저우쭤런은 어린 시절부터 동식물에 관심을 두고 박물학 서적 읽기를 좋아했다. 또한 당시 유행했던 진화론의 영향 속에서 인간의 진화 과정에 관심을 갖게 되었고, 이러한 관심은 자연스럽게 생물학에 관한 관심으로 이어져 인간의 문제를 이해하고 연구하는데 생물학 지식의 중요성을 인식하게 되었다. 1920년대 중반 저우쭤런 산문의 가장 큰 변화는 ‘생활의 예술’을 추구하며 주변의 다양한 일상에 관심을 쏟는 것이었다. 이 과정에서 일상에서 흔히 볼 수 있는 야생초나 나무, 새, 곤충 등이 산문의 소재가 되었다. 대부분 세시풍속이나 먹거리, 놀이와 같이 일상생활과 밀접한 관련이 있거나 주변에 흔히 볼 수 있고 인간과 매우 가까운 것들이었는데, 대상 자체에 대한 박물학적 지식과 함께 이를 둘러싼 민간 사회의 풍속과 인간의 정서와 감정을 결합하여 묘사한 것이 이 시기 초목충어 산문의 주된 특징이었다. 초목충어 산문의 또 다른 특징 가운데 하나는 동식물에 관한 전통 지식의 잘못된 부분을 바로잡고자 했다는 것이다. 주로 동식물에 관한 각종 문헌 기록이나 민간 속설 가운데 잘못 전해져 내려오거나 과학적 상식에 부합하지 않는 내용을 찾아 그 오류를 지적하고 비판했다. 여기서 전통 박물학 지식과 관련하여 저우쭤런이 문제점으로 지적한 것은 크게 두 가지이다. 하나는 중국인들이 자연을 관찰하고 이해하는 데 관심이 없다는 점이고, 다른 하나는 미신이나 윤리적 목적에서 잘못 전해진 지식이 많다는 것이었다. 이러한 비판의식으로부터 저우쭤런은 동식물에 관한 지식을 기록한 다양한 과거 문헌들을 검증하고 비평함으로써 과학적 지식에 바탕을 둔 새로운 윤리건설을 위한 토대를 제공하고자 했다.

Participation of Local Autonomy Authorities in National Legislation and Policy Making Hong, Joon Hyung The Local Autonomy and Decentralization is the core element fo national competitiveness. Particularly, the local autonomy constitutes an indispensable foundation of the government structure under Korean Constitutional law. In Korea, local autonomy authorities still have very little participation in the process of national legislation and policy making. This is due to the persistent tendency of government centralization from previous constitutions in Korea. This article explores some issues regarding local authorities' participation in national level legislation and policy making, focusing on their current status, related problems and some innovation measures. The article proposes alternatives, from the perspective of legal policy, divided into four categories: Constitutional amendment, Statutory revision of those acts like National Assembly Act, Local Autonomy Act, and other relevant acts, and other initiatives at non-legislative policy level. 자치와 분권화는 국가경쟁력의 핵심이며 지방자치는 헌법이 보장해 온 국가 구성의 초석이다. 국정, 다시 말해 국가 입법 및 정책결정과정에 있어 중앙집권적 타성이 지배해 왔기 때문에 지방자치단체의 국정 참여는, 그 책임의 소재와 무관하게, 극히 저조한 수준에 머무르고 있다. 지방자치단체의 국정 참여는 법제도, 규범 그리고 현실 모든 면에서 크게 미흡하다. 그렇다면, 지방자치단체의 국정 참여, 왜, 어디까지, 어떻게 할 것인가? 이 논문은 지방자치단체의 입법․정책에 대한 참여 문제를 그 현황과 문제점, 대안과 실천방안을 중심으로 모색한 후 그 법정책적 대안을 헌법개정, 법률 수준, 특히 국회법, 지방자치법 등 일반법 수준, 각각의 개별법 수준, 법률하위법령 수준, 또는 비입법적 정책 수준으로 나누어 제시하고 있다.

유비쿼터스 환경에서의 개인정보 보호 : 법정책적 고찰 a Legal Policy Consideration

Ubiquitous computing, or 'ubicomp' environment presents significant challenges for information privacy law; The emergence of ubiquitous sensor networks based on RFID technology and IPv6, together with robust data mining techniques, for example, will amplify the tracking and profiling capabilities of personal information collectors. There exists, therefore, a well justified public perception and fear that personal information including information privacy might be threatened on unprecedentedly pervasive scale in the ubiquitous computing environment. This is indeed a common concern almost all the information societies share, and it is an urgent one. The problem we face now is not, whether we should accept the ubicomp environment with the risk of being thrown in a informational panopticon, but how, where and to what extent we should tackle the risks and threats from the emergence of the ubicomp environment for the sake of personal information and privacy. This paper reviews the staus quo of legal system for protection of personal information and privacy now in an emerging ubicomp environment in Korea and tries to present a reasonable and workable solutions. Recognizing the interrelatedness between the level of protection and the technologies including the privacy enhancing technology (PET), this article calls for a balanced timing of legislative measure to protect personal information and privacy in the ubicomp environment. At one extreme, we might paralyze the development of ubicomp based technologies, if we set out to prematurely intervene and regulate the technologies. At the other, we might lose for good effective timing of legislative policy making to protect personal information and privacy by merely idling away time waiting for the technology development including PET. The article also emphasizes the critical importance of reforming and reinforcing the existing infrastructure for protection of personal information and privacy in real space as well as in cyberspace.

백화점의 탄생과 근대 상하이의 소비문화 -192,30년대 상하이의 화교 자본 백화점을 중심으로

1917年10月20日,先施公司在上海最繁華的南京路開業。這是現代上海第一個華人開辦的百貨公司。之後,到1930年代,在南京路上永安、新新、大新公司陸續開業,曆史上一般把它稱作上海四大百貨公司。它們對當時上海現代消費文化的形成影響很大。本文從消費文化的角度探討192,30年代百貨店的誕生與上海消費文化的關系。這時期上海百貨公司與以往的雜貨店最大的不同點是,其建築和外裝的壯大華麗。當時的四大百貨都在建築方面做了很大的投資,在百貨大樓的高度、外裝上互相競爭的同時,也在內部設備的先進化、空間的合理布置方面做了不少的努力。百貨公司通過這種空間資本化的戰略喚起了消費者的欲望,建構了一種資本主義化的欲望生產機制。在營銷方面,它們都共同標榜了“環球百貨”的目標。所謂“環球百貨”指的是以銷售外產高級商品爲主的經營戰略。而“白球百貨”的標榜本身意味著它們主要的服務對象是中產以上的有錢人。爲了贏得他們的博愛,這時期上海的百貨公司制定了一系列銷售戰略:如發行‘折子’、上門送貨、發行禮券等。同時也引進了西方先進的銷售制度和促銷活動,以教育消費者:如實行明碼標價制,開展時裝表演會、兒童用品展覽會,大減價等。另外,它們還都追求了百貨店的娛樂化,即建設一種以購買、商務、娛樂、休閑爲一體的綜合娛樂空間。最早開業的先施公司在上樓同時開先施樂園、東亞飯店、屋頂花園等娛樂設施以來,這種娛樂化的空間布置成爲這時期上海百貨公司的慣例:永安、新新、大新都開娛樂場和屋頂花園以及其他娛樂設施。結果,百貨公司就成爲一種世外桃源,他既滿足顧客購物欲望的同時,也滿足1920年代以來不斷增加的上海市民大眾消費的需要,扮成192,30年代上海消費文化的寵兒。
