20세기 후반부터 공공예술단체가 창출한 예술적 재화에 대한 시장 경합성이 제한적이기는 하지만 증가하고 있다. 이러한 맥락에서 1997년 외환위기를 기점으로 중앙정부와 지방자치단체의 직·부속기관인 공공예술단 체들에 대한 신공공관리적 혁신을 위해 비영리 재단(또는 특수) 법인화가 추진되었다. 그 일환으로 서울시향 과 관련된 재단법인화가 두 차례에 걸쳐 진행되었고, 궁극적인 목적은 예술성·공공성·효율성의 증진이었다. 특히 예술성의 부족은 공연에 대한 관람객의 만족도를 떨어뜨리고, 서울시향의 브랜드와 같은 공공재의 창출을 어렵게 한다. 더구나 예술성은 경합성이 높아지고 있는 공연시장에서 경쟁력의 핵심이다. 이처럼 중요한 예술성의 증진에 대해 서울시향의 신공공관리적 혁신이 얼마나 기여했고 그 한계는 무엇인지에 대하여 심층적으로 분석한다. 서울시향의 공연에 대한 음악평론, 시장평가, 그리고 서울시향 관계자들과의 면접자료에 대한 분석결과는 일관되게 2005년 서울시향의 단독 재단법인화에 의한 출연기관으로 전환을 통해 도입·시행된 신공공관리적 혁신이 서울시향의 예술성을 놀라울 정도로 향상시켰음을 보여준다. 신공공관리적 혁신의 방안으로 단독 재단 법인화의 핵심은 예술감독을 책임자로 한 교향악단의 자율성 강화이다. 교향악단의 자율성 강화를 위해 이원적 지배·운영구조를 채택하였고, 예술감독이 오디션을 토대로 계약임용제와 성과급 및 연봉제를 원칙대로 시행하였으며, 그 결과로 예술성이 획기적으로 향상된 것이다. 특히 교향악단 내부에 경쟁을 강화하기 위한 오 디션과 계약임용제가 서울시향 예술성의 초석인 예능도를 향상시키는데 크게 기여한 것으로 드러났다. At the end of the 20th century, the market contestability of performing art was growing in South Korea, and at the time of the 1997 financial crisis, there was a move to transform public art organizations into nonprofit foundations. With the intention of strengthening its artistic merit and efficiency and contributing to the public interest, Seoul Philharmonic Orchestra underwent two transformations as a result of privatization. First, in 1999 it became an orchestra attached to Sejong Center for the Performing Arts as a nonprofit foundation. Second, in 2005 Seoul Philharmonic Orchestra became an independent orchestra as a nonprofit foundation. We analyzed the influence of the two privatizations of Seoul Philharmonic Orchestra on its artistic merit. Analysis of music critiques, market evaluation, and interviews with orchestra personnel reveals that the second privatization in 2005 dramatically improved the artistic merit of the orchestra. However, is such improved artistic merit sustainable? This study determines that for Seoul Philharmonic Orchestra to sustain its improved artistic merit it must 1) establish a system to recruit an excellent art director, 2) develop a human resource management system with internal and self-actualizing motivation that can minimize negative effects of competitive auditions, and 3) redraft the articles of the Seoul Philharmonic Orchestra to strengthen its autonomy.
