Skype의 구조 및 사용정보 분석을 통한 디지털 증거획득 및 분석방법 제시

인터넷 전화는 인터넷을 통해 실시간으로 대화를 주고받을 수 있는 소프트웨어이며, 점차 사용률이 증가하고 있는 추세이다. 그러나 인터넷전화의 사용률이 증가함에 따라 인터넷전화를 사이버 범죄의 도구로써 악용하는 사례가 증가하고 있다. 본 논문은 인터넷 전화서비스 중, 가장 많은 가입자를 가지고 있는 Skype를 분석하였다. 분석 결과 Skype로 부터 사용자 정보와 사용 흔적을 획득할 수 있었으며, 이 결과는 사이버 범죄수사나 법정증거로써 유용하게 활용될 수 있을 것이다.
「정신건강복지법」비자의 입원제도의 개선을 위한 사법입원제도 도입 가능성에 대한 연구

2020년 4월 한국은「정신건강복지법」개정이후 비자의 입원의 입원요건을 입원 필요성 및 자・타해 위험으로 강화했다. 더불어 입원적합성심사위원회를 통해서 입원 적법성 여부를 심사하도록 하여 형사상 절차와 차별을 두어 준사법적 성격을 가진 행정위원회로서 성격을 갖추도록 했다. 이처럼 한국에서 형사상 구금 절차와 구별하고자 환자의 치료와 인권보장을 위해 입원적합성심사위원회가 설립된 취지는 긍정적이라고 볼 수 있다. 그러나 여전히 사회의 구성원으로서 정신질환 환자의 “인간다운 삶”을 보장하기 위한 기구로서의 기능과 그 역할, 그리고 그 책임의 명확성을 평가할 때는 여전히 미흡한 실정이다. 이에 환자들의 인권을 실질적으로 보호할 기관으로서 입원적합성심사위원회에 사법심사 제도를 도입이 검토될 시점이다. 비자의 입원에 관련한 정신질환자에 대한 인권침해에 관련하여 나타날 수 있는 사항들에 대해서 다음과 같은 점을 고찰하였다. 1) 입원적합성심사위원회가 의료전문가의 객관적이고 공정한 진단체계를 가지기위해 진단의 전문성을 기해야 한다는 점, 2) 정신질환에 있는 국민의 인권 회복과 기본권을 적극적으로 보장하기 위한 치료목적을 판단하기 위해 비자의 입원 판단과정에서 헌법상 비례의 원칙과 더불어 우리나라 실정에 맞는 사법 입원 제도를 수정하여 적용해야 한다는 점, 3) 자기 결정권의 회복 차원으로서 비자의 입원의 결정과정과 그 이후의 조치에 대해서 단계적 정책 변화를 위한 독일과 프랑스의 비형사적절차 및 국제보건기구가 제시하는 독립성과 중립성 원칙 수용을 위한 우리나라의 사법심사 제도의 단계적 도입 가능성을 기술하였다. After the revision of the Mental Health Welfare Act in April 2020, Korea strengthened the hospitalization requirements that could only be hospitalized or self-injury risks, and made it clear that it had a quasi-judicial nature by examining the legality of hospitalization through the hospitalization suitability review committee. As such, the purpose of establishing an inpatient suitability review committee to treat patients and guarantee human rights in order to distinguish it from criminal detention procedures in Korea is positive. However, as a member of society, it can still be seen as insufficient when evaluating the function and role as an organization to ensure the “human life” of mentally ill patients, and the clarity of their responsibilities. As an institution that practically protects the human rights of mentally ill people, it is time to consider introducing a judicial review system to the Hospitalization Suitability Review Committee, and the following points were considered regarding human rights violations for mentally ill people related to visa hospitalization. 1) The hospitalization suitability review committee must take expertise in diagnosis in order to have an objective and fair diagnostic system of medical experts. 2) In order to determine the purpose of treatment to actively guarantee the human rights recovery and basic rights of the people in mental illness, the principle of proportionality under the Constitution and the judicial hospitalization system suitable for the situation in Korea should be revised and applied. 3) In order to apply non-criminal procedures in Germany and France and to accept the principles of international health organizations, Korea can gradually introduce the judicial hospitalization system.

The microstructure of carbon film, deposited using hot-filament chemical vapor deposition, was investigated in relation to deposition pressure and methane concentration as deposition variables. Methane concentration in hydrogen gas was varied from 0.5 to 5% in volume. Deposition pressures were 5, 15, 45 and 75 Torr. Filament temperature and deposition temperature were fixed at 2100 ℃ and 950 ℃, respectively. With increasing methane concentration, the surface morphology changed its microstructure from microcrystalline diamond, to nanocrystalline diamond, to graphite. Raman spectroscopic analysis and X-ray diffraction analysis confirmed the bonding structures corresponding to each microstructure. At 5 Torr, the surface showed a fine grained morphology, different from the microstructures in the other pressure cases; however, the bonding nature also changed from diamond to graphite with increasing methane concentration.

The unit of a buoyant force included in the 7th national science curriculum for 6th grade students. On the contrary, it seldom that students` conception about buoyant phenomena is studied, even though there has been many studies of students` conceptions of basic science contents. The purpose of this study was to survey the elementary school students` conceptions of a buoyant force, to analyze their cognitive levels, and to explore the relationships between them. Sixth grade students (total numbers is 192) were selected from 5 classes in two elementary schools in a local city of Kyungsangdo. They were asked to respond two kinds of test, which are the Logical Thinking Ability (GALT) to investigate students` cognitive levels and the Buoyant Force Questionnaire (BFQ). We developed BFQ test, based on the 7th national science curriculum for 6th grade and the previous researches of a buoyant force. We, qualitatively, analysed students` frequency of responses about a buoyant force and their types of explanation, and, quantitatively, analysed the relationships between cognitive levels and conceptions of a buoyant force with SPSS/PC 7.0 programmes. The results of cognitive level showed that half of 6th grade students were in the concrete operational stage, 43.2% in the transitional stage, 6.8% in the formal stage. However, their sub-logical thinking abilities in a combinational, conservational, controlling variables, proportional, probability and cotrelational logic were very fluctuated from 91% to 8%. The results that only 4.8% of elementary students had correct conceptions of a buoyant force suggest that 6th grade students had great difficulties in understanding of that concept. Their difficulties would originated from the frequent common-sense explanations of a buoyant phenomena in terms of the weight or the unique properties or the contact area of an object or with/without air. Furthermore students` explanations, frequently, changed with context of problems of a buoyant force. Scheffe test of quantitative results that elementary students in the concrete level had 50.6% of concept formation in a buoyant force, the transitional level 54.5%, and in the formal operational level 62.8% showed significant differences of conceptions of a buoyant force with cognitive levels. Therefore the concrete operational elementary students had more difficulties of understanding of a buoyant force than the transitional and formal level, which is required to higher cognitive levels. This conclusion have implications that the unit of a buoyant force have to be presented with concrete activities for majority of students who are in concrete and transitional levels.
