Recently, pedestrians suffered inconveniences with moving on the next building due to the high-rise buildings. So, the number of passageways is increasing for convenience of pedestrians. Currently, people are paying attention to building energy saving. We anticipated that It increases the cooling load of the building and building energy by a passageway. We chose a passageway for a subject because people are paying attention to building energy saving lately. The purpose of this study was to analyze the indoor thermal environment according to the passageway. We measured temperature of building with passageway using a multifunctional device in order to progress the study. On analysis based on investigation, finishing material and glass area of passageway have an effect on indoor thermal environment. The result shows that the cooling load of building alter depending on characteristic of passageway.

China is currently the biggest cross border E-commerce market in the world. What’s more, through trend in economic integrate example of FTA, Korean and Chinese governments will orchestrate preferable trading conditions for cross border E-commerce. Therefor we will focus on how facilitating of getting into cross-border E-commerce market between China and Korea. There are two main reasons for rapid growth of Chinese cross border E-Commerce market. First, Chinese government concentrated on fostering and supporting related industry. Second, there has been a improvement in Chinese people’s level of earnings and consumption, internet and mobile users also have been increased. Although Chinese government’s concentration, policy was less effective than expected due to exposure of side effect. The purposes of recent policy called "4.8 action" are the reform of tax system, restriction of imported items, and simplifying clearance procedure. But it caused confusion of market and amplifying uncertainty, so "4.8 action" has been partially delayed by announcing of "5.25 action". Given this view, our main goal is to research for strategy to vitalize cross border E-commerce between Korea and China. Through empirical research by analyzing trade data and related policies, we are conclude followed. First, there are need to Strategy of advance preparation and understand of market situations. Second Korean corporations to have utilize cross border E-commerce comprehensive pilots in 13 cities of China based on long term views. 중국은 이제 전 세계에서 가장 큰 국경간 전자상거래 시장을 형성하고 있다. 한중 양국 정부는 FTA 체결 등 경제통합의 흐름 속에서 국경간 전자상거래 활성화를 위한 교역조건 개선 등을 지속적으로 추진할 예정이다. 본 연구 역시이러한 한중 국경간 전자상거래 활성화에 초점을 맞추었고 특히 중국의 전자상거래 정책변화에 대해 심도 깊게 다루고자 하였다. 중국의 국경간 전자상거래가 급부상하는 이유는 크게 두 가지를 들 수 있다. 첫째 중국 정부가 제조업은물론 유통업과 같은 서비스업 등의 산업경쟁력을 높이기 위하여 전자상거래 관련 산업에 적극적인 지원정책을 펴고 있기 때문이다. 둘째, 중국소비자들의 소득과 소비가 향상되면서 인터넷과 모바일 사용자 또한 증가되었기 때문이다. 그러나 중국정부의 이러한 노력에도 불구하고 전자상거래 정책의 효과는 기대보다 적게 나타나고 있다. 세재개편과 수입제품에 대한 제한 그리고 통관절차간소화 등을 추진하는 이른바 “4.8 조치”는 시장혼란과 불확실성의 증가를 가져왔다. 중국정부는 부작용을 줄이기 위해 “5.25 조치”를 통해 일부 정책의 시행을 연기하게 되었다. 이러한 관점에서 본 연구는 한중간 국경간 전자상거래활성화를 위한 전략을 도출하는데 그 목적이 있다. 이를 위해 대중국 국경간전자상거래 관련 현황을 제시하고 중국정부의 정책변화에 따른 시사점을 도출하고자 하였다. 중국정부의 급격한 정책실행과 이에 대한 혼란의 시기에 대응하기 위해서는 유예조치기간동안 미리 인증이나 상표권을 취득하는 등 제도시행을 대비하고 시장에 대한 분석을 시행해야 한다. 또한 중장기적인 관점에서현재 13개 도시에서 운영하고 있는 국경간 전자상거래 종합시험구에 진출하여이를 활용하는 방안을 마련할 필요가 있다.

We have experienced three cases of posterior cortical fracture of tibia during the removal of interlocking intramedullary nail which was made of titanium alloy with the prominent distal angulation. And we observed the distal translation of entry point in one case. The main reason of posterior tibial cortical fracture can be explained by the following statements: (a) prominent distal angulation increases cross sectional surface of nail in medullary canal at the time of extraction and (b) the distal translation of entry point increases the interface of posterior cortex at the time of extraction. In conclusion, we advise caution in the extraction of tibial nail of distally translated entry point which have a prominent distal angulation.

법경제학의 시각에서 바라본 부동산 이중매매의 형사처벌

Interpretation of criminal statute is regulated by the principle of strict interpretation, which is a sub-principle of “nullum crimen, nulla poena sine lege”. However, there sometimes exists possibility of policy-based decisionmaking in construing criminal statutes. Policy-based decisionmaking operates in the context of purposive interpretation or constitutional interpretation. Concretely, a judge determines whether it is proportional to punish a specific conduct which falls under the criminal statute with vague or ambiguous conception on the first appearance. In this proportionality analysis, law and economics approach can play a useful role, especially when the criminal statute regulates economic activities. In this paper, I analysed the recent decision from the Supreme Court which upheld its long-standing precedents criminalizing double sale of real estate. While it is positive that the Court is trying to justify its judgement with diverse approach including law and economics, there are two problems in the analysis of the Court. First, the concept of “efficient breach”is not exactly understood by the Court. Second, the majority opinion fails to persuade that the criminalisation of double sale is the only way to enforce property rule between the first buyer and the seller. 형법의 해석은 죄형법정주의의 하부 원칙인 엄격해석의 원칙의 지배를 받지만, 현실적으로는 형벌조항의 해석에 있어서 정책적인 판단이 불가피하게 개입된다. 이와 같은 정책적 판단은 법률해석의 방법론 중 목적론적 법률해석 또는 헌법합치적 법률해석의 방법을통하여 해석 과정에 들어오게 되고, 구체적으로는 입법취지를 달성하기 위한 수단으로서의 형사처벌이 비례의 원칙을 위반하지 않았는지를 판단하는 방법으로 나타나게 된다. 특히, 재산범죄의 처벌과 관련하여서는 법경제학적 방법론이 비례의 원칙을 구체적으로 적용함에 있어서 유용한 방법론이 될 수 있고, 부동산 이중매매에 관한 대법원 전원합의체판결에서 실제 법경제학적 분석이 일정 부분 차용된 것을 볼 수 있었다. 본고에서는 그러한 분석의 시도 자체에 대하여는 긍정적으로 평가하는 전제에서, 첫째 그 과정에서 이른바‘효율적 계약 파기’개념이 지나치게 과대평가되어 적용되었다는 점을 지적하였고, 둘째이중매매에 대한 형사처벌의 필요성에 대하여 동의규칙과 보상규칙의 관점에서 분석하면서 대법원의 현재 입장은 중도금 지급 이후의 이중매매에 대하여 동의규칙을 관철시키기위한 것이기는 하나, 반드시 형사처벌만이 그러한 관철의 수단이 될 수 있는 것은 아니라는 점을 지적하고자 하였다.

식물층에서의 편파별 후방 산란 측정과 산란 모델의 비교

본 논문은 후방 산란 계수 및 지표면 특성(ground truth)에 대한 측정 방법을 기술하며 후방 산란 계수 측정값과 radiative transfer 이론을 적용하여 개발된 산란 모델을 비교함으로써 산란 모델의 정확성을 검증한다. R 밴드 $(1.7\sim2.0GHz)$의 주파수 대역에서 polarimetric scatterometer 시스템으로 한강생태공원의 수풀 지형에서의 후방 산란 계수를 입사 각도의 변화와 지표면 수분 함유량의 변화에 따라 측정한다. 이 측정 결과를 지표 산란 모델과 비교한 결과 동일 편파의 경우 비교적 잘 일치하며 교차 편파의 경우 보정을 해줌으로써 산란 모델의 정확성을 얻을 수 있다. In this paper, we describe a measurement technique for the backscattering coefficient and ground truth of a vegetation canopy in detail. A simple microwave backscattering model for vegetation canopies is verified by being compared with this measurement. An R-band$(1.7\sim2.0GHz)$ scatterometer system is used to measure the backscattering coefficient of a vegetated area in the Han-river park for various incidence angles and a wide range of the soil moisture contents. It is found that the model agrees quite well with the measurements for co-polarized radar backscatter, and needs a correction for cross polarized radar backscatter.
