김대중 정부의 출범과 함께 시작된 지방교육분권은 교육부 중심의 유·초·중등 교육에 관한 권한을 시·도교육감에게 배분하는 것에서 출발한다. 그러나 지난 정부까지 권한 배분은 하향식 방식 등으로 실질적인 권한이 배분되지 않았다는 평가를 받고 있다. 본 연구는 현재까지 이루어진 교육부 중심의 유·초·중등 교육권한 배분 실태와 문제점을 분석하고, 중앙정부가 아니라 시·도교육청 차원에서의 유·초·중등교육 권한 배분 방안을 모색하고자 하였다. 이를 위해 본 연구자를 중심으로 전국 17개 시·도교육청의 영역별 전문가로 구성된 TF를 운영하여 교육부의 사무를 전수 조사하고, 보충성의 원칙을 기본 방향으로 하여 교육과정, 진로, 인성 등의 영역으로 나누어 배분 사무를 선정하였다. 그 결과 현재 지방과 학교에서 추진되어야 할 390건의 사무가 교육부에 집중되어 있음을 확인하였고, 이 중 337건을 시·도교육청 배분 사무로 선정하였다. 본 연구에서 이루어진 권한 배분 사무들이 교육부에서 시·도교육청으로 더 실효성 있고 안정적으로 배분되기 위해서는 「유·초·중등교육 권한 포괄적·일괄 배분 특별법」(가칭)이 제정되어야 하며, 권한 배분으로 인한 학교 업무 부담을 최소화하기 위해 교육부 사무가 단위학교로 배분되기 전에 시·도교육청 차원에서의 과감한 폐지가 선행되어야 함을 제언한다. Since Kim Dae-jung government, the decentralization of education authority has distributed the authority of primary and secondary education from the Ministry of Education to the superintendents of the city/provincial education offices. However, the distribution has not been successful so far and the process is still considered top-down. The study is to analyze the status and problems regarding the distribution and suggest measures for distributing the authority of primary and secondary education from the Ministry of Education to the superintendents of the city/provincial education offices. In order to investigate the over all affairs of the Ministry of Education, a special task force team consisting of experts from 17 city/provincial education offices has been formed. With the principle of subsidiarity, the affairs of the Ministry of Education were divided into 13 sectors; curriculum development, career education, and character building education, etc. The findings show that 390 educational affairs which belong to the city/provincial education offices or individual schools were assigned to the Ministry of Education. Among them, 337 educational affairs were chosen as the candidates for affairs of the city/provincial education offices. For more substantial and successful distribution of education authority, [Special Act on Comprehensive Distribution of Primary and Secondary Education] (tentative) should be legislated. In order to minimize the burden on individual schools from the distribution of authority, unnecessary educational affairs of the Ministry of Education should be drastically abolished before they are distributed to individual schools by the city/provincial education offices.
