Den unterschiedlichen Ausprägungen der Konzeption von Restorative Justice ist das Bestreben nach einer sozialkonstruktiven Lösung strafrechtlich relevanter Konflikte gemein, die über eine bloße materielle Wiedergutmachung hinausgeht. Im Zentrum steht vielmehr das Bemühen, die durch die Straftat oder schon vor der Straftat zerbrochene Beziehung zwischen Täter und Opfer zu reparieren. Nach Idee von Restorative Justice solle eine Straftat nicht mehr als Verletzung einer allgemeinen, abstrakt existierenden Rechtsregel betrachtet werden, sondern als Zufügung von Leid an dem einzelnen Opfer. Reaktionen auf die Tat sollten daher hauptsächlich darauf gerichtet sein, dieses Leid zu lindern. Der Umgang mit den Konflikten soll dabei aus der justiziellen Verfügungsgewalt herausgenommen und diese von den Betroffenen selbst zu lösen sein. Eine wichtige Rolle spielt hierbei die “community”. In koreanischen Rechtsordnung und Rechtspraxis existiert schon traditionell die Idee von Restorative Justice, also etwa in Form von “Habeui”. Diese Figur berücksichtigt jedoch nicht die Komponente der Konfliktlösung zwischen Täter und Opfer. Soweit die Aufgabe des gesamten Strafrechts und der Strafjustiz nicht auf Übelszufügung sondern Integration der Täter, Opfer und Gemeinschaft gerichtet werden soll, soll die Programme, die Idee von Restorative Justice verwirklichen, in das Rechtsfolgensystem des koreanischen Strafrechts ausdrücklich eingeführt werden.

Restorative Justice ist ein Weg, mit Opfern und Tätern umzugehen, der die Lösung der Konflikte, die aus dem kriminellen Akt entstehen sowie die Lösung der Probleme, die zu der Tat geführt haben in den Mittelpunkt steht. Allgemeiner formuliert handelt es sich bei Restorative Justice um einen rationalen lösungsorientierten Umgang mit Kriminalität. Hinsichtlich eines theoretischen Umgehens mit Restorative Justice stellt sich jedoch eine Frage, welche Verhältnisse von Restorative Justice und Strafjustiz stehen. Es handelt sich bei Restorative Justice um eine autonome Problemlösung, fällt die herkömmliche Strafjustiz eine autoritäre Streitentscheidung. Setzt man hier auf die Informalität des Vorgehens, ist das Prozedure dort von Formalität geprägt. Ergibt es aber aus diesem Hinsicht, dass Restorative Justice den institutionellen Rahmen der Justiz zu verlassen und den Parteien in diesen Rahmen eine gewisse Handlungsautonomie zurückzugeben?. Der Umstand der tweilweisen Zurückdrängung des staatlichen Strafanspruchs und die Einschränkung des staatlichen Gewaltmonopols vermögen keinen Bruch mit dem strafjustiziellen System zu bewirken. Die einzelnen Programmen von Restorative Justice bleibt dem staatlichen Justizsystem verhaftet, die bleibt eine strafjustizielle Reaktionsform.
Impact of the Expansion of Private Brands on Korean Retail and Manufacturing

The private brands (PB) of corporate retailers are booming in Korea. This paper examines the effect of the rise of PB on Korean retail and manufacturing. By utilizing both store-level data and firm-level data, I find that the expansion of PB elevates the profits of corporate retailers but does not significantly affect, and in some cases even reduces, those of subcontracting manufacturers. This occurs not only because sales of national brands (NB) decline due to the launch of similar PBs but also because the imbalance in the bargaining positions of the two parties has caused retail margins to be set high while manufacturers’ operating profits are set low. The paper provides policy recommendations for fair contracts and cooperative development between retail and manufacturing companies.

This study aims to prepaThis paper describes how Building Information Modeling (BIM)-based design approach enables us to change the process of building design in terms of its computational representation and process. This paper also presents a newly developed way of building design approach using space objects. It is so-called BIM-enabled space object-centered building design. IFC (Industry Foundation Classes), as a neutral file format that is recently adopted in AEC-FM (Architecture, engineering, construction and facility management) industry for data exchange, provides the common building model schema from which several analyses and reviews are carried out even in early phase of building design. Space objects, like other building objects, can carry their information-rich space objects and space use semantics properties internally to the model. This article tackles some issues of space object, how building space objects can be organized and classified within BIM systems based on their semantics, and the reflection on best practices learned from some projects and application development. All the research and development features noted in this article are implemented as a plug-in or stand-alone application module that constitutes a broad range of BIM applications.re a suitable checklist for evaluating the facilities for children in Kid‘s cafes, based on the precedent studies about the facilities for infant and children who are the main users of Kid‘s cafes and the regulations for the facility management, and then suggest the base data for installing the facilities for children in Kid‘s cafes and organizing safety control standards. For this, a checklist which emphasized the safety for infants and children most and positively reflected their emotional and behavioral aspects in the evaluation items for the facilities, were organized and suggested. In this checklist with 47 items suggested through this study, the evaluation items for securing the safety and the sanitary facilities for infants and children, which guardians thought most importantly, accounted for the largest portion. This was the content of the standards for facilities which was not included in the standards for the approval of simple business, but this was considered as the essential evaluation items required for the prevention of the safety accidents for infants and children in Kid‘s cafes.
China’s Consumer Market: Growth, Changes, and Korea’s Opportunities

This paper examines the aspects of changes in China’s consumer market since the mid-1980s. By comparing urban and rural residents’ expenditures, I find that the rural consumer market has exhibited extraordinary growth. Over the past decade, the consumption growth rate and average propensity to consume by rural residents have surpassed those of their urban counterparts, with the former’s consumption patterns becoming increasingly similar to the latter’s. Such a phenomenon prevails in rural areas which neighbor secondand third-tier cities where urbanization is progressing rapidly. These findings imply that Korean companies need to diversify their export goods in line with China’s expanding rural markets while further differentiating their product composition to satisfy the heterogeneous demands in urban areas. With regard to the government, efforts must be made to strengthen the export cooperative system so that it targets not only urban but also rural markets in China.
