Im Hinblick auf die relativ arme wissenschaftliche Geschichte seit Beginn der modernen Rechtswissenschaft am Ende der Joseon-Dynastie und seit der Befreiung aus der japanischen Kolonialherrschaft wurde in Korea keine richtige in Methode oder Ausrichtung anders gerichtete Schulen gebildet bzw. regelrechten Debatten geführt, sondern einige von bestimmten Universitäten oder von führenden Professoren geleiteten Personalgruppen fungieren als Schulen. Mittendrin hat die Yonsei-Verfassung, d. h. die Verfassungssrechts-Studien an der Yonsei-Universität, durch die bisherige Errungenschaft auch eine Rolle in der koreanischen Verfassung gespielt, wobei ihre hellen und dunklen Seiten gut zu erkennen sind. In dieser Arbeit verfolge ich in der gegenwärtigen Zeit, in der die Verfassungsgelehrten der Dritte Generation in den Ruhestand treten und die der Vierte Generation das Rückgrat bilden, die Geschichte der Yonsei-Verfassung und stellen meinen eigenen Vorschlag für eine fortschrittliche Zukunft vor

This report analyzes some issues that gave rise to heated discussions on economic law. Especially, the core of these disputes is on whether the regulation on the market by government is good thing or not. Before World War Ⅰ, the majority of economists predicted that the governmental regulation would have a bad influence on the market so it should be left to flow naturally like a river. However, it proved to be failed by Great Depression after World War Ⅰ. The ultimate aim of economics is the proper distribution of resources. In conclusion, although the governmental intervention once achieved considerable amount of success, It is not one of necessary nor a sufficient condition of perfect market any more.

The Constitution declares the principle of parliamentary legislation in Article 40. But Articles 75 and 95 (and some more Articles in Constitution) permit the Administration to make legislations. on the ground of delegation. And Administration has another power of rule-making. Under the principle of “rule of law” administrative rule cannot regulate the people directly. It can only regulate the administrative office and its people directly. But sometimes the Supreme Court granted that it has the power to regulate the people directly. In that case some questions are arising. Administration rule-making procedure is different from that of Administration legislation. But the regulating power is very similar. So the Administration rule that has the regulating power must be promulgated and be open to the judgement of the court.

The president-elect Noh declared that he would share the executive power with the prime minster to keep the government from the risk of dictatorship. In addition, regarding the electoral system, he would intend to operate the major or medium constituency system in order to eradicate regional parties. The subject of the study is focused on both the efficiency of the division of the president's executive power and the parliamentary electoral system. The following is the result of the study. 1. The form of Korean government is a presidential system. The vital prerequisite for a presidential system is 'one person executive'. Namely, the presidential system does not allow any kind of dual authorities between the president and his cabinet. The governmental system that the president-elect Noh premeditated is a dual authority system, which means a semi-presidential government and hence is not able to be acceptable to the current constitutional organization. Therefore, if he insists on the share of executive power with a prime minister, he should revise the constitution firstly. 2. The Electoral systems are divided into Majority Representation System and Proportional Representation System. It is hard to say that major or medium constituency system is necessarily preferable to prevent a party from regionalism in the Majority Representation System. I would rather suggest that it is more effective to supplement or partially revise the Proportional Representation System while maintaining the minor constituency system to overcome the problem of regional parties.

Cyber-medicine is the model of health care offerings via the Internet. As computers become more accessible and increasing numbers of people become familiar with the Internet, patients will have the opportunity to take advantage of the unique health care possibioities offered by cyber-medicine. Cyber-medicine enables interactions between doctor and patient. And now cyber-medicine may prove to be a significant advance in the provision of medical services. But Cyber-medicine offers both the best and worst of Internet technology.
