鐵道産業 治安制度의 效率化 方案에 관한 硏究 : 建設交通部 鐵道公安制度를 中心으로

현재 한국철도공사의 사업장내에는 건설교통부 소속 철도공안이라는 특별사법경찰 기구가 치안 유지 임무를 수행하고 있으며, 그 외 지방자치단체에서 운영하는 지하철 사업장내에는 관할 지방경찰청 소속의 일반사법경찰인 지하철 경찰대에서 치안업무를 수행하고 있다. 결과적으로 철도지역내 치안유지라는 동일한 업무특성에도 불구하고 이러한 치안기구의 양분으로 인하여 업무효율성 결여, 고객 중심적 치안 서비스 미흡 및 철도치안 시너지 효과 미흡 등 많은 문제점을 야기하고 있다. 본 논문의 목적은 지하철 운영사의 치안관련 정책부서 담당자 116명을 대상으로 한 설문결과를 토대로 철도가 가지는 광역성 및 고속성이라고 하는 특수한 성격으로 인해 공간적 이동이 신속히 이루어지는 철도범죄에 효율적으로 대처하기 위한 방안을 마련하는데 있다. 현행 철도치안 인력규모(약 700명)로 철도지역내의 효율적인 치안유지를 위해서는 건설교통부 소속 철도공안 제도를 확대·개편, 철도 특별사법경찰기구(가칭, 철도경찰대)를 설치함으로써 국내 철도 및 지하철의 치안 수요를 통합 관리하는 것이 바람직하다. 또한 치안인력의 전문화, 지역간 공조수사를 통한 시너지 효과를 최적화하는 것이 필요하다. 설문조사 결과 116명중 84%가 철도전문 특별사법경찰기구 도입의 필요성에 공감하였고, 73%는 건설교통부 철도공안을 중심으로 특별사법경찰기구 설치시 전문지식 활용으로 철도치안수요에 효율적 대처, 고객중심적 치안서비스제고 및 철도운영자와 협력관계 증진 등의 개선 효과를 기대하였다. There are two kinds of police authorities in Korean railway industry. One is the Special Judicial Police, under the authority of the Ministry of Construction and Transportation, charged with maintenance of public order on trains, in stations and other places of business operated by the Korea Railway Corporation. The other is the Local Subway Police, belonging to the Local Police Agencies, whose jurisdiction covers trains, station and other areas managed and operated by local governments. The existence of two separate entities for common objective of railway security has given rise to problems including inefficiency in performance and lack of customers-focused police service and synergic effects. Based on the result of questionnaires conducted on 116 rail security policy-makers in local subways, the purpose of this study is to search for solutions to rail crimes that allows for rapid spatial movements since they take place on fast moving trains. In order to increasing efficiency of crime prevention in the railway industry with about 700 rail policemen at present, it is desirable for central government to establish a special judicial police body(tentatively named Railway Police Headquarter) by restructuring and expanding the Special Judicial Police of Ministry of Construction and Transportation to bring railway security under a single authority and an integrated railway security systems operation. In addition, it is necessary to train rail crime specialists and maximize synergic effects of jointly cooperated investigations among different district of jurisdictions. Survey results showed that 84% of the 116 surveyed agreed that it is necessary to set up a special judicial police body. 73% viewed that establishment of the special judicial police body with MOCT's Railway Police Office as the basis would allow for more efficient rail crime fighting since members of the police force would be specialists in the field. They also added that doing so would also enhance rail services by making them customers-oriented and that such a police body would make it possible to maintain improved cooperative relationships with rail operators.
