establishes the theoretical basis of public integrity as a virtue of police ethics, suggests integrity education for the establishment of integrity culture, and morality as an element for this. This was done to propose the use of Moral Competence Test made by G. Lind of Konstanz University. So this study examined previous studies on the concept, meaning, and importance of integrity, and focused on drawing implications for establishing police ethics. This study shows that the police's integrity, which has been analyzed through the press release analysis, still has many negative perceptions and needs to improve the integrity. Therefore, it is necessary for the police organization to conduct systematic integrity education on a firm theoretical basis for integrity and to measure it empirically. And it is required to measure the individual's integrity awareness and competency by applying the proposed morality measurement tool and to improve the awareness of integrity. Integrity is also a virtue required for personal ethics, but the organizational climate for it to be exercised as an organizational ethic must be established, which should be supported by the design, implementation, and evaluation of the effectiveness of systematic education programs. For improving the police ethics, this study proposes integrity education for this purpose and expects to continue empirical research by means of morality measurement tool. In concrete, the education should include cognitive contents of knowledge in the anti-corruption law and regulations, corruption cases, and way to resist the corruption. It also should contain affective contents of promoting the will to implement the ways of integrity and to resist the corruption.

경찰윤리 정립방안에 관한 연구

경찰비리의식의 실태와 사회화 과정에 관한 실증 분석

이 연구는 경찰관의 가치의식을 통하여 우리나라 경찰조직의 윤리적 분위기와 경찰비리의 사회화를 실증적으로 분석하고, 경찰행정의 윤리성 제고를 위한 실천적 함의를 모색한다. 분석 결과, 우리나라 경찰관들은 경찰비리의 윤리적?법적 차원을 잘 이해하고 있으나 인권의식, 동료의 비행, 절도 행위에 대한 윤리적 민감성이 부족하고, 경찰 내 불신의 문화가 보편화되어 있으며, 경찰비리가 조직 내 사회화 과정을 통해 발전할 수 있음을 확인하였다. 이 연구는 경찰조직의 윤리성 제고를 위한 실천적 과제로서 간부후보생을 대상으로 한 리더십 윤리교육의 강화와 인사행정 전반에 걸친 윤리성 제고 노력, 그리고 조직의 윤리적 분위기를 개선하기 위한 문화사업의 전개를 촉구한다.

경찰의 윤리의식이 조직 내 온정주의 문화에 따라 부패인식에 미치는 영향

이 연구는 일반직 공무원에 비해 청렴이 강조되는 경찰관의 윤리의식 수준이 온정 주의에 따라 부패인식에 미치는 영향을 살펴보고자 하는 것이 목적으로 연구의 완성도 를 높이기 위해 위하여 현직 경찰관 대상 설문을 통하여 수집된 자료를 바탕으로 연구 를 진행하였다. 경찰의 윤리의식은 청렴성이 강조되는 경찰조직에 중요한 역할을 하는 것으로 높은 윤리의식을 요구하는 경찰 직업의 특성상 채용 당시부터 특별한 윤리수준 을 요구하고 있는 편이다. 그러나 조직 내 부패에 호의적인 온정주의가 부패에 대한 인 식을 바꿔놓을 것이라는 가정 하에 현직 경찰관을 대상으로 실시한 설문조사를 분석하 니 다음과 같은 결과를 도출하였다. 경찰관 개인의 윤리수준이 높을수록 부패에 대하여 부정적인 인식을 하는 것으로 나타났으며, 개인의 윤리수준과 온정주의는 아무런 상관 이 없는 것으로 나타났다. 그러나, 경찰관 개인의 윤리수준이 온정주의를 매개요인으로 설정하여 미치는 영향을 살펴본 결과, 두 요인 모두 부패에 대한 인식에 영향을 미치는 것으로 나타났다. This paper aims to examine an effect of the ethical level of police officers that are highly required to be upright on corruption perception according to paternalism culture. Generally, the ethical level of individuals is affected by an organizational culture and highly likely to change perception toward corruption, and hence, it has a purpose to verify it. The study was completed based on information collected by a survey of current police officers. The ethics of the police officers that are highly required to be honest plays a significant role to the officers. Thus, the police officers tend to have a high level of ethics when they are first hired due to the characteristics of the police profession requiring a high sense of ethics. However, under the assumption that paternalism overflowed within an organization might affect the ethical level of police officers and change the perception toward corruption, a result of the confirmation on actual hypotheses formulated by a survey of current police officers showed the following details. It was suggested that the higher a sense of ethics of individual police officers was, the more they had a negative recognition on corruption, and there was no correlation between individuals’ ethical level and paternalism. However, as a result of an examination on the effect of the ethical level on the recognition by setting up paternalism as a mediating factor, two factors affected the perception toward corruption.

경찰공무원 부패방지를 위한 청렴성 제고방안

이 연구는 경찰공무원 및 경찰조직의 부패방지를 위해 청렴성을 제고하는 방안 을 수립하는 것이 목표이다. 경찰부패는 경찰의 권한과 직업적 특권의 남용에 의하 여 각종 유혹에 굴복하는 것이므로, 무엇보다 청렴성의 제고가 필요하다. 청렴은 부패를 방지하고 도덕적 규범에 일치하여 행동하는 품질이기 때문에 경찰공무원 및 경찰조직이 부패에 저항할 수 있게 하는 강력한 행동규범이 된다. 따라서 이 논문은 경찰부패 방지를 위하여 청렴성의 개념정립, 경찰부패의 현황과 경찰의 자 기 통제, 부패의 요인별 사례를 검토한 후 경찰공무원의 개인적 요인, 제도적 요인 그리고 환경적 요인에서 경찰 청렴성 제고 방안을 제시한다. 경찰공무원의 개인적 요인에서 청렴성을 유지하기 위해서는 윤리적인 경찰공무 원상의 정립 및 윤리적 리더십의 확립이 요구된다. 경찰의 제도적 요인에서 청렴성 달성을 위해서는 경찰조직에서 청렴관리의 실천 그리고 내부고발제도의 실질적 운 영이 필요하다. 경찰 환경적 요인에서는 고결한 명분의식의 배제 그리고 윤리적 책 임의식의 함양이 필요하다. 고결한 명분의 부패를 해소하기 위해서는 합리성의 원 칙에 따른 선택, 행위합리화와 잘못된 부문화의 배제, 조기경보제도 운영 그리고 윤리적 딜레마 해결을 위한 합리적 의사결정력의 제고가 요구된다. 윤리적 책임의식의 함양을 위해서는 인성과 도덕성 위주의 채용, 교육·훈련에서 강의식보다 역할극의 활용과 윤리적 딜레마에 대한 가상훈련, 일탈사례 중심과 시 청각 교육의 확대, 경찰현장과 학교의 지속적 연계를 통한 평생교육체계의 확립 그 리고 청렴성 제고를 위한 교육의 확대가 필요하다.
