Least Median of Squares(LMS) 방법을 응용하여 초기 기본집합을 설정하는 김종우(1996)의 ELMS는 기본집합에 이상치들을 잘 배제시킨다. 이 방법의 사용에서 반복되는 기본집합의 추출에 따른 문제점은 처리 속도를 LMS에 비해서 크게 줄이지 못하고 있다. 따라서 김종우(1996)에서 제시한 2단계 방법중에 1단계에서 사용한 ELMS의 적절한 크기를 결정하는 방법을 제시하고자 한다.

Rousseeuw(1984)가 제시한 Least Median of Squares(LMS) 방법을 개선한 염준근, 박종구, 김종우(1995)의 ELMS는 효율적으로 이상치들을 인식한다. 그러나 이 방법에서 최적의 subset을 결정하기 위하여 사용하는 종유석 그림은 정확한 기준 점을 선정하는데 어려움을 나타내고 있다. 따라서 ELMS를 사용한 이상치 판별을 위한 적절한 크기의 subset 결정 방법을 제시하고자 한다.

A two-stage service policy for an M/G/1 queueing system

We introduce the $P_{\lambda,\tau}^{M}$ service policy, as a generalized two-stage service policy of the $P_{\lambda}^{M}$ policy of Bae \emph{et al.} (2002) for an $M/G/1$ queueing system. By using the level crossing theory and solving the corresponding integral equations, we obtain the explicit expression for the stationary distribution of the workload in the system.

A temporary tieback wall was instrumented to monitor its performance during construction of underground structure. An excavation 9.7 meter deep was monitored using slope inclinometer. The in-situ measurement data are discussed and analyzed. Lateral movements of the wall as measured with the slope inclinometer are represented. Especially, Lateral displacements of the two positions under completely different condition are compared to investigate the effect of backfilling between soldier pile and the soil behind wall. In addition, a numerical analysis using the program FLAC was performed, whose results are compared with the field measurements.

중국 NFT 디지털 작품 거래 시 저작권법의 해석과 그 한계 및 대안 연구

NFT 예술품 보호와 관련해서는 저작권 등기 오류, 기만, 해킹행위, 관리 감독 시 리스크, 플랫폼 책임과 같은 주의해야 할 불법행위로 인해 디지털화 추진 과정에서 발생할 수 있는 남용의 폐해를 방지해야만 한다. 또한 NFT 예술품의 미학 및 기술적 특징을 고려하여 적극적으로 기술적 차원의 보호와 법률차원의 보호라는 이원화된 보호 모델을 확립해야 한다. NFT 예술품의 미학과 암호기술의 결합이라는 특징은 오로지 예술적 가치를 구비하여야만 비로소 예술품이 될 수 있다. NFT의 주요 쟁점으로는 저작권의 권리 확정과 거래 및 관리가 있다. 다음으로, NFT 예술의 법률 속성을 분명히 해야 하는 대상은 무엇인가 라는 문제가 있다. 또한 스마트 협약에는 NFT 예술품 거래 분쟁 해결 제도와 책임분담규정이 반드시 포함되어야만 한다. 스마트 협약에서 예술품 가격의 거품을 관측하기 위한 암호 규칙을 제정하고, 실시간으로 악의적인 가격 조종 현상을 관측하며 계약가격의 임의변경 심사제도를 확립함으로써 거래규칙 파괴를 회피하도록 해야 한다. 궁극적으로는 전자대리(Electronic agent)를 통해 스마트 협약의 유효성을 보장하고 자체 감독 관리를 실현해야 한다. 이를 위해서는 최대한 이른 시일 내에 「예술법」을 핵심으로 하는 NFT 예술품등 디지털 예술을 보호 범주에 포함하고 예술품 범위를 확대함으로써 그 조정범위를 개방해야 한다. 또한 NFT 예술품 분류체계를 확립하여 NFT 예술품의 서로 다른 속성에 근거하여 그에 상응하는 原 창작자의 권리와 의무, 규제를 확정해야 한다. NFT와 관련해서는 가상자산 기금 감독 관리회사 각도에서 거래 플랫폼의 역량과 리스크 관리모델, 적격 회계 심사, 돈세탁 추적과 테러와의 전쟁, 세무 등을 구체적으로 규정해야 한다. 또한 감독 관리 주체와 감독대상을 확정하고, 각 부문 간의 행정장벽을 타파함으로써 중국문화 여행부를 감독관리부문으로하는 감독체계를 확립하여 중국예술협회, 중국예술품 소장협회 등 업계 조직의 감독 관리 권한과 직능을 공고히 해야 한다. 관리 감독 표준도 정해야 한다. 주의해야 할 것은 박물관 소장자료의 NFT化는 현행 법률체계 하에서 규제해야만 한다는 점이다. 이와 동시에 박물관 소장자료의 NFT化를 하기 이전과 NFT 실시 과정, NFT 이후의 모든 절차가 합법적으로 진행될 필요가 있다. 이를 위해 박물관 소장자료를 NFT로 변경하는 절차와 관리 감독, 규제기관과 절차 또한 제정되어야 한다. 복수의 NFT를 제작하는 상황에서 작품 자체의 복제와 저장에 필연적인 연계는 없기 때문에 물리적 의의 에서의 작품 매체는 발생할 수 없다. 따라서 이것을 저작권자가 보유한 복제권이 통제하는 행위로 간주하는 것은 성립되기 어렵다. 따라서 인터넷 정보 전송권으로 규제하는 것으로 충분하며, 복제권 침해 여부에 대해서는 논의할 필요가 없다. 다만 사실상 物의 이전이 존재하지 않기 때문에 NFT 디지털 작품 거래의 대상은 결코 작품 매체가 아니며, 단지 거래 내역 내지 원본 인증서인 것이다. NFT 예술작품의 거래는 발행권 통제를 받아야만 한다는 견해가 있는데 그 이유는 예술작품의 판매는 오프라인 유형 작품 판매와 동등한 법률 효과를 실현할 수 있기 때문이라는 견해가 있다. 그러나 중국 항저우 인터넷 법원은 NFT 예술작품 판매행위는 인터넷 정보 전송권 통제를 받는 것이지 발행권 통제를 받지는 않는다고 인식하였다. 그 ... Regarding the protection of NFT artworks, it is necessary to prevent the harmful effects of abuse that may occur in the digitalization process due to illegal activities such as copyright registration errors, deception, hacking activities, risk in management and supervision, and platform responsibility. In addition, considering the aesthetics and technical characteristics of NFT artworks, a dual protection model of technical protection and legal protection should be actively established. The characteristic of the combination of the aesthetics of NFT artworks and cryptographic technology can be an artwork only when it has artistic value. The main issues of NFT include the determination of copyright rights, transactions, and management. Next, there is a question of which object should clarify the legal properties of NFT art. In addition, the smart agreement must include the NFT art trade dispute resolution system and responsibility sharing regulations. In the Smart Convention, cryptographic rules should be established to observe bubbles in art prices, observe malicious price manipulation in real time, and establish a screening system for arbitrary changes in contract prices to avoid the destruction of transaction rules. Ultimately, it is necessary to ensure the validity of smart agreements and realize self-supervised management through electronic agents. To this end, the scope of adjustment should be opened as soon as possible by including digital arts such as NFT artworks, which are the core of the Art Act, in the protection category and expanding the scope of artworks. In addition, the NFT art classification system should be established to determine the rights, obligations, and regulations of the original creator based on the different attributes of NFT art. Regarding NFT, the competence and risk management model of the trading platform, qualifying accounting screening, money laundering tracking and the war on terrorism, and tax should be specifically defined from the perspective of the virtual asset fund supervisory management company. In addition, the supervisory authority and function of industry organizations such as the China Arts Association and the China Art Collection Association should be strengthened by establishing a supervisory system with the Ministry of Culture and Tourism as the supervisory management department by identifying supervisory management subjects and breaking administrative barriers between sectors. Standards for supervision of management and supervision should also be established. It should be noted that the NFTization of museum collections must be regulated under the current legal system. At the same time, all procedures before the NFTization of museum collections, the NFT implementation process, and after NFT need to be legally carried out.
