        부양의무위반의 형사적 규제에 관한 비교법적 연구 - 독일과 오스트리아의 제도를 중심으로 -

        In Korean Civil Law, a person who has a family is under obligation to support them. However he is not punishable, even if he doesn’t fulfill such a duty. The reason is that there is no penal provision for this conduct in Korean Criminal Law. There are people whose rights to live is threatened without the fulfillment of such a duty. Most of the people entitled to maintenance are often socially weak. They are children, divorced women, and aged parents. They should be legally protected from this menace. A person who does not fulfill such a legal obligation in Austria or Germany is punished. The punishment plays an important role in the society, as it is both justifiable und necessary. The reason being, failure to fulfill such an obligation is not a case of a simple debt, rather, to persons without a livelihood, it is a menace to their right to live. In order to criminalize the failure to fulfill family obligations, provisions concerning obligations to support family in Korean Civil Law should be revised. This criminalizing is based on the premise that the law makes sufficient provision for family support. The present Korean Civil Law has many insufficient provisions. The introduction of this punishment will stimulate the fulfillment of such obligations und will protect many dependants from this menace.

        독일 저작권법과 정보통신서비스법에 의한 ISP의 형사책임(하)

        In dieser Arbeit wurden die strafrechtliche Verantwortlichkeit der Internet-Provider nach dem deutschen Urheberrecht und Teledienstegesetz(TDG) untersucht. Zunachst wurde die Straftatbestande des Urheberstrafrechts gepriift. Dem- nachst wurde die strafrechtliche Verantwortlichkeit von Providern aus den Besonderheiten des Internet nach den all- gemeinen strafrechtlichen Vorschriften erlautert. Danach gibt es die Erorterung von Einschrankung der die strafrecht- liche Verantwortlichkeit der Diensteanbieter durch TDG. Nach dieser Untersuchung wurde wichtige Unterschiede zwischen deutschen und koreanischen Uhrheberrechts gefunden. In dem deutschen Uhrheberstrafrecht ist eine Versuchsstrafbarkeit vorgesehen und die Tat wird nur au f Antrag verfolgt, es sei derm, das die Strafverfolgungsbehrde wegen des besonderen offentlichen Interesses an der Strafverfolgung ein Einschreiten von Amts wegen fur geboten halt. Aus diese Griinde ist das Bereich der Strafbarkeit waiter als im koreanischen Uhrheberstrafrecht. AuBerdem nicht verhindert die Tatigkeit der Provider, sondem ganrantiert die Modifikation der strafrechtliche Verantwortlichkeit der Internet-Provider. Diese kann ein guter Hinweis bei Anderung koreanischen Uhrheberrechts sein werden.

        요노스케(世之介)를 통해 바라본 일본 에도(江戸)시대의 호색(好色)문화와 그 양상에 대하여

        『好色一代男』は、不特定多数の町人の代表格である世之介を通して当時の典型的ともいえる一代記という構成の中で、当時の性風俗と世相、町人の生活様態を示している。作者自身も町人出身である井原西鶴は、この作品を通じて、各地域の遊郭を案内する実用的なガイド指針書のような効用性を表わした。しかし、その当時の町人たちがあえて行うことができなかった人間解放への旗を世之介という人物に投影して町人に代理満足をさせることにより時代性の打破を模索しようとしていたことが、本作品が我々に伝える最も重要なメッセージであると考えられる。このような作者の精神は、彼のその後の作品である『好色五人女』、 『好色一代女』などにも受け継がれた。このような好色物シリーズで西鶴は現実的で、一方では密かに抵抗の旗を上げる町人作家としての名を高くしたのである。

        예술교육 효과 측정을 위한 척도개발과 적용

        The purpose of this study is to develop a measurement scale of Art Education Effect. In order to achieve the aim, the study adopted ‘Modified Delphi Technique’ based onthe existing literary and FGI were examined to list the elements measuring the arteducation effect . Process of sorting several unitizing concepts, categorizing constructsand theming constructs generated a proposed developing a measurement scale of arteducation effect. These elements again were developed into 32 items under a total of 7 componentcategories according to the art effects and variables in consideration of the uniquecharacteristics of art effectsb as a field of culture and art. The scale of art education effect is based on the seven underlying dimensions:enjoyment, cooperation, stress, communication, consideration, self-control capability,desire. Finally, 32 items could be selected through a measurement verification ofgoodness of fits to the date. The high level of GFI value shows that standardsdeveloped in this study are effective as a tool to measure the art education effect. The study will make contributions to academic achievement of the art education effect. 본 연구는 예술교육 효과 측정을 위한 척도의 개발과 타당화라는 두 가지 연구목적에 대하여 구체적인 연구문제를 설정하였다. 첫째, 예술교육 효과측정을 위한 척도개발을 위해 예술교육의 구성요인과 구성요인별 문항은 무엇인지 살펴보았다. 둘째,델파이 방법을 통하여 10명의 전문가들이 2회에 걸쳐 35개의 예비문항을 구성하고설문조사를 실시하였다. 탐색적 요인결과 총 32문항, 7개의 요인이 추출되었다. 7개의 요인은 즐거움, 협동, 스트레스, 소통, 배려심, 자기조절, 희망 요인이다. 신뢰도분석 결과 하위영역별 신뢰도 및 문항 전체 신뢰도가 양호한 것으로 나타났다. 탐색적 요인분석을 통해 확정된 예술교육효과 측정도구의 문항들이 7개의 요인구조를타당하게 반영하고 있는지 알아보기 위해 확인적 요인분석을 실시하였다. 확인적 요인분석 결과 상대적합도 지수들을 살펴보면 TLI 값은 .81, CFI 값은 .89로 적합한수준을 나타내었다. 절대적합도 지수인 RMSEA는 .05로 적합하게 나타났다. 다음으로 예술교육효과의 측정 모형의 판별타당도를 확인하였다. 확인적 요인분석 결과 모형의 적합도와 타당도 분석 결과 본 연구에서 개발한 예술교육효과 측정 척도 모형의 구인타당도가 확보되었다.

        일본 요괴문화 원형 속의 여성 요괴 이미지와 상상의 계보

        Considering the process of the image of Ubume, its diversity and meaning in Japanese female yokai tales, one cannot regard it as a simple yokai passing by in fad. Ubume forms one large central axis in the lineage of the image of the major female yokai portrayed in the Japanese yokai culture. The main goal of this paper is to reconsider the meaning of the critical issues associated with the origin and the development of the clear image of Ubume, by examining the lineage of the image and imagination of Ubume, which is focused on as the scope of female yokai in this paper. This study examined the issues surrounding the name and notation of Ubume, the development of Ubume’s image within the literary transition, the background of the fundamental limitation of female yokai with relation to her feminity, birth, and children, and lastly investigated the modern transformation of Ubume used in various ways. As a result, Ubumee was regarded as the existence of fear from the traditional image of yokai, the existence of deep grudge against dying without giving a birth to any children, and the existence of motherhood to take endless care of children. The image of Ubume has incessantly changed and handed down within the characteristics of each region and the special circumstances faced by those who live there, experiencing those regional characteristics. In the future, the Ubume story, its derived images, the ranges of the recognition, the patterns of interpretations, and the transformations are all expected to continue to be diversified in many ways.

      • 일본 괴담물의 공간속 각성(覺醒)과 몽환(夢幻)구조의 의미에 관하여

        日本の怪談の中にももちろん、現実空間と異空間の間の境界というのは、設定されていることは予想できる。現実空間の中の人々は異空間に対して様々な想像をしながら、知らないから行くことができない空間である異空間について限りなくあこがれや不安をともに感じながら、そこの考えをして認識しようとした。これを反映したものが日本の怪談物だと言えるだろう。怪談物の内容は怪奇的で幻想的なものであったが、人々は異空間をめぐる物語中の現実空間で味わうことができなかった限界を克服し解決していこうとした。異空間を想定することで、人間は自身の世界を築き上げてきたものといえるだろう。したがって、境界を越えた現実空間と異空間の間を巡る怪奇の構造を通して怪談物の現実空間と異空間との間の設定、覚醒と夢幻の構造などを調べることができた。

        일본 애니메이션 속 요괴콘텐츠 구현 방식과 상징성 연구 -요괴 애니메이션을 중심으로-

        This paper basically aims to study the secret of popularity of Japanese animation in the world. Among the numerous reasons for the popularity, it is true that various and unique genre attributes of Japanese animation have become a great driving force that positions Japanese animation in the current fame. Especially, it analyzes the reason and tries to read out the diachronic meaning focusing on the background of a Yokai animation being loved for a long time of all popular genres. Also, it analyzes the way of embodying Yokai contents in a Yokai animation and symbolic meanings. In the process, it presents not only the meaning of Yokai contents in Japan, separating a real and surreal space and crossing the boundary between human beings and Yokai, and the coexistence and confrontation etc. between the beings who have crossed the boundary, but also the reasons for such aspects to be developed. Thus, by effectively using the double features of Yokai that coexists with humans peacefully and makes them scared, it fully shows that the strategic value and sustainability as a cultural content of a Yokai content.

        작품 속에 설정된 무사도문화와 그 의미

        본고를 통하여 「깃카노지기리」란 작품이 표면적으로는 ‘신의’를 주제로 하고 있고 그것이 물론 가장 중요한 소재인 것은 분명하지만, 작품의 행간 속에는 ‘무사도에 대한 미화’와 ‘명예로운 죽움에 대한 찬양’이라는 주제도 숨겨져 있다고 연역하였다. 그 주제는 ‘무사도를 완벽하게 따르는 이상적인 무사’를 통해 전달되고 있으며, 이런 구성이 일본의 문화적 특성을 반영하고 있다는 것 또한 알 수 있었다. 이렇게 작품 속에 드러나는 무사도의 모습을 파헤쳐 분석하는 이유는, 작가가 예상치도 못한 부분까지 소급해 잘못을 추궁하고자 함이 아니다. 일본과 그 주위 나라를 비극으로 이끈 무사도문화가 어떻게 발전되고 어떻게 왜곡되었는지를 살펴봄으로서, 앞으로 있을 또 다른 의미에 있어서의 잘못을 미리 막고 비극이 반복되지 않게 하고자 하는데 그 목적이 있다고 할 수 있다.
