보험소비자보호에 관한 연구 – 2012년 입법예고된 상법 보험편 개정안 통칙편을 중심으로 -

Insurance is a social economic system, which relieves economical anxiety due to uncertain physical or material damages. So, insurance law revision needs prudent review on protection of insurance consumer. The purpose of Insurance law revision is in modernization and modernized insurance must correspond to modern society and global standard. Among the revision, protection of insured consumer is the most important task. You can easily find such precedents in advanced legislation cases. According to Section 6, Clause 1 of German insurance contract act, which has been revised in July 5th 2007, and activated since beginning of 2008, 'If the difficulty in assessing the insurance being offered or the policyholder himself and his situation gives occasion thereto, the insurer must ask him about his wishes and needs and, also bearing in mind an appropriate relation between the time and effort spent in providing this advice and the insurance premiums to be paid by the policyholder, the insurer shall advise the policyholder and state reasons for each of the pieces of advice in respect of a particular insurance. He shall document this, taking into account the complexity of the contract of insurance being offered.' This statement regulates responsibility of insurer to consult and provides regulatory protection to policyholder. If this has not been fulfilled or documented, such act can be a legal basis of compensation. A strong will of legislator to protect insurance consumer can be seen through above legislation. South Korean government also have made pre-announcement of legislation on amendments of insurance law, according to social environment change and new insurance superintendence change, in June, 15th, 2012 through public announcement '2012-156' of Department of Justice. Such amendment has been prepared under principle of rational and fair balance between insurance company and insurance consumer, balance among civil act, insurance inspection regulation and foreign countries' legislation cases, protection of policyholder, and procurement of good intention of insurance system. However, despite of commercial law commission's effort on insurance law amendments, there can be seen some insufficient items on aspects of insurance consumer. So following thesis will cover insurance consumer protection mainly on insurer’s duty to deliver and explain the insurance clauses, insurance agency's authority, duty of disclosure related regulations, and regulation on period of extinction session on insurance claim.

대기오염 원격측정용 LIDAR의 레이저광으로 사용하기 위해 반복율 500Hz급 엑시머 에리저를 개발하고 이의 고반복 에이저 출력특성, 레이저 가스의 유로구조와 CR특성을 조사하였다. 레이저 장치는 유선형의 가스유로, 주전극 직렬 UV 예비전리방식 등의 방법을 사용하고 컴팩트한 구조로 제작하여 가스 실용적을 10 liter 이하로 소형화하였다. KrF 레이저를 500Hz로 동작할 때의 최대출력은 53watt, 출력변동율은 .+-.6.7%, CR은 2.3, 방전체적은 2.0(H)*1.2(W)*56(L)=134$cm^{3}$ 이다. 이때 초기 출력에너지의 50%까지 출력이 감소할 때의 레이저가스의 수명은 3*$10^{6}$ shots이다. A 500 Hz repetition rate excimer laser was developed as light source for pollution lidar. In this paper, the high repetitive output characteristics, the gas flow loop structure, and CR(clearing ratio) characteristics were investigated. Our laser system was constructed compact structure with a streamline gas flow loop and UV preionization. The real gas volume of laser is 10 liter. At 500 Hz repetitive operation, we have obtained average power of 53 watt with KrF laser gas. The variation of laser output, CR, and active volume are $\pm$6.7%, 2.3, and 2.0(H)$\times$1.2(W)$\times$56(L)=134 ㎤, respectively. Laser output power is declined to half at 3$\times$$10^6$ shots.

레이저 가스를 하나의 횡류팬만으로 순환시키는 동심 원통형 구조의 소형 엑시머레이저를 개발하였다. 이 방치를 1kHz의 고속으로 반복동작시켰을 때 KrF 레이저의 평균출력은 56watt였다. 본 논문에서는 kHz급의 소형 엑시머레이저를 실현할 수 있는 설계 파라메터와 레이저 가스의 CR(Clearing Ratio)특성을 분석하였다. 평균출력 56watt일 때 레이저 효율은 1.2%, CR은 2.97, 출력변동율 .+-.9%이다. 이때 레이저 가스용적은 10 liter이고 방전체적은 1.8(높이)*1.2(폭)*30(길이)=64.8$cm^{3}$이다. A compact excimer laser was developed with coaxial type which the one line cross flow fan is only used. At 1 kHz repetitive operation, average power of KrF laser is 56 watt. In this paper, Design parameter and CR characteristic are investigated for attainment of the compact 1 kHz excimer laser. We have obtained overall efficiency of 1.2% with KrF laser gas. At this time, CR and the variation of laser output are 2.97, $\pm$9%. Laser gas volume and active volume are 10 liter, 1.8(H)$\times$1.2(W)$\times$30(L)=64.8 ㎤, respectively.
