        자본시장법 역외적용에 관한 소고

        It is principal that application of domestic law is within the nation. Butin some cases, extraterritorial application of laws means that it is applied outsidethe national territory. There had not been any provision or precedent aboutextraterritorial application of Anti-Trust Law in Korea before the case of GraphiteElectrodes international cartel (2002). Extraterritorial application of laws wasapplied in this case. The legal basis of extraterritorial application wasestablished in Korean Anti-Trust Law 2-2 and Korean Capital Market Act. When deciding whether to exercise subject matter jurisdiction over aclaim brought by a foreign plaintiff alleging securities fraud, a court, as a generalrule, applies the effect test, the conduct test or a combination of the two. Inlight of the delicate international political concerns raised when courts assertjurisdiction over foreign actors or actions, however, courts should be careful toapply the anti fraud provisions only when international considerations warrantthe exercise of jurisdictionThis study is dealing with extraterritorial application regarding International Jurisdiction and its trend of discussion in Anti-Trust Law. By studying U.S. precedent about extraterritorial application in securities law, it will broaden thewidth of our view. The internationalization of stock market results in anincrease in unfair trading. This means that it is necessary to discussextraterritorial application of domestic capital law in depth. So we have toconsider the legitimate sovereignty of other nations, prevent extraterritorialapplication of the antifraud provisions of securities law, regulate unfairtransaction like securities fraud in advance, be prepared to have a consistentsystem of extraterritorial application.

      • 사례분석을 통한 안전문화 연구

        This research paper carries out the qualitative case study about nuclear events and accidents in the point of view of human factors. In order to perform the task, the structure of human factors about nuclear accidents is taken effect. For the detailed structure, domestic accidents and foreign accidents should be classified and characteristics, organizational culture, manpower structure and policy environment of Korean nuclear reactor should be compared and analyzed. Also, the importance and frequency of occurred events are comprehended through the horizontal classification of nuclear accidents and the structure of human factors in the steps of workers, managers and general controller is attempted through the vertical classification. Furthermore, an organized analysis framework about the occurrence of nuclear events and accidents is provided after separating the stages into individuals and the team to distinguish the characteristics of individuals and the organization. The provided analysis framework can contribute to the establishment of the theory for nuclear safety culture’s inherent model by applying to Kori 1 SBO case on 2011 and Tokaimura nuclear accident in Japan.

        장병의 다양성 수용도가 혁신행동에 미치는 영향 : 부대원 신뢰의 매개효과

        Purpose - This study deals with the Openness to Diversity(OD) of soldiers in the military organization for efficient unit operation of the military organization composed of various soldier. The purpose of this study was to examine the effects of information and value OD on innovative behavior and the mediating effect of unit-members trust. Design/methodology/approach - The 269 samples of this study were surveyed on army soldiers. The Exploratory Factor Analysis (EFA), the multiple regression, bootstraping analysis were hired in order to analyze the data. Findings - The results showed that the information & value OD were positive(+) effect on innovative behavior. Unit-members trust showed a mediation effect between OD and innovative behavior. Research implications or Originality - First, according to Defense Reform 2.0, the military is expected to be composed of more diverse classes in the future. There is a theoretical contribution that examine their perception of diversity within the military. Second, OD was confirmed as a variable predicting the innovative behavior of soldiers and unit-memeber trust mediate the relationship between OD and invative behavior.

        현재 환경 모니터링을 위해서 국내외 여러 어플리케이션으로 환경을 관측하는 시스템이 연구 개발되고 있다. 본 연구는 해양 모니터링(미세조류관측) 시스템의 RIA(Rich Internet Application)서비스를 위해 인터페이스를 Google Api를 이용하였고 데이터들을 시각화하기 위하여 데이터의 가치와 구조에 따라 분류하여 Chart로 표현함으로 사용자에게 직관적 판단과 정보를 습득할 수 있게 하였다. Flex Component를 이용하여 미세조류의 Data를 자동으로 그래픽화 한 후 차트로 나타내어 사용자들에게 직관적으로 정보를 습득할 수 있는 어플리케이션을 제안한다. 향후 부표에서 각종 센싱 기술을 이용하여 실시간으로 습득 되는 데이터를 실시간으로 온라인에서 확인하고 예측할 수 있게 될 것이다.

        지하 공연시설의 성능위주 방재계획에 관한 연구

        In this study, the evacuation of underground theater was investigated by applying ‘performance-based design’ of fire-evacuation plan. The risk of occupants in the Underground theater is high, because the evacuation routes coincide with smoke movement and long congestion delay by high density of spectators. Therefore, the investigation of occupants evacuation safety through the smoke movements is one of the most important factor of ‘performance-based design’ The results of this study were as follows; 1) Without smoke removal system, the safety of 120 of 800 occupants could not secured. 2) The ventilation standards for underground could not sufficiently secure the safety of occupants. 3) In case of operating ventilation system 4 times of ventilation standards, the evacuation time was sufficiently secured.

        자연환기덕트를 통한 초고층 공동주택의 환기성능 분석

        The purpose of this study was to analyze the indoor ventilation performance by CFD simulation in the high-rise apartment according to the use of natural ventilaion duct. There are several ventilation problems in high-rise apartment becase of compact design. Natural Ventilation Duct(NVD) is devised for solving ventilation problem by air inflow from outdoor through Bernoulli’s effect. To analyze NVD performance, two theoretical model was designed. One is existing study model, and the other one is reform model which improve the performance of first model. The results of this study were as follows; the 1st model showed ventilation performance to some degree. But, there was the inverse ventilation. The 2nd model showed better ventilation performance than 1st model. Moreover 2nd model solved the inverse vetilation problem of 1st model. So, it could be possible to put NVD to practical use later.

        국내 중소 과학관 현황 분석: 과학관의 조직, 운영, 교육을 중심으로

        이 연구의 목적은 지방 과학관의 조직, 운영, 교육 등의 실태를 분석하는 것이다. 이를 위하여 과학관 분석을 위한 평가틀을 개발하고, 28개의 과학관을 선정하여 관계자와의 심층면담을 실시하였다. 주요 연구 결과는 다음과 같다. 첫째, 과학관의 전문 인력이 부족하여 원활한 과학관 운영이 어려웠다. 둘째, 과학관의 재정상태가 매우 좋지 않았다. 셋째, 과학관의 시설이나 전시물 관리에서 부족한 측면이 다수 발견되었다. 넷째, 과학관의 관람객을 이끌 수 있는 다양한 홍보나 마케팅이 소극적으로 이루어지고 있었다. 다섯째, 과학관의 연구 및 교육프로그램에 미흡한 부분이 많이 발견되었다. 실태조사 결과를 바탕으로 지방 과학관의 발전 방안을 위한 방안을 논의하였다. This study aims to investigate the current status of science museum in terms of evaluating its organization, management, and education program. The analytical framework developed for examination are as follows: First, the lack of professional staff in most target museums is the biggest impediment for domestic science museums to function properly. Second, funding has been very poor. Third, most museums failed to properly sustain exhibits, equipment, and facilities. Fourth, various advertising and marketing efforts for attracting more visitors are hardly done. And lastly, the domestic museums made little effort in pursuing research focusing on improving exhibitions and education program. Based on these findings, the future directions for domestic science museums to step-up opportunities have been discussed in this study.

        Ka 대역 위성 출력 전력 제어 기술 연구

        Ka 대역 위성통신 시스템에서 강우 감쇠 보상을 위해서는 위성 탑재체에서 강우 지역의 출력 전력을 높일 수 있는 시스템이 요구된다. Ka 대역 출력 전력 제어 기술은 위성 탑재체에서 하향 링크(19.8 ~ 22.2 ㎓)의 출력전력 조정을 가능하게 한다. 본 논문에서는 다중 빔 안테나와 다중 입출력 증폭기를 이용한 Ka 대역 위성 출력전력 제어 기술에 대하여 소개한다. 한반도 상에 8개의 빔을 형성하기 위해 배열 급전 소자와 반사판으로 구성된 다중 빔 안테나가 설계되었다. 빔 당 목표 EIRP는 59 ㏈W 이상이며, 강우 감쇠 보상을 위한 전력 제어 기능은 강우 지역에 비 강우 지역 대비 최대 6 ㏈의 EIRP 상승이 가능하도록 설계하였다. 다중 입출력 증폭기는 다중 빔안테나와 함께 구성될 때 위성 출력 전력 제어를 위해 효과적으로 사용될 수 있다. 4x4 다중 입출력 증폭기가 기술 검증을 위해 제작되었으며 Ka 대역 위성 송신 주파수 대역에서 24 ㏈ 이상의 격리도 성능을 나타낸다. For Ka-band satellite communication system, a new flexible payload technologies which can compensate rain attenuation have to be developed. The Ka-band satellite output power control technology enables to adjust downlink output power of satellite payload in Ka-band (19.8 ~ 22.2 ㎓). In this paper, we introduce multi-beam antenna with multi-port amplifiers for Ka-band flexible output power allocation system. We have designed multi-beam antenna with array-fed reflector to form 8 beams on the Korean Peninsula. The target EIRP per beam is more than 59 ㏈W. The system is designed to present 6 ㏈ boost beams for rainfall areas. Individual beams were optimized by the excited amplitude and phase of feed elements of the feed cluster. The multi-port amplifier(MPA) is one of effective approaches for flexible power allocation in combination with multi-beam antenna. In case of using MPA in multi-beam system, the inter-port isolation characteristic of MPA is important parameter to avoid interference among the output ports. In this paper, we propose a new MPA structure that consists of two 4x4 Buttler matrixes and phase/amplitude controllable power amplifier modules.

        피팅 파손면적분석기법을 이용한 기어재의 피팅 수명 실험

        The object of this study is to investigate the definite method for pitting damaged surfaces. Pitting is a sort of fatigue damages and it is made by a repetitive load. For a judgment between damages or not, sensing vibrations of test equipment is simple. However, it is not only difficult to observe a growth of pitting but also impossible to detect the juncture of initial pitting. Therefore, a method for the pitting damaged area measuring technique was effectively implemented by Two Roller Machine. The change of surface damaged area was measured by an optical microscope in regular time and calculated by the use of dark and bright ratio of test specimens' pictures taken by optical microscope. In conclusion, S - N Curves gained by Failure rate - Cycle graph was led and the curves are able to be chosen as occasion demands for a failure area percentage.
