우리나라 무역사기 사례 분석에 관한 연구

본 연구는 무역거래에서 빈번히 발생하고 있는 무역사기 사례를 파악하여 무역기업의 피해를 최소화하기 위한 주요 대처방안을 제시하고자 한다. 무역은 그 특성상 많은 위험을 내포하고 있는데, 어느 일방 당사자자 고의적으로 자신의 이익을 얻기 위해 상대방을 속이고 이익을 얻게 되면 무역사기 행위가 된다. 최근 코트라 통계에 따르면 우리기업 대상 무역사기 사건은 2018.9부터 2021.8까지 82건, 166건, 135는 135건으로 매년 발생하여 크고 작은 피해를 보고 있다. 이에 Kotra의 최근 5년간 자료를 통하여 대금결재사기와 선적불량사기를 중심으로 사례를 분석하고 이에 따른 무역거래자의 위험과 손해를 미연에 방지하기 위하여 사전대처방안과 사후대처방안을 제시한다. 또한 실무적시사점으로 무역거래자에게 무역사기에 대한 인식의 제고를 통한 주요 지침의 제공 및 안정적이고 지속적인 경쟁력을 향상시킬 수 있을 것으로 사료 된다. 정책적 제안 및 시사점으로는 설명회와 교육개최, 교육프로그램의 개발 및 대회개최, 범정부적 협력을 통한 무역사기 예방체제 구축방안을 마련하여야 한다. Purpose : The purpose of this study is to analyze trade fraud cases and present pre- and post-measures to prevent risks and damage to trade traders. It also aims to help revitalize exports and imports by presenting practical and policy implications. Research design, data and methodology : This paper is Along with a literature, review, this study focuses on the Kotra’s trade fraud cases from 2017 to 2021. Results : According to the analysis results, payment fraud is unpaid in long-term transactions based on trust, extension of payment date, suspension of transactions due to change of representative, company liquidation, and payment avoidance. Examples of defective shipments include fraud cases of non-existent companies and product shipping cases different from the contents of the contract. Conclusions : As a result of the study, pre- and post-counter measures for trade fraud are presented. The practical implications are that it is possible to provide major guidelines to trade traders by raising awareness of trade fraud and improve stable and continuous competitiveness. Policy proposals and implications are to establish a system to prevent trade fraud through briefing sessions and education, development and competition of educational programs, and pan-government cooperation.

한국 국제물류주선업체의 다각화 성과에 관한 연구

The purpose of this paper is to analyze Korea's Freight Forwarders' diversification-level and research the determinant factors for diversification and economic success. Determinant factors for diversification are not only of the existing and target industry but any retention resources as well. Success is divided into financial success and non-financial success. In terms of retention resources, three factors (management, service, and financial resources) have a great impact on diversification in statistical analysis. It shows that the level of diversification is heavily related to important results. Diversification has a positive effect on the outcome of freight forwarding industry. Therefore, the international freight forwarding business needs to diversify its related businesses, which can lead to synergy with the existing industry, by thorough study about what they have as resources. In conclusion, this study made it clear that bringing professionals and manpower and providing customers with a variety of services in the field of logistics are the most important goals for successful freight businesses.

직접운송간주와 통과선하증권에 대한 대법원 판례 연구 : 대법원 2019. 2. 14. (선고 2017두63726) 판결을 중심으로

2021년 1월 현재 우리나라는 2004년 칠레와의 FTA를 시작으로 최근 영국까지 총 17건, 58개국과 FTA가 발효되었다. FTA의 확산으로 우리나라의 경제적 영토 확장에 따른 교역증대 등을 통하여 우리 기업의 경영활동과 국민후생에 긍정적인 효과를 기대할 수 있다. 그러나 주의할 것은 늘어난 발효건수 만큼 각각의 FTA별 적용요건이 다르다는 것이다. 특히 간과하기 쉬운 직접운송 의 적용과 관련하여 분쟁이 빈번이 발생하고 있다. 이에 본 연구는 수입자 측면에서 원산지검증과 관련하여 가장 먼저 선행되어야 하는 한‧아세안 FTA의 ‘직접운송’의 충족을 위한 ‘통과선하증권’과 관련한 최근 의미 있는 대법원 판례를 중심으로 분석해보았다. 대법원에서는 ‘통과선하증권’이 제시되지 않더라도 ‘한·아세안 FTA 협정의정서 3’ 제9조에서 정하는 서류의 제시에 대하여 ‘직접운송 간주요건’으로 인정하고 있다. 수출국에서 수입국까지의 전체 운송경로가 입증되는 모든 서류로 인정되는 성과를 거두고 있다는 점에 그 의의가 크다. 이후 한‧아세안 FTA 협정상 ‘직접운송 간주서류’에 대한 반영이 되고 있음이 확인되었다. 향후 수입자는 운송경로가 직접운송인지 제3국 경유 운송인지를 확인하여 자사 물품이 운송과정에서 환적하는 경우, 반드시 경유지에서 발행하는 증명서류를 사전에 준비하여 세관의 사후검증에 대비하여야 할 것이다. Purpose : The purpose of this study was that the application requirements for each agreement due to the spread of FTAs are different, and disputes are frequent, especially in relation to the application of direct transport due to lack of understanding. Thus, its intention is to provide guidance to traders by anlaysis of the recent Supreme Court precedent analysis. Research design, data, methodology : This paper analyzes Along with literature research, this study focused on the Supreme Court precedents with the Korea-ASEAN FTA agreement, customs law, FTA special law and case. Results : Analysis shows that the scope of the Supreme Court s direct transportation was expanded by acknowledging not only the Through bill of lading issued by the exporting party in Article 9 of the ASEAN-Korea FTA Agreement 3. Conclusions : Regarding the requirements for direct transportation of the Korea-ASEAN FTA, the significance lies in that achieved results are recognized in all documents proving entire transport route from the exporting country to the importing country. Since then, it has been confirmed that it is reflected in the direct transportation considered documents . The importer should check the transport route and prepare for post-verification in customs by preparing certification documents issued at the stopover when own goods transship during the transportation process.

Facile diverted synthesis of pyrrolidinyl triazoles using organotrifluoroborate: discovery of potential mPTP blockers

<P>This article describes the rapid and diversified synthesis of pyrrolidinyl triazoles for the discovery of mitochondrial permeability transition pore (mPTP) blockers. The 1,3-dipolar cycloaddition of ethynyl trifluoroborate with azidopyrrolidine produced a key intermediate, triazolyl trifluoroborate <B>4</B>, which subsequently underwent a Suzuki–Miyaura coupling reaction to afford a series of 1,4-disubstituted triazoles <B>2</B>. Subsequent biological evaluation of these derivatives indicated <B>2ag</B> and <B>2aj</B> as the most potent mPTP blockers exhibiting excellent cytochrome P450 (CYP) stability when compared to the previously reported oxime analogue <B>1</B>. The present work clearly demonstrates that a 1,2,3-triazole can be used as a stable oxime surrogate. A Transient Effect of Convalescent Plasma Therapy in a Patient with Severe Covonavirus Disease 2019: A Case Report

A 65-year-old male patient with an end-stage renal disease was diagnosed with coronavirus disease 2019 (COVID-19) by reverse transcription polymerase chain reaction. The patient complained of cough, sputum, and respiratory distress that worsened three days ago. The patient required mechanical ventilation and extracorporeal mentrane oxygenation. On day 9, convalescent plasma collected from a 34-year old man who recovered from COVID-19 45 days ago was administered. The patient showed immediate clinical improvement. However, on day 14, the patient’s clinical course worsened again. On day 19 and day 24, vancomycin-resistant Enterococcus faecium bacteremia and methicillin-resistant Staphylococcus aureus pneumonia were found. After long-term supportive care, he slowly recovered. He was discharged on day 91 without any oxygen requirement. This case report suggests that convalescent plasma therapy might just provide a short-term relief and that persistent effort for critical care is necessary to save patients from severe COVID-19.

Synthesis and Biological Evaluation of Arylsulfonylpiperazine Derivatives as 5-HT₆ Receptor Ligands

The 5-HT6 antagonists are mainly related to the treatment of cognitive dysfunction or impairment associated with Alzheimer's disease and schizophrenia. There have been lots of efforts to develop 5-HT6 antagonists. As in our efforts, arylsulfonylpiperazine derivatives 1-3 were designed, synthesized and biologically evaluated against the human recombinant 5-HT6 serotonin receptor. Total 36 compounds were synthesized and the most active compound among the synthesized compounds is compound 2h with an IC50 value of 1.5 μM. The compound 2h is novel as 5-HT6 receptor ligand and could act as lead for the novel 5-HT6 receptor ligands.

Objective To evaluate whether oral contraceptive pill (OCP) pretreatments in gonadotropin-releasing hormone (GnRH) antagonist ovarian stimulation protocols takes positive effects on in vitro fertilization (IVF) outcomes in respect to retrieved oocyte number, oocyte maturation rate, fertilization rate, good quality embryo rate, cycle cancellation rate, pregnancy rate and clinical abortion rate. Methods A total of 194 cycles using GnRH antagonist protocol was performed at infertility clinic of our institute from September 1st, 2009 to February 28th, 2010. The medical records of GnRH antagonist protocols for IVF with or without OCP pretreatment in our IVF unit were retrospectively analyzed. We compared the IVF outcomes between OCP pretreated (n=41) and no pretreatment group (n=153). Results In cycles with OCP pretreated group, the total used dosage of gonadotropin (3019.38±1379.00 IU) were higher than that of no pretreatment group (2551.52 ± 1157.05 IU, P = 0.054). The duration of ovarian stimulation in OCP pretreated group (11.5 ± 2.0) was significantly longer than that of control group (9.5 ± 1.9, P = 0.000). The number of gained total embryo (2.8±0.9 vs. 2.5±1.0, P = 0.055) and fertilization rate (77.2% vs. 65.5%, P = 0.017) were significantly higher in OCP pretreated group. There is no significant difference in pregnancy rate between two groups (39.4% vs. 30.0%, P = 0.304). Conclusion OCP pretreatment before GnRH antagonist protocol for IVF appears not to have reliable benefit in terms of IVF outcomes. Wellcontrolled and large-scaled studies are needed.

Genetic Characterization of Atypical Shigella flexneri Isolated in Korea

Three types of serotypically atypical Shigella flexneri isolates were collected between 2007 and 2008 from Korean patients at the Korea National Institute of Health (NIH). These atypical isolates were characterized and compared with serologically typical S. flexneri. The first grouping of 11 atypical isolates displayed agglutination only with polyB antiserum and exhibited no reaction with any typing or grouping sera (PolyB:un). The second group of 3 isolates displayed reactions with typing sera IV, but also did not bind with any grouping sera (IV:un). The third group of 14 isolates exhibited a plural agglutination pattern, reacting with typing sera II, and two grouping sera (II:(3)4,7(8)). Amongst these atypical isolates, isolates belonging to IV:un and II:(3)4,7(8) exhibited greater antibiotic resistance, in particular to ampicillin, streptomycin, and trimethoprimsulfamethoxazole, than typical S. flexneri strains. Furthermore, all II:(3)4,7(8) strains harbored integrons. This study suggests that these multiple antibiotic-resistant atypical S. flexneri are new subserotypes of S. flexneri that await further serological classification.

Synthesis and Biological Evaluation of Aryloxazole Derivatives as Antimitotic and Vascular-Disrupting Agents for Cancer Therapy

<P>A series of aryloxazole, thiazole, and isoxazole derivatives was synthesized as vascular-targeting anticancer agents. Antiproliferative activity and tumor vascular-disrupting activity of all of the synthesized compounds were tested in vitro using various human cancer cell lines and HUVECs (human umbilical vein endothelial cells). Several compounds with an arylpiperazinyl oxazole core showed excellent cytotoxicity and metabolic stability in vitro. Among this series, two representative compounds (<B>6</B>-<B>48</B> and <B>6</B>-<B>51</B>) were selected and tested for the evaluation of anticancer effects in vivo using tumor-bearing mice. Compound <B>6</B>-<B>48</B> effectively reduced tumor growth (42.3% reduction in size) at the dose of 100 mg/kg.
