소비자 분쟁의 해결을 위한 유럽의 ODR 법제의 발전과 현황

국경간 전자상거래에 있어 ODR은 소비자의 피해를 신속하고 경제적으로 구제할 수 있는 효율적인 해법으로 제시되고 있다. 유럽연합은 2013년 입법을 통해 소비자 분쟁의 대체적 분쟁 해결에 관한 지침(이하 EU ADR 지침)과 소비자 온라인 분쟁해결에 관한 규정(이하 EU ODR 규정)을 채택하였고 이 입법의 구체적인 실행의 결과물로서 2016년 범유럽적인 ADR 포털인 EU ODR 플랫폼을 창설하여 소비자와 사업자에게 서비스를 개시하였다. EU ODR 플랫폼은 소비자들의 ADR 절차에의 접근가능성을 제고하여 소액분쟁에서의 피해 구제 가능성을 높혔다는 점에서 큰 의의를 가진다. 이와 관련하여 이 논문은 먼저 소비자 보호를 위한 유럽연합 차원의 입법의 연혁을 살피고, 소비자 보호를 위해 ADR과 ODR이 대안으로 제시되게 된 배경에 대하여 검토한다. 이후 EU ADR 지침과 EU ODR 규정의 주요한 내용에 대해 간략히 살피고, 특히 유럽내에서 영업을 영위하는 기업이 EU ODR 규정의 적용을 받는 유럽 연합 회원국 내에 설립된 사업자에 해당하는지 여부에 대하여 분석한다. 이와 관련하여 기업이 유럽 내에 물리적 시설을 갖추지 않고 웹사이트를 통해 소비자와 계약을 체결하고 물품 또는 서비스를 공급할 경우 유럽 연합 회원국 내에 설립된 경우로 해석할 수 있는지가 주된 논점이 된다. 이후 EU ODR 플랫폼의 현황과 전망에 대하여 개괄하고 이와 유사한 시스템의 운영이 우리나라에서의 소액 소비자 분쟁에 있어서 어떠한 시사점을 가질 것인지에 대하여 논하고자 한다. Online Dispute Resolution(hereinafter ODR) has long been considered as an effective option to resolve consumer disputes in a B2C cross-border transcations in a faster and more economical way. Recently European Union adopted two important legislation, one is Directive on alternative dispute resolution for consumer disputes(hereinafter EU ADR Directive) and the other is Regulation on online dispute resolution for consumer disputes(hereinafter EU ODR Regulation) in 2013 and implemented the mandates of the legislations by launching the EU ODR Platform in February 2016, which is a pan european ADR portal available to all consumers and traders in Europe. The EU ODR Platform is a meaningful step forward in that it increases consumers’ access to justice and enhances the possibility of redressing consumers’ damages in low value high volume disputes. On the recent changes in European regulatory framework on ODR, this paper will first take a look at the legislative history in EU to protect consumers in European single market and the reason why the ADR and ODR were presented as the optimal alternatives in consumer disputes. Then the provisions of EU ADR Directive and EU ODR Regulation will be briefly analyzed with the focus on the interpretation of the definition of “trader established in the Union” when an entity conducts business via website accessible in Europe without physical presence such as branch, agency or an office. Lastly, the prospect of EU ODR Platform and its implication in consumer dispute resolution system in Korea will be discussed.
