주민소송의 법적 성격에 대한 소고

This article is on the Object of the Inhabitants' Suit in Korea. It is very important tool for inhabitants to control the local government. It is influenced very strongly by the Japanese Inhabitants' suit. At the same time, it is necessary to make the logical thinking of the Inhabitants' Suit on the Constitutional principle. This point is contributed to the substitutional legalism at the national level. The local government act is the specific law of the constitution and materializes the constitutional doctrine. The constitution is not only a set of laws that draws out the organization of a state and guarantees fundamental rights, but also materializes various interests of the members(including fundamental rights) of the community and acts as the highest ranking living standard that regulates everyday issues. Fundamental rights, a value that materializes the norms of the constitution, are not restricted to the areas of fundamental rights but also reach out to all areas of national and local communities. It is the role of the Inhabitants' Suit to be the way for the balance between public interest and private interest. In the Inhabitants' Suit, the basic principles of the constitutional law must be embodied ; the democracy, the legalism, the welfare. The democracy is related to a proper qualification of the accuser. The legalism is related to a proper qualification of the object of suit. In the objective legalism the Inhabitants' Suit is more meaningful in the legal character of suits and the intensity of rating illegality. In the future, the role of local government is more powerful and the funtion of Inhabitants' Suit is more active. So It is necessary to be profoundly discussed on the several principles of the Inhabitants' Suit as the suit for public interest suit. 주민소송을 비롯하여 일련의 주민참여 프로젝트는 재정의 방만함을 통제하는 측면에서 그 도입이 논의된 것은 사실이나, 이러한 사회적 필요성에 더하여, 헌법적 관점에서의 성숙한 법논리도 도출되어야 한다고 생각한다. 주민소송제도의 의미가 단지 ‘납세자의 권리 및 의무’로만 제한되어 인식되는 것을 지양하고, 보다 성숙한 지방자치의 기틀을 마련하고, 더 나아가 국가적 차원에서도 보다 실질적인 법치주의의 구현이라는 측면에서도 기여할 수 있다고 본다. 지방자치는 지역공동체가 국가 내의 부분사회로서 지역 주민의 의사에 따른 자율규율을 통하여, 지역의 유지ㆍ발전과 함께 주민의 실질적 권익을 보장하고, 나아가 국가발전과 국민의 기본권의 실질적 보장에 기여하는, 민주주의의 구현원리이자 실천태이다. 법치행정의 원리에 대한 이해는 행정법 전체를 관통하는 큰 물줄기를 형성하는 학문 기반이 되기도 한다. 재원의 목적에 대한 지향점은 주민의 복리향상이어야 한다. 주민소송은 그 공동체의 다른 구성원 또는 공동체 자체와의 이해반영 및 조절을 위한 통로로서 기능한다. 민주주의 원리는 특히 주민소송의 원고적격과 관련하여 중요하게 작동하게 된다. 객관소송으로서 주민소송은 객관적 법치주의의 핵심에 놓여 있다. 특히 주민소송의 유형별 법적 성격 및 위법성의 심사강도를 검토함에 있어 중요하다. 앞으로 지역공동체로서의 지방자치단체의 역할은 보다 강화될 것이며, 이에 헌법상의 기본원리의 구현으로서 주민소송은 보다 원활한 기능을 할 것으로 보이므로, 공익소송으로서 주민소송의 제법리가 헌법의 기본원리를 중심으로, 행정법의 체계하에서 심도깊게 논의되는 것이 필요하다고 본다.

영화 <인셉션>에서 표현된 초현실적 공간 구성에 관한 연구

Dreams are always an interesting topic of research due to their capabilities of being the subject of creation and methodology for artists who pursue extraordinary works. Especially the surrealist artists, who were the popular trends of the 20th century literature and art, considered dreams to be the expressions of the subconscious, thus attempted to convey it in their work. Christopher Nolan’s <Inception> has visualized the ambiguous material surrealists have attempted to acquire, known as dreams, through 21st century technology, robust logic, and the various methodologies of the surrealists. This study contemplates the mechanism of creation of surrealism as well as the methods of expression of said surrealism in the film <Inception> through surrealist artists and their work. As a result, in the movie <Inception>, surrealism is expressed in 3 ways, spacial, phenomenal, and episodical, and has also expressed surreal, bizarre and shocking emotions through the expressive methods of surrealist artists, such as dépaysement, paranoia critic, and trompe l’œil. The space shown in the movie also forms the subconscious universe of each character, not as the physical space of a simple background. 꿈은 경이로움을 추구하는 예술가들에게 그 자체가 창작의 소재인 동시에 방법론이 될 수 있기 때문에 언제나 흥미로운 탐구의 대상이다. 특별히, 20세기의 문학·예술 사조던 초현실주의의 예술가들은 꿈이 무 의식의 표출이라고 생각했기 때문에 꿈의 세계를 표현하기 위해 노력하다. 크리스토퍼 놀란 감독의 화 <인셉 션>은 초현실주의자들이 획득하려고 했던 꿈이라는 모호한 소재를 21세기의 기술력과 그만의 탄탄한 논리성 위 에 초현실주의자들의 다양한 방법론을 차용하여 눈으로 확인할 수 없는 무의식의 공간을 가시화하다. 본 연구는 화 <인셉션>의 공간에서 표현된 초현실성의 창조 원리와 표현기법을 초현실주의의 예술가들과 그들의 작품을 통해 고찰해보고자 하다. 연구 결과, <인셉션>에서 화 속의 초현실성의 표현방식은 공간적·현상적, 그리고 사건적 표현방식의 3가지 유형으로 표현되었으며 초현실주의의 예술가들이 사용했던 데페이즈망, 파라노이아 크 리틱, 트롱프뢰유 등의 표현방식들을 차용해서 초현실적인 기이하고 충격적인 감성을 표현하다. 작품에서 표현 된 공간은 단순히 배경으로서의 물리적 공간의 차원이 아닌 심리적 공간으로서 각 인물의 무의식의 세계를 형상화하다.

The more the importance of the Electronic Space in human beings increases, the closer the core of the society moves to it. The relation ship of a nation and a person is changing and the role of government is being altered. Accordingly, It should be thought over the basement of the e-Government Act as the legal order in the Electronic space. The e-Government Act has the nature as a combination law of T-Code and L-Code. It has to make the balance ; on the one hand, as the actualized law of constitutional law, and on the other hand, as the technology law. In the e-Government Act, the basic principles of the constitutional law must be embodied ; the e-democracy, the e-legalism, the e-welfare. But they are equal to the substance of protecting human rights in comparison with the those of former times. The e-democracy reinforces the participation-democracy, so the more citizen have a say in legislation and take part in the conduct of state affairs. And there are the global rules standardization, the regulation by the Governance, and the combination of T-Code and L-Code etc. as the distinctive things of the e-legalism. And the e-welfare demands to close a gap in digital divide, but also expends the free use of compositive contents ; of various types, interactive contents by the multimedia units. As the technical law, The e-Government Act has to play a important role in developing the competitive power of the knowledge-industry. Although Korea was an underdeveloped country in the Industrial Revolution, in the Electronic Space it must to be one of forward countries, IT G8 in the information-technology days. It needs very much to make the mutual- complementary network of government, business, citizen.

대학생의 가족주의 가치관과 부모부양의식에 관한 연구

The purpose of this study is to investigate the trend of the familism and the awareness of parent-supporting, how socio-demographic variables affect the concept of familism and how the concept of familism affact the awareness of parent-supporting. The data were collected from 191 university students. A brief summary of the result of this study is as following: (1) Most respondents appeared to have the modern familism-individualism. (2) The awareness of parent supporting was reported highly: the order of the awareness of parent supporting was as follow : financial supporting, service supporting, emotional supporting. (3) Male students tran lemale ones and the older group than younger ones have the traditional familism. The male students have higher awareness of financial supporting than emale students. The older group than younger ones have high awareness of emotional supporting. The respondents who have the older father than younger ones have high service supporting. (4) The socio-demographic variable which affects on the familism is sex; male students have more the concept of traditional tendency than female students haute. (5) The variable which affects the awareness of parent supporting strongly is the familism. That is to say, the more the familism, the more the awareness of the parent supporting.
