        보증보험과 청구보증통일규칙

        청구보증이란 일반적으로 지급청구서 및 기타 보증서에 명시된 서류를 보증의 유효기간 내에 보증조건에 일치하게 제시하여 지급청구를 하면 수익자에게 일정한 금액을 지급하겠다는 보증인의 지급약속을 말한다. 서류성과 독립성은 청구보증의 중요한 특징으로 이해된다. 한편 보증보험회사가 발행하는 ‘Counter Guarantee Bond’는 국제거래관계상 청구보증의한 형태인 구상보증의 역할을 하는데, 이러한 기능이 원활하게 수행되기 위해서는 원보증과 마찬가지로 독립성과 서류성이 요청된다. 그런데 보증보험에는 그 성질에 반하지 않는 한 민법상 보증의 규정이 적용되므로(상법 제726조의7), 서류성과 독립성을 가지는 보증보험은 일반적으로 부종성이라는 성격을 가지는 민법의 보증과 차이가 있어 위 상법의 규정에 반하는 것은 아닌지 의문이 생길 수 있다. 이 글은 독립성과 서류성을 가지는 CGB가 보증보험으로서의 성격을 잃지 않는다고 주장 한다. CGB는 서류성, 독립성을 가진다는 점에서 청구보증과 본질적인 특성을 공유하지만, 권리남용의 국면에서 주채무의 성립 및 소멸이 심사된다는 점에서 희박하나마 부종성이 인정되 고, 따라서 보증보험으로서의 성질을 잃지 않은 새로운 유형의 보증보험계약으로 볼 수 있다. 한편 현재의 CGB는 현재 국제적으로 널리 통용되는 청구보증통일규칙(URDG 758)상의 청구보증과 동일하지는 않은 바, 향후 청구보증통일규칙에 따라 표준화된 내용으로 보증보험을 설계할 필요가 있다. 이 글은 이러한 유형의 보증보험 역시 법률적으로 가능하고 유효하다는 점을 주장한다. Demand guarantee is defined as an undertaking issued by the guarantor upon the instructions of the applicant to pay the beneficiary the sum that stated in the guarantee, upon presentation of a demand complying with the terms of the guarantee. Documentary character and independence are important features of demand guarantees. Counter Guarantee Bond(CGB), issued by the guarantee insurance company, serves as counter-demand guarantee in international trades. In order to perform these functions as counter-demand guarantee well, independence and documentary character are required as well as original demand guarantee. However, the provisions of the Civil Act concerning guaranteed debts shall apply mutatis mutandis to guarantee insurance contracts to the extent not contrary to the nature thereof(Commercial Act article 726-7, provisions applicable mutatis mutandis). In general, the guarantee of civil law is understood to have the feature of subordinate property. Therefore, one may wonder if the guarantee insurance with documentary character and independence runs counter to the commercial law Article 726-7, provisions applicable mutatis mutandis. This article argues that CGB with independence and documentary character does not lose its guarantee insurance character. therefor it does not run counter to the law. CGB shares essential characteristics with a demand guarantee in terms of documentary character and independence, but can be seen as a new type of guarantee insurance contract that does not lose its character as a guarantee insurance policy. The current CGB is not the same as the demand guarantee in URGS 758. It may be necessary to design CGB with standardized contents in accordance with URGS 758. This article argues that this type of guarantee insurance is also legal and valid.

      • Carvacrol Protects against Hepatic Steatosis in Mice Fed a High-Fat Diet by Enhancing SIRT1-AMPK Signaling

        <P>We investigated the protective effect of carvacrol against high-fat-diet-induced hepatic steatosis in mice and the potential underlying molecular mechanisms. Mice were fed a normal diet, high-fat diet, or carvacrol-supplemented high-fat diet for 10 weeks. Compared to mice fed the high-fat diet, those fed the carvacrol-supplemented diet showed significantly lower hepatic lipid levels and reduced plasma activities of alanine aminotransferase and aspartate aminotransferase and plasma concentrations of monocyte chemoattractant protein 1 and tumor necrosis factor <I><I>α</I></I>. Carvacrol decreased the expression of LXR<I><I>α</I></I>, SREBP1c, FAS, leptin, and CD36 genes and phosphorylation of S6 kinase 1 protein involved in lipogenesis, whereas it increased the expression of SIRT1 and CPT1 genes and phosphorylation of liver kinase B1, AMP-activated protein kinase, and acetyl-CoA carboxylase proteins involved in fatty acid oxidation in the liver of mice fed the high-fat diet. These results suggest that carvacrol prevents HFD-induced hepatic steatosis by activating SIRT1-AMPK signaling.</P>

        The Effect of Magnetic Flux Change on Blood Flow and Vascular Aging in the Peripheral Vascular System under Magnetic Stimulus

        The change in the blood flow and improvement of vascular aging in the peripheral vascular system under strong pulsed magnetic fields using three differently shaped coils (elliptic spiral, circular solenoid, and elliptic solenoid) were analyzed by the photoplethysmograms (PPG). The magnetic stimulation was performed on the hand with the maximum field intensities of approximately 0.4 T and transition times varying from 0.074 to 0.138 ms, generated from three different coils. The changes of blood perfusion under strong magnetic field were analyzed using the volume of blood flow integrated from PPG and the aging index calculated from the second derivative PPG (SDPPG) signal. Although the changes in volume of blood flow do not show any difference during stimulation of 5 min. using three different coil types, the aging index, which is referred the vascular aging, calculated from PPG measured from the middle finger was distinctly decreased after stimulation of 3 min. for elliptic spiral and circular solenoid coils. These two coils have high magnetic flux changes, dB/dt of 4.70 and 5.68 × 10^3 T/s, whereas that of elliptic solenoid is 2.90 × 10^3 T/s. In addition, after 5 min. stimulus, retrieving aging index was observed. We found that high magnetic flux change, dB/dt, is a key role to improve vascular aging in peripheral vascular by stimulating with pulsed magnetic field.

        Assessment of Pulsed Magnetic Field Stimulus by Using Finger Photoplethysmogram and Pressure Pulse Waveform

        Photoplethysmogram (PPG) and pressure pulse waveform (PPW) were compared and evaluated for the efficacy of stimulating knuckles by using the pulsed magnetic field. Both signals were observed simultaneously while the knuckles were exposed for 10 min to the pulsed magnetic field, with maximum field intensity of 0.8 T and transition time of 0.126 msec. After 5 min stimulation of the knuckles, the results showed that the aging indexes calculated from the second derivative of the PPG were increased from ?1.913 to 0.072, and that of the PPW from ?0.063 to 0.387. However, for the relatively long-term stimulation for 10 min, we found that the values of both the aging indexes of the second derivatives and augmentation index of the PPW returned to the starting level. The changes observed in characteristic factors such as the aging indexes of the second derivatives and augmentation index of the PPW indicate the potential of pulsed magnetic field stimulation as a therapeutic method for the treatment of patients with peripheral vascular disease.

      • Molecular cloning and characterization of the germ cell-related nuclear orphan receptor in chickens

        <P>Nuclear receptor subfamily 6, group A, member 1 (NR6A1), also known as germ cell nuclear factor/retinoid receptor-related testis-associated receptor and neuronal cell nuclear factor, is a member of the nuclear orphan receptor superfamily. NR6A1 has been cloned in various species including humans and mice, but it has been scarcely investigated in avian species. In the present study, we cloned the chicken NR6A1 (cNR6A1) from a testis cDNA library. The cloned cNR6A1 sequence was mapped to chromosome 17 and contained an open reading frame of 1.4 kb encoding 445 amino acids. Multiple alignment analysis of the cNR6A1 protein-coding sequence with NR6A1s from humans, mice, boars, rats, zebrafish, and Xenopus showed high degrees of homology, 89%, 90%, 89%, 88%, 83%, and 87%, respectively. Using RNA interference, changes in the expression of pluripotency-, germ cell-, and differentiation-related key genes by silencing of cNR6A1 were validated in chicken blastoderm-derived embryonic stem cells. Among those genes, the relative expression levels of POU5F1, CRIPTO, DAZL, DDX4, BMP15, GSC, and SOX7 changed significantly compared to the control group. We also confirmed that the activity of alkaline phosphatase, known as a pluripotency marker, was maintained by cNR6A1 gene silencing in chicken blastodermal cells.
