갈등 관리 프로세스에 의한 ABS협상의 갈등 사례 분석

생물다양성협약이 발효되면서 유전자원의 물질적 거래 즉, ‘유전자원에 대한 접근과 이의 이용으로 발생한 이익의 공평한 공유(ABS)’의 구체적인 기준을 정립하기 위한 나고야 의정서가 채택되었다. 이 의정서는 선진국과 개도국 간, 생물자원 부국과 빈국 간, 생물자원을 이용하는 다국적 기업과 전통지식을 보전하려는 환경보전단체 간 갈등 과정끝에 채택된 것이다. 이 사례를 바탕으로 갈등 과정, 갈등 주체와 쟁점을 분석하였고, 선행연구 고찰을 통해 주요 갈등요인을 규명하여 갈등 관리 프로세스에 적용하였다. 이를 통해 소수의 개별 사례에 한정된 갈등 사례가 아닌 다양한 형태의 갈등 사례에 대해 갈등 예방 및 해결을 위한 시사점을 도출하고자 하였다. 일반 갈등 사례와 ABS협상 사례의 교집합적인 갈등 요인을 분석하기 위해 선행연구를 검토하여 본질적 측면, 자원 배분 측면, 의사소통ㆍ정보공유 측면으로 구분하였다. ABS협상 타결 과정에서 갈등이 예방 및 해결된 사례에 따라 이해당사자들 간 상호 신뢰 구축, 협상중재자 양성을 위한 정책적 관심 제고, 갈등 관리를 위한 법적ㆍ정책적 체계 구축이 주요 시사점으로 제시되었다. Nagoya Protocol designed to establish criteria about material trade of biological genetic resources(ABS) was adopted in the 10th conference of the Parties to the Convention on Biological Diversity. In the course of the negotiation for adoption of the protocol, there was conflict between developed and developing countries, resource-rich and poor countries, and multinational corporations and environmentalists. This study investigates conflict process, subjects, issues and major factors in the negotiation case, and analyzes the negotiation by using the Conflict Management Process. To develope conflict management strategies for various conflict cases, we examine previous studies and analyze the intersectional conflict factors of this case and general cases, such as Fundamental side, Resource-allocation side, and Communication/Information-sharing side. These analyses of conflict prevention/resolution of the ABS negotiation show the importance of building mutual trust among stakeholders, enhancing mediator training, and constructing appropriate legislative/policy systems for successful conflict management.

발달장애학교 중학교과정 직업교과 담당교사의 직업교과서 활용에 대한 인식

이 연구는 발달장애학교 중학교과정 직업교과 담당교사의 직업교과서 활용에 대한 전반적인 인식과 만족도 및 구체적인 사용실태를 알아봄으로써, 2011 개정 중학교 직업교과서 활용을 위한 보완점과 개선점을 밝히는 데 목적을 두었다. 연구목적을 달성하기 위해, 9개 지역 17개교 발달장애학교에서 중학교과정 직업담당교사 167명을 목적표집하였다. 연구 결과, 발달장애학교 중학교과정 직업교과 담당교사의 직업교과서에 대한 활용 비율은 40%이하였다. 교과서 내용을 학생 수준에 맞게 재구성하거나 순서를 조정하여 활용하는 것으로 나타났으며, 주로 보조 자료로 활용하고 있었다. 교과서 구성체제에 대한 만족도는 내용 조직, 외적 체제, 내용 제시, 내용 선정, 평가의 순으로 나타났다. 직업교과서의 활용도는 직업생활, 직업탐색, 직업준비, 진로설계 순이었다. 이러한 연구결과는 좋은 교과서를 보급하는 것도 중요하지만 교과서 내용의 재구성 방법을 연수한다거나, 영역별로 재구성의 효과를 현장의 다양한 사례를 통해 점검해보는 것, 활용 매뉴얼 보급 등 보다 효과적인 전달체계가 필요함을 시사한다. This study was intended to identify supplement points and improvement points for using 2011 revised middle school vocational textbook by investigating general recognition, satisfaction level, and specific usage of vocational textbook of teachers for middle school courses at special school of developmental disabilities. To this end, this study selected 167 vocational teachers for middle school courses at 17 special schools of developmental disabilities from 9 districts. As a result, the application rate of vocational textbooks of teachers for middle school courses at special school of developmental disabilities was below 40%. It was identified that they reconstructed the textbook contents or adjusted the order according to the students level, and they were mainly used as the supplementary data. The satisfaction level for textbook structure was in the order of content structure, external system, content presentation, content selection, and assessment. The application degree of vocational textbook was in the order of vocational life, job search, vocational preparation, and career planning. It is important to supply good textbooks, but the research results suggested that it is necessary to provide more effective delivery system as training the reconstruction method of textbook contents, reviewing the effect of reconstruction by area through various cases, and supplying application manual.

연구논문 : ABS 선례분석을 통한 국내 자생 생물자원의 주권적 권리확보 방안 연구

This paper investigates to secure sovereignty rights on the native biological resources to copewithNagoya Protocol, themost compulsory international regime onABS. As a result of analysis on successful ABS cases, four criteria needed to be reviewed for securing sovereignty rights are deducted. These criteria could be summarized as follows: 1) Geographical range of biological resources, 2) Status of ownership of traditional knowledge, 3) Relationwith patent and 4) Procedures to ensureABS ownership. On the basis of these criteria, this study reviews the actual condition of the regulations and international regimes such as Convention on Biological Diversity and Nagoya Protocol to deduct the national counterplan for securing sovereignty rights. The result of this study is as follows. First, in-situ endemic species should be more conserved, restored, and discovered steadily. Secondly, database on traditional use should be established as evidential material considering similar culture area. Thirdly, terms and conditions of contract should be expeditiously decided depending on negotiation between parties because of absence of international regulations related with patent. Accordingly, international negotiating power on patent issue should be enhanced. Lastly, the proper actions in the procedures of successful ABS cases should be constantly reviewed to strengthen the national sovereignty rights on biological resources and be used in awisemanner.
