본 연구는 현재 논란이 되고 있는 한·미 행정협정의 불평등한 내용은 무엇이며 어떻게 개선해야 할 것인가에 대한 대안을 마련하는데 그 목적이 있다. 한·미 행정협정의 내용 중에서 가장 문제점으로 지적되고 있는 부분이 형사 재판권에 관한 사항이다. 이 중에서도 피의자의 인도 시점이 가장 큰 문제라고 생각하는 사람이 많지만 사실은 어느 한 부분만을 지적할 수가 없고, 한·미 행정협정 제22조에 규정되어 있는 형사 재판권의 모두를 문제점으로 지적할 수 있다. 동 협정을 개선함에 있어서 몇 가지 사항에만 국한하여 부분적으로 개선을 한다던가, 합의 의사록이나 합의 양해사항 정도의 미세한 점에 대해서만 논의해서는 안되고, 형사 재판권 전체의 내용을 정책적·행정적·법률적 차원에서 국회와 통수권자가 앞장서서 근본적으로 개선한다는 의지를 보여야 한다.

경제의 발전에 따라 우리나라에서도 청소년의 약물 오 · 남용이 계속해서 증가하고 있다. 약물의 오·남용은 한번 습관화되면 중단하기가 매우 어렵고 육체적, 정신적 파괴를 가져올 수 있으며, 전파력이 강하기 때문에 현재의 증가 추세로 미루어 볼 때 결코 도미노 현상에 대해서 방심할 수 없는 상황이다. 미래의 주역인 청소년들이 건강하게 성장할 수 있도록 하기 위하여 마약과 약물의 오·남용으로부터 보호하는 것은 무엇보다 중요하고 시급한 실정이다. 청소년기는 성격적 특성으로 인하여 기성세대의 체제에 저항하며 도전하려는 시기이므로 사회에서 금기하는 것들을 모두 하고 싶어한다. 이와 같은 모험심을 가지고 있기 때문에 청소년들은 약물의 유혹에 쉽게 탐닉하게 된다. 청소년기의 특징은 여러 가지 관점에서 관찰할 수 있다. 그러나 청소년의 약물 오·남용은 가장 문제시 되는 사안이다. 그러므로 본고에서는 흡연, 음주, 흡입제, 마약 등 남용 실태를 파악하고 그에 대한 대책을 마련해 본다. Very rapid change and development in economical growth and material civilization resulted in very remarkable growth in the social welfare state environment. Teenagers' drug abuse resulted in many problems as the addict class proliferated and the age of addicts followed a downward tendency. Even with stout regulation and penalty, the number of drug addicts showed an increasing trend. It is reasonable that active medical remedy for narcotic addict is performed simultaneously while exposing and punishing drug addicts in order to eradicate drug addicts. So this thesis analyze the actual state of the problems deeply and researches short and long-term consistent counter-measures and emphasizes eradication of drugs and public information to teenagers at the local and central government's level.

청소년의 흡연·음주 실태조사 및 정책대안에 관한 연구 : 전라북도 고등학교 학생을 대상으로

흡연과 음주는 성장기에 있는 청소년에게 매우 치명적인 신체적ㆍ육체적 의존성과 금당증상을 일으키는 전염성이 매우 강한 사회병리적 질환이라고 정의할 수 있다. 그런데 이러한 폐해를 잘 모르는 청소년등은 호기심이나 동료의 권유와 압력 또는 자기도 모르는 사이에 흡연과 음주에 도취되어 버리는 경우가 대부분이다. 청소년 누구도 흡연과 음주로 인한 피해의 예외가 될 수 없다는 사실을 우리 모두 깊이 인식하여야 한다. 정부기관에서도 청소년의 흡연과 음주의 방지가 국가 정책의 일부임을 자인하고 필요한 자원을 지원하는 등 정책적 배려가 있어야 한다. 그리고 지방자치단체, 사회단체, 학교, 가정을 등이 모두 합심하여 청소년의 흡연과 음주를 방지하여야 한다. 특히, 흡연은 육체를 파멸시키는데 그치지 않고 영혼까지 송두리째 파멸키신다는 점에서 세계 각국에서는 흡연을 금연으로 전환하는 사업을 전개하고 있다. 흡연과 음주는 단기 1회적인 교육 방법으로 실효를 거둘 수 없기 때문에 그 원인을 파악하고 국가적 차원에서 그 정책적 대안을 강구하여야 할 것이다.

청소년 마약류 남용 실태조사 및 정책대안에 관한 연구 : 전라북도 고등학생을 대상으로

우리나라 청소년의 약물 남용 추세는 1989년에서 1991년은 하락세, 1991년에서 1993년은 약물에 따라 증가하거나 감소하는 경향을 보이다가 1996년 이후 대부분의 마약류 등이 증가하는 추세이다. 성인의 경우 필로폰, 마약 등이 남용 약물의 주류를 이루고 있으나 청소년의 경우 경제적인 이유와 구입의 용이성 등으로 신나, 가스, 본드 등 유해화학물질과 한외마약^(1))인 신경안정제, 수면제, 진해 거담제 등이 남용되고 있다. 청소년의 약물 남용은 더 이상 방치해서는 안되고 중앙정부와 지방정부 차원에서 대책을 세워 차질 없이 시행해 나가야 한다. 그리고 우리 모두는 관심을 갖고 미래의 주역인 청소년을 선도하고 보호하는 데 수고를 아끼지 않아야 한다. The Drug dilemma was designed for those who teach and counsel students. Young men and women have widely varying amounts of information about the mind altering drugs. 임의동행은 경찰행정작용 또는 임의수사의 한 방법이다. 피의자 등은 수사기관의 임의동행의 요구를 받았을 때에 임의로 동행을 승낙할 수도 있고, 거부할 수도 있다. 피동행자가 임의동행을 거부하였을 때에는 수사기관은 동행을 강요할 수 없고, 구속의 요건이 있을 때에 한하여 체포영장을 발부받아 체포하거나, 긴급구속의 요건에 해당될 때에는 영장 없이 긴급체포 형식으로 강제 동행한 후 구속영장을 청구할 수 있다. 이러한 처분은 형사소송법의 규정에 의하지 않는 한 피동행자의 신체를 구속하거나 그 의사에 반하여 답변을 강요할 수 없기 때문에 문제가 되는 것이다. 이러한 문제를 입법론, 판례 등을 참고하여 실제 우리나라의 임의동행에 의한 수사의 적법성에 부수하여 운영실태의 범위와 한계 등 책임성 문제를 고찰해 본다. Violation on duty to notify the party to have the right to call an investigation authority, Violation on the time of company, Violation on the place of company, and Violation on using force such as compulsory during the process of voluntary company in state of illegal voluntary company. It also has to decide whether the evidences are illegal and eliminated by these two requisites even in probative value and evidence admissibility on confession of the party under the illegal voluntary company.

The purpose of this study is to examine localization of the police system in Korea today with emphasis on previous attempts during the last fifty-two years, since the foundation and neutralization several times without any success in the past because they still followed the central government police policy. I believe that the localization of the police system is needed today and must be realized on a basis of necessity. First, We need the local government to be stabilized, police investigation to be independent, and political neutralization. The localization of the police must be achieved in order to realize the democratization of our society. Many people desire the localization of the police force since such localization is already practiced in various other general fields of policy including economy and culture. The purpose of this study is to examine localization of the police system in Korea today with emphasis on previous attempts during the last fifty-two years, since the foundation of the Korean National Police. The Korean National Police have had their own localization and neutralization several times without any success in the past because they still followed the central government police policy. I believe that the localization of the police system is needed today and must be realized on a basis of necessity. The localization of the police must be achieved in order to realize the democratization of our society. Many people desire the localization of the police force since such localization is already practiced in various other general fields of policy including economy and culture.
