Golf의 drive swing에 있어서 양다리 무게 重心 變化에 관한 分析

When a golfer makes driver swing, one's balances swifts one leg to the other. To investigate this phenomenon, two excellent players and two beginners are exampled, and legs' electromyograms and X, Y electronic recorders are used. Therefore, We have the results as follows: 1. Beginners' take back is short and hasty. 2. At downswing, beginners' start outside, otherwise excellent players inside. 3. At the finish, beginners' shoulders swing rather short and low than excellent player. 4. Beginners whole body get nervous owing to excessive tention. 5. At the moment of impact, beginners use only arms, but excellent players whole bodies. However, this results may not be applicable to all cases, for only a small number of players are exampled.

In solving international commercial disputes, arbitration has a unique advantage. Therefore, when most parties sign a charter party, they contain arbitration clauses. Whether the arbitration clause in the charter party can be effectively incorporated into the bill of lading and bind to the third party‐bill holder becomes an important issue. Based on the problem above, this paper compares the arbitration system between Korea and China, and discusses the composition of the Chinese Maritime Court and the Chinese court's adjudication of arbitration for foreign countries, which are recognized and enforced in China. What is most important in this study is observing the Chinese case from the beginning of 2000 to the present in order to rule whether the Chinese court can effectively incorporate the arbitration clause in the charter party into the bill of lading, as well as whether it constitutes an effective binding force for third parties and changes in standard of recognition. Finally, through comparative analysis, the study concludes that in China, the arbitration clause in the charter party can be effectively incorporated into the bill of lading, and that the conditions for the third parties can be effectively restrained. There must be several points to be noted when recording the bill of lading. This would then help reduce the legal risks and promote the sustainable development of international transactions. 본 연구는 중국 해사중재 중 용선계약 관련 제3자 중재조항의 편입에 관한 연구이다, 중국사례분석을 통해 국내와 비교 및 해운업계 실무가들에게 중국 해사중재제도의 올바른 이해를 제시하고자 한다. 현재 중국은 해사와 해상사분야로 구분되어 있으며 해사법원을 설치해 운영 중이다. 본 연구의 분석사례는 해상사고로 인한 보험회사의 대위권 승계 시 용선계약 상 중재조항이 선하증권에 편입되어 운송인과 보험회사 간 중재합의가 인정되는지 여부이다. 과거 중국의 경우 중재합의는 독립 절차조항이라 제3자 구속력이 없다고 판단하였다. 그러나 2006년 ‘중재법 적용에 관한 문제의 해석’이 나오면서 중재조항 편입 요건이 보다 구체화되었다. 이를 충족하기 위해 선하증권 정면에 중재조항 제3자 편입여부를 명확하게 기재할 것과 선하증권에 용선계약 명칭과 계약일자를 명확하게 기재해야 중국에서 선의의 선하증권 소징인에게 중재조항의 효력이 인정될 것이다. 다만 선하증권 이면 중재조항에 대해 인정한 사례도 있지만 오직 한 번만 존재하고 유사한 사건에서 아직까지 동일한 해석이 내려진 적이 없어 이는 매우 이례적인 경우로 판단된다.

Seneca is the most important philosopher on leisure studies. It is said that his viewpoints for leisure ard written in the works of “on the Shortress of Life”“On Tranquility” On Leisure”and in western world, to say nothing of the study focused on Seneca´s philosophy of leisure. So it is the aim of this essay to make review what the Seneca´s philosophy of leisure is and, also what the philosophy tells us to think about the meaning of leisure toward our learning society.

勳舊의 黃昏 –成俔에게 나타난 文章華國의 사명과 현실의 괴리-

In the late 15th century, the culture and arts of the Joseon Dynasty were refined and established. Seong Hyeon[成俔, 1439~1504] was a literary figure of this period who greatly contributed to the Ye-Ak[禮樂, Artistic Culture] of the Joseon Dynasty, especially towards the popularization of music. Seong Hyeon took great pride in his family's role in the overhaul of the cultural system. However, there were many unlucky descendants in his family and the king's attitude towards the nobility, especially to the Hun’gu Faction, changed greatly. This resulted in the inevitable emergence of new intellectuals in the provinces. Under these circumstances, Seong Hyeon devoted himself to the world of learning and governance. He was presumably the last student of the learned scholar-governor, Tong yu[通儒]. Seong Hyeon enjoyed public and private banquets. During that time, the public and private lives of a governor’s life were not divided. They thought that they lit the cultural light to the Joseon Dynasty. However, the new intellectuals thought that truth was to be found inside humans. Consequently, the quests for the light of truth outside a human being was replaced by the quest for truth inside oneself. 15세기 후반은 조선왕조의 문화 문물이 크게 정비된 안정기이다. 성현(成俔, 1439~1504)은 이 시기를 대표하는 문인이면서 조선의 예악 문화 특히 음악 정비에 크게 기여하였다. 성현은 자신의 가문에 큰 자부심을 갖고 있었다. 그러나 성현에게는 불안함이 나타나기 시작했다. 성현을 중심으로 한 가계에 자손들이 불행한 사람들이 많았고, 왕이 대신과 세가의 자세들을 대하는 태도가 크게 변하였으며, 지방에서 실력을 쌓은 새로운 지식인으로 교체되기 시작했다. 이러한 상황 속에서 성현은 선비의 상을 통유(通儒)에 두고 학문의 세계에 몰두하였다. 성현은 공적 사적 연회를 통하여 생활의 즐거움을 누리는 데서 낙을 찾았다. 또한 관료의 일상은 공적인 삶과 사적인 삶이 구분되지 않는다는 것을 깨닫고 이러한 삶에 철저하게 몰입했다. 예악 문화는 아름다운 의례와 음악을 통해 숭고 체험을 느끼게 하는 것이라고 생각했다. 조선 왕조의 문화 문물을 정비하는 것은 왕조를 비추던 찬란한 문화의 빛[文明]을 만드는 일이었다. 그러나 이 당시에 등장하는 새로운 지식인은, 진리의 빛[明德]은 인간 내면에 있다고 생각하였다. 이들 지식인은 내적인 수양과 인격 구현을 더 중시하였다. 이들의 등장과 함께 성현과 같은 인물들은 교체되었다. 그것은 숭고한 태양이 저물어 가는 황혼과 같았다.
