The purpose of this study is to examine ethical problem on ungentlemanly act of intentional foul in sport competitions. Although intentional fouls are used within the limit of allowed number of fouls or rules for just warning, whether or not victory led by such intentional foul is morally valid is questionable when it is against the fair play spirit of sport. Ethical consideration on intentional foul was conducted from deontological view and teleological view. By proposing utilitarian view that intentional fouls are wrong only when one loses in the end, and it is okay as long as the opponent is dominated, along with the deontological view of retribution justice arguing for inevitable punishment, intentional fouls should be punished and controlled. However, in reality where even malicious fouls are prevalent, coaches and athletes should be able to tell what is right and wrong with reason and conscience. In order to have good conscience, athletes must have training habits that are helpful to each other, coaches should teach athletes that all athletes are their colleagues, not enemies, and the audience should form a bond of sympathy so intentional fouls are eradicated. Therefore, character cultivating education should come first for athletes and coaches than victory in competitive situations. 이 연구는 스포츠경기에서 비신사적인 행위로 간주될 수 있는 고의적 반칙에 대한 윤리적 문제를 검토하고자 한다. 고의적 반칙은 개인의 제한된 반칙 수 또는 경고수준의 규정 내에서 전술의 일부로 활용되고 있으나, 스포츠가 추구하는 페어플레이 정신을 역행하는 행위이기 때문에, 고의적 반칙으로 인한 승리가 도덕적으로 유효한가에 대해 문제를 제기하는 것이다. 고의적 반칙에 대한 윤리적 입장은 규범윤리에서 목적론적 관점과 의무론적 관점에서 논의를 시도하였다. 즉 고의적 반칙은 결과적으로 패했을 때만 그른 것이고 상대를 제압하면 유용하다고 하는 공리주의적 견해와 고의적 반칙에 대한 필연적 처벌을 주장하여 응보적 정의를 드러내는 의무론적 견해를 제시함으로써, 일벌백계에 의한 예방적 목적과 해악의 원리를 근거로 하는 강제적 차원에서 벌칙으로 제재를 가해야 한다는 것이다. 그러나 심판에 적발되지 못한 악의적인 반칙도 비일비재 하는 현실에서 선악을 판단하는 양심에 따라 선수와 지도자는 이성적 판단으로 무엇이 옳은가를 분별할 줄 알아야 한다. 선수는 서로에게 도움이 되는 훈련습관이 강조되어야 하고, 지도자는 상대가 적이 아닌 동료의식을 심어주어야 하며, 관중은 고의적 반칙이 근절될 수 있도록 공감대를 형성해야 할 것이다. 따라서 경쟁상황에서 승리가 먼저이기 전에 인격을 위한 선수와 지도자의 인간교육이 우선되어져야 할 것이다.

지방대학 교육 만족도에 영향을 주는 요인에 대한 잠재성장모형분석

This study examines the structural relationship on factors that affect educational performances in local universities using seventh(2010) to ninth(2012) data from the panel of middle school students of the Korea Education and Employment Panel(KEEP). The results are as follows. First, as a result of analyzing the research model, it was found that university facilities and resources, curriculum, university counseling, and professor interview significantly affect the intercept of teaching-learning satisfaction, and the significance of the variance of the intercept showed that individual differences are existed in teaching-learning satisfaction factor. Second, curriculum and university counseling significantly affect the slope of teaching-learning satisfaction. Third, university counseling and the intercept and slope of teaching-learning satisfaction have a significant effect on university education satisfaction. 지방대학의 경쟁력 강화의 시대적 필요성에 따른 지방대학 교육의 체계적 이해를 도모하기 위하여 본 연구는 지방대학의 교육 만족도에 영향을 미치는 요인에 대한 구조적 관계를 잠재성장모형으로 분석하였다. 한국교육고용패널조사(KEEP) 중학생 패널 7차(2010년)에서 9차(2012년) 자료를 이용하여 지방대학의 교육만족도에 영향을 주는 요인의 변화와 관계를 분석하였고 연구결과는 다음과 같다. 첫째, 본 연구의 잠재성장모형에서 제시한 대학시설지원, 교육과정, 기초학습 프로그램, 대학상담, 교수 면담은 교수-학습 만족도와 관련이 있으며, 초기치의 분산이 유의한 것으로 나타나 개인차가 존재하는 것으로 나타났다. 둘째, 연구대학시설지원, 교육과정, 대학상담, 교수면담이 교수-학습 만족도의 초기치에 영향을 미치는 것으로 나타났다. 셋째, 교육과정 및 대학상담이 교수-학습 만족도의 변화율에 영향을 미치는 것으로 나타났다.

As the healthcare environment has changed both socially and politically importance of public health doctors' roles has increased and ongoing revision of their roles is also needed in Korea. However, many problems have decreased the job satisfaction of public health doctors. This study aims to determine the factors that influence public health doctors' satisfaction. The survey was conducted over the course of 2 months by questionnaire methodology. A total of 881 respondents (response rate, 90.1%) participated and 778 valid responses were analyzed using SAS version 9.1. Items about arranged organization, work task, employee welfare and services, education, public health doctor’s system, and the role of public health doctors were included in the questionnaire. It was found that the satisfaction of many respondents was not high and they had negative perceptions of arranged organization, work, environment, employee welfare and services, education, system, and their own role. Although the public health doctors have professional knowledge of healthcare, they were not satisfied with their role because they were required to do inappropriate work, improperly arranged and found performing work difficult when treated unfairly or not paid fairly. Therefore, policies focused on financial compensation or system improvement must be established to increase the satisfaction of public health doctors. This study’s limitation was that the survey was done through two modalities. However, it is meaningful that issues related to the public health doctors were dealt with more comprehen-sively in this study than other studies.

This study discussed fairness of judge in sports with “categorical imperatives” in Kant's duty ethics, Aristoteles'“virtue ethics”and“courage”in Plato's dialogue. Judges, in sports, not only have the responsibility of making decision based on duty ethics but also carry the duty of morality even in the situation that goes off the duty ethics. The decision of judge is on Kant's duty ethics, which is an act by the will from respect of the rule and it should be made with no compensation. However, every factors on sport game does not solved by duty ethics. Accordingly, the courage and character based on morale, in other word, high moral responsibility of judge reveals fairness. Aristoteles tells that character by virtue ethics inures habit and this habit makes big difference. In short, right judgement comes from clear understanding and its act of the rule. And for intuitional judgement needs the constant effort because it is formed by repeated empirical learning and training. And the courage is completed through experience and persistent education of wisdom, and the essential factors of it are precise judgement by constant practice and technical skills. For being judge with this right courage and fairness, the necessity of reasonable educational system and consistent effort for improving professional quality should be given and it will establish the role of judge as alive fairness and interesting sports game. 이 연구는 칸트의 의무윤리에서 ‘정언명법’과 아리스토텔레스의 ‘덕윤리’와 플라톤의 『라케스』에서 대화중 ‘용기’에 대한 문헌고찰을 통하여 스포츠에서 심판의 공정성에 대하여 논의하였다. 심판은 의무윤리에 기초한 판정의 책임뿐만 아니라 의무윤리에 비켜가는 판정의 애매한 상황에서도 도덕성에 기초하는 판정에 대한 의무를 지니고 있다. 심판의 판정은 칸트의 의무윤리에서 의무, 즉 규칙에 대한 존중으로부터 자신의 의지에 따라 이루어지는 행위이며, 행위의 결과에 그 어떤 보상 없이 판정되어야 한다. 그러나 의무윤리만으로 경기의 모든 것이 해결되는 것은 아니기 때문에, 도덕적 윤리에 기초하는 용기와 품성이 결과적으로, 격(格)을 갖춘 심판의 도덕적 책임이 공정성을 발현시킬 수 있다. 아리스토텔레스는 덕윤리에 의한 품성이 습관을 길들이고 습관이 큰 차이를 만드는 것이라고 하였다. 요컨대 올바른 판정은 규칙을 명확히 이해하고 이행하는 행위로부터 비롯되며, 직관에서 주어지는 판정은 반복된 경험적 학습과 훈련에서 만들어지는 것이기 때문에, 부단한 노력의 결과물이 되어야 한다. 그리고 심판의 용기는 경험과 앎의 지속적인 교육을 통해서 완성되며, 반복연습에 의한 정확한 판단력, 기술적 테크닉이 필수적이다. 이러한 참된 용기와 공정성을 갖춘 심판이 되기 위해서 합리적 교육시스템의 필요성과 전문인으로서의 자질향상을 위한 꾸준한 노력이 전제되어질 때 공정함이 살아있는 흥미로운 스포츠경기로서 심판의 역할 매김이 가능하게 될 것이다.
